I, Charles Cox, hereby declare as follows:

1. I am over the age of 18 years, make this Declaration based on personal knowledge, and

am competent to testify to the facts contained herein.

2. On or about December 7,2009, our daughter disappeared from the horne she shared with
her husband Joshua Powell and her two sons in West Valley City, Utah.
3. Susan was reported missing on December 7, 2009, when she failed to show up to work

and our grandsons were not dropped off at daycare.

4. On December 7, 2009, local police went to the family horne to check on the family's
whereabouts and no one was horne.

1 5. Joshua and our two grandsons were not heard from until they showed up at the house at

2 approximately 5:00 p.m. on December 7, 2009. Joshua told police that he left the family horne
3 just after midnight to take our grandsons camping in subfreezing conditions. He told police that

4 when he left Susan was sleeping and when he returned she was gone. The following day I spoke
5 with him and he informed me that Susan was getting ready for bed when he left.
6 6. To date, Susan's whereabouts are unknown and police have labeled her disappearance as

7 highly suspicious. Joshua is the only named person of interest in the investigation to find Susan
8 and has been extremely uncooperative with law enforcement in helping find her.

9 7. Eleven days after Susan's disappearance Joshua moved to Puyallup, Washington, where

10 he currently resides in the horne of his father, Steven PowelL.

11 8. In 2010, Joshua and his family created a website called SusanPowell.org. The website

12 seeks to address the Powell family's belief that Susan ran off with another man, Steven Koecher.

13 Around the same time that Susan disappeared, Utah resident, Steven Koecher, also disappeared.

14 Although investigators in Susan's and Mr. Koecher's disappearance have found absolutely no
15 link between the two, the Powell family has held steadfast to this belief.
16 9. In an attempt to give credit to their outlandish belief that Susan ran off with another man,

17 the Powell family has begun publishing and distributing Susan's personal journal entries. While
18 neither I nor my wife have ever read the journal entries, out of

respect for our daughter's privacy,

19 I know that Susan began writing journal entries at the age of 8 and continued writing until she

20 was approximately 20 years old. Journal entries have been published on SusanPowell.org and
21 distributed to numerous media outlets.

22 10. The journal entries are of a very private nature and detail very personal family matters.

23 One journal entry has been published on SusanPowell.org that details a quarrel between our

1 daughter and my wife. The journal entry was written by a friend of Susan's, Brittainy Cornett.

2 Ms. Cornett never consented to the release of the entry and it was written in the journal with the
3 knowledge it would be kept private. Another journal entry that was distributed to various media
4 outlets details an episode where our daughter consumed a number of over the counter headache

5 medication and had to be taken to the hospital as a precaution. While there are a number of
6 journal entries and I have only seen the ones that have been released by the Powell family, I can

7 only assume that all of them detail very personal family matters and are private.

10 b. Attached as Exhibit B are true and correct copies of news articles discussing

11 journal entries and their distribution by the Powell family

12 11. The publication and distribution of these journals has caused my wife and I severe

13 emotional distress and anguish. It is horrible enough that we have had to endure the
14 disappearance of our daughter, but now her husband and his family are releasing private
15 information about our family. They have no right to release this information and it invades my

16 privacy, my wife's privacy, and most importantly, my daughter's privacy. Our daughter has
17 never consented to the release of this information and my wife and I have never consented to the

18 release of this information.

19 12. My wife and I have made repeated requests to Joshua and his family to not publish the

20 journals or distribute them. We have also made repeated requests that the journals be given to us
the
21 as they are not Joshua's property and we know our daughter would not consent to his use of

22 journals.

1 13. Every day we have to read a news story about our daughter and see her name flashed in

2 the media. I can't even begin to explain the pain, anger and frustration my wife and I feel not

3 knowing the whereabouts of our daughter and having to watch her husband and family behave in
4 such a maner. Every day my wife and I sit on pins and needles not knowing if the Powell
5 family is going to release more journal entries and disclose more private information about my

6 daughter and our family. The acts of Joshua and his family are outrageous and I beg this Cour
7 to recognize our rights, the rights of our daughter, and the rights of our family as we continue to

8 await word on the fate of our daughter.

