ThedislikeandmistrustforChristianson campuswasonethingIlearnedfromhostingan atheisttable.Anotherthingwashowclearlydivided Christiansareintheirbehaviorbasedongender.Of thosewhoidentifiedthemselvesasChristians,wore ChristianjewelryorcarriedChristianBibles,the menandthewomenactedentirelydifferently.The Christianwomenbothaskedquestionsandgave answers.Theyspokeandlistenedtomeandto otherpeopleatthetable.TheChristianmen, however,wereangryandcondescending.Iwastold bytheChristianmenI'mustliveanemptylife,'thatI 'didn'tknowwhatIwastalkingabout,'thatI'should readtheBiblebeforeIquotefromit,'andmore. Thestandardsthatsecularnonprofit organizationsareheldtomakesthemverydifferent fromreligioustaxexemptorganizations.Religious taxexemptorganizationsarenotheldtothese standardsortoanyotherstandard.Areligious organizationmaydeliverfoodtothehungry,offer sheltertothehomelessandcounselingtothe troubledortheymaydononeofthesethings,orit maydothesethingstoastandardfaroutside acceptednorms(suchasofferingprayerasa substituteformedicalcareorcounseling).Religious

groupsareexemptfromtaxeswhetherornotthey servetheircommunityandlessenthetaxburden. Thereisnolegalobligationonareligiousgroup's parttodemonstratetheyhavedeliveredfood, shelterorothertangibleservices;thereisnolegal obligationonareligiousgroup'sparttodoanything toretaintheirtaxexemptstatusotherthanfilingor refilingtheproperforms.Itisnotpossibleto measuremeasureshowmuchreligionOregonians need,howmuchreligionreligiousorganizations provide,howmanypeopletakeadvantageof religion,whetheroneformofreligionismore beneficialthananyother,orwhetherornotreligion iscosteffective.Whileisitpossibletostatehow manypeopleclaimreligiousaffiliation,itisnot possibletostatewhatthatmeans.Itisnotpossible todetermineifatwoyearoldjustasreligiousasan adult.Itisnotpossibletolegislatehowoftenorin whatwayagroupmustbereligioustoqualifyfortax exemptstatus.Becausethereisnooversightto determinehowmuchareligiousgroupservesits community,thereisnojustificationfortaxexempt statusforreligiousorganizationsinOregon. Oregonlawdoesnotstatewhatreligionis. Oregonlawisalsonotconsistentinwhen individualsareexemptfromlegalpunishmentdueto religion.Sometimesactivitiesareforbiddenbylaw irregardlessofreligion,othertimestheyareallowed ifreligionissaidtobeinvolved.Inthecaseof EmploymentDivisionDepartmentof HumanResourcesofOregonvs.Smithit wasdeterminedthatthestateofOregonisnot compelledtoallowtheuseofpeyote[7].Although peyotehasbeenapartofNativeAmericanreligions forcenturies,andalthoughtheplaintiffswere themselvesNativeAmericansandwereusing peyoteforwhattheyclaimedwerereligiousreasons, thestateSupremeCourtdeterminedtheywerenot entitledtounemploymentcompensationafterbeing firedduetousingpeyote.Thelegalinjunction againstpeyoteusetrumpedtheirreligiousclaims.

