THE PARTIES 1. Ferox is a limited liability company duly organized and existing under the laws of
the State of Utah, with its principal place of business located at 270 North Geneva Road, Orem, Utah 84057. 2. Ferox alleges on information and belief that defendant ConSeal is a Florida
corporation with its principal place of business located at 90 Kerry Place, Suite 2, Norwood, Massachusetts 02062. 3. Ferox alleges on information and belief that defendant Earth Eco is a Nevada
limited liability company with its principal place of business located at 711 South Carson Street, Suite 4, Carson City, Nevada 89701. 4. Ferox alleges on information and belief that defendant Genesis is a Utah limited
liability company with its principal place of business located at 772 East Utah Valley Drive, Suite 388, American Fork, Utah 84003. 5. Ferox alleges on information and belief that defendant Green Foot is a Nevada
limited liability company with its principal place of business located at 2360 Corporate Circle, Suite 400, Henderson, Nevada 89074. 6. Ferox alleges on information and belief that defendant Mr. Madsen is a resident
and citizen of the State of Utah. JURISDICTION AND VENUE 7. This is a civil action for patent infringement arising under the patent laws of the
United States, including 35 U.S.C. 271; for false advertising under Section 43(a) of the Lanham Act, 15 U.S.C. 1125(a); for false marking under the patent laws of the United States,

including 35 U.S.C. 292; for state law unfair competition under Utah Code Ann. 13-5a-101, et seq.; and for state law deceptive trade practices Utah Code Ann. 13-11a-1, et seq. 8. This court has original jurisdiction over the subject matter of this action pursuant
to 28 U.S.C. 1331, 28 U.S.C. 1338(a) and 28 U.S.C. 1338(b). 9. The state law claims asserted herein are so related to those over which this Court
has original jurisdiction as to form part of the same case or controversy. This Court therefore has supplemental jurisdiction pursuant to 28 U.S.C. 1367 over the state law claims asserted herein. 10. Ferox alleges on information and belief that ConSeal has sent infringing goods
into the stream of commerce knowing those goods would eventually be sold within the State of Utah to Feroxs injury, which relates to the claims asserted by Ferox, and out of which Feroxs claims, in part, arise. 11. Ferox and Steve Perry of ConSeal met in Utah in April of 2009 to discuss
potential business relationships between the parties. At least by the time of the 2009 negotiations, ConSeal learned the identity of Feroxs ferrocene-based fuel additive formulation and subsequently began manufacturing and selling tablets made of a nearly identical formulation. 12. As a result of these negotiations and its business endeavors, Ferox alleges on
information and belief that ConSeal has transacted business within the State of Utah, contracted to supply services or goods within the State of Utah, and/or caused injury within the State of Utah. By virtue of its actions described herein, this Courts exercise of personal jurisdiction over ConSeal is consistent with the Constitution of the United States and Utah Code Ann. 78-27-24. 13. Ferox alleges on information and belief that defendant Earth Eco has transacted
business within the State of Utah, contracted to supply services or goods within the State of Utah

to defendant Genesis, and/or caused injury within the State of Utah. By virtue of its actions described herein, this Courts exercise of personal jurisdiction over Earth Eco is consistent with the Constitution of the United States and Utah Code Ann. 78-27-24. 14. Ferox alleges on information and belief that defendant Genesis has transacted
business within the State of Utah, contracted to supply services or goods within the State of Utah, and/or caused injury within the State of Utah. By virtue of its actions described herein, this Courts exercise of personal jurisdiction over Genesis is consistent with the Constitution of the United States and Utah Code Ann. 78-27-24. 15. Ferox alleges on information and belief, that defendant Green Foot maintains the
web site located at www.greenfootglobal.com (the Green Foot Website), which is a commercially active website where consumers from the State of Utah can enter into transactions with Green Foot to purchase Green Foots infringing goods. 16. Ferox alleges on information and belief that defendant Green Foot has transacted
business within the State of Utah, contracted to supply services or goods within the State of Utah, and/or caused injury within the State of Utah. By virtue of its actions described herein, this Courts exercise of personal jurisdiction over Green Foot is consistent with the Constitution of the United States and Utah Code Ann. 78-27-24. 17. Ferox alleges on information and belief that defendant Mr. Madsen has transacted
business within the State of Utah, contracted to supply services or goods within the State of Utah, and/or caused injury within the State of Utah. By virtue of his actions described herein, this Courts exercise of personal jurisdiction over Mr. Madsen is consistent with the Constitution of the United States and Utah Code Ann. 78-27-24.

