ExecutiveSummary
TherearemanycompellingreasonswhyNevadaneedstoproceedwiththeadoptionand implementationofthe2009IECCenergycodeandreferencedASHRAEStandard90.12007,andto implementameasurementandverificationprocesstoassurea90%rateofcodecomplianceby2017. Theseinclude:astatelevelcommitmenttotheeffort,theapprovalofARRAfundsfortheeffort, economic,environmentalandindustryopportunities,andgeneralsupportfromthelocalmunicipalities andthepublic.WiththeexceptionoftheARRAfunding,whichexpiresin2012,theneedtodevelopa processforconsideration,adoptionandimplementationoffutureenergycodespromulgatedbythe InternationalCodeCouncil(ICC)canbesupportedbyallofthesereasons.Thepurposeofthisdocument istoguidetheStateintheprocessofadoptionandimplementationofthe2009IECCand,overthenext fiveyears,intheprocessofconsideringfutureenergycodeadoptionbaseduponthecodesdeveloped bytheInternationalCodeCouncil(ICC)onathreeyearcycle. Ultimately,consumerexpectationsmaybethestrongestreasonsforimplementingthe2009IECCand futureenergycodesandforworkingtoensurethatthereisahighrateofcodecompliance.Buyersand occupantsofhomesandcommercialbuildingshaveanexpectationthattheyaregettingfullvaluefor theirinvestmentinnewandremodeledresidentialand/orcommercialbuildings.Itistheirexpectation thatthesebuildingsarebeingconstructedinaccordancewiththelatestgenerallyacceptedbuilding technologyasreflectedincurrentbuildingcodes,withthepresumptionthatlocalbuildingdepartments arevalidatingthiswhenissuingacertificateofoccupancy. WhiletheNevadaStateOfficeofEnergy(NSOE)andtheRenewableEnergyandEnergyEfficiency Authority(REEEA)havebeenutilizingARRAfundstoprovideextensivecodetrainingthroughout Nevada,therearemanypeoplewhowillstillbeinneedoftrainingaftertheARRAfundingisnolonger available.SomeoftheStateslocaljurisdictionshavecodeenforcementprocesseswhichareinsufficient tobringaboutahighlevelofcodecompliance.Asaresult,theirprocessesneedtobeimprovedinsome manner,includingidentificationofhowcodeenforcementcanbeprovidedmoreefficientlyandhow codeadoption,implementationandenforcementwillbefunded. The90%compliancemeasurementandverification(M&V)requirement(pursuanttotheacceptanceof ARRAfunds)presentsitsownuniquesetofchallenges.Themeasurementandverificationprocessisstill intheprocessofdevelopment,andquestionsremainastowhowilldotheplanreviewandinspection portionsoftheprocess.IntheLasVegasmetroarea,thelocaljurisdictionswanttohandlethisin NevadaEnergyCodesStrategicPlan Page5 05/24/11


houseotherwiseknownasasecondpartyM&Vprocess.IntheRenoSparks/CarsonCitymetroarea, theearlyindicationfrombuildingcodeofficialsisthattheywanttohaveanindependentthirdparty handletheM&Vprocess.Therehasnotyetbeensufficientresponsefromtheruralareastodetermine ifthereisaconsensusormajoritydecisiontowardseitheralternative.Perhapsthegreatesttwo problemsrelatedtothe90%complianceissueare: 1) TheStateofNevadaisresponsiblefortheM&Vprocess,buttheARRAfundswillnolonger beavailableformostoftheprojectedM&Vprocesstimeframe;and 2) Currently,theredontseemtobeanyconsistentreliablecostestimatesfortheM&V process,particularlyforcommercialconstruction. Thereareanumberofnational,regionalandNevadaentitiesthatcanprovideresourcestoassistwith thecodeadoption,implementationandcomplianceverificationprocesses.AstheStateproceeds effortswillbemadetoutilizetheseresourcesasfullyaspossible.

