The Big Flea Superstore (BFSS) strives to maintain a clean and attractive market. The rules and regulations are for the benefit of all dealers and will be enforced. All dealers will be immediately notified of any changes or additions to these rules. Unless you have written permission from the management, then you are expected to follow all these rules. BUSINESS HOURS Business hours are strictly enforced. Our advertised time of operations is from 8:00 AM to 5:00 PM. All interior dealers are required to open their spaces promptly by 9:00 AM. Failure to open on time or close early will result in a $10.00 fine per occurrence and may result in revocation of your vending privileges. Dealers must remain open until the announced closing at 5:00 PM. You must vacate the building by 5:30 PM. DEALER SETUP (INTERIOR) Setup hours for new dealers and dealer day for existing vendors is every Thursday from 10 AM to 6 PM. No exceptions. This insures security for the dealers merchandise left during the week. Every dealer must sign in and out during the setup and they are required to stay within their designated area. Dealers must conduct business in a way that does not interfere with the quiet enjoyment of the shoppers and neighboring vendors. Excessive noise and odors are not allowed. All dealers children must be supervised at all times. Dealers must conduct themselves in a professional manner at all times between themselves and customers of BFSS. All interior vendors are required to notify BFSS two weeks in advance before vacating their rental space. Failure to give notice may result in you being responsible for additional rent. All interior and exterior dealers vacating their space are required to do so by the close of the business day on Sunday. Failure to do so will result in the dealer being charged for one additional weekend rental. Exterior spaces that have been reserved will be held to 8:00 AM, at that time spaces will be rented to the next dealer unless prior arrangements have been made with the management. RESERVATIONS Reservation for space rental must be made in advance. No refunds will be issued. Without exception all rent must be paid in advance of the days business. If you are leaving any merchandise or reserving apace for the following week, your rent must be paid on the Sunday proceeding that week. Absolutely no sub-leasing permitted. Sale of your business is permitted but buyer must be approved by management. If buyer is approved by management BFSS reserves the right to relocate you or reduce the number of booths. PARKING Dealers are required to park in the designated parking area. Under no circumstance will any dealer park in front of the building or in the main parking lot. All handicapped spaces are reserved for our customers only. Handicapped vendors will be assigned parking spots on the Ann & Hope side of the building at the dealers entrance. License plates must be on file in our office along with a copy of your handicapped permit. The dealer door will be open from 6:30 AM to 9:00 AM and will reopen at 5:00 PM for exiting. LEIN FOR UNPAID RENT Dealer hereby agrees that BFSS shall have a lien on any of the dealers merchandise left in the dealers space for any unpaid rent or other obligation of the dealer to BFSS. In order to satisfy a lien after seven (7) days notice has been given, dealer hereby authorizes BFSS to sell dealers merchandise left in dealers space at public of private sale without any further notice to dealer. BFSS will apply the proceeds of the sale of said merchandise to the expense of the sale, the dealers obligation for rent and the excess, if any, to the dealer. PAYMENTS Rental space payment may be paid by cash, check, money order or credit card. There will be a $35.00 fee charged for all returned checks, In the event of a returned check, all future rent must be paid in cash. If a vendors merchandise occupies a rental space in our interior rental space, dealers will be required to pay rental for space no matter whether the dealer is present in the space or not, including closing of BFSS due to bad weather. LICENSE AND TAXES State law requires that we obtain a sales tax permit from all of our dealers; a valid copy must be on file with your application. If you do not have a sales tax number we can provide you with a 30 day Rhode Island Flea Market Vendors Permit at the cost of $10.00. Dealers will not be allowed to open for business until they have furnished us a copy. Dealers must comply with all applicable state and federal laws. No alcoholic beverages permitted on the property. This will be strictly enforced. Anyone failing to adhere to said rule will be asked to leave the property immediately. The BFSS is a SMOKE FREE ENVIROMENT, therefore smoking in not allowed inside the facility. You are not permitted to smoke in the main entrance. A designated smoking area will be clearly marked. MERCHANDISE The selling or any reproduced licensed merchandise without valid written permission from the owner of the product is strictly prohibited on this property. Any products that are copyrighted or have a registered trade mark shall not be copied or reproduced for sale at the BFSS. Reproductions and distribution of any copyrighted material including CDs or cassette tapes without authorization of the copyright owner is strictly prohibited.

