. License agreement This End User License Agreement accompanies the Burn4Free CD & DVD product and r elated explanatory materials ("Software"). The term "Software" also shall includ e any upgrades, modified versions or updates of the Software licensed to you by Ikysasoft s.r.l. uninominale. Please read this Agreement carefully. At the end, you will be asked to accept this agreement and continue to install or, if you do not wish to accept this Agreement, to decline this agreement, in which case you will not be able to use the Software. Upon your acceptance of this Agreement, w e grant you a nonexclusive license to use the Software, provided that you agree to the following: 1. Use of the Software You may install the Software on a hard disk or other storage device and make bac kup copies of the Software. Burn4Free CD & DVD can be re-distributed on internet, CD-ROM or anything, freely as long as NO FEE is charged and all the files remain INTACT AND UNMODIFIED. If you download the Software from the Internet or similar on-line source, you mu st include this copyright notice for the Software with any on-line distribution and on any media you distribute that includes the Software. Ikysasoft s.r.l. uninominale does not condone, or encourage any usage of Burn4F ree CD & DVD that may infringe copyright laws and we urge you to adhere to the a ppropriate copyright laws of your country or legal jurisdiction. 2. Advertisers The ads appearing on our sites and within Burn4Free CD & DVD application are del ivered by us or by our advertising partners. These ads may contain cookies. Burn 4Free CD & DVD comes with web based ads. In the course of serving advertisements to those sites or Burn4Free CD & DVD application, we or advertising partners ma y place or recognize a unique "cookie" on your browser. We use cookies to delive r content specific to your interests, among other purposes. Ikysasoft s.r.l. uninominale shall not be responsible or liable, dir ectly or indirectly, for any damage or loss caused or alleged to be caused by th e use of or reliance on any such content, goods, or services available on or thr ough any such site or resource. 5. Copyright and Trademark Rights

The Software is owned by Ikysasoft s.r.l. uninominale, and its structure, organi zation and code are the valuable trade secrets of Ikysasoft s.r.l. uninominale. The Software is also protected by Italian and European Copyright Law and Interna tional Treaty provisions. You may use trademarks only insofar as required to com ply with Section 1 of this Agreement and to identify printed output produced by the Software, in accordance with accepted trademark practice, including identifi cation of trademark owner s name. Such use of any trademark does not give you any rights of ownership in that trademark. Except as stated above, this Agreement do es not grant you any intellectual property rights in the Software. 6. Restrictions You agree not to modify, adapt, reverse engineer, decompile, disassemble or othe rwise attempt to discover the source code of the Software. You are not allowed t o sell, re-sell, rent or lease Burn4Free CD & DVD, any portions of it or its li cense or any portions of a license without written permission from the Author. Y ou are not allowed to remove any product identification, copyright, proprietary notices or labels from Burn4Free CD & DVD. 7. Termination Without prejudice to any other rights, the Author of this Software may terminate this End-User License Agreement if you fail to comply with the terms and condit ions of this End-User License Agreement. In such event, you must destroy all cop ies of the SOFTWARE PRODUCT and all of its component parts. 8. No Warranty The Software is being delivered to you AS IT IS and the author and his team make no warranty as to its use or performance. Ikysasoft S.R.L. UNINOMINALE DOES NOT AND CANNOT WARRANT THE PERFORMANCE OR RESULTS YOU MAY OBTAIN BY USING THE SOFTW ARE OR DOCUMENTATION. Ikysasoft S.R.L. UNINOMINALE MAKES NO WARRANTIES, EXPRESS OR IMPLIED, AS TO NONINFRINGEMENT OF THIRD PARTY RIGHTS, MERCHANTABILITY, OR FIT NESS FOR ANY PARTICULAR PURPOSE. IN NO EVENT Ikysasoft S.R.L. UNINOMINALE BE LIA BLE TO YOU FOR ANY CONSEQUENTIAL, INCIDENTAL OR SPECIAL DAMAGES, INCLUDING ANY L OST PROFITS OR LOST SAVINGS OR FOR ANY CLAIM BY ANY THIRD PARTY. The entire risk arising out of use or performance of the SOFTWARE remains with you. Some states or jurisdictions do not allow the exclusion or limitation of incidental, conseq uential or special damages, or the exclusion of implied warranties or limitation s on how long an implied warranty may last. IN SUCH EVENT YOU MUST NOT INSTALL T HE SOFTWARE PRODUCT. Ikysasoft s.r.l. uninominale is under no obligation to main tain, support or update Burn4Free CD & DVD in any way, or to provide updates or error corrections. 9. Governing Law and General Provisions This agreement shall be governed by the International Copyright laws, the Copyri ght laws of Italy and the Copyright laws of European Union. This Agreement will not be governed by the United Nations Convention on Contracts for the Internatio nal Sale of Goods, the application of which is expressly excluded. If any part o f this Agreement is found void and unenforceable, it will not affect the validit y of the balance of the Agreement, which shall remain valid and enforceable acco rding to its terms. You agree that the Software will not be shipped, transferred or exported into any country or used in any manner prohibited by any export law s, restrictions or regulations. This Agreement shall automatically terminate upo n failure by you to comply with its terms. This Agreement may only be modified i n writing signed by Ikysasoft s.r.l. uninominale.