Thisisanexampleofanactivitybeingillegal whetherornotitwas'religious.' Conversely,Oregonlawprovidesimmunityto manychargesifthecrimeoccurredasreligion. Thesecrimeshaveincludedhomicidebyabuseor neglect,firstandseconddegreemanslaughter, criminalmistreatment,requirementsforchildrento wearabicyclehelmet,andnonsupportofchildren. Untilrecently,allofthesecrimescouldbeexcusedif thedefendantclaimstheywerecommittedas religion[8]. AllnewbornsinOregonaregivenadropof vitaminKbylaw,butparentscanpreventtheir childrenfromreceivingprotectionagainst spontaneoushemorrhagingforreligiousreasons. TheFollowersofChristChurchinClackamas Countytookadvantageofreligiousexemptionfor murderbyallowingnearlyeightychildrentodie sincethe1950sfromtreatablemedicalconditions. Inoverhalfofthesedeaths,thestatedidnot attempttoestablishthecauseofdeath,therecord waslostortheirdeathswerelistedasdueto'natural causes.'EvenwhenanOregonmedicalexaminer broughtthesedeathstotheattentionoftheDistrict Attorney'soffice,theprosecutordeclinedtofile charges.InthewordsofRitaSwan,aparentmay bebeatingortorturingachild,butifheorshecan showthatthechildwasprayedfor,criminalcharges mustbedismissed[9].OregonHouseBill 2494endedcriminalexemptionsforparentswho treatchildrenonlywithprayerin1999,butonlyafter hearingopposingtestimonybyOregonchurches [10].Whilechildsacrificeisnolongerlegalin Oregon,othercriminalexemptionssuchasnot requiringareligiouschildtowearabicyclehelmet remain[11].Theseareaexamplesofanotherwise illegalactivitybeinglegalbycallingit'religious.' Oneofthelargerreligiousorganizationin OregonistheArchdioceseofPortland.The ArchdioceseofPortlandisunderthedirectordersof theRomanCatholicChurch,ledbythePopeof

Rome.In1962,PopeJohnXXIIIgavehisapproval toadocumentoutliningthepolicyoftheRoman CatholicChurchintheeventofchildabuseby clergy.Thepolicywastokeepchildabusebyclergy secretandtotransferabusiveprieststonew parishes.Thepolicyitselfwastobekeptsecretbut wasrevealedin2003.Thepolicyhasneverbeen retracted[12];infact,thecurrentPopestatedin 2001thatthepolicywasstillineffect[13].More thanonehundredandsixtyninevictimsofclerical childabusehavesuedtheArchdioceseofPortland forchildabuse,andmorethan$53,000,000.00has beenassignedtosettlementssofar.Whilethe ArchdioceseofPortlandfiledforandreceived permissiontodelaypayingitsvictims,itdidhavethe fundstomakebuildingupgradescosting$1.6million dollars[14].TheArchdioceseofPortlandis estimatedtoownbetween$300,000,000and $500,000,000inproperty,noneofwhichistaxed.It alsoownsspecialpurposefunds,investmentfunds, andloanfunds,noneofwhicharetaxed.In2003its revenuewasnolessthanandperhapsgreaterthan $8.2million,noneofwhichwastaxed[15].The ArchdioceseofPortlandisonlyoneoutof6,862 religiousorganizationsclaimingORS307.140tax exemptioninthestate[16].Toquotethe Oregonian,TheCatholicChurchoperatesnotby secularlaw,butbychurchlaw[17]. ReligiousorganizationsinOregonarenot compelledtofollowthesamestandardsof educationandemploymentasanyothereducatoror employerinthestate.Fundamentalfactsofnature whicharepartofthebasiccurriculumforanyother schoolinthestatemaybeomittedordeliberately misrepresentedinreligiousschools.Anysecular employerwhohiresandfiresbasedongender, ethnicity,sexuality,maritalstatusorbeliefsis subjecttolegalsanctions,butiftheemployeris religioustheymayhireandfireatwillareprotected bylawindoingso. Nonprofitorganizations(bothsecularand