KeyDecisionstoBeMade:
Toproceed,NSOE/REEEAmustmakesomecriticaldecisionsandneedskeyinformationaboutcode enforcementandthe90%complianceM&VineachofthreeregionsintheState(LasVegas,Reno Sparks/CarsoncityandRural),towit: 1) Whowilldoplanreviewsfor2009IECCenergycodeenforcement?IntheLasVegasmetroarea, itappearsthatallenergycodeplanreviewswillbedonebybuildingcodeofficials.IntheReno Sparks/CarsonCitymetroarea,thebuildingdepartmentshaveahistoryofdoingresidentialand somecommercialplanreviewsinhousebutoutsourcingtheplanreviewsforcomplexbuildings. Insomeoftheruralareas,itmaymakesensetohavediscussionsabouthowtobestaccomplish theenergycodeplanreviewprocess. 2) Whowilldoinspectionsfor2009IECCenergycodeenforcement?InRenoandLasVegas,the buildingdepartmentshaveindicatedtheywillbehandlingthiseffort.Insomeoftherural jurisdictions,whilethelocaljurisdictionsareresponsibleforinspectionsitmaymakesenseto havediscussionsabouthowtobestaccomplishcodeenforcement. 3) Whatistheincrementalcostassociatedwithtransitioningfromthe2006IECCtothe2009IECC forthecodeenforcementefforts?TrueincrementalcostscannotbedetermineduntilNevada beginstheM&Vsampling,sincetherewillbealinkagebetweenthechangeincodesandthe levelofcompliance. 4) Whatistheincrementaleffortandassociatedcostincodeenforcementassociatedwithmoving fromthecurrentlevelofcompliance(notyetmeasuredinNevada,butprobablyinarange between6580%forresidentialconstruction)toa90%levelofcompliance?Again,tobe determinedbutsamplinginNevadamustbeconductedfirst. Note:TheM&Vprocessisaseparateprocesslayeredontopofthecodeenforcementprocesssortof aqualitycontrolfeedbacklooptohelptheconstructionindustryandcodeenforcementofficials determinehowwellthenewcodesarebeingfollowedandenforced.TheM&Vprocesswillbe conductedforasmallsubsetofallconstruction,consistingof44projectsineachoffourcategories:1) newresidential;2)residentialremodel;3)newcommercialand4)commercialremodel,foratotalof 176projectsinNevada.Itinvolvescollectinginformationattheplanreviewstageandatvariousstages ofconstructionthroughinspection.PacificNorthwestNationalLaboratory(PNNL),whichistheentity overseeingandprovidingtechnicalsupportfortheM&Vprocess,recommendsanindependentthird partyprocess,butstillpresentedfirstpartyandsecondpartyprocessesasoptionsforcompliance evaluation. 5) WhowilldoplanreviewevaluationfortheM&Vprocess;buildingdepartmentsorindependent thirdparties? 6) Whowilldosite(inspection)evaluationsfortheM&Vprocess;buildingdepartmentsor independentthirdparties? 7) IfbuildingdepartmentshandletheM&Vplanreviewand/orsiteevaluations,wouldtherebea benefittohaveindependentthirdpartyvalidationoftheM&Vprocesses?Iflocaljurisdictions desiresomesortofindependentvalidation,theymightconsiderusingtheEnergyCode Ambassadors.EnergyCodeAmbassadors,iftheyagree,mightbeabletohandletheM&V processorprovideathirdpartyvalidation. 8) WhataretheestimatedcostsassociatedwiththeM&Vprocess?Aprocesswillneedtobe developedformakingthisdetermination.Onealternativeforestimatingthesecostsfor commercialconstructionwouldbetohireanArchitecturalandEngineeringfirmexperiencedin planreviewandinspectionstocreateatable/matrixassociatedwithbuildingoccupancy,type andcomplexityofconstruction,andtiedtoconstructioncostsmuchliketheICCtablethatis typicallyusedbylocaljurisdictionsfordeterminingbuildingfees.Forresidentialconstruction, HERSprovidersandothercertifiedenergyauditorshavesignificantexperienceinthirdparty evaluations. 9) WhatarethepreferredoptionsforfundingtheseM&VeffortsaftertheexpirationofARRA funding?WhataretheStatesbestoptionsandchancesforsecuringfunding?Isthissomething thatcanbetaskedtothecollaborativeteam1todetermine,orperhapsdonewithassistanceof outsidepartnerssuchastheSouthwestEnergyEfficiencyProgram(SWEEP)ortheBuilding CodesAssistanceProject(BCAP)?

