Stare Decisis in Constitutional Law

Judges and justices are servants of the law, not the other way around. Judges are like umpires. Umpires don't make the rules; they apply them. The role of an umpire and a judge is critical. They make sure everybody plays by the rules. But it is a limited role. Nobody ever went to a ball game to see the umpire. Judges have to have the humility to recognize that they operate within a system of precedent, shaped by other judges equally striving to live up to the judicial oath. And judges have to have the modesty to be open in the decisional process to the considered views of their colleagues on the bench.

Court to compassionately REINSTATE him based on the same jurisprudence / STARE DECISIS that Your Honors predecessors --- the 19th Narvasa and 20th Davide Courts --- used in CAGIGAL & MURO and VILLEGAS, respectively; in these 2 and 1 REINSTATEMENTS of dismissed Judges, Judge Floro ardently believes that by FAITH (that does Justice), this 21st Court (that barely has TIME, for it will bow on December 9, 2006,
or 215 days from this 5th First Friday) is PRE-DESTINED to REINSTATE at the

very least, ONE Judge; we fervently appeal that the 21st Chief Justice, as a FINAL FEATHER on his cap, bestow upon the herein unfortunate respondent, the same extraordinary RESOLUTIONS that the NARVASA & DAVIDE Courts did benignly GRANT upon the 3 dismissed RTC Judges.

Stare Decisis in Constitutional Law --Adherence to precedent ordinarily limits and shapes the approach of courts to decision of a presented question. Stare decisis is usually the wise policy, because in most matters it is more important that the applicable rule of law be settled than that it be settled right. . . . In the light of the cited secondary authority, respondent Judge

Floro hereby anchors his hypothesis on the very same jurisprudence and ground rules Your Honors have cited. With due respect, please allow the herein respondent to make the following observations: Nature of Proceedings for Removal of Judicial Officers
a) As early as 1893, it was ruled that:

an impeachment proceeding for removal of judges is of judicial and criminal in nature and is governed by the rules applicable to criminal cases. The charge must, therefore, be proved beyond reasonable doubt.
[48 C.J.S. 27, p. 975; citing Ala.- State v. Hasty, 63 So. 559m 184 Ala. 121; State v. Hastings, 37 Neb., 96). b) The States Supreme Courts promulgated the case law, that:

The removal of a judicial officer is a matter usually regulated by the constitution or statutes, and removal proceedings must be in strict accordance with such provisions.
[Mont. State ex rel. Ryan v. Norby, 165 P.2d 302; Ind. State v. Dearth, 165 N.E. 489, 201 Ind. 1; Okl. State v. Rowe, 300 P. 727, 149 Okl. 240]. c) In this jurisdiction, as early as 1922, Justice Malcom, in the

case of In Re Horilleno (43 Phil. 212) declared that:

The grounds for removal of a judge of first instance under Philippine law xxx xxx the quantum of proof to establish the cause of removal must be proof beyond reasonable doubt.

d) In the recent case of Lachica (February 28,2006), Madame

Justice Ynares-Santiago cogently stressed --- it is now settled that before a judge is removed from office, the charges must be proved beyond reasonable doubt:
In its attempt to cleanse the Aegean stables, so to speak, this Court must tread on with utmost circumspection and prudence to make sure that

only the guilty is denounced and the innocent absolved. It must be stressed in this regard that xxx, the general rules as to admissibility of evidence in criminal trials apply and the culpability of the respondent should be established beyond reasonable doubt. Thus, as in criminal cases where the dictates of due process is observed with utmost stringence, the respondent judge in this administrative complaint should likewise be given full opportunity upon reasonable notice to defend herself and to adduce evidence in support thereof for the Court will not allow itself to be an instrument that would destroy the reputation of any member of the bench by pronouncing guilt on the basis of incomplete evidence or mere speculation.

THE CONSTITUTIONAL COMMISSION OF 1986s Mr.

Concepcion and Fr. Bernas (with 29 others) defeated the proposal of Mr. De Castro to insert a comma (,) and the amendment regarding the procedure to determine incapacity of judges; Mr. De Castro desperately fought for the insertion of the words AS DETERMINED BY THE GOVERNMENT PHYSICIAN CHOSEN BY THE SUPREME COURT; but he only got 1 other vote: 2 vs. 31 (against his proposed amendment). 6. Verily, as stressed by Mr. Concepcion, upon interpellation by Fr. Bernas, a) an enabling law may be passed, or b) the JBC may be consulted by the High Tribunal; but in any case, Mr. Concepcion WON: the judges medical incapacity is determined by a c) COMMITTEE OF DOCTORS created by the Supreme Court. xxx. The court has deemed it best to choose in every case the DOCTORS who shall probably determine the INCAPACITY of a member or judge to d) INSURE IMPARTIALITY (1 Rec. 495-6). Applying the foregoing clear INTENT of the 1987