Venue is proper in this judicial district pursuant to, at least, 28 U.S.C. 1391(b)
and/or 1400(b). FACTUAL BACKGROUND 19. 20. Ferox is an innovator in the field of fuel treatment. Ferox came to its position of technological leadership through hard work and
substantial investment in research and development. As a result of its endeavors, Ferox developed a novel formulation which is protected by United States Patent No. 7,959,693 (the 693 patent), a true and correct copy of which is attached hereto as Exhibit A. 21. 22. 23. compound. 24. Ferox makes and sells products covered by one or more of the claims of the 693 Ferox is the owner by assignment of the 693 patent. Ferox has not licensed the 693 patent to anyone. The693 patent claims a composition including a fuel-soluble ferrocene
patent, including Feroxs Fuel Tab fuel additive and Truck Tab fuel additive. 25. Ferox alleges on information and belief that ConSeal imports, makes, uses, sells,
and/or offers for sale within the United States and within the State of Utah, either directly or through established distribution channels, fuel additive, including fuel additive designated as FuelFX. 26. Ferox alleges on information and belief that ConSeals FuelFX product is covered
by one or more claims of the 693 patent and that ConSeals importation, manufacture, use, sale, and/or offer for sale infringes one or more claims of the 693 patent.

Ferox alleges on information and belief that ConSeal has sold products that are
covered by one or more claims of the 693 patent to Earth Eco and Green Foot. 28. Ferox alleges on information and belief that Earth Eco has in turn sold products
covered by one or more claims of the 693 patent to defendant Genesis. 29. Ferox alleges on information and belief that defendants Earth Eco, Genesis, Green
Foot, and Mr. Madsen (as a distributor for Green Foot) have in turn sold infringing products to the consuming public. 30. Ferox alleges on information and belief that ConSeal has represented to Earth Eco
and Green Foot that each was an exclusive distributor of the ConSeal products accused of infringement herein. 31. On September 14, 2011, Ferox sent a copy of the 693 patent to ConSeal by
Certified Mail, return receipt requested. On September 20, 2011, ConSeal received Feroxs September 14, 2011 correspondence attaching a copy of the 693 patent. FIRST CAUSE OF ACTION (Patent Infringement of the 693 Patent Against ConSeal) 32. By this reference Ferox realleges and incorporates the foregoing paragraphs as
though fully set forth herein. 33. Ferox alleges on information and belief that ConSeal has infringed one or more
claims of the 693 patent by making, using, selling, offering for sale within the United States, or importing into the United States systems and products that embody one or more of the claims of the 693 patent, or by contributing to infringement, inducing others to infringe the 693 patent, or carrying out acts constituting infringement under 35 U.S.C. 271.

