CONTRACT

In Consideration of M/S.SHAPOORJI To engage M/S MFT ROADLINES PRIVATE LIMITED (Delivery Networks) as transport contractor for transportation of the finish product. Its Head Office at CG-200 Sanjay Gandhi Transport Nagar new delhi-42 Both the party here by agree to abide by the terms & condition as given in this contract and put in their Signature and seal to authenticate the same.

TERMS AND CONDITIONS CHARGEABLE WEIGHT:

Minimum chargeable weight per G R will be 100 kgs. And the volume will be converted in to weight based on formula 1 cft =18 k gs and the charged weight will be arrived at by considering the actual or converted weight which ever is higher.

VALUE SURCHARGE:
THIS SURCHARGE IS LEIVED BASED ON THE DECLARED VALUE OF GOODS BEING TRANSPORTED. The value surcharge will be 0.25% 0f the declared value. Value surcharge is minimum Rs. 200/-(We will issue only COF)

CONSIGNMENT NOTE CHARGE:

The fixed transaction charge will be Rs. 100/- per consignment note (G R).

HANDLING CHARGE:
Handling charge will be charged towards loading the material of the factory site and unloading charge will be charged if the payment of the labor made by the driver on behalf of us at the destination or consignees goes down. The clams will be raised in the bill of the same G.R. against which the loading / unloading was done.

FUEL SURCHARGE:
In the event of a hike in fuel price, every 50 paisa hike in the average fuel price will mean an additional 1% hike in the fuel surcharge,

CONGESTION CHARGE:
PUNE LUCKNOW, PATNA & GUWAHATI a congestion charge will be @ RS 200/- applicable PER WAY for the metro destination DELHI, MUMBAI, KOLKATTA, BANGLORE, HYDERABAD, AHMEDABAD and BILL.

SERVICE TAX:
Service tax on total fright will be deposited by you as applicable by the central excise act from time to time.

MATERIAL INSURANCE:
You would insure the material your self we shall take every precaution for the safe delivery of material, however, in case of loss and damages during transit or due to natural calamity, we shall issue necessary certificate, to lodge your clams with your under writers. The material will be booked on owner risk.

PAYMENT TERMS:
The goods will be booked on TBB basis hence the payment of these bills should be made with in 30 days from the date of G R booking.

DESTINATION EXTENSION SERVICE CHARGE:

A PART FROM DELIVERING TO THE DESTINATION UNDER THE SCHEDULED NETWORK, WE ALSO DELIVER TO OTHER LOCATION COVERING THE ENTIRE NOOK AND CORNER OF THE COUNTRY FOR CATERING TO THE LOCATIONS SERVICED OUR DESTINATION EXTENSION SERVICE WE CHARGE THE FOLLOWING OVER AND ABOVE THE NORMAL FRIGHT APPLICABLE TO THAT STATE.

Charge for any destination in India will be Rs.8/- per kg or minimum Rs. 1000/- which ever is higher.

SCOPE OF SERVICE:
The scope of service would cover distribution of goods Ex ANY POINT to ANY LOCATION to location to which the consignment was booked with in India.

DELIVERED MATERIAL ACKNOWLEDGMENT:

As policy the delivery acknowledgment is not handed over the does not from of a prerequested for submission of fright bill M/S PARTY NAME. Can however ask for specific G RS delivered material acknowledgment, the scanned images or hard copies of which of (as required) shall be provided.

BASIS OF BOOKING:
The consignment will booked on TBB basis/to pay and paid basis, the rate, term and conditions are the monthly credit contract EX A B C only if M/S PARTY NAME . Opts for booking consignment on fright to pay basis. The fright will be as the rate quoted will not be applicable; the booking will done as per the existing retail rate band of the company same will apply to the in bound consignment. The rate quoted is only ABCDEFand for out bound credit only. The to pay service charge is applicable for all the to pay consignment.

TRANSIT:

The transit days are exclusive of the date of booking and the date of delivery. The cute-off time for pick up will be 5pm, any request received after this will have the shipping date of the next day. Every effort is made by M/S MFT ROADLINES PRIVATE LIMITED (Delivery Networks) to adhere to committed scheduled but it does not take any responsibility of delays that or beyond the controls of its management and the company does not accept any responsibility for the consequential I losses suffered due to delay in delivery.

STATUTORY LEVIES:
All government levies like octroi, entry tax and tool tax paid on behalf of the consignments and including the service charge are payable by your consignee at the time of the delivery. In the event of non payment of the dues the consignment may be delivered unless your make the due payment before delivery of the consignment in question and in case of TBB basis booking all the charges will be raised at in the bill prepared against the particular consignment. The consignment carried by us stands cleared by custom, excise, sale tax authorities and its confiscation for its laps on these accounts for non-compliance of the statutory requirement would be responsibility/ liability of M/S. And detention on check post Rs. 1500/2200/- for 9mt/15mt. Truck will be charged extra and also in case of truck detains at destination.

TERMINATION:
Either party subject to one months notice can terminate the contract upon termination on clearance of all the dues and MFT ROADLINES PRIVATE LIMITED (Delivery Networks) will undertake to deliver all stock as require by M/S

SHAPOORJI

EXPIRY OF CONTRACT:

This contract is between MFT ROADLINES PRIVATE LIMITED (Delivery Networks) and M/S SHAPOORJI and other subsidiaries other companies or the branch on mutually agreed terms.

JURISDICTION:
The court in Delhi only will have the jurisdiction in case of any disputes related to this contract.