ActionItems:
ThefollowingrecommendationsarespecificactionstepsthatNSOE/REEEAshouldtakeinorderto advancetheadoptionandimplementationofthe2009IECCenergycodeandreferencedASHRAE Standard90.12007,andtoimplementameasurementandverificationprocesstoassurea90%rateof codecomplianceby2017,aswellastodevelopanongoingprocessandinfrastructureforthe considerationandadoptionoffutureenergyefficiencycodes. NevadaActionItem1:StatewideEnergyCodeCollaborative. OrganizeaStatewideNevadaEnergyCodeCollaborativealongthelinesoftheIdahomodel,for thepurposeof:1)assistingwiththeevaluation,adoptionandimplementationofnewenergy codes;2)considerationofneworrevisedprocessestoimprovelevelsofcodecompliance;3) expansionofenergycodeoutreachandawarenessthroughoutlocalgovernments,the constructionindustryandthegeneralpublic;and4)considerationofandpursuingotherresources thatcouldbeutilizedtoadvanceenergyefficiencythroughenergycodesinNevada. NSOE/REEEAshouldidentifykeyparticipants/stakeholdersforachievingsuccess,withparticipants providinggeographicandindustrysectordiversity,aswellasamethodoffundingthe collaborativeafterARRAfundingisnolongeravailable. NevadaActionItem2:EnergyCodeTraining. Intheareaofenergycodetraining,NSOE/REEEAshould: 1. InvestigatehavingCommunityCollegesoffercoursesforstudentsinterestedinbecoming buildingcodeofficialsordesignorconstructionprofessionals,withappropriatetuition levelstocovercostsoftheseclasses; 2. UtilizetheCollegeofExtendedStudiesatUNRand/orUNLV,and/orprivateentities,to provideclassesqualifyingforCEUsforprofessionalsdesiringtoenhancetheirskillsand obtainneededCEUsintheirprofessions.Studentstypicallypayfeestotaketheseclasses. Thisisthetraditionalmodelforprovidingthissortoftraining,andwhenprovided throughExtendedStudies,theuniversitysystemdistancelearninginfrastructureisoften usedtoprovidetraininginruralareasoftheState; 3. ContinuetocoordinatewiththeSouthernNevadachapteroftheInternationalCodes Council(SNICC)forenergycodeclassestobeofferedattheEducodeConferenceheld annuallyinLasVegas,whichprovidesICCCEUstobuildingcodeofficials.WhileARRA fundswereutilizedtoprovidescholarshipstoNevadabuildingcodeofficialsin2011,the traditionalmodelisforthebuildingcodeofficialstoeitherpayfortheirownregistration andtravelexpensesortobereimbursedbytheirlocaljurisdictions.TheNorthernNevada ICCchaptercanalsobeutilizedtopromoteandhosttrainingevents; NevadaEnergyCodesStrategicPlan Page8 05/24/11


4. NSOEcouldcontinuetosponsorfreetrainingacrossNevada,whichwouldrequire identificationofafundingsourceaftertheARRAfundingends; 5. Utilizethenetworkofenergycodeambassadors(buildingcodeofficialvolunteers specificallytrainedtoprovideenergycodetrainingandadvice)toprovidepeertraining andconstructionindustrytraining(whichwouldalsorequiredafundingsourceafterthe ARRAfundingends);and 6. UtilizethesupportvolunteeredbyNVEnergytosponsorenergycodetrainingthroughout itsserviceterritory. NevadaActionItem3:PotentialforRuralJurisdictionCollaboration. NSOE/REEEAneedstoencouragetheruralcountiesandcitiestocometogetherperhapsinviting ororganizingthemeetingthroughtheNevadaAssociationofCountyOfficials(NACO)andthe NevadaLeagueofCitiesandmakedecisionsabouthowtheywishtoproceedwithcode enforcement(planreviewandinspection).Codeenforcementistheresponsibilityoflocal jurisdictions. ThecollaborativeteamorNSOE/REEEAcouldprovideexamplesofsystemsandmethodsincluding regionalcodeenforcementmodels(i.e.travelingEnergyCodeAmbassadors). Thisisthemosturgentoftheactionitems,sincethestateadoptionprocessofthe2009IECCenergy