ConSeals making, using and/or selling a fuel additive identified as FuelFX, gives rise to a cause of action for infringement of the 693 Patent, pursuant to at least 35 U.S.C. 271 and 281. 35. Ferox alleges on information and belief that ConSeal has manufactured, offered
for sale, and sold infringing products, including, for example, a fuel additive identified as FuelFX, despite an objectively high likelihood that its actions constitute infringement. 36. Ferox alleges on information and belief that ConSeals production and sales of
infringing products have been both willful and deliberate. 37. By reason of the foregoing, Ferox has suffered damages and irreparable harm and
is therefore entitled to monetary and/or injunctive relief against ConSeal, pursuant to 35 U.S.C. 28385, as more fully set forth herein. SECOND CAUSE OF ACTION (Unfair Competition Against ConSeal) 38. By this reference Ferox realleges and incorporates the foregoing paragraphs as
though fully set forth herein. 39. ConSeal, by its actions set forth hereinabove, has engaged in intentional business
acts or practices that are unlawful, unfair, and/or fraudulent and that have caused a material diminution in the value of the 693 patent, in violation of, inter alia, Utah Code Ann. 13-5a102(4). 40. ConSeals conduct as set forth hereinabove gives rise to a cause of action for
unfair competition and related wrongs under the statutory and common law of the State of Utah, including at least Utah Code Ann. 13-5a-101, et seq. 41.

By reason of the foregoing, Ferox has suffered damages and irreparable harm.

By reason of the foregoing, Ferox is entitled to actual and punitive damages from
ConSeal, along with its attorneys fees and costs pursuant to at least Utah Code Ann. 13-5a103(1)(b) as more fully set forth herein. THIRD CAUSE OF ACTION (Patent Infringement of the 693 Patent Against Earth Eco) 43. By this reference Ferox realleges and incorporates the foregoing paragraphs as
though fully set forth herein. 44. Ferox alleges on information and belief that Earth Eco has infringed one or more
claims of the 693 patent by making, using, selling, offering for sale within the United States, or importing into the United States systems and products that embody one or more of the claims of the 693 patent, or by contributing to infringement, inducing others to infringe the 693 patent, or carrying out acts constituting infringement under 35 U.S.C. 271. 45. The conduct of Earth Eco as set forth hereinabove, including, for example, Earth
Ecos making, using and/or selling a fuel additive identified as EcoSave Fuel Tablets, gives rise to a cause of action for infringement of the 693 patent, pursuant to at least 35 U.S.C. 271 and 281. 46. Ferox alleges on information and belief that Earth Eco has offered for sale and
sold infringing products, including, for example, a fuel additive identified as EcoSave Fuel Tablets, despite an objectively high likelihood that its actions constitute infringement. 47. Ferox alleges on information and belief that Earth Ecos sales of infringing

By reason of the foregoing, Ferox has suffered damages and irreparable harm and
is therefore entitled to monetary and/or injunctive relief against Earth Eco, pursuant to 35 U.S.C. 28385, as more fully set forth herein. FOURTH CAUSE OF ACTION (Unfair Competition Against Earth Eco) 49. By this reference Ferox realleges and incorporates the foregoing paragraphs as
though fully set forth herein. 50. Earth Eco, by its actions set forth hereinabove, has engaged in intentional
business acts or practices that are unlawful, unfair, and/or fraudulent and that have caused a material diminution in the value of the 693 patent, in violation of, inter alia, Utah Code Ann. 13-5a-102(4). 51. Earth Ecos conduct as set forth hereinabove gives rise to a cause of action for
unfair competition and related wrongs under the statutory and common law of the State of Utah and other states, including at least Utah Code Ann. 13-5a-101, et seq. 52. 53. By reason of the foregoing, Ferox has suffered damages and irreparable harm. By reason of the foregoing, Ferox is entitled to actual and punitive damages from
Earth Eco, along with its attorneys fees and costs pursuant to at least Utah Code Ann. 13-5a103(1)(b) as more fully set forth herein. FIFTH CAUSE OF ACTION (Patent Infringement of the 693 Patent Against Genesis) 54. By this reference Ferox realleges and incorporates the foregoing paragraphs as

