Chapter 1: PROJECT PARTICULARS & STATUTORY/ LEGAL REQUIREMENTS 1.1 Project Outline/ Description Espace Ouvertures Lte is applying for an Environmental Impact Assessment Licence for the setting up of an artisanal winery at La Joliette Industrial Area, Petite Riviere, in the district of Black River. The setting up of an artisanal winery project is in line with the strategy of diversifying and increasing inland tourism facilities to reduce pressure on the coastlines and within the lagoons around Mauritius while setting up agro-touristic facilities in Mauritius in a context of building a greener Mauritius within the Maurice Ile Durable (MID) framework. The promoter is Mr. Debrobee Ghurburrun, who is an experienced businessman. He is the Managing Director of four successful companies & has been studying wine elaboration in Italy. His qualifications and experience is an asset for the successful implementation and management of such a challenging project. This Environmental Impact Assessment has been drawn up based on the plans and documents submitted by the promoter, site visits and as well as various meetings held with the proponent and the immediate neighbours. 1.2 The Proponent: Espace Ouvertures Lte This section deals with section 18(2) (a) of the Environment Protection Act (2002) by giving the name and address of the proponent: Espace Ouvertures Lte La Joliette Industrial Area. Petite-Riviere Phone No. 233-1096 Date of Incorporation: 1st of March 2005 1.3 EIA Consultant This section deals with section 18(2) (a) of the Environment Protection Act (2002) by giving the name, address and qualifications of the consultant who prepared the EIA: Mr. Santchurn Kaviraj Registered Professional Engineer: RPEM 803 Address: Santchurn Lane, Glen Park, Vacoas. Undertaking and land Ownership This section deals with section 18(2) (a) of the Environment Protection Act (2002) by describing the ownership of the undertaking and of the land on which it is being constructed: The undertaking will be owned and managed by Espace Ouvertures Lte. The undertaking will be housed in an existing industrial building of 300 m2, on a portion of land of extent of 5311 M2, located at La Joliette Industrial Area, Petite Riviere in the district of Black River belonging to the promoter, Mr. Debrobee Ghurburrun, as evidenced by a deed Registered and Transcribed in volume 6014 No.11. A Certificate issued by Public Notary Mrs. Danielle Low Kwan Sang expressing her opinion as to the land on which the undertaking is to be executed is enclosed as Document 1.

Zoning This section deals with section 18(2) (a) of the Environment Protection Act (2002) by describing the zoning of the site As mentioned in chapter 1 section 1.4, the undertaking will be housed in an existing industrial building of 300 m2, on a portion of land of extent of 5311 M2, located at La Joliette Industrial Area, Petite Riviere in the district of Black River belonging to the promoter, Mr. Debrobee Ghurburrun, as evidenced by a deed Registered and Transcribed in volume 6014 No.11. The Project site is located in an existing industrial building surrounded by other small & medium scale industrial/commercial activities such as Food Processing Industries, Construction Companies, a Swimming Pool Manufacturer and an abandoned Karting Track & Club.

Land Conversion Permit The proposed artisanal winery will be housed in an existing Industrial building; therefore the need for a Land Conversion Permit does not arise.

Clearance from the Mauritius Revenue Authority Espace Ouvertures Lte shall apply to the Mauritius Revenue Authority for a clearance to set up an artisanal winery once the Environmental Impact Assessment Licence is obtained from the Ministry of Environment & Sustainable Development.

Clearances from CWA, CEB and WWMA Clearances from the Central Water Authority, the Central Electricity Board and the Wastewater Management Authority for this Project have already been obtained. Tap water from the CWA is already available on site and the measured outflow is 6 Litres per minute. This supply is amply sufficient to meet the demands of the proposed artisanal winery including water that will be used in the product process as well as for domestic use. Three phase 380v & single phase 240v electricity is already available on site. According to the forseen power consumption of the artisanal winery, the existing electrical supply is sufficient. Existing facilities to dispose of the domestic wastewaters through on site disposal systems (Septic tank/ absorption pit) already exist. The small volume of wastewaters generated by the proposed artisanal winery, consisting mainly of lees, shall be sprayed as fertilizer for the green spaces and lawns on the site itself. Clearance shall be sought from the Wastewater Management Authority before such action is taken.

Building and Land Use Permit Espace Ouvertures Lte has applied for a Building and Land Use Permit to the Black River District Council for the setting up of an artisanal winery at La Joliette Industrial Area, Petite Riviere. Once the Environment Impact Assessment Licence has been issued by the Ministry of Environment & Sustainable Development, it will be adduced as documentary evidence. Copy of the application for Building & Land Use Permit issued by the Black River District Council is enclosed as Document 2.

Environmental Impact Assessment Requirement The first schedule (Section 15 (2) Part B) of the Environment Protection Act (2002) gives a list of undertakings requiring an Environment Impact Assessment. The said project fits in this list which includes: Subsection 22: Industrial Manufacture of beer, wine and spirit. Espace Ouvertures Lte has therefore entrusted the task of making an Environment Impact Assessment for the setting up of an artisanal winery to Mr. Santchurn Kaviraj on the 14th May of 2010

Bottler / Distiller License Requirement Espace Ouvertures Lte has applied for a Trade License as a Manufacturer / Distiller/ Bottler of Alcoholic and Non-Alcoholic Drinks and / or Vinegar as provided for under the Eighth Schedule (Section 102) of the Local Government Act 2003 as amended by the Business Facilitation Act 2006.