CONSTITUTIONS FRAMERS, respondent Judge Floro begs this Court to set aside, due to clear impression of NULLITY, the said March 7, 2001 findings of the mental health professionals who interviewed/analyzed him: Dr. Rosa Mendoza is a general physician; Dr Celeste Vista, although a psychiatrist, is a government physician who is not an IMPARTIAL DOCTOR (part of the PANEL OF DOCTORS, that must be created by the High Tribunal); Ms. Sanchez & Ms. Cruz are mere psychologists. Mr. Concepcion made a very important remark and answer upon interpellation by Fr. Bernas: that the JBC may be consulted on the matter of incapacity of incumbent judges, since: a) the Constitution places it under title VIII (Judicial Department), b) the Supreme Court has supervision over it, and c) it conducts mental tests upon applicants to judicial posts before nomination. 7. Like Judge Muro (who was reinstated on 11 December, 1995,

251 Scra 111), Judge Floro hereby renews his pledge and sincerely attests to his unsullied name and service records as lawyer and judge prior to this administrative case; with all sincerity Judge Floro hereunder writes a humble and contrite gesture by making a --a)

Solemn Commitment ---

that he will avoid creating a situation that spawns suspicion of arbitrary and improper conduct; that he would adopt usual and expected method of doing justice and not seek to be extreme or peculiar in his judgment or spectacular or sensational in the conduct of the court; and

b)

that he would avoid all appearances of impropriety, specially those that create suspicion of partiality, bias or improper motive; and more specifically, he would avoid any public expression of his religious

In this regard also, Judge Floro takes refuge in the 21st Chief Justices immortal words regarding the subject freedom in the Bill of Rights:
xxx perseverance of this Court in safeguarding the peoples constitutionally enshrined liberty. Worse, our people will surely condemn the misuse of legal hocus pocus to justify this trifling with constitutional sanctities.

11. In line with the pronouncement of the 18th FERNAN Court in the In re: Petition for Dismissal from Service of Judge Baltazar R. DIZON case, and borrowing the words therein, the Decision to dismiss herein respondent took effect on March 31, 2006 and released on April 6, 2006. III. Judge FRANKLYN A. VILLEGAS, November 18, 2004 REINSTATEMENT 12. Like Judge Villegas, respondent Judge Floro borrows his words, as herein respondent humbly begs this 21st Court to reconsider the decision in the spirit of the doctrine of STARE DECISIS thus:
Respondent anchors his hypothesis on the very same jurisprudence Your Honors have cited. With due respect, please allow the herein respondent to make the following observations: (a) In Davila vs. Generoso, [336 SCRA 576, 580 (200), citing Longboan vs. Polig, 186 SCRA 557, 561, (1990), the respondent Judge therein was required to comply the directives of the Honorable Courts directives, particularly in the cited Resolutions therein, more specifically, Resolution dated January 21, 1998, requiring him to show cause why he should not be dealt with disciplinarily or held in contempt for failure to comment on subject complaint of complainant Davila and to comply with the resolution of August 13, 1997, within ten (10) days from notice. The same was followed with a Resolution dated October 5, 1998, wherein the respondent judge was required to comply with the resolution of January 21, 1998, within ten (10) days from notice, under pain of appropriate disciplinary action, yet, he was still afforded one last chance and finally in a Resolution dated March 17, 1999, the respondent was required to show cause why he should not be dealt with more severely for

failure to comply with the Resolution, dated December 11, 1995, and to file the required comment within ten (10) days from notice. It is most respectfully noted that there were at least three (3) warnings given the respondent before he was finally handed the verdict of dismissal from service. (b) In Parane vs. Relosa, [238 SCRA 1, (1994)], the respondent likewise failed to heed the Honorable Courts directives and in the Resolution of August 4, 1994, the Court, wishing to afford respondent Judge another opportunity to explain himself, resolve thusly:
WHEREFORE, finding respondent Judge guilty of gross misconduct and insubordination in his continued failure to comply with the lawful orders of this Court, the Court hereby IMPOSES on the respondent Judge a FINE of Five Thousand Pesos (P5,000,00). Said respondent is still required to COMPLY with the resolution of 22 July 1993 within ten (10) days from receipt hereof, with a STERN WARNING that noncompliance therewith will be dealt with most severely as so herein above expressed. x x x With respondents continued defiance of the last Court directive, he was ultimately dismissed from the service on November 7, 1994. It is further noted that the respondent was afforded his final chance before the extreme penalty of dismissal from the service was handed down.

(c) In the case of Guerrero vs. Deray [A.M. No. MTJ-02-1466, 10 Dec. 2002, citing Joseph vs. Abarquez, 261 SCRA 629 (1996), the respondent was found guilty of gross incompetence and inefficiency, gross misconduct and conduct prejudicial to the best interest of the service. The Honorable Court has meted upon the respondent the extreme penalty of dismissal because it was warranted by the circumstances, when it said: In other words, indifference or defiance to the Courts orders or Resolutions may be punished with dismissal, suspension or fine as warranted by the circumstances. (d) In the case of Erlinda Alonto-Frayna vs. Judge Abdulmajid J. Astih [300 SCRA 199 (1998)], The Honorable Court found the respondent guilty of gross inefficiency and neglect of duty exacerbated by his audacious stance in defying the Courts orders.

