    LICENSEFORORGANICAGRICULTUREUSEOFTHEMONTVIEW CONSERVATIONAREA WHEREAS,TheConservationCommissionoftheCityofNorthamptonwishesto maintainthesoilfertilityofthelandunderitscustody,keepthelandopenfor recreationaluse,encouragewildlifehabitat,preserveopenspacesandvistasand supportagricultureandorganicfarming, NOWTHEREFOREtheCommissiongrantsthisLICENSEtoMollyMerrett,Lisa DePianoandPaigeBridgens(withoutrightofassignmentorsubstitution)toallow thelicenseestopracticeorganicfarminginamannercongruentwithproperuseof theCityofNorthamptonConservationLand. 1.ThepremisesaretheConservationLandonMontviewAvenueatassessorsmap ID32C352thatflanksthepropertyofDoraLewisandJamesNashandabutsthe propertyofBenJamesandOonaCoyandanaccessroad.Itcontainsasoccerfield andwetland,andconsistsof3.2acres. 2.

    TheLICENSEshallcommenceimmediatelyandterminateDecember31, 2012. 3.TheLicenseesshallpaytheCommissiontheequivalentofonehundred dollarsperacreperyearinsweatequity,whichmayconsistofstewardingthe land,hostingeducationaleventsforthecitiesresidents,mowingasnecessaryand maintainingpathsforfarmandpublicuse. 4TheLicenseesshallusethepremisesonlyforthepurposesofoperatingan organicfarmandrelatedactivates,suchaseducationaleventsrelatedtothe farm.TheLicenseesmayirrigate,cultivate,plantandotherwisefarmforthat purposeonlyinaccordancewiththeSoilConservationPlanapprovedbythe USDANaturalResourcesConservationServices,withsuchamendmentsasare approvedbytheUSDANaturalResourcesConservationServices,withsuch amendmentsasareapprovedbytheNRCSandtheNorthamptonConservation Commission.Saidplanisincorporatedintothisagreementbyreference. 5.TheLicenseesshallhonortheNeighborhoodAgreementdraftedjointlyby Licenseesandneighborsandattachedhereto. 6.TheLicenseeswillerectnopermanentstructuresandwillstorenofarming equipmentonthepremises,exceptduringthegrowingseason.TheLicenseeswill notdamagetheproperty. 7.Thepublicshallhaveaccesstothepremises,exceptasnecessarytoprevent damagetocropsandequipment. 8.ThelicenseesagreetoforeverreleaseandholdharmlesstheCityof Northampton,theirofficers,employeesandagents,fromanyactions,claims, damagesandliabilitieswhatsoever,faranydamagesorliabilityresultingfrom

    propertydamageorpersonalinjurywhichtheLicensees,theiragentsoremployees orvolunteersmaysustainonthepropertyduringthelifeofthislicenseandfrom anyliabilitywhichmaybeallegedbyathirdpartywhichariseoutoforonaccount oftheLicenseesactivatesontheproperty.TheLicenseesagreetoindemnifytheCity ofNorthamptonforanylossordamageincurredbytheCityofNorthamptonofthe agreementoranyactivityunderit. 9.Anescrowaccountshallbeestablishedintheamountof$300.00tobeusedby theNorthamptonConservationCommissionifthisLeaseisterminatedforany reasonandthepropertyneedstobeimproveduponofrestored.Otherwise,the Licenseesagreetoplantnativegrassesandleavethelandasitappearedpriorto theirchanges.TheLicenseesagreethatanytreesorshrubsleftonthelandbecome thepropertyoftheCity.
