HOUSING/RENTALAGREEMENT

Thisagreementisastabulatedandsignedbetweenthelandlordandtenantandconflictsor challengesbetweenbothpartieswillbemanagedbythemorreferredtothecourtsystemfor resolution.NorthernCaribbeanUniversityisnotasignatorytoanyoftheseagreementsandwillonly berequiredtohaveonfile,intheofficeofStudentServicesandRecords,informationasisrequiredby lawandtherulesandregulationsoftheUniversity. Individualswhohavebeenlivinginuniversityhousingmustcompletetherelevantapplicationformfor offcampushousing,andreceiveapprovalfromtheOfficeofStudentServicesandRecords.The applicationmustbeaccompaniedbyaletterofparentalapprovalwhichmustincludethefullname, addressandtelephonecontactoftheparent(s).

13. Garbagemustberemovedfromthebedroomandbathroomareaatleastonceperweek. 14. GarbageiscollectedbytheNationalSolidWasteManagementprogramme,providedbythe ManchesterParishCouncil,thereforethegarbageshouldbeplacedintheappropriate receptaclesodesignatedforcollection. 15. Thetenantwillcleanhisorherroomandthecommonareasonaregularbasismakingthem freefromgarbageandotherobnoxiousodorstomaintaingoodsanitation. 16. Thetenants(s)willshowregardforthefactthattheyarelivinginasharedhouseandassuch showdueregardforatolerablenoiselevel.Thatis:radio,television,computer,iPods,MP3 playersetc.shouldnotbeplayedloud,norshouldtherebeanynoisethatwoulddisturbthe otheroccupantsintheadjoiningroomsorinthehouse. 17. Allelectricalandelectronicappliancesmustbeprotectedbysurgeprotectors,asthelandlord willnotbeheldliableforanydamageresultingfrompowersurges,negligenceofthenational powerserviceprovider,lightningoranyotheractofGod. 18. Tenantsmustsecuretheirpropertyasthelandlordwillnotbeheldliableforanylosshowever caused. 19. Tenantsarerequiredtokeeprelevantwindowsanddoorslockedtoprevententryby unauthorizedpersons. 20. Thelandlordreservestherighttopayannouncedorunannouncedvisitstotherentedquarters tocheckontheconditionofthepremises. 21. Tenantsarerequiredtoadheretotherulesof:notdefacingthewalls,lightfixtures,furnitureor furnishings,oranyitemprovidedintheresidencebypasting,nailing,makingholesetc.Itemsin theroommustreflectthephilosophyandstandardsasisalsorequiredattheuniversity. 22. Occupantsarerequiredtokeepthesurroundingareas(outside)thepremisescleanandtidy. 23. Thereisnoprovisionforvisitorstoovernightorspendlonghoursvisiting.Whilevisitorsarenot denied;therevisitwillbeundercertainconditions. a) Roomsareoutofboundsforvisitorsofthesameoroppositesex.Thisregulationrelatesto unmarrieduniversitystudentswhooccupytherentedspace. b) Visitorswillconformtothenoisecontrolsandallothersuchregulationstowhichthe tenant(s)areresponsible,includingthegovernmentregulationswithrespecttotheNoise AbatementAct. c) Visitorswhodrivevehiclesmustbeadvisedtoplaytheircarradiosveryloworturnthem off. d) Visitorsarenotexpectedtoarriveatnightorstaylate. 24. Itisexpectedthattenant(s)shouldcomehomeatreasonablehoursandthatentrytothehouse shouldbequietaspossible.Studentsarerequiredtomaintainthesamehoursasthosesetout bytheuniversity. 25. Tenant(s)arerequiredtoadvisethelandlord/agentaboutovernight/weekendleaveand periodsofabsencefromthepremisese.g.vacationleave 26. Thelandlordandtenantswilldeterminethecostsforperiodsoflongleave,especiallyifpersonal itemsarenotremovedfromtheproperty. 2