13. Because of Stare Decisis, and more importantly, since the 20th Davide Court wanted to be the same as its predecessor, the 19th Narvasa Reinstatement Court, C.J. Davide, with COMPASSION that does JUSTICE, tersely WROTE the destiny of Judge VILLEGAS, citing precedents of clemency, mercy and compassion upon Judges: In administrative cases involving discipline of judges and court personnel, we have allowed second or even third motions for reconsideration
In our En Banc decision of 03 February 2004 in A.M. No. 03-1515-MTJ (Dolores Imbang vs. Judge Deogracias del Rosario, MCTC Patnongon, Bugasong, Valderama, Antique), we meted the penalty of fine of P10,000 on respondent Judge for his failure to comply with many directives of the Office of the Court Administrator requiring him to file a comment on the Complaint

and for failure to immediately resolve pending motions and to decide a case within the 90-day period, which constituted gross inefficiency. In that case the complaint was filed on 31 July 1998 yet. Judge Del Rosario was required to comment thereon by the OCA in its 1st Indorsement of 9 February 1999, but Judge Del Rosario did not comply with it despite several subsequent letters from the OCA, forcing the OCA to report the matter to the Court and to recommend that Judge Del Rosario be fined in the amount of P5,000 for his obdurate defiance of the several directives of the Office of the Court Administrator; considered to have waived his right to defend himself in said case; and be fined P2,000 for delaying the administration of justice by failing to decide Civil Case No. 318 entitled Dolores Imbang vs. Alice Guerra. In the del Rosario case, despite our conclusion that Judge Del Rosarios failure to comply with the Courts directive to file his comment to the letter complaint against him constitutes a blatant display of his indifference to the lawful directives of the Court and gross misconduct and insubordination; and his prior convictions in two administrative cases, we merely imposed upon him a fine of P10,000. He was further directed to show cause within 10 days from notice why he should not be dismissed from the service for his refusal to file his Comment as directed by the Court. While indeed a second motion for reconsideration is a prohibited pleading under the 1997 Rules of Civil Procedure, we have allowed it in certain cases. Besides, in administrative cases involving discipline of judges and court personnel, we have allowed second or even third motions for reconsideration whenever justified by the circumstances. In the instant case, and taking the foregoing observations, we have resolved to give due course to the second motion for reconsideration and to partly grant the relief prayed for. The penalty of dismissal from the service which we have imposed on respondent may seem, indeed, to be harsh. There were administrative cases of more serious nature where we have been less harsh. (Zarate vs. Judge Balderian, (A.M. No. MTJ-00-1261, 3 April 2000; 386 Phil. 1); Guintu vs. Judge Lucero, (A.M. MTJ-93-794, 23 August 1996, 329 Phil. 704). Only last 10 September 2004, in Tamondong vs. Judge Marino de la Cruz, (A.M. No. 00-1-10-RTC) we merely imposed a fine of P40,000, despite the finding of repeatedly failing to heed the Courts show cause orders, as well as the lawful directives of the OCA. WHEREFORE, in light of the foregoing, the Second Motion for Reconsideration of respondent is hereby given due course, and is partly granted. The penalty of dismissal from the service imposed on respondent is hereby REDUCED to suspension for a period reckoned from the time respondent received a copy of the decision of 19 November 2003 until he shall re-assume office by virtue of this Resolution, which he must do within ten (10) days from notice of this Resolution. Respondent is further directed to pay, within thirty (30) days from notice of this Resolution, a fine of P50,000. SO ORDERED. xxx.
[EN BANC, A.M. No. RTJ-03-1812. November 18, 2004, PABLITO R. SORIA, ET AL., complainants, vs. JUDGE FRANKLYN A. VILLEGAS, Regional Trial Court of Pagadian City, Branch 19, respondent, R E S O L U T I O N, DAVIDE, JR., C.J.]

III.a. Judge Philbert I. Iturralde, August 31, 2000 Lifting of Preventive Suspension and November 21, 2000 Full REINSTATEMENT 14. Respondent Judge Floro also cites, with due respect:

