Rural land use dispute

T
he RM of Saskatche-
wan issued its second
denial of a conditional use
order application on Sep-
tember 6th during a pub-
lic hearing that several
area residents attended.
Te application had been
made by Lynn Forbes and
her father Dave of Prince
Albert, SK. Te Forbes had
purchased two parcels
of land from Emil and Sal-
ly Saler in 2010; one par-
cel is 136 acres, the other
is 6.31 acres. While both
parcels now belong to the
Forbes, they have separate
land titles and tax levies.
Te Forbes had applied
for a conditional use or-
der to construct a non-
farm dwelling on the 6.31
acres, located at NW-14-
14-19-W.
Te Forbes desire is
to keep horses and cattle
on the 136 acres, with their
family residence located
on the 6.31 acre parcel.
Te reason they do not
want to build their home
on the 136 acres, Forbes
explained, is practicality.
Lynn said it would cost an
extreme amount of money
to do the work needed for
a home on that parcel.
Before she purchased the
land, Lynn says she con-
tacted the Midwest Plan-
ning District and asked if
she could build on the 6.31
acres. I was told that I had
to apply for a conditional
use order but that no one
had ever been denied.
In July, Lynn applied for
a Conditional Use to con-
struct a non-farm dwell-
ing on the 6.3 acres as well
as a Variation Order to
change the distance to the
property line to accom-
modate an existing water
run. Tree counsellors
voted in favour of approv-
ing the application, but it
was defeated.
According to the Prov-
ince of Manitobas Land
Use and Development
website, conditions may
be attached to a decision
and the approval of con-
ditional use is granted at a
municipalitys discretion.
Under Te Planning Act ,
council makes a decision
on a conditional use ap-
plication and it is fnal.
Her only recourse was to
reapply, which she did on
September 6th.
Tere have been nu-
merous examples in the
area of conditional uses
and subdivisions being
permitted. RM council
acknowledges that no
conditional use order ap-
plication has ever been
turned down before, but
also stated that there has
never been any opposi-
tion to one before.