codeiswellunderway,andwhenthecodeisadoptedandbecomeseffective,itwillsetaminimum levelforalljurisdictionsinNevada.Untilotherfundingoptionsaredeveloped,theruraljurisdictions shouldassumethatthecostsofcodeenforcementwillbecoveredthroughbuildingpermitfees, regardlessofwhodoestheplanreviewandinspection.Afterastatewidecollaborativeisformed,it mightworkwithruraljurisdictionstoexplorethepotentialforstateassistanceifthereisnotan appropriatelevelofcompliancewiththenewenergycode. NevadaActionItem4:SelectinganOptionforMeasurementandVerificationRenoSparksand RuralJurisdictions. NSOE/REEEAwillneedtoworkwiththeRenoSparks/CarsonCitymetroareajurisdictionsandthe ruraljurisdictionstodeterminehowtheywillproceedeitherdoingtheirownsamplingorusinga certifiedthirdpartyentitytoconducttheM&Vprocess.Ineithercase,aprimaryissuewillbe howtofundtheM&VeffortsforalloftheseyearswhenARRAfundsarenolongeravailable.As partofthisconsideration,therewillneedtobeadeterminationofwhattypeof expertise/certificationwillbeneededbyanevaluator.

NSOE/REEEAshouldcontinuetoinvestigateandinvolvekeystakeholders(perhapsthroughthe collaborativesuggestedinActionitem1)inreviewingoptionsforfundingboththehighercostsof planreviewandinspectionsassociatedwiththe2009IECCandthecostsofM&Vinyearsafterthe ARRAfundsarenotlongeravailable. Withtheadoptionofanyoralloftheseactionitems,NSOE/REEEA,shouldconsiderthefollowing operationalprocesses: Assigncorrespondingrolesandactionstoeachkeyparticipant/stakeholder, Establishmilestonesfortrackingprogresstowardthe90%goal,and Provideascheduleforcompletingactions. Havingtransitionedfromthefastestgrowingstateinthenationforthelastthreedecadestothestate worsthitbytheGreatRecession,Nevadashouldtaketheopportunityofthisslowerperiodofgrowthto becomeanationalmodelforenergyefficiencyandrenewableenergy.Becomingaleaderinenergy codeadoptionandimplementationisabsolutelyakeycomponentinthisdecision.

WhyDoesNevadaNeedanEnergyCodesStrategicPlan?
1. GovernorsAssuranceCertification:AttheheightoftheGreatRecessioninMarchof2009,in orderforNevadatoreceiveover$34.7millioninARRAfunds,NevadasformerGovernorexecuteda GovernorsAssuranceCertificateandlettercommittingNevadatotheadoptionofthe2009IECCenergy codeandANSI/ASHRAE/IESNAStandard90.12007.ThesedocumentsfurthercommittedNevadato adoptaplantoachieve90%compliancewithineightyears(Appendix1). NevadascurrentGovernor,BrianSandoval,hasexpressedhisinterestingrowingtheenergyefficiency industryinNevadaandaccordinglyhasdeterminedthattheStatescommitmenttoadoptthe2009IECC energycodeandreferencedASHRAEStandard90.12007isexemptfromhisexecutiveorderbarring theimplementationofanynewregulationsinNevada. 2. NRS701.220:Asindicatedonpage3oftheGovernorsletter,theGovernordirectedthe NevadaStateOfficeofEnergy(NSOE)tointroduceabillandworkwiththe2009NevadaLegislatorsand localgovernmentsforthemodificationofNRS701.220subsection4,sothatthegoverningbodyofa localgovernmentthatenforcesabuildingcodeshalladoptandenforcethestandardsadoptedbyNSOE astheminimumstandards. NevadaRevisedStatute(NRS)701.220(seeAppendix2fortheentireNRS701.220)includesthe followinglanguage:
1.TheCommissionershalladoptregulationsfortheconservationofenergyinbuildings,including manufacturedhomes.Suchregulationsmustincludetheadoptionofthemostrecentversionof theInternationalEnergyConservationCode,issuedbytheInternationalCodeCouncil,andany