religious)areforbiddenfromendorsingpolitical candidates.Butsomereligioustaxexemptgroups wanttohavetheircakeandeatittoo.TheSonrise ChurchofHillsborolostitstaxexemptstatusafter partisancampaigningonitsproperty[18].The ChristianCoalitionhaspublishedthesamesortof votingguidesthatcosttheSonriseChurchitstax exemptstatus[19].TheNewHopeCommunity ChurchofClackamashasheldpartisancampaign meetingsonitsproperty[20].Thecampaignto electGeorgeW.Bushsolicitedthesupportof hundredsofreligiousorganizations[21].Tofurther blurthelinebetweenstateandsuperstition,the HouseofRepresentativeshasinitiatedabillthatwill merelyfinereligiousorganizationthatengagein partisanpoliticsratherthanrevoketheirtaxexempt status[22].Religiousorganizationscannowavail themselvestofederalfundsthroughGeorgeW. Bush's'faithbasedinitiatives'lawbutapparently thismoneyismadeavailablemainlytoChristian organizations,asfewotherreligiousorganizations thathaveappliedhavereceivedsuchfunds.Under faithbasedfunding,taxdollarscangotoagencies thatrefusetohireorserveminorities,women, homosexualsoranyoneelseforanyreason. In1998theAuditsDivisionoftheStateof OregonDepartmentofRevenueconductedanaudit ofpropertytaxexemptions.Itdeterminedthat amongreligiousorganizationsclaimingtaxexempt statusunderORS307.140,thesumof $2,010,492,000.00waslostintaxyear19951996 [23].Thisfigurerepresentsonlyrevenueslostfrom propertytaxes,anddoesnotincludeotherlost formsofrevenuesconnectedtoemployment, businesses,museumsandothersourcesofincome forreligiousorganizations.Theauditstatesthat41 ofthe154organizationsauditedthatweregranted taxexemptstatusdidnotevenmeettheminimal statestandardsfortaxexemptstatus(whatever thosemightbe).Theauditdoesnotspecifically statehowmanyoftheseorganizationsweretax

exemptunderORS307.140.butthefactthatone thirdoftheorganizationsthatclaimed(andwere granted)exemptiontotalingseventeenpercentof $170.9billiondollarsinpropertytaxes[24]werenot qualifiedtodososuggeststhatOregonreligioustax exemptionlawisindireneedofsupervisionand revision[25].Amongotherrecommendations,the auditsuggestedthatOregonneedsacleardefinition ofwhatareligionistobeabletofairlyevaluate applicationsforORS307.140taxexemptstatus [26].Thisrecommendationwasnotmentionedin theDepartmentofRevenue'sreply[27]norina 1999reportontheirprogressinimplementing1998 audit[28].Religioncontinuestogoundefined,but Notes:

religioustaxexemptioncontinuestobegranted. AtwhatcostdoesOregongranttaxexempt statustoreligiousorganizations?Thestatedeficit forfiscalyear2004wasbetween$950,000.00and $1,267,000.00[29].Ifreligiousorganizationswere taxedonlyfortheirpropertyandonlyathalftherate ofanyotherorganization,thestatebudgetwouldbe allbutbalancedwithinasingleyear. Beingreligious,thedefiningtraitthathasno definition,isinthemainanexcusetodoasone pleaseswithoutconsequenceinOregon.The majorityofreligiousorganizationsinOregondonot abuseandsacrificechildren.Instead,theydo nothing.Doingnothingandruiningchildren'slives shouldnotberewardedwithtaxexemption.

Internationalhasrightlyspokenagainsttheuseof torture,imprisonmentwithouttrialorrepresentation, extraordinaryrenditionsandotherwarcrimesofthe GeorgeW.Bushadministration.Amnesty Internationalhasrightlyspokenagainstsimilar crimescommittedbyothergovernments.Allof thesestandsweremadeatsomerisktothe organization,andattimesAmnestyInternational hassufferedforitsstance.ThatAmnesty Internationaliswillingtostandupforwhatisjust ratherthanwhatismerelyexpedientiswhyI maintainmymembership.Butthereisone governmentthat,inspiteofitswelldocumented historyofabuses,AmnestyInternationalhasyetto criticize.ThatgovernmentisVaticanCity. ThisletterdemonstratesthatVaticanCity,by wayoftheRomanCatholicChurch,has systematicallyshelteredchildabusersfordecades.
