(1) He must be a master of the language of the Arabs, knowing its different dialects, the import of their poems, their proverbs, and their customs. [30] (2) He must have a complete grasp of the differing opinions of the scholars and jurists of Islam. [31] (3) He must be a jurist himself, learned in the Quran, having memorized it and knowing the difference of the seven readings of the Quran while understanding its commentary, being aware of what is clear and what is obscure in it, what it abrogates and what is abrogated by it, and the stories of the prophets. (4) He must be learned in the Sunna of the Messenger of Allah, capable of distinguishing between its sound hadith and its weak hadith, its continuous hadith and hadith whose chain of transmission is broken, its chains of transmission, as well as those hadith which are well known. [32] (5) He must be scrupulously pious in the religion, restraining his lower desires with respect to righteousness and trustworthiness, and his doctrine must be built upon the Quran and the Sunna of the Prophet. One who is missing in any of these characteristics falls short and is not permitted to be a Mujtahid whom people imitate. [33]

Conditions for Ijtihad

What is becoming increasingly noticeable during these times is the amount of people who state: 'I follow the Quran and Sunna.' In many instances this relates to, 'I don't need to follow the qualified scholarship of the four sunni madhabs.' What these people fail to realise is the sheer depth of knowledge and understanding the founders of the four madhabs and their students had of both the Quran and Sunna. How did they gain this understanding? Fear, Taqwa, Iman and a fierce intellect. They also fulfilled all the necessary pre-requisite criteria in order for them to perform ijtihad, as outlined by Shaykh Abdul Hakim Murad below: "In order to protect the Shariah from the danger of innovation and distortion, the great scholars of usul laid down rigorous conditions which must be fulfilled by anyone wishing to claim the right of ijtihad for himself. These conditions include: (a) mastery of the Arabic language, to minimise the possibility of misinterpreting Revelation on purely linguistic grounds; (b) a profound knowledge of the Quran and Sunnah and the circumstances surrounding the revelation of each verse and hadith, together with a full knowledge of the Quranic and hadith

commentaries, and a control of all the interpretative techniques discussed above; (c) knowledge of the specialised disciplines of hadith, such as the assessment of narrators and of the matn [text]; (d) knowledge of the views of the Companions, Followers and the great imams, and of the positions and reasoning expounded in the textbooks of fiqh, combined with the knowledge of cases where a consensus (ijma) has been reached; (e) knowledge of the science of juridical analogy (qiyas), its types and conditions; (f) knowledge of ones own society and of public interest (maslahah); (g) knowing the general objectives (maqasid) of the Shariah; (h) a high degree of intelligence and personal piety, combined with the Islamic virtues of compassion, courtesy, and modesty. A scholar who has fulfilled these conditions can be considered a mujtahid fil-shar, and is not obliged, or even permitted, to follow an existing authoritative madhhab." In this day and age it seems highly unlikely that there are many, if any people who fulfill the above criteria, making it a Fard on us lay people to follow one of the schools of the four mujtahid Imams. So the next time you hear someone saying its a bida to follow a madhab or that they follow only the Quran and Sunna, ask them if they fulfill the above criteria.