amendmentstotheCodethatwillnotmateriallylessentheeffectiveenergysavingsrequirements oftheCodeandaredeemednecessarytosupporteffectivecomplianceandenforcementofthe Code,andmustestablishtheminimumstandardsfor: (a)Theconstructionoffloors,walls,ceilingsandroofs; (b)Theequipmentandsystemsforheating,ventilationandairconditioning; (c)Electricalequipmentandsystems; (d)Insulation;and (e)Otherfactorswhichaffecttheuseofenergyinabuilding. TheregulationsmustprovidefortheadoptionofthemostrecentversionoftheInternational EnergyConservationCode,andanyamendmentsthereto,everythirdyear. ... 4.ThestandardsadoptedbytheCommissioneraretheminimumstandardsfortheconservation ofenergyandenergyefficiencyinbuildingsinthisState.Thegoverningbodyofalocalgovernment thatisauthorizedbylawtoadoptandenforceabuildingcode: (a)Exceptasotherwiseprovidedinparagraph(b),shallincorporatethestandardsadoptedby theCommissionerinitsbuildingcode; (b)Mayadopthigherormorestringentstandardsandmustreportanysuchhigherormore stringentstandards,alongwithsupportingdocuments,totheCommissioner;and (c)Shallenforcethestandardsadopted.

3. EconomicReasons:While$34.7millionwasasignificantamountofmoneymuchneededby Nevadaduringtherecession,neithertheGovernornortheLegislaturewouldhavetakentheactions citedaboveunlesstheenergycodeadoptionmadegoodeconomicsensefortheStateofNevada.The followingaresomeoftheeconomicaspectsofenergyefficientbuildingcodesthathavemotivated governmentsandthebuildingdesignandconstructionindustriesacrosstheU.S.toadoptenergy efficientbuildingcodes. Utilityinfrastructureandratepayercostbenefitcomparison:Energysavedatthepointofusenotonly reducestheneedforthatamountofenergytobeproducedatthesource,butalsoreducestheamount ofenergyrequiredfortransmission(losses),aswellascostsassociatedwithnewproductionfacilities neededtoaccommodategrowingenergyrequirementsintheregion.Further,mostenergyproduction involvessomelevelofenvironmentalimpactmitigationcost,andthis,too,isavoidedthroughenergy efficiency.Overtime,significantportionsofallofthesevarioussavings(avoidedcosts)accruetorate payers. InNevada(climatezones3and5),ifoneassumesa50yearlifefornewresidentialunits,thetransition fromthe2006IECCtothe2009IECCresultsinenergysavingsatacostequivalenttolessthan $0.005/kWhor$0.14/therm.Tobeconservative,iftheassumedlifeoftheunitsisshortenedto20 years,thecomparisonsstatedinenergyproductioncostequivalenciesareoflessthan$0.34pertherm or$0.012perkWh(seeAppendix3).Thisissignificantlylowerthanthecostofprovidingenergy throughelectricalgenerationorthedirectuseofnaturalgasforspaceandwaterheating.Asgreater energyefficiencyisachievedthroughnewconstructionincorporatingnewcodes,theweightedaverage useofenergypersquarefootwilldecrease.Energyefficiencycodesreduceenergydemandacrossthe boardforallnewconstruction;justasrisingdemandpushespricesup,energyefficiencycanhelpkeep energypriceslow. Economicimpactanalysis:Nevadaimportsthevastmajorityoffuelsusedtoproducetheenergy consumedinthestateapproximately89%in2008accordingtoDOE.4Nevadas2008expendituresfor coalandnaturalgaswereestimatedtobeinexcessof$2.6billion.Importationofenergyresultsinthe exportationofdollars.Justasbaseindustrieshaveaneconomicmultipliereffectthroughexports (resultinginimportingdollars,whichthenripplethroughthelocaleconomy),energyefficiencyresultsin whatisknownasimportsubstitution,resultinginasimilareconomicimpactmultipliereffect.Inthis instance,improvementsinnewconstructionwillbesubstitutedforfutureenergyconsumption.The increasedconstructionexpenditureswillproducenonrecurringpositiveeconomicimpacts,andfewer dollarsbeingexportedforenergyoverthelifetimeofthosebuildingsmeansmoremoneywillbe availabletobespentlocallyonothergoodsandservices,creatinganongoingpositiveeconomicimpact inthelocalcommunitiesandintheState. 