Respondent Judge Iturralde

What complainant Federico Calilung said in his sworn statement (Exhibit A) that respondent Judge Suriaga assured him (Calilung) there would be no problem in the case on appeal because Judge Iturralde himself assured him (Suriaga) of a favorable decision in consideration of the amount of P250,000.00, to which he (Iturralde) agreed, is totally hearsay and not true. Federico Calilungs testimony that although he was not able to talk to Judge Iturralde himself, it was his lawyer, Atty. Marlon Lauder, who did regarding the case on appeal and Judge Iturralde said he should talk to Judge Suriaga instead because they had already come to an agreement regarding the matter, is again totally hearsay and not true. What the Calilungs swore in their affidavit dated April 20, 1999, that Judge Suriaga instructed them to prepare the money and told them there was no problem in the appeal as Judge Iturralde has assured them of a favorable decision and about the scheduled pay-off on April 19, 1999 at his rented house where Judge Iturralde would receive the money, is likewise totally hearsay and not true. So is the alleged telephone call by Judge Suriaga insinuating that he (respondent Judge Iturralde) was at the other end of the line, is totally hearsay and not true. At 1:35 in the afternoon of April 19, he was in his sala conducting a hearing as scheduled in the calendar for that day starting from about 1:30 oclock in afternoon and ending at about 4:00 oclock p.m.i[152] He was supposed to hear twelve cases for that day starting from 1:30 oclock. He arrived at his sala about 12:30 oclock noon, took his lunch and went over the record of the cases involved. He received no telephone call from anybody that afternoon of April 12, 1999 while in Court in Angeles City. He inquired from the members of his staff if they received any for him and they told him there was none. The joint affidavit of his staff members to that effect is marked Exhibit 6. The calendar of cases set for hearing on April 19, 1999 is marked Exhibits 7, 7-A and 7-B. He then left to fetch his wife at the Veterans Memorial Hospital near Shoemart at EDSA in Quezon City. He reported for work next day, April 20, and until Friday of that week. He went on leave of absence beginning April 27, 1999, the application therefor he filed on March 25, duplicate copy of which is marked Exhibit 8. He tried once at the driving range but his back ached. He has a set of golf clubs which he bought hulugan. The medical certificate attesting to his health is marked Exhibit 10. It is not true he was supposed to go to Judge Suriagas house in Angeles City on April 19, 1999. That is totally hearsay and not true. On the basis of the foregoing evidence, the Investigator, (Ret.) Justice Pedro A. Ramirez recommended the dismissal of both respondents with the forfeiture of benefits except accrued leaves. As regards the case against Judge Iturralde, complainants capitalized on a telephone conversation that allegedly transpired in the house of Judge Suriaga on April 19, 1999, the date the latter was entrapped and arrested. There being no sufficient showing at this time to establish the culpability of Judge Iturralde, the case against him should be referred back to the Office of the Court Administrator for further investigation as to his participation in the anomalous transactions complained of. In the meantime, in order to enable Judge Iturralde to perform his functions, this Court lifts his suspension pending the proceedings against him. WHEREFORE, in view of all the foregoing, judgment is hereby rendered: 1.] Respondent Wilfredo S. Suriaga is DISMISSED from the xxxz 2.] The administrative complaint against respondent Philbert I. Iturralde is REFERRED back to the Office of the Court Administrator for further

SO ORDERED. [EN BANC, A.M. No. RTJ-99-1437. August 31, 2000, FEDERICO S. CALILUNG, complainant, vs. JUDGE PHILBERT I. ITURRALDE, RTC, Branch 58, Angeles City, respondent, PER CURIAM]

15. Judge Iturralde was exonerated and fully reinstated, thus:

Concededly, administrative proceedings are not strictly bound by formal rules on evidence. However, the liberality of procedure in administrative actions is still subject to limitations imposed by the fundamental requirements of due process. Thus, the old but still very much applicable and oft-quoted case of Ang Tibay v. CIR 69 Phil. 635 [1940].states that "{t}his assurance of a desirable flexibility in administrative procedure does not go so far as to justify orders without a basis in evidence having rational probative force." In short, mere uncorroborated hearsay or rumor does not constitute substantial evidence. GSIS v. CA, 296 SCRA 514 [1998], citing Ang Tibay v. CIR, supra., citing Consolidated Edison Co.v.National Labor Relations Board, 59 S. Ct. 206, 83 Law ed. No. 4, Adv. Opp., p. .Indeed The Rules, even in an administrative case, demand that, if the respondent judge should be disciplined for grave misconduct or any graver offense, the evidence against him should be competent and should be derived from direct knowledge. 36 Raquiza v. Castaneda, Jr. 81 SCRA 235 [1978].The Judiciary to which the respondent belongs demands no less. Before any of its members could be faulted, it should only be after due investigation and after the presentation of competent evidence, especially since the charge is penal in character. OCA v. Judge Filomeno Pascual, 259 SCRA 604 [1996], citing Raquiza v. Castaneda, supra. Misconduct is defined as any unlawful conduct on the part of a person concerned in the administration of justice prejudicial to the rights of parties or to the right determination of the cause. Canson v. Garchitorena, SB-99-9J, 28 July 1999, 311 SCRA 268, citing Blacks Law Dictionary, Fourth ed., p. 1150.It generally means wrongful, improper or unlawful conduct motivated by a premeditated, obstinate or intentional purpose. Ibid., p. 285, citing Words and Phrases, Vol. 27, p. 466, citing Sewell v. Sharp, La App., 102 So 2d 259,261.The definition, however, can hardly apply to respondent Iturralde since the record is bereft of any persuasive showing of a wrongful, improper or unlawful conduct on his part. What, in fact, appears on record is at most an indictment for an alleged illegal act yet to be performed and to be confirmed during the April 19, 1999 entrapment operation which never materialized. In this regard the Court finds it useful to reiterate the ruling in Raquiza v. Castaneda, Jr., See note 196.which held that The ground for the removal of a judicial officer should be established beyond reasonable doubt. The Supreme Court said Friday it sacked Judge Florentino Floro, who worked in the Manila suburb of Malabon, after psychiatric and psychological tests concluded he was not fit for the job. Floro, who told a courtroom that he has psychic visions, also claimed he can appear in two places at once and is able to inflict pain on corrupt officials using his paranormal powers, the Supreme Court said in a statement.