All merchandise being sold by the dealer must be listed. Any changes must have the written approval by the management. The sale of any alcoholic beverages and/or fireworks or flammable products is strictly prohibited. Management reserves the right to restrict the sale, display or distribution of pornographic or any other objectionable printed material, photographs, films, books, magazines, ect. The sale of firearms of any kind is prohibited. No soliciting, walking sales, hawking, free giveaways, drawings, surveys, petitions, political advertisement or raffles are allowed without the express written permission of the management. No animals may be sold or given away on the property. Restricted items are but not limited to the sales of food, candy, tobacco, lottery tickets and all beverages. You may not sell curtains of any kind. RISK AND LOSS OF INSURANCE BFSS must have unrestricted access to all booths with breaker boxes, air-conditioning and heating or overhead lights No Exceptions. A $100.00 service fee will be charged when walls must be removed to expand or reduce the number of booths. Only our maintenance crew will be permitted to do this work. Dealers merchandise is to be sold and displayed within rental space area. NO MERCHANDISE WILL BE DISPLAYED BEYOND THE END OF THE SIDE WALLS. Any dealer desiring not to have their photo, booth photo, or merchandise photo, displayed on television, the internet or any other type of advertisement must advise BFSS by written notice to keep on file stating you do not wish to be part of any advertisement. REMODELING No remodeling or electrical work is to be done without prior approval of the management. All partitions, walls, countertops, lighting or building improvements, ectthat are attached to the building shall be considered as lease hold improvements and become the property of BFSS when rental space is terminated. No holes will be permitted in the floor. Wall height shall not exceed 7 (seven) feet. All remodeling shall be done with screws, no nails. No solid-tops may be erected on any booths. ELECTRICITY Outlets are available for most interior rental spaces; excessive use of extension cords will not be permitted. Only heavy duty cords are allowed. The cost of plugging anything into our electricity will be charged at $5.00 per weekend. Dealers connecting to building electricity for any use whatsoever without paying for the privilege in advanced will be accessed a $20.00 penalty. Dealers requiring large amounts of electricity will be charged accordingly. No coffee pots, heaters, televisions, small appliances or fans without permission without management approval. Each dealer is restricted to 300 watts. NO HEATERS OF ANY TYPE PERMITTED. All lights must be turned off every night. Anyone in violation of these rules will be fined $20.00 per day. TRASH Trash must be disposed of in trash containers provided; boxes must be broken down, separated from trash and placed in the dumpster. Failure to dispose of trash properly will result in a $20.00 service fee. Trash barrels are for customers only. Dealers may dispose of their small trash lunch bags, cups, Kleenex, ect. in the trash barrel. But ABSOLUTELY NO BOXES. INDEMNFICATION Each dealer will indemnify and hold harmless, The Big Flea Superstore Flea Market, J.M.P. Promotions LLC and the Ann & Hope Inc. from any claimed loss or injury suffered as a direct result of the dealers merchandise of the dealers actions This indemnification shall include all attorneys fees, court costs and other expenses related to defending any claim, cause of action. Further the dealer will indemnify and hold harmless The Big Flea Superstore Flea Market, J.M.P. Promotions LLC and the Ann & Hope Inc. its employees, shareholders, agents, officers affiliates and directors from any civil liability to any person, corporation, company or other individual entity from any damage that may occur as a result of the Dealers use of occupancy of a rental space or the personal actions of the dealer while on the BFSS premises. Any failure of any dealer to comply in any respect with the rules and requirements of this provision, as written or as modified, shall subject the dealer to the indemnification provisions to the benefit of the Big Flea Superstore Flea Market. BFSS, J.M.P Promotions LLC, Ann & Hope Inc. its employees, owners, investors, management, shareholders, affiliates and agents assume no responsibility for any dealer merchandise left in the building at any time. Dealer understands that its occupancy is expressly subject to the lease between JMP Productions and Ann & Hope, Inc. as the same may be amended, and rules and regulations adopted in connection with the lease. I hereby certify and acknowledge that: I have read and fully understand the terms and conditions of this agreement and management disclaimer. I hereby agree to abide and adhere to all the terms, conditions, rules and regulations herein.
