ACKNOWLEDGEMENT OF RISKS AND INDEMNITY AGREEMENT BETWEEN LITOK BANGAU ENTERPRISE, KINABATANGAN, SANDAKAN AND THE ABOVE REGISTERED PARTICIPANT. 1. In consideration of and as a condition of my acceptance of my entry in any of the organised activities at Tanjung Bulat such as staying overnight, lake cruising activities, jungle trekking, bird-watching and wildlife-observation, and to use the equipment and services being supplied; I agree to the terms of this Acknowledgement of Risks Agreement and I hereby agree to release, indemnify and hold harmless LITOK BANGAU ENTERPRISE, its officers, employees, agents, volunteers, contractors, public bodies, landholders and sponsors, from and against any and all claims, demands, right or cause of action, suits, expenses, costs and proceedings of any nature whatsoever which may be made by me or on my behalf or by other parties for or in respect of or arising out of any injury, loss, damage or death caused to me or my property as a result of my participation in any of the stated activities, whether breach of contract or in any way whatsoever. 2. I accept, acknowledge, understand, agree and fully aware that the organised activities by LITOK BANGAU ENTERPRISE at Tanjung Bulat such as staying overnight, lake cruising activities, jungle trekking, bird-watching and wildlife-observation are forms of adventure events that are set to take place in outdoor environment and they include certain inherent dangers, risks and unpredictability that accompany such adventures, whether they are known or unknown. I also understand that some risks in these activities and cannot be eliminated or reduced. These inherent and other risks, hazards and dangers may result in bodily injury (including paralysis), illness, mental or emotional trauma, disability, death or damages to me or my family, heirs or assigns that may occur as a result of my participation in this activity or as a the negligence of any party, including the released parties. 3. I further state that I am of lawful age, or that this acknowledgement of Risk Agreement is being signed by my parent or legal guardian if I am not of lawful age to sign this release, that I understand the terms herein are contractual and I also agree that in the event I am injured or my property is damaged I will bring no claim, legal or otherwise, in respect to that injury or damage. 4.