Ferox alleges on information and belief that Genesis has infringed one or more
claims of the 693 patent by making, using, selling, offering for sale within the United States, or importing into the United States systems and products that embody one or more of the claims of the 693 patent, or by contributing to infringement, inducing others to infringe the 693 patent, or carrying out acts constituting infringement under 35 U.S.C. 271. 56. The conduct of Genesis as set forth hereinabove, including, for example,
Genesiss making, using and/or selling a fuel additive identified as EcoPure, gives rise to a cause of action for infringement of the 693 patent, pursuant to at least 35 U.S.C. 271 and 281. 57. Ferox alleges on information and belief that Genesis has offered for sale and sold
infringing products, including, for example, a fuel additive identified as EcoPure, despite an objectively high likelihood that its actions constitute infringement. 58. Ferox alleges on information and belief that Genesiss sales of infringing products
have been both willful and deliberate. 59. By reason of the foregoing, Ferox has suffered damages and irreparable harm and
is therefore entitled to monetary and/or injunctive relief against Genesis, pursuant to 35 U.S.C. 28385, as more fully set forth herein. SIXTH CAUSE OF ACTION (Unfair Competition Against Genesis) 60. By this reference Ferox realleges and incorporates the foregoing paragraphs as
though fully set forth herein. 61. Genesis, by its actions set forth hereinabove, has engaged in intentional business
acts or practices that are unlawful, unfair, and/or fraudulent and that have caused a material

diminution in the value of the 693 patent, in violation of, inter alia, Utah Code Ann. 13-5a102(4). 62. Genesiss conduct as set forth hereinabove gives rise to a cause of action for
unfair competition and related wrongs under the statutory and common law of the State of Utah and other states, including at least Utah Code Ann. 13-5a-101, et seq. 63. 64. By reason of the foregoing, Ferox has suffered damages and irreparable harm. By reason of the foregoing, Ferox is entitled to actual and punitive damages from
Genesis, along with its attorneys fees and costs pursuant to at least Utah Code Ann. 13-5a103(1)(b) as more fully set forth herein. SEVENTH CAUSE OF ACTION (Patent Infringement of the 693 Patent Against Green Foot) 65. By this reference Ferox realleges and incorporates the foregoing paragraphs as
though fully set forth herein. 66. Ferox alleges on information and belief that Green Foot has infringed one or more
claims of the 693 patent by making, using, selling, offering for sale within the United States, or importing into the United States systems and products that embody one or more of the claims of the 693 patent, or by contributing to infringement, inducing others to infringe the 693 patent, or carrying out acts constituting infringement under 35 U.S.C. 271. 67. The conduct of Green Foot as set forth hereinabove, including, for example,
Green Foots making, using and/or selling a fuel additive identified as EnviroTabs, gives rise to a cause of action for infringement of the 693 patent, pursuant to at least 35 U.S.C. 271 and 281.

Ferox alleges on information and belief that Green Foot has offered for sale and
sold infringing products, including, for example, the fuel additive identified as EnviroTabs, despite an objectively high likelihood that its actions constitute infringement. 69. Ferox alleges on information and belief that Green Foots sales of infringing
products have been both willful and deliberate. 70. By reason of the foregoing, Ferox has suffered damages and irreparable harm and
is therefore entitled to monetary and/or injunctive relief against Green Foot, pursuant to 35 U.S.C. 28385, as more fully set forth herein. EIGHTH CAUSE OF ACTION (Unfair Competition Against Green Foot) 71. By this reference Ferox realleges and incorporates the foregoing paragraphs as
though fully set forth herein. 72. Green Foot, by its actions set forth hereinabove, has engaged in intentional
business acts or practices that are unlawful, unfair, and/or fraudulent and that have caused a material diminution in the value of the 693 patent, in violation of, inter alia, Utah Code Ann. 13-5a-102(4). 73. Green Foots conduct as set forth hereinabove gives rise to a cause of action for
unfair competition and related wrongs under the statutory and common law of the State of Utah and other states, including at least Utah Code Ann. 13-5a-101, et seq. 74. 75. By reason of the foregoing, Ferox has suffered damages and irreparable harm. By reason of the foregoing, Ferox is entitled to actual and punitive damages from
Green Foot, along with its attorneys fees and costs pursuant to at least Utah Code Ann. 13-5a103(1)(b) as more fully set forth herein.