4. EnvironmentalReasons:Energyefficiencyisoftenacknowledgedasthequickest,cheapestand cleanestwaytoreduceenergyuseandlowergreenhousegasemissions.Cuttinginefficient,wasteful energyuseinthebuildingsectormakesgreatsensebecausebuildings(includingresidential)accountfor 70percentoftheelectricityand40percentofthetotalenergyusedintheUnitedStates.Sincethe averagelifespanofabuildingis50yearsormore,achievableandcosteffectiveenergyefficiency requirementsputinplacetodaywillaffectbuildingenergyusagethrough2061andbeyond. Becauseenergycodesreducebuildingenergyconsumption,thosecodesalsoreducepowerplant emissionsofgreenhousegasesandairpollutantsfromtheburningoffossilfuels.Electricityproduction isoneoftheleadinggeneratorsofairpollutioninourlocalcommunitiesandgloballypollutants

Further,theBEPstudydeterminedthatthegapsweredifferentineachofthreegeographicregions:the LasVegasMetroarea,theRenoSparks/CarsonCityMetroarea,andRuralNevada.Themostsignificant challengeappearstobethelackofinfrastructureandresourcesneededforcodeadoptionand implementationinRuralNevada.Thenextgreatestchallengeseemstobeidentifyingtheresources neededtoaccommodatethehigherlevelofeffortthatwillberequiredforplanreviewandinspectionto assurethatthenewcodesarebeingfollowedandtomeasureandverifycompliance(the90% compliancerequirementassociatedwithreceivingthe$34.7millionofARRAfunding)onanongoing basisparticularlyinthefaceofbuildingdepartmentstaffreductionsresultingfromthecurrent recessionandthedropinpermitfeesthatfundbuildingdepartments. LocalGovernmentalBuildingDepartments:ThebuildingdepartmentsintheLasVegasmetroarea workedtogether(SouthernNevadaBuildingOfficialsorSNBO)andhavealreadyadoptedthe2009 IECCwithseveralamendments(allreviewedanddeemedmorestringentbyPNNL),tobecome effectiveJuly2011.Thiscollaborativeeffortissignificantandshouldbenefitimplementationofthe 2009IECCintheregion. AnumberofjurisdictionsinnorthernNevadaformedasteeringcommitteefortheadoptionofthe2006 IECC.WhilecertainlynotasprogressiveastheLasVegasmetrobuildingdepartments,thiscooperation innorthernNevadarepresentsaresourcethatcanprobablybeutilizedagaintoassistwithlocal adoptionandimplementationofthe2009IECC. ByNevadalaw(NRS275),Nevadabuildingcodeofficialsarerequiredtobecomecertifiedbyacode officialsassociation(InternationalCodeCouncilorICC).AccordingtoICC,therewere48plan examinersandbuildinginspectorsinNevadawithenergyinspectorcertificationsin2010. Atthistime,withinNevadaonlytheLasVegasmetroareabuildingdepartmentsaresubstantiallyready forimplementationofthe2009IECCenergycode.ThroughoutalloftheState,theeconomiccrisishas ledmanybuildingdepartmentstosignificantlyreducethesizeoftheirstaffs,andtheyhavelimited flexibilityfordealingwiththescaleofchangethatwillberequiredwiththeimplementationofthe2009 IECCenergycode.Forexample,insomebuildingdepartmentsattending2009IECCtrainingcanmean thatnooneislefttohandleongoingwork.Somebuildingdepartmentbudgetshavelittleorno allowancefortravelexpensetoattendtraining.Anyadditionaltimerequirementsforplanreviewand inspectiontoassureproperimplementationofthe2009IECCenergycodeswillbeproblematicinmany, ifnotmostNevadacommunities.