Susan's friend Brittainy wrote a real-time letter directly into Susan's Journal as Brittainy was wItnessing the severe emotional abuse Judy Cox was inllicting on Susan at that very moment This letter describes the kind of emotional abuse that the Powells have always known about based on the Powells' own firsthand experience with Judy Cox. Susan experienced this type of emotional abuse by her mother. Judy Cox. every day of Susan's young hIe.

In addition to documenting the abuse that Brittainy was witnessing. Brittainy also wrote that she could empathize with Susan. Having been a victim of
emotional abuse herself. Brittiny was one of

the few people that really

understod Susan Susan always speak of Brittiny as one of her dearest friends and Susan regrets not having stayed closer in touch with Brittainy over the years.
The Powells know that Briuainy loved Susan as a dear friend and probably still does. Susan is at a time again when she needs help. Chuck and Judy Cox have been making statements in the media for a year to manipulate Susan's image and relaiionships. Because of the Powells' increasing understanding of Susan as they continue to read Susan's childhood journals, the Powells believe that even now. this ongoing abuse is destroying this loving mother and wife. wherever she may
be.

Chuck and Judy Cox's abuse of Susan and her children. inflcted both in the
media and privately. must be stopped. In the Powells' opinion. Chuck and Judy
Cox pretend to be abuse-victims' "advocates" only so they can take donations 10

a foundation under the pseudonym of "Susan Cox Powell" The Coxes created this pseudonym with ill-intent. On November 6, 20 I O. The Salt Lake Tribune pubJished that "The Coxes acknowledge they inserted Susan's maiden name to disassociate her from her husband ..... In point of fact, the Powells have seen how Chuck and Judy Cox have ahenated each of their daughters from the men they each loved over the years. Chuck and Judy Cox are abusers who have hijacked the system In order to collect donations.
The Powells can only hope for Brittainy's continued support for Susan as the Powells pubJish this letter in full because the Powells feel Brittainy's words are so powerful

Letter to Susan written directly into ber journal

The six page leiter Brittiny wrote directly into Susan's journal describe a real-time account of

the emotional abuse what Susan regularly writes in her journal as she is

Susan sufTered in her childhood home. This type of abuse is typical of what the Powells have witnessed what Susan has told the Powells and it is typical of growing up. It is also typical of

firsthand of Judy Cox.

Brittainy's letter begins by describing the scene Brittainy is al Susan's childhood home, Chuck and Judy Cox's home. and she is watching Susan tear up chicken for dinner. Susan's mother is yelJing, manipulating. threatening. and berating Susan incessantly Susan is almost in tears Susan always said her Jife was nol as happy as outside observers thought it was. Briltainy truly empathizes with Susan because Britlainy knows what it is i ike to never be able to do anything right

Susan can never do anything right for her mother. Judy Cox No matter how hard Susan tries. it is never good enough. Susan feels unloved and worthless. but ii isn't her fault According to Brittainy. what Susan needs to do is to control Susan's own anger and stop yelling back Brittainy lovingly suggests that Susan should respond softly. If Susan's mother keeps yelling. talk more softly still Thre is no excuse for the way Judy Cox is treating Susan. but it is clear that Susan's mother still loves Susan and Susan wil always love her mother

Most imponantly Susan necds to know that It IS not her fault that her mother subjects her to daily humiliation and emotional abuse According to Britiainy. Susan's mother. Judy Cox, needs to understand what she is doing to Susan and correct her own behavior Susan is a beautiful and loved person. Susan is overwhelmed by fceliigs of worthlessness almost daily and she deserves to be happy and believe in her own self-worth Susan's desire to go on living depends on her own feelings of self-worth.

Chuck objects to the release of information from his daughter's journals,

Chuck said that the information already released by the Powells comes from when his daughter was a

teenager.
In one passage, the television station reports, Josh claims that Susan had written she had "taken 10 Ibuprofen" but then later stated she "wasn't trying to kill herself." Steve. according to the TV station, said this information shows "that Susan led a double-life from the time she was 13,14, or possibly even 12." Chuck said he believes Susan was about 13 at the time of the incident, which his family recalls involving six pills of the over-the-counter headache medication Cox said his daughter was taken to an emergency room as a precaution, but was released. A health policy in place at the time required a social worker visit after such an

incident, Chuck said.

