COMES NOW, Forced-Intervenor through the undersigned Authorized Representative and unto this Honorable Office, most respectfully state: 1. That on October 26, 2011 the Honorable Med-Arbiter Jasmin M. Demetillo. CPA set the Preliminary Hearing of the above-entitled Case. The PARTIES, Petitioner MPLONOWM AND Forced-Intervenor, SAMAGEWU-TUPAS mutually agred for an early election , so both agreed to have a CONSENT ELECTION to be held on November 15, 2011. The Hon, Med-Arbiter, informed the Petitioner and the Forced-Intervenor that the PRO-LABOR PEOPLES CHAMP MOVEMENT-MAKAR( PCM-M ) had filed their Motion for Intervention, but failed to present to the PARTIES the Motion filed by the PCM-M, thereafter the Hon. Med-Arbiter showed purporterd to be DOCUMMENTS containing Certificate of Registration, By-Laws, List of Officers of etc. of PCM-M.

Forced-Intervenor SAMAGEWU-TUPAS requested that they be provided Xerox copies of the PCM-M Documents and Petitioner MPLO-NOWM, likewise requested for a copy of said Documents, which was allowed by the Hon. Med-Arbiter voluntarily without question. The Honorable Med-Arbiter, then requested the Petitioneer and Forced Intervenor to comment on the Documents of PCM-M within ten (10) days and was accepted by the Petitioner, MPLO-NOAM and Forced-Intervenor, SAMAGEWU-TUPAS.

2 That the Trade name: PEOPLES CHAMP MOVEMENT-PCM is associated and

personally organized by World Boxing Champion and Incumbet Congressman Manny Pacman Pacquiao, idolized by millions of people around the world and the current No. 1POUND FOR POUND boxer in the world. Surely the organizers and the incumbent officers and Labor Consultant of Pro-Labor Peoples Champ Movement-Makar (PCM-M )has only one thing in mind and that is TO RIDE ON THE POPULARITY OF MANNY PACMAN PACQUIAO and his PEOPLES CHAMP MOVEMENT ( PCM). However the PEOPLES CHAMP MOVEMENT ( PCM ) was duly Registered with the Commission Elections ( COMELEC), Manila of which the Second Division of said Office Promulgated a DECISION on May 7, 2009 declaring PEOPLES CHAMP MOVEMENT (PCM ) as a LOCAL POLITICAL PARTY to operate in General Santos City and Sarangani Province. Please see attached Xerox copy of said Decision hereto attached as Annex A. The PEOPLES CHAMP MOVEMENT (PCM ) was conceived and conceptualized by various friends and loyal supporters of Manny Pacquiao and herein undersigned Authorized Representative of Forced-Intervenor, SAMAGEWU-TUPAS, is one of the thousands who ORIGINALLY ORGANIZED the PCM as a Political Parrty and cannot therefore , be used by anyone WITHOUT AUTHORITY or PERMISSION from the Honorable Congressman Emmanuel D. Pacquiao and the Officers of PEOPLES CHAMP MOVEMENT PCM (POLITICAL Party). For a clearer view of the entire picture, allow us to inform this Honorable Office that Makar Port is located at Barangay Labangal with 29,963 Registered voters and the

incumbent Barangay Captain is the Sister-in-Law of Manny Pacquiao and those who voted to B/Captain Lorelei Pacquiao comes from all walks of life especially the rank and file employees of SCIPSI. IT IS MOST RESPECTFULLY PRAYED OF THIS HONORABLE OFFICE TO WITHOLD THE RGISTRATION OF Pro-Labor Peoples Champ Movement-Makar (PCM-M) AND TO DISQUALIFY SAID INTERVENOR FROM PARTICIPATING IN THE CONSENT ELECTION SET ON NOVEMBER 15, 2011, UNLESS MR. HENRY LAS PINAS AND HIS CONSULTANT/ADVISER MR. ALVIN DELA TORRE, WILL BE ABLE TO SHOW A WRITTEN AUTHORITY FROM THE OFFICERS OFM PEOPLES CHAMP MOVEMENT ( PCM ) OFFICERS AND FROM THE HONORAB LE CONGRESSMAN EMMANUEL D. PACQUIAO; THAT THEY ARE ALL ALLOWED TO USE THE GENERIC NAME OF PCM, A POLITICAL PARTY OF WHICH MEMBERS OF SAMAGEWU-TUPAS , LIKE MYSELF ARE ALSO MEMBERS. FORCED-INTERVENOR, FURTHER PRAYS FOR OTHER RELIEF AND REMEDIES AVAILAB LE UNDER THE LAW.
