seeking waiver of pre deposit and stay of recovery in
m a t t e r o f a p p e a l f i l e d i n r e l a t i o n t o o r d e r o f The Assistant
Commissioner of Central Excise No. 14, Municipal Road, Azeez Nagar,
Reddiyarpalayam, Pondicherry – 605010 vide Order-In-Original No.
27/2005(S.Tax) dated 6th July, 2006.

2) F o r t h a t t h e A p p l i c a n t s u b m i t s t h a t t h e f a c t s a n d e v e n t s
leading to the filing of this appeal have been narrated in
detail in memorandum of appeal in Form No. ST 4 and the
Applicant craves leave of your honour to adopt, recite and
maintain the same in support of this application and
reiterates and maintains the averments contained therein
in support of this application.

3) F o r that the Applicant submits that they have strong

prima-facie case on merits and demand of penalty would

put undue hardship if they are called upon to pre-deposit

the dues during pendency of this appeal.

4) F o r t h a t A p p l i c a n t w i s h e s t o b e h e a r d i n p e r s o n .

above, stay order be passed to grant waiver of pre-deposit of

entire adjudication levies and stay the recovery of demands

during the pendency of this appeal, and hear the appeal on

and fairness, the Applicant would be beholden and would