27. Intheeventthatthetenant(s)isunabletoreturnattheprescribedtime(especiallyfrom overnight/vacationleaves)thelandlordmustbeadvisedasamatterofcourtesyespeciallyin thesetimesofkidnappingandabduction. 28. Noprovisionismadeforthekeepingofpets. 29. Wherethetenant(s)has/haveamotorvehicle,suchvehicleshallbeparkedintheyardatthe tenant(s)risk.Thelandlordisnotresponsibleforanylosstoeitherthevehicleoritscontents. 30. Thelandlordwillfromtimetotimesharewiththetenant(s)producefromtheproperty.The tenant(s)arenottoharvestanyproducefromthepropertywithouttheexpressedpermission fromtheLandlord. 31. Thelandlordwillfromtimetotimesharewiththetenant(s)producefromtheproperty.The tenant(s)arenottoharvestanyproducefromthepropertywithouttheexpressedpermissionof thelandlord. 32. Uponintentiontoleavethepremises,thelandlordhasarighttoexaminetherentedareato determinethecondition(damage,defacementetc.)andreceivethekeys. Thisagreementwillbebindingandwillrequireonemonthsnoticefromeitherparty(tenantor landlord)forrelease. 1. Tenantsshallnotlease,sublease,orassignthepremiseswithoutthepriorwrittenconsentofthe Landlord(butthisconsentshallnotbewithheldunreasonably). 2. Landlordmayenterthepremisesatreasonabletimesforthepurposesofinspection,maintenance, orrepair,andtoshowthepremisestobuyersorprospectivetenants.Inallinstances,exceptthose ofemergencyorabandonment,theLandlordshallgiveTenantreasonablenotice(atleastoneday) priortosuchentry. 3. Tenantagreestooccupythepremisesandshallkeepthesameingoodcondition,reasonablewear andtearexcepted,andshallnotmakeanyalterationsthereonwithoutthewrittenconsentofthe Landlord. 4 Tenantfurtheragreesnottomaintainapublicnuisanceandnottoconductbusinessorcommercial activitiesonthepremises. 5. Tenantshall,uponterminationofthisAgreement,vacateandreturndwellinginthesamecondition thatitwasreceived,lessreasonablewearandtear,andotherdamagesbeyondtheTenantscontrol. N.B.ABANDONMENT:ItshallbedeemedareasonablebeliefbytheLANDLORDthatanabandonment ofthepremiseshasoccurredwheretheTENANT,hasbeenabsentfromtheunitfor14consecutive days. 6.SECURITYDEPOSITS:TENANTshalldepositwithlandlordthesumof$_____________asasecurity deposittosecureTENANT'Sfaithfulperformanceofthetermsofthislease.Thesecuritydepositshall notexceedtwotimesthemonthlyrent.AfteralltheTENANTShavevacated,leavingthepremises vacant,theLANDLORDmayusethesecuritydepositforthecleaningofthepremises,anyunusual wearandteartothepremisesorcommonareas,andanyrentorotheramountsowedpursuantto theleaseagreementTENANTmaynotusesaiddepositforrentowedduringthetermofthe rent/leaseagreement.Within21daysoftheTENANTvacatingthepremises,LANDLORDshallfurnish TENANTawrittenstatementindicatinganyamountsdeductedfromthesecuritydepositand returningthebalancetotheTENANT.IfTENANTfailstofurnishaforwardingaddresstoLANDLORD, 3

thenLANDLORDshallsendsaidstatementandanysecuritydepositrefundtotheaddressgivenby thelesee. 7. INITIALPAYMENT:TENANTshallpaythefirstmonthrentof$__________andthesecuritydeposit intheamountof$__________foratotalof$____________.Saidpaymentshallbemadeinthe formofcashorcashier'scheckandisallduepriortooccupancy. 8. OCCUPANTS:Thepremisesshallnotbeoccupiedbyanypersonotherthanthosedesignatedabove asTENANTwiththeexceptionofthefollowingnamedpersons:______________________________ 9. SUBLETTINGORASSIGNING:TENANTagreesnottoassignorsubletthepremises,oranypart thereof,withoutfirstobtainingwrittenpermissionfromLANDLORD. IfLANDLORD,withwrittenconsent,allowsforadditionalpersonstooccupythepremises,therent shallbeincreasedby$xxxforeachsuchperson.Anypersonstaying14dayscumulativeorlonger, withouttheLANDLORD'Swrittenconsentshallbeconsideredasoccupyingthepremisesinviolation ofthisagreement. 10.CONDITIONOFPREMISES:TENANTacknowledgesthatthepremiseshavebeeninspected.Tenant acknowledgesthatsaidpremiseshavebeencleanedandallitems,fixtures,appliances,and appurtenancesareincompleteworkingorder.TENANTpromisestokeepthepremisesinaneatand sanitaryconditionandproperlyuseandmaintainallelectrical,gas,heating,plumbingandother appliancesprovidedbythelandlord,andtoimmediatelyreimburselandlordforanysumsnecessary torepairanyitem,fixtureorappurtenancethatneededserviceduetoTENANT'S,orTENANT'S invitee,misuseornegligence. 11.TENANTshallberesponsibleforthecleaningorrepairtoanyplumbingfixturewhereastoppagehas occurred.TENANTshallalsoberesponsibleforrepairorreplacementofthegarbagedisposal(if applicable)wherethecausehasbeenaresultofbones,grease,pits,oranyotheritemwhich normallycausesblockageofthemechanism.Thetenantwillfurthernotcauseintentionalor carelessdamagetothedwelling. 12.Further,TENANTshallnotdoorkeepanythinginoraboutthepremisesthatwillobstructthepublic spacesavailabletootherresidents.Loungingorunnecessaryloiteringonthesteps,publicbalconies orthecommonhallwaysthatinterferewiththeconvenienceofotherresidentsisprohibited. 13.LANDLORD'SRIGHTOFENTRY:LANDLORDmayenterandinspectthepremisesduringnormal businesshoursanduponreasonableadvancenoticeofatleast24hourstoTENANT.LANDLORDis permittedtomakeallalterations,repairsandmaintenancethatinLANDLORD'Sjudgmentis necessarytoperform.IftheworkperformedrequiresthatTENANTtemporarilyvacatetheunit, thenTENANTshallvacateforthistemporaryperioduponbeingserveda7daysnoticeby LANDLORD.TENANTagreesthatinsucheventthatTENANTwillbesolelycompensatedbya correspondingreductioninrentforthosemanydaysthatTENANTwastemporarilydisplaced. 14.Thelandlordwillprovideadequatelocksandkeys 4