NINTH CAUSE OF ACTION (False Advertising Against Green Foot) 76. By this reference Ferox realleges and incorporates the foregoing paragraphs as
though fully set forth herein. 77. Ferox alleges on information and belief that Green Foot has used in commercial
advertising or promotion a false or misleading description of fact or representation of fact that misrepresents the nature, characteristic, qualities or origin of its goods, services or commercial activities. 78. Ferox alleges on information and belief that Green Foot advertises that its
EnviroTabs product is patented and refers to EnviroTabs as our patented technology. 79. Ferox alleges on information and belief that these and other statements made by
Green Foot on the Green Foot Website are statements made in commerce that are false and misleading and are likely to cause confusion or mistake as to the nature, characteristics, qualities, origin or approval of Green Foots goods and services. 80. Green Foots acts constitute false advertising in violation of Section 43(a) of the
Lanham Act, 15 U.S.C. 1125(a) and applicable common law. 81. Green Foots acts of false advertising have caused and continue to directly and
proximately cause Ferox to suffer damages in an amount to be determined. 82. Pursuant to 15 U.S.C. 1117 and other applicable law, Ferox is entitled to recover
damages from Green Foot resulting from its false advertising, including without limitation recovery of Green Foots profits, damages sustained by Ferox, the costs of this action, three times Feroxs actual damages, or such other sum as the Court shall determine is just.

attorneys fees to Ferox pursuant to 15 U.S.C. 1117 and other applicable law. 84. Green Foots acts of false advertising have caused and continue to directly and
proximately cause Ferox to suffer immediate and irreparable injury for which Ferox has no adequate remedy at law. Such injury will continue unless this false advertising by Green Foot is preliminarily and permanently enjoined. TENTH CAUSE OF ACTION (False Marking Against Green Foot) 85. By this reference Ferox realleges and incorporates the foregoing paragraphs as
though fully set forth herein. 86. Green Foot has marked upon, affixed to, or used in advertising in connection with
at least its EnviroTabs product the words "patented" and our patented technology for the purpose of deceiving the public. 87. 88. Ferox has suffered a competitive injury as result of Green Foots actions. The conduct of Green Foot as set forth hereinabove gives rise to a cause of action
for false marking, pursuant to at least 35 U.S.C. 292. 89. By reason of the foregoing, Ferox is entitled to monetary relief against Green
Foot, pursuant to 35 U.S.C. 292, as more fully set forth herein. ELEVENTH CAUSE OF ACTION (Unfair Trade Practices Against Green Foot) 90. By this reference Ferox realleges and incorporates the foregoing paragraphs as

Green Foot, by its actions as set forth hereinabove, has represented, represents,
and will continue to represent that its goods or services have sponsorship, approval, characteristics, ingredients, uses, benefits, or qualities that they do not have, including its EnviroTab product, and has thereby engaged in deceptive trade practices, pursuant to, inter alia, Utah Code Ann. 13-11a-3(1)(e). 92. Green Foots conduct as set forth hereinabove gives rise to a cause of action for
deceptive trade practices and related wrongs under the statutory and common law of the State of Utah, including at least Utah Code Ann. 13-11a-1, et seq. 93. Ferox alleges on information and belief that Green Foot has engaged in deceptive
trade practices against Ferox in willful and deliberate disregard of the rights of Ferox and the consuming public. 94. By reason of Green Foots acts of deceptive trade practices, Ferox has suffered
damages and irreparable harm. 95. By reason of the foregoing, Ferox is entitled to preliminary and permanent
injunctive and monetary relief against Green Foot, along with its attorneys fees and costs, pursuant to at least Utah Code Ann. 13-11a-4(2)(a), (b), and (c), as more fully set forth herein below. TWELFTH CAUSE OF ACTION (Patent Infringement of the 693 Patent Against Mr. Madsen) 96. By this reference Ferox realleges and incorporates the foregoing paragraphs as
though fully set forth herein. 97. Ferox alleges on information and belief that Mr. Madsen has infringed one or
more claims of the 693 patent by making, using, selling, offering for sale within the United

