CONTRACT OF LEASE This AGREEMENT OF LEASE made and entered into by and between: THE LESSOR: Elsa R.

Avenir -andTHE LESSEE: ____________________________________ of legal age, married/single, a resident of ____________________________________ . WITNESSETH: That the LESSOR hereby leases unto the LESSEE, and the latter hereby accepts in the lease from the former, the premises known as and located at ________________________________________________, under the following terms and conditions: 1. The monthly advance rental shall be ____________________________ (P ___________ ) Pesos, Philippine Currency, to be paid by the LESSEE to the LESSOR on or before the ______ of each and every month, plus one (1%) percentum surcharge per month for payment of rentals made after the ______ day of the month due. It is expressly agreed and understood that the payment of rental berein stipulated shall be made without the necessity of express demand and without delay on any ground whatsoever. 2. The term of this lease _________________________ commencing on _________________________ and expiring on _________________________, ______ . 3. That during the term of this lease, the LESSEE shall pay and defray any and all costs of water, electric, gas, telephone bills and other services connected with, used and utilized by him/her in the premises leased; However, it is also provided that the LESSEE shall give a cash deposit of ____________________________ (P ___________ ) Pesos, Philippine Currency, to the LESSOR, which will be duly receipted as guarantly deposit. The said guarantly deposit to be return upon showing satsifactory proof that the LESSEE has fully paid his/her obligations at the time of termination or expiration of this lease agreement, including water, electric and other bills of damages to the premises leased due to improper use and negligence. 4. That the LESSEE shall not any instance during the term of this lease, use and utilize for cooking or otherwise, any fuel that produces smoke of flame which is a hazard to fire; nor may he/she take care of any livestock therein which may cause any kind of nuisance to other occupants or neighborhood; nor may he/she sublease and/or transfer his/her right as leassee on the whole or a portion of said premises to any third person without the knowledge and consent in writing the LESSOR. 5. That at the time of delivery to and occupancy by the LESSEE of the premises leased, it has been inspected and found by the latter that the same is in an orderly and good habitable condition, including electrical and plumbing installations and fixtures such that henceforth, any and all defects and troubles on those fixtures shall be immediately repaired by his/her at his/her own exclusive account and expense, without any obligation on the part of the LESSOR. The LESSEE shall be responsible also for any damage or injury caused in the said premises by himself/herself or that of his/her family and ther persons under his/her supervision and care, and any such damage or injury shall be immediately repaired at his/her exclusive expense. 6, That LESSEE shall not claim any damage on account of necessary work that the LESSOR may order to be done in the building and which would in any way interrupt his/her use of the premises leased.

The LESSEE hereby expressly recognize the absolute right of the LESSOR to sell the leased premises and in the event of sale, this contract to lease shall be seemed ipso facto cancelled and the right of the said LESSEE to occupy the premises considered automatically terminated. 8. The LESSOR reserves the right to prescribe or limit the weight of any heavy safe, equipment or other articles which may be placed in the leased premises. No machinery, equipment or articles of any kind which exceeds 500 kilos, dead weight shall be allowed inside the leased premises. The LESSOR shall have the right to designate the position or location for such heavy objects, within the leased premises for reasons of security. 8-a. That the LESSEE agreed with the LESSOR that the leased premises shall be occupied by not more thant the maximum of __________ ( _____ ) persons, and it is also well understood that drunkeness within the said premises is strictly prohibited and shall be a ground for cancellation of this contract. 9. That the LESSEE shall not make any alteration in the interior or exterior of the the premises leased, nor introduce any permanent improvement therein without the written consent of the LESSOR first had and obtained, and should such consent is given, all expenses incurred therefore shall be for the exclusive account of the LESSEE, without any right of reinbursement frm the LESSOR at the termination or expiration of this lease and in which event such permanent improvement so place therin shall become the absolute and exclusve property of the LESSOR without any obligation of such reinbursement on his part. 10. The LESSEE shall not use or utilize the premises leased for any unlawful or immoral purpose and that in the use of the same, he/she shall see to it that no nuisance whatsoever is caused which will adversely affect the neighborhood otherwise, he/she shall be exclusively liable for any consequence. 11. That a violation of any of the conditions and stipulations herein provided shall be sufficient cause for the termination of this lease and in such event the LESSOR is hereby allowed and granted by the LESSEE the right to take immediate physical possession of the premises leased, by closing, locking the same without any court action to the effect which the latter hereby waive absolutely. In the event of the LESSOR is forced to resort to judicial suit to protect his rights and interests arising from this contract by reasn of LESSEE's violation of any of the terms, conditions and stipulations herein provided, the latter further obligates himself/herself to pay to the former as and for attorney's fee, a separate sm of no less than ____________________________ (P ___________ ) besides costs of suit by law. 11-a. Failure of the LESSOR to exercise any of his rights or to insist in one or more instances upon strict performance of any of the covenants herein agreed/or provided by law, shall not be construed as abandonment of any of them as the same shall continue in full force and effect. No waiver in writing and signed by him. 12. The LESSEE hereby grants the LESSOR or his authorized representative the right to inspect during daytime the premises occupied by ther former for verification of any injury or damage caused therein by the LESSEE. 13. The LESSEE shall voluntarily express his or her dersire to renew the Contract of Lease one month before the expiration date. Failure to notify the LESSOR about his or her desire to renew the contract will mean that the LESSEE will vacate the premises contract will mean the premises immediately after the expiration of the contract.
