A protest has been done by the Captain against the local stevedoring company declining any
liability due to improper working ability from them.

The agency PortMar through his Manager Capt Duarte also confirmed the Captain’s allegation,
saying that the ship’s cargo equipment was in due order and in his opinion full liability should be
addressed against the stevedoring company, ENAPOR.

Furthermore the weather/sea was reported relatively good and no swelling verified.

3. Conclusion/recommendations

• The cargo has been inspected by the surveyor at the quay side and by visual inspection
is clear that several averages happened to the above mentioned vehicles which can drive
to a constructive total lost.

• Having all those facts in mind and several elucidative pictures attached to this report we
conclude that there is a clear ground to suppose that improper or lack of skill of the water
operation was the cause of the incident and therefore making the vessel liable with this
regard.
This survey was carried out at the presence of the Receiver’s Agent and Aron Chief Mate,
represents a true statement and done without any prejudice.