15.Thelandlordisnotresponsibleforthecostofcorrectingproblemswhicharecausedbythetenant. 16.Thelandlordwillkeepcommonareassuchaslobbiesstairwaysandhallsreasonablycleanandfree fromhazards. 16.ALTERATIONS:TENANTshallnotmakeanyalterationstothepremises,includingbutnotlimitedto installingaerials,lightingfixtures,dishwashers,washingmachines,dryersorotheritemswithout firstobtainingwrittenpermissionfromLANDLORD.TENANTshallnotchangeorinstalllocks,paint, orwallpapersaidpremiseswithoutLANDLORD'Spriorwrittenconsent;TENANTshallnotplace placards,signs,orotherexhibitsinawindoworanyotherplacewheretheycanbeviewedby otherresidentsorbythegeneralpublic. 17.INSURANCE:TENANTmaymaintainapersonalpropertyinsurancepolicytocoveranylosses sustainedtoTENANT'Spersonalpropertyorvehicle.ItisacknowledgedthatLANDLORDdoesnot maintainthisinsurancetocoverpersonalpropertydamageorlosscausedbyfire,theft,rain, wateroverflow/leakage,actsofGOD,and/oranyothercauses. 18.LATECHARGE/BADCHEQUES:Alatechargeof6%ofthecurrentrentalamountshallbeincurredif rentisnotpaidwhendue. Ifrentisnotpaidwhendueandlandlordissuesa'NoticeToPayRentOrQuit',TENANTmusttender cashorcashier'schequeonly.IfTENANTtendersacheque,whichisdishonoredbyabanking institution,thenTENANTshallonlytendercashorcashier'schequeforallfuturepayments.This shallcontinueuntilsuchtimeaswrittenconsentisobtainedfromLANDLORD.Inaddition,TENANT shallbeliableinthesumof$xxxforeachchequethatisreturnedtoLANDLORDbecausethecheque hasbeendishonored. 19.PERSONALPROPERTYOFTENANT:OnceTENANTvacatesthepremises,allpersonalpropertyleftin theunitshallbestoredbytheLANDLORDfor14days.Ifwithinthattimeperiod,TENANTdoesnot claimsaidproperty,LANDLORDmaydisposeofsaiditemsinanymannerLANDLORDchooses.
Landlord's Access to the Rental Property The landlord must give the tenant at least a two-day notice of intent to enter the property at reasonable times. The law states, however, that tenants must not unreasonably refuse to allow the landlord to enter the rented property when the landlord has given at least one day's notice of intent to enter at a specified time to show the dwelling to prospective or actual buyers or tenants. Tenants also must not unreasonably refuse the landlord access to repair, improve, or service the dwelling. In case of emergency, the landlord can enter without notice. Despite what you may hear from trusted and well-meaning advisers, you may not withhold your rent payments until the landlord makes repairs. You can be evicted for doing this. If you are having problems, contact the landlord. You also have the option to leave the premises.