It said Floro admitted he believes in duwendes _ a Tagalog word that means mystic dwarfs _ and that he has a convenant with his "dwarf friends Luis, Armand and Angel." He also held "healing sessions" in his chambers and claimed he was so powerful he could perform his duties, including writing, while in a trance. "His mental problems, for now, appear to render him unfit for the delicate task of dispensing justice, not because of any acts of corruption and debasement on his part, but clearly due to a medically disabling condition," the Supreme Court said in its decision. Nonetheless, the psychological and psychiatric reports used to determine Floro's mental impairment do not disqualify him from re-entering government service, although he is barred from dispensing justice, the court said. It said those reports found Floro to be equipped with analytical power and that his "character traits of suspiciousness, seclusiveness, preoccupation with paranormal and psychic phenomena ... (are) not detrimental to his role as a lawyer." The court began to investigate the judge in 1999 after an administrative court audit team recommended he be subjected to psychiatric examination, and after a complaint from the mother of a plaintiff in a frustrated homicide case that Floro dismissed. The court awarded him three years in back salary and allowances because "his separation from the service is not a penalty as we ordinarily understand the word to mean."

Judge Florentino Floro Jr of Malabon RTC Branch 73 also sought the disqualification of the six doctors who declared him mentally impaired after he admitted that he is gifted with psychic powers and is a friend to three dwarves. This comes via the Scotsman. A judge in the Philippines who claimed he could see into the future and admitted consulting imaginary mystic dwarfs has asked for his Supreme Court job back after being sacked. This may be the kind of breakthrough in international law that our leftwing looney judges have been waiting for! Imagine the kind of decisions they could arrive at, if only they were allowed to read entrails and cast chicken bones. Maybe what this former judge needs to do is sit back and wait for an opening on the ninth circus court here in the US. STILL CRAZY AFTER ALL THESE WEEKS

A couple of weeks back we learned of a judge in the Philippines who was relieved of his duties after his superiors discovered that the judge believed that he could see into the future and used imaginary dwarf friends to help him render decisions. Last week the judge went in front of Manilas Supreme Court to plead his case. They should not have dismissed me for what I believe, said former judge Florentino Floro. This is the first time this happened in the Judiciary. So far, no word on whether the Supreme Court judges will re-instate him, but things dont look good considering new information which came forth during the hearing, when Floro confessed that he had three dwarf friends named Armand, Luis, and Angel and that he conducted psychic healing sessions in his chamber during breaks. Monday, May 08, 2006 In the News: Judge asks magical dwarves for answers Filipino fortune-telling judge Manila, Wednesday May 3: Apparently, a Filipino judge was fired from the Philippines Supreme Court because he frequently consults with three imaginary, magic dwarves. Yes, the dwarves have names: Armand, Luis and Angel. As Noona so aptly put it, "why us?" Well why not us? In a country where some people believe in incision-less cancer surgery, why not magic dwarves? I'd rather have the magic dwarves than fake cancer surgery any day. I've said it before, and I'll say it again... them Filipinos be crazy, yo.

Judge in Philippines Discriminated Against for Being Psychic

The persecution of the psychically gifted continues. Judge Florentino Floro, who until recently presided over a jurisdiction in suburban Manila, was removed from the bench on "administrative grounds" because of prejudice against those who have the ability to see the future and conduct supernatural healing sessions in chambers. Judge Floro also apparently started each court day with a reading from the Book of Revelations, which is just the kind of thing you want to hear before trying to plead down a traffic ticket. Judge Floro also said he had made a covenant with "dwarf friends" -- who hasn't? -- and claimed a variety of other supernatural abilities. The country's Supreme Court ruled that, assuming for the sake of argument that psychic phenomena did exist, they had "no place in a judiciary duty-bound to apply only positive law." The court stressed that Floro was not guilty of any misconduct or corruption, but found that he did have "mental problems" that rendered him "unfit for the delicate task of dispensing justice." Judge's Mystic Dwarf Friends Identified

I previously reported on Judge Florentino Floro, a judge in the Philippines who was removed from the bench recently for acts as innocuous as fortune-telling, faith healing in chambers, and beginning each court session with a cheery reading from the Book of Revelations. He also said he had made a covenant with "dwarf friends," but little was known about these friends until this week. Floro was back in the news because he is appealing the ruling by the country's Supreme Court removing him from office. The grounds are discrimination against people who tell fortunes, heal people, read from Revelations and make covenants with mystic dwarfs. (Also, he "criticized court procedure," probably the last straw.) "They should not have dismissed me for what I believed," Floro told reporters after filing his appeal. According to the court, it did not dismiss him for what he believed, it dismissed him for believing something that was nutty. A court-appointed expert found that Floro was suffering from psychosis and the court agreed, partly because of the above and also because of new revelations about the role of the "mystic dwarfs." Of which there were three, named "Armand," "Luis" and "Angel." If he is not forgiven his mistakes he has decided to run for the Presidency of the Philippines. After what happened in the U.S. of A. in 2000 and 2004 I wouldnt bet against him.