"They concluded that she was not suicidal," he said. "In Steve's mind. that proves that she was"

Alina says her family has cooperated with the FBI. and will continue to do so, but they have nothing new to
contribute. She said the family allowed its Puyallup home to be searched last year without a warrant. Alina said authorities haven't contacted the family for over a year "and we have sent things as recently as few months ago, when we think of thing that may be leads."
Alina says her brother has already attempted to cooperate with polce.

"Josh spoke extensively to police but when they began lying to him he said, 'i guess I need an attorney. They haven't called us since then We haven't seen or heard from the West Valley City police," she said

She also says Josh would be willing to speak with the FBI - as long as they pay his lawyer's fees,
Josh recently told the Salt Lake Tribune that he is willing to talk with federal authorites, but not West Valley City police.

He told the newspaper that he considered the search in Ely an opportunity for authorities to set him up.

"It occurred to me," Josh said, according to the paper, "they were planting something in Ely so they could

magically show it to the media."

The FBI Utah offce's spokeswoman Debbie Dujanovic Bertram declned comment Monday. And a message left for Josh Powell's Salt Lake City attorney Scott Williams was not immediately returned.

The AP could not independently verify the validity of the documents and Chuck Cox didn't immediately return an email Monday evening.

West Valley City police Sgt. Mike Powell, who is not related to the Powell family, said Monday that police wouldn't comment on the journal entries.

Supporters of missing Utah Mom Susan Cox Powell are outraged that her father-in-law plans to publish her prvate journal online, and they've launched a Facebook campaign to stop him.
"We need to step up for Susan and her loved ones, and not allow this to happen. Susan deserves respect and justice," reads the description of the "Stop Josh Powell from publishing Susan Cox

Powells journals" Facebook page.

A related petition at change.org is asking GoDaddy.com -- the host of SusanPowell.org, a website
operated by Susan's father-in-law Steve Powell - to take down his site.

"Steven Powell has begun transcribing missing mom Susan Cox Powells personal journal ... Steve's son, Josh Powell, is the SOLE person of interest in the still open investigation of Susan's disappearance," reads a description of the petition. "The Powell family claims that Susan is alive and left voluntarily. IF this is the case, the 2,000+ pages of Susan's personal journal legally
belong to Susan as she is the sole copyright owner. See U.S. Copyright Law chapter 2."

During a recent interview with NBC's "Today" show, Steve Powell said he has 2,000 pages of journals his daughter-in-law allegedly kept before she went missing. The journals, he said, back up his theory that she ran off with another man.
"People don't know that there are two distinct sides of Susan. She was very ... kind of an open
person in a sexual way... with the opposite sex," Powell said on the show.

Susan Powell, 28, was reported missing by her family on Dec. 7, 2009, after she failed to show up

for her job as a stockbroker at Wells Fargo FinanciaL. Her husband, Joshua Powell, told police he had been camping with their two children, ages 2 and 4, and had last seen his wife around
midnight.

Suspicious of Joshua Powell's story, investigators named him a "person of interest" in his wife's disappearance. Several search warrants were served, including one to draw biological samples from him. Police also impounded the family van.
No one has been charged in Powells disappearance, and police say the case remains an active investigation. Joshua Powell, 34, and his two children have since moved back to his hometown of

Puyallup, Wash.
Susan Powell's best friend, Kiirsi Hellewell, expressed her thoughts on the journals in a July 14 post to her online blog, "Pieces of Me."

"What kind of a man does this? What kind of a person not only violates the sacred privacy of a young girl by reading her thoughts... but also decides he's going to publish her private thoughts to the entire world," Hellewell wrote.
"This is so wrong, on every level," she continued. "This is an act of total depravity, And I hope the people of this country and this world will realize this and stand up for Susan, for truth, for justice."