States, or importing into the United States systems and products that embody one or more of the claims of the 693 patent, or by contributing to infringement, inducing others to infringe the 693 Patent, or carrying out acts constituting infringement under 35 U.S.C. 271. 98. The conduct of Mr. Madsen as set forth hereinabove, including, for example, Mr.
Madsens sale of a fuel additive identified as EnviroTabs, gives rise to a cause of action for infringement of the 693 patent, pursuant to at least 35 U.S.C. 271 and 281. 99. Ferox alleges on information and belief that Mr. Madsen has offered for sale and
sold infringing products, including, for example, the fuel additive identified as EnviroTabs, despite an objectively high likelihood that his actions constitute infringement. 100. Ferox alleges on information and belief that Mr. Madsens sales of infringing
products have been both willful and deliberate. 101. By reason of the foregoing, Ferox has suffered damages and irreparable harm and
is therefore entitled to monetary and/or injunctive relief against Mr. Madsen, pursuant to 35 U.S.C. 28385, as more fully set forth herein. THIRTEENTH CAUSE OF ACTION (Unfair Competition Against Mr. Madsen) 102. By this reference Ferox realleges and incorporates the foregoing paragraphs as
though fully set forth herein. 103. Mr. Madsen, by his actions set forth hereinabove, has engaged in intentional
business acts or practices that are unlawful, unfair, and/or fraudulent and that have caused a material diminution in the value of the 693 patent, in violation of, inter alia, Utah Code Ann. 13-5a-102(4).

Mr. Madsens conduct as set forth hereinabove gives rise to a cause of action for
unfair competition and related wrongs under the statutory and common law of the State of Utah and other states, including at least Utah Code Ann. 13-5a-101, et seq. 105. 106. By reason of the foregoing, Ferox has suffered damages and irreparable harm. By reason of the foregoing, Ferox is entitled to actual and punitive damages from
Mr. Madsen, along with its attorneys fees and costs pursuant to at least Utah Code Ann. 135a-103(1)(b) as more fully set forth herein. PRAYER FOR RELIEF WHEREFORE, Ferox prays for judgment as follows: A. 693 patent; B. For injunctive relief enjoining Defendants, and their respective officers, directors, A judgment finding Defendants jointly and severally liable for infringement of the
agents, employees, representatives and all persons operating in concert with Defendants, as follows; a. from manufacturing any products falling within the scope of the claims of the 693 patent; b. from using any product or method falling within the scope of any of the claims of the 693 patent; c. from selling, offering to sell, licensing or purporting to license any product or method falling within the scope of any of the claims of the 693 patent; d. from importing any product into the United States which falls within the scope of any of the claims of the 693 patent;

e. from actively inducing others to infringe any of the claims of the 693 patent; f. from engaging in acts constituting contributory infringement of any of the claims of the 693 patent; and g. from all other acts of infringement of the 693 patent; C. For judgment finding the infringement of the Defendants to be willful, and for an
award of enhanced damages in connection with such finding; D. For judgment finding this to be an exceptional case and awarding Plaintiff its
costs and attorneys fees incurred herein; E. F. G. Lanham Act; H. Entry of a permanent injunction pursuant to 15 U.S.C. 1114 enjoining Green A judgment finding Green Foot liable for false marking; A judgment finding Green Foot liable for unfair trade practices; A judgment finding Green Foot has committed false advertising under the
Foot, its officers, agents, servants, employees and those persons in active concert or participation with it from further acts of false advertising; I. An award of damages adequate to compensate Ferox for infringement of the 693
Patent, in an amount to be proven at trial, including treble damages, lost profits damages, reasonable royalty damages, and other damages allowed by 35 U.S.C. 284; J. 103(b); An award of actual and punitive damages pursuant to Utah Code Ann. 13-5a-