When the word is used in a generic or non-specific sense the proper plural *is* "dwarfs", the adjectival form is "dwarfish", etc. One of those many marvelous inconsistencies in English.... Talking to Garden Gnomes

Hi All, Welcome back to SilverHorn Lodge, nestled on the shore of Silverhorn Lake, high atop Silverhorn Mountain. If my typing is a little off, I apologize but I am covered in Croc Bloc and it's making my fingers a little slipperly. However, I haven't seen a crocodile all afternoon. I hope everyone has had a chance to review the list of contents from the Silverhorn Emergency Kit and you are making your own now, be prepared, several natural disasters are just around the corner, and if they don't happen you'll have a neat box of fun stuff to play with. I gotta tell ya, if you play Milli Vanilli enough, it grows on ya. I think they are going to be big someday! My team of Silverhorn Mountain Lodge Financial Advisors are currently considering marketing our own emergency kits. If we do, we will make them available to all our paid up members at a deep discount. We care about you and want you prepared and ready for any eventuality. A Silverhorn Mountain visit is never complete without a comment on something in the news, so here is something I came across today. A Supreme Court judge from the Philippines, (I didn't even know there was such a place as the Philippines anymore) has been fired and fined a bunch of Philippine money for

conduct unbecoming a judge. What did he do you ask? not much, he was caught talking to garden gnomes. It's amazing what some people will do, apparently the poor old judge so enjoyed his discussions with the garden gnomes he brought them in to court and appointed them as his advisors. Armand, Luis and Angel are the three garden gnomes who had been providing the now ex- Supreme Court Judge with guidance. Apparently, the government in Manila discovered that the gnomes were pretty bright, so they fired the judge and appointed the gnomes to the bench. We have a few garden gnomes around Silverhorn Lodge. I brought them home from the hardware store a couple of years ago. The clerk assured me they were good workers around a garden, however, I disagree, all I ever see the little fellas do is stand around. But like the judge, most of the time I find their advice as helpful as the advice I get from real people. An evening on the back porch of the Lodge with our gnomes is usually thought provoking, if not profound. It is often entertaining, especially if Marcello plays his guitar and sings. I have found them to be pleasant to have around, especially when I am in need of someone to talk to, they are very good listeners, although one of them, Carlos, sometimes gets a little wound up and he is a little too opinionated for me. Don't ask him about the war in Iraq, or cinch bugs. Alonzo, on the other hand, is very quiet, he is my favorite, but I have banished him to the far side of the backyard, facing the forest. He used to be on the front walk of the Lodge, but he got caught looking up the dress of one of our female guests and I had to put him out back. He claimed it was because his is only 22 inches tall and his head is permanently cemented in an upward looking direction. Nonetheless, I had no choice but to move him, the guest was threatening legal action. I have to admit that on occasion, I have incorporated some of what Alonzo, Carlos and Marcello tell me in these stories. I wasn't aware that talking to them was a crime, I'll have to be a little more careful when I take them to the store for an ice cream. On another note, our financial folks have turned their skills to marketing now because poor weather is slowing down the tourist trade here on the mountain so we are taking the mountain to them. Online auctions are the chosen route and most of my stuff is flying off the shelves. I only have one pair of shoes left. It's amazing what will sell on the internet. They offered me a job in distribution and shipping, but I declined their offer because I am much too busy keeping - 46 -

you all informed with the goings on around here. Besides I am making money from this, since the first Silverhorn story hit the world wide web, I have accrued $7.22 in ad revenue. I only need another $92.78 and the ad company will be sending me a cheque. I think part of the problem was the dwards themselves. Armand has a proven track record and Luis is pretty reliable, but Angel is another story. The judge most likely got fired because he was consulting a dwarf whose name carries a religious connotation. This is

just another example of a man being fired for expressing his faith. Or because hes crazy, although the court points out theyre not qualified to make that decision.

This reminds me of the time I got suspended for hanging out behind the high school with Doc, Sneezy, Happy and Dopey. They slapped me with some kinda trumped up drug charge and told me I was hallucinating. I successfully sued the school for discriminating against my beliefs. Goddamn secularists. Reminds me of the time my boss wouldnt give me an extra long lunch break to commune with the spirit world. He told me I had to fit it in the confines of my 30 minute lunch break or two 10 minute breaks. Luckily, one doesnt *have* to swear on a bibble in court anymore, but I would love to one day be called to testify in a trial I could give a fuck about. Since Muslims are making moves to have Qurans stocked in courtrooms so they can swear on them rather than bibbles, and the whole idea is to just make you swear on something you deeply believe in so as to further guarantee you keep your oath of truth, I would love an opportunity to insist that I be allowed to swear on the book I believe in most: Everyone Poops