Powell's disappearance comes as both families have publicly traded accusations over her fate.
Chuck Cox, Susan's father, and Steve Powell, Josh's father, argued loudly in front of reporters and television cameras in Puyallup, Wash., on Saturday. The families are scheduled to meet in court Tuesday, with Josh Powell requesting a restraining order against Cox.

The family of Josh Powell, whom authorities have called a person of interest in his wife's disappearance, is backing up assertions that Susan ran off with another man in December 2009, leaving her husband and two sons, by saying that pages from her diary prove she had a history of erratic behavior. The family initially released the documents to K1VX in Salt Lake City ( http://bit.y/qS3qNO). As sent to The Associated Press on Monday by Josh's sister, Alina Powell, the two journal entries - seven handwritten pages on what appears to be school notebook paper - details events from Susan's life in 1996 and 1998. In the email, Steve Powell contends the documents prove, "Susan is a lot more vulnerable emotionally than Chuck and Judy Cox would like people to believe."
Cox objects to the release of information from his daughter's journals.

"They don't have authority to do it," he said. "If she is alive, which they claim, she then stil maintains control over her writings, copyright wise. If they publish it, I'm prepared to take action. I have an attorney and we're waiting."

Cox said that the information already released by the Powells comes from when his daughter

was a teenager.
In one passage, the television station reports, Josh Powell claims that Susan had written she had "taken 10 Ibuprofen" but then later stated she "wasn't trying to kill herself." Steve Powell, according to the TV station, said this information shows "that Susan led a double -life from the time she was 13,14, or possibly even 12." Cox said he believes Susan was about 13 at the time of the incident, which his family recalls involving about six pills of the over-the-counter headache medication. Cox said his daughter was taken to an emergency room as a precaution, but was released. A health policy in place at

the time required a social worker visit after such an incident, he said.
"They concluded that she was not suicidal," he said. "In Steve's mind, that proves that she

was."
In the journal entry about the incident, Susan wrote that she was repeatedly being asked if she had been trying to commit suicide. "No!!!" the journal entry states.
The AP could not independently verify the validity of the documents and Chuck Cox didn't

immediately return an email Monday evening.

West Valley City police Sgt. Mike Powell, who is not related to the Powell family, said Monday that police wouldn't comment on the journal entries.
Susan Powell was last seen at her home on Dec. 6, 2009. She was reported missing the next day when she failed to show up for her job in West Valley City, Utah.

Alina Powell says her family has cooperated with the FBI, and will continue to do so, but they have nothing new to contribute. She said the family allowed its Puyallup home to be searched last year without a warrant.
Authorities haven't contacted the family for over a year "and we have sent things as recently as few months ago, when we think of thing that may be leads," she said.
Alina Powell says her brother has already attempted to cooperate with police.
"Josh spoke extensively to police but when they began lying to him he said, 'I guess I need an attorney.' They haven't called us since then. We haven't seen or heard from the West Valley City police," she said. She also says Josh would be willing to speak with the FBI - as long as they pay his lawyer's

fees.
Josh Powell recently told the Salt Lake Tribune that he is willng to talk with federal authorities, but not West Valley City police. He told the newspaper that he considered the search in Ely an opportunity for authorities to set him up.
"It occurred to me," he said, according to the paper, "they were planting something in Ely so

they could magically show it to the media."

Both Susan and Josh Powell are natives of Puyallup, and Josh moved back there with his young sons after Susan disappeared. Susan's father -inlaw and father also live in Puyallup. In recent interviews, Josh Powell has claimed that his wife was mentally "unstable" before she vanished, and Steven Powell has claimed that she initiated a ftrtatious, "sexually charged" relationship with him. Her father, Chuck Cox, has denied those claims - as did Bremner, who called them a "complete lie."

"They try to say that she took some aspirin and tried to kill herself. She didn't," she says. "I mean, she was a kid. You say funny things when you're a kid. She was an adult woman with two children aged 2 and 4 when she disappeared, and to mock her memory or try and malign her is just

irresponsible."
The restraining order issued against Josh and Steven Powell comes a few days after Josh obtained a no-contact order against Chuck and Judy Cox, forbidding them coming within 500 feet of him or his sons.