BCAPRecommendation#2:Thestatecouldmakeextrameasureforoutreachtoruralareasof thestate. Inanticipationoftherecurringthreeyearcycleforconsideringnewenergycodes,NSOE/REEEAcould repeattheadhocprocesscurrentlybeingemployedforadoptionofthe2009IECCenergycodes.A betteroptionwouldbetoestablishastatewideNevadaEnergyCodeCollaborative,involving stakeholdersrepresentingdifferentgeographicregionsandintereststoevaluatenewenergycode adoptionandimplementationprocessesfortheState. AmodelforthiscouldbetheIdahoEnergyCodeCollaborativewhichhasbeeninexistenceforoverten years.ItsmembershipincludesrepresentativesfromtheAssociationofIdahoCities,theStateofIdaho, theBuildingContractorsAssociation,IdahoAssociationofBuildingCodeOfficials,Idahochapterofthe AmericanArchitectsAssociation,IdahoRealtorsAssociationandlegislators.Anyonewhofeelstheyare astakeholdercanbeamember.WhennewcodesarereleasedbytheInternationalCodesCouncil,the IdahoEnergyCodesCollaborativemeetsonceortwiceperquarteruntilimplementationisgoingwell. Theirbudgethasbeenaround$140,000peryear,andthemoneyhascomefromtheNorthwestEnergy EfficiencyAlliance(NEEA).Nevadawouldneedtoidentifyafundingsourceifitweretopursuethissort ofstatewidecodecollaborationinthefuture.NEEAreceivesamajorityofitsfundingfromthe BonnevillePowerAdministration,whichisafederalnonprofitandispartoftheU.S.DOE.Thereisno similarentityinthesouthwesttofundthesetypesofefforts. Argumentsagainstthismethod:Theowners/occupantsofneworremodeledbuildingsarethe primebeneficiariesofthenewenergycodes.Itismoreequitablethattheyultimatelybearthe incrementalcoststhanspreadingthemouttoallratepayers.Asabove,utilizingthiswould requireagreementbythePUCwhichcouldbeproblematicand/ortimeconsuming.Therecould belegalactionsopposingthisapproach. 3. Utilitycompanycontributions,withassociatedRPScredits.Thisapproachwouldencourage utilitycompaniestomakecontributionstocoverallorsomeportionofthecostsofcode enforcementand/orM&Veffortsintheirservicearea.Inreturn,theutilitieswouldbeallowed tocountsomeportionoftheresultantenergysavingsasaportionoftheenergyefficiency portionoftherenewableenergyportfoliostandards. Argumentsforthismethod:Whennewenergycodesareimplementedwithahighrateof compliance,ithelpsmovetheStateofNevadaandthenationtowardsabetterenergyfuture includingalowercarbonfootprint,lessdependenceuponforeignsuppliesoffossilfuelsanda strongerandmorediversestateeconomy.Therefore,itwouldbegoodpublicpolicytoallow theutilitycompaniestomakethesecontributionsandobtainsomecreditfortheenergy efficiencyachievedtowardstheirRPSgoals. Argumentsagainstthismethod:Typicallyenergyefficiencyachievedthroughnewbuilding codesdoesntcounttowardstheRPSstandard.Ifallowed,thiswoulddilutetheotherefforts thatarecountedtowardsmeetingtheRPSgoals. 4. Utilizefederalfunding,suchasEnergyEfficiencyCommunityBlockGrants(EECBG)tohelpcover allorsomeportionofthecostsofcodeenforcementand/orM&Vefforts. NRS 701.220 Adoption of regulations for energy conservation in buildings; exemptions; applicability and enforcement; procedures for adoption. 1. The Commissioner shall adopt regulations for the conservation of energy in buildings, including manufactured homes. Such regulations must include the adoption of the most recent version of the InternationalEnergyConservationCode,issuedbytheInternationalCodeCouncil,andanyamendments totheCodethatwillnotmateriallylessentheeffectiveenergysavingsrequirementsoftheCodeandare deemed necessary to support effective compliance and enforcement of the Code, and must establish theminimumstandardsfor: (a)Theconstructionoffloors,walls,ceilingsandroofs; (b)Theequipmentandsystemsforheating,ventilationandairconditioning; (c)Electricalequipmentandsystems; (d)Insulation;and (e)Otherfactorswhichaffecttheuseofenergyinabuilding.