Well, the story doesnt surprise me at all. The Phillipinos are extremely religious (large % are RCs). This struck me as odd: The Supreme Court said it was not within its expertise to conclude that Floro was insane, but agreed with the court clinics finding that he was suffering from psychosis. My wife is an immigrant from the Philippines, and I love her family, but there is a lot of whackiness in the country. This is a country that elected a former actor and incompetent (Joseph Estrada) for president (I know some people are going to bring up Reagan, but cmon, even if you disagreed with his policies, he had political experience before being elected president) and nearly electing another former actor and incompetent (Fernando Poe, who died less than a year after the election, so it was probably a good thing he did not win). There is a lot of poverty and desperation in the Philippines, and the masses get fed up when they dont see the professional politicians like Arroyo delivering for them, so they look to charismatic populist figures who talk a good talk but dont have a friggin clue about how to govern a populous and sprawling archipelago. 13. So let us help them out. By keeping Zacarias Moussaoui locked up, well fed, and spending his days watching movies, the midget jurors are endangering hundreds of American lives. They are creating incentives for al-Qaeda and its affiliates to grab planes, trains, and embassies full of Americans, hold them at bayonet point or whisk them off to friendly places, and threaten to murder them unless their well-fed comrade in the federal pen is released. Actually, his belief in these magical dwarves doesn't make him as unqualified as a religious person, IMO. His belief is a strike against him, a sign of poor judgement at least as it regards supernatural beings of small stature... and clearly he has a mental illness. But *I* have a mental illness - and some of the people I met in psych wards had fairly good judgement... one man who was schizophrenic is a particular example. Not ideal candidates, but then religious believers are worse, because they not only show the same poor judgement in regard to supernatural things, but for some it's "easier" to be religious, because it's so popular - so many others are religious. That shows even worse judgement - the ability to be easily swayed to illogical conclusions. Ya gotta give this guy the edge... but maybe he should have to recuse himself if Rumplestiltskin ever comes up in front of him. The Intent of the Framers of the 1987 Constitution (1 Record 443, 495-6, and 1 Journal 237 of the 1986 Constitutional Commission, specifically, the Constitutional Conventions Mr. Concepcion & Fr. Bernas, S.J.) is: The power to determine the incapacity of judges to discharge the duties of their office is part of the overall administrative authority of the Supreme Court over all its members and all the members of the judiciary. It can only declare the incapacity of a judge (under Sec. 11, Art. VIII,Constitution) by creating a panel of impartial (private) doctors-specialists in the field. Ms. Francianina G. Sanchez, Clinical Psychologist and Chief Judicial Staff Officer, Psychologist Ms. Beatriz O. Cruz Dr. Celeste P. Vista, M.D. (Psychiatrist and Medical Officer IV), and Supreme Court Senior Chief Staff Officer, general practitioner and government physician Dr. Rosa J. Mendoza, M.D. who conducted the mental tests on Judge Floro (on December 15, 2000) are absolutely disqualified by the Constitutional provision; and their March 7, 2001 psychological/psychiatric evalulation reports are NULL and VOID ab initio/inadmissible for any legal purpose. Constitutional Weight and Value of the September, 1998 JBC En Banc Final VOTE, Nomination and Presidential Appointment of Judge Floro upon the Issue of his Mental Fitness as Judge vis--vis the OCAs Resurrection of the Issue in its Judicial Audit (Requested by Judge Floro) Memorandum-Complaint Report of July, 1999 without any Private Complainant and without any Sworn Complaint.

II.
Without the complainant, OCAs presenting the 6 mental health professionals --- Dr. Cecilia Villegas and Ms. Melinda Grio, 1995 & Dr. Celeste Vista, Ms. Beatriz Cruz, (I.Q. 68 of Judge Floro) Ms. Francianina G. Sanchez, 1998, 2001, and general physician Dr. Rosa J. Mendoza, M.D. --- their questioned (evaluation) report on Judge Floro, aside from being grossly incomplete and inadequate, is HEARSAY evidence. Judge Floro is entitled to cross-examine said mental health professional who made the report. Without such examination, he would be deprived of the right to confront and examine the witnesses against him. The Investigator (Ret.) Justice Pedro A. Ramirezs repeated denials of (1) Judge Floros Continuing Trial Objections and (2) December 5, 2000, September 28, October 9, 2001 & February 21, 2002 Omnibus Motions to a) put on the witness stand, to confront and to determine their qualifications as experts b) to cross-examine and c) to disqualify or inhibit, the said 6 mental health professionals, violated the cardinal primary rights of Judge Floro

(Ang Tibay vs. CIR) to administrative, substantive and constitutional due process of law; it is no less than denial of justice; such denial suffices to cast on the investigation, official acts and the mental reports the impress of nullity. Utter failure of the complainant OCA to a) present said mental health professionals as witnesses, b) to mark and offer in evidence their mental evaluation reports as demanded in writing (motions and continuing objections at the trial) by Judge Floro, is tantamount to SUPPRESSION of EVIDENCE (under the 1989 Rules on Evidence).

III.
Judge Floros cardinal primary rights --- 2. the tribunal must consider the evidence presented; 3. the decision must have something to support itself; 4. the evidence must be substantial 5. the decision must be based on the evidence presented at the hearing ---were flagrantly violated by the Investigator (Ret.) Justice Ramirezs March 7, 2001 Partial Confidential Report: it blatantly discarded, excluded, and failed to consider the testimonies and opinions of all his ordinary witnesses. Acuna (former Malabon Fiscal), Atty. Arsenio Reyes (Malabon Lawyer), and b) Judge Floros neighbors/townmates Jocelyn Fernandez, Belen Gomez, Asuncion Borjal, Jovita Estrella, Dr. Ma. Nieves Celeste, M.D., & Danilo Cuarto --- proved by unrebutted, clear, convincing and straightforward testimonies/opinions (excluded by J. Ramirezs Report and Conclusions) his medical and mental capacity / fitness to sit as RTC Judge. Their opinions refuted, traversed and nullified the lies, fabrications and falsehood offered by the OCAs witness Judge Aquino,Jr., inter alia.

Justices Flerida Ruth Romero (Member of the Theosophical Society) and Jesus Elbinias believed and practiced PSYCHIC PHENOMENA during their incumbency, b) DWARVES exist and can be proved by scientific methods, c) Judge Floros authentic healing was duly investigated and proved, d) Judge Floros belief in Psychic Phenomena as GIFTED is not abnormal but paranormal, and e) trance and by location can be proved.

IV.
Judge Floros cardinal primary rights --- 2. the tribunal must consider the evidence presented; 3. the decision must have something to support itself; 4. the evidence must be substantial 5. the decision must be based on the evidence presented at the hearing --- were flagrantly violated by the Investigator (Ret.) Justice Ramirez: In bad faith, with bias and partiality, J. Ramirez a) denied all the Continuing Objections of Judge Floro at the trials, he blatantly discarded, excluded, and failed to consider practically all of Judge Floros ADMITTED EXHIBITS 1 67/sub-markings. The Investigator (Ret.) Justice Ramirez in bad faith, with bias and partiality, threw the Blue Temporary ROLLO and a Ballpen to/towards Judge Floro at a hearing. He warned and punished Judge Floro, as he said in the TSN: he intentionally OMITTED and failed to file the required (by Sec. 5, Rule 140, Rules of Court) REPORT and RECOMMENDATION (due on May, 2001) in the 2 consolidated administrative cases (A.M. NO. 99-7-273-RTC & A.M. NO. RTJ-06-1988, ARRIEGO case, Formerly A.M. OCA IPI No. 99812-RTJ) so that Judge Floros case would not be decided and so that his suspension would be prolonged indefinitely.

Judge Floros expert witnesses Psychiatrists Dr. Eduardo L. Jurilla, Dr. Eduardo T. Maaba & psychologist Rowena A. Reyes --- certified and testified on their testimonies in chief that Judge Floro is mentally fit to sit as Judge. Their expert testimonies are IMPECCABLE. Judge Floro TIMELY registered CONTINUING OBJECTIONS to the improper / inadmissible cross-examination questions a) regarding the field of Psychic Phenomena (which field is not the expertise of the witnesses on Psychiatry and Psychology), and b) regarding assumptions not warranted by the evidence.

The Investigator (Ret.) J. Ramirez in bad faith, with bias and partiality blatantly discarded, excluded, and failed to consider their expert testimonies as a whole; he merely selected the negative portions of the crossexamination, forgetting that the lone OCA witness, Judge Aquino, Jr. miserably failed to IMPEACH the expert witnesses/testimonies. All the expert witnesses of Judge Floro NEVER testified on crossexamination that Judge Floro is unfit to sit as Judge. On the contrary, Dr. Maaba specifically testified that Judge Floro is not psychotic, not insane, since his belief in dwarves and the paranormal are not abnormal but CULTURE-ORIENTED; while Dr. Jurilla and Ms. Reyes stressed that they do not know Psychic Phenomena; nowhere in their cross-examination can be found any testimony that says Judge Floro is unfit to sit as Judge.

VI. A.
Judge Floro, his family and mild retarded brother Robert V. Floro have no defective genes (regarding mental disease). Robert V. Floros mild mental retardation (according to Cupertino Psychiatrists Records) was due to wrong medicine given to his mother during pregnancy. There is / was no medical proof whatsoever presented, that mental retardation can be inherited. To punish Judge Floro because of wrong medicine is cruel and unusual punishment banned by the Constitution.

VII.
The Fundamental Law forbids punishment for professing religious beliefs. Judge Floro, with due respect, cannot be relieved from office due to his religious beliefs in dwarves, angel of death, the gifts of the Holy Spirit --prophecy and spiritual healing --- and the paranormal or the spiritual.

I gathered a group of people about 12 or so, 15, a small number. MANILA: A Philippines judge has been sacked from his post for having dwarfs as friends and for claiming that he has psychic powers, court records showed yesterday. In a 72-page ruling, the Supreme Court voted unanimously to relieve Florentino Floro of his post as presiding judge in the suburban city of Malabon in metro Manila for being mentally unfit to discharge his duties. Floro confessed to the Office of the Court Administrator that he has dwarf friends named Armand, Luis and Angel, and that he conducts healing sessions in his chamber during his break time. Floro also claimed to be endowed with psychic powers and ability to inflict pain and sickness on people. The high court said that while it was not within its authority to conclude that Floro is insane, it agreed with the findings of the Supreme Court clinic that the judge was suffering from psychosis. Sacked judge in appeal A REGIONAL Trial Court (RTC) judge in Malabon who was relieved by the Supreme Court over his mental condition has asked to be reinstated. Judge Florentino Floro Jr of Malabon RTC Branch 73 also sought the disqualification of the six doctors who declared him mentally impaired after he admitted that he is gifted with psychic powers and is a friend to three dwarves. According to the judge, the amended Rules of Court never included weirdness, healing, psychic phenomena and the like as grounds for discipline. However, the Supreme Court said, psychic phenomena, even assuming such exist, have no place in a judiciary, which is bound to apply only positive law.
