General Terms and Conditions of Business of MuseMaps, Dutch Chamber of Commerce (KvK) number: 54425956 1 Scope (1) The

following General Terms and Conditions are an integral part of any contract between MuseMaps and the customer (hereinafter: Customer) and their respective legal successors. (2) MuseMaps renders services and delivers goods exclusively on the basis of its General Terms and Conditions. 2 Contract / Performances (1) The presentation of performances in particular in brochures, advertisements and on the internet does not constitute a binding offer by MuseMaps. (2) A contract is not concluded until confirmed in writing by MuseMaps or until MuseMaps has begun processing the order. Subsidiary agreements, changes and supplements are not valid until confirmed in writing by MuseMaps. (3) MuseMaps reserves the right to refuse customer orders in individual cases. Customer orders may be refused in particular if the order deviates from the conditions posted by MuseMaps, or if the customer is known to have a bad credit rating. (4) Orders and delivery addresses outside of Austria, France, Germany, Italy, The Netherlands, United Kingdom can be accepted, but different shipping cost apply. If the customer already paid but MuseMaps cannot ship to the specified location, any payments already made will be refunded, or credited to customer's credit card account. For more information about shipping elsewhere, please contact us using the contact form. 3 Copyright (1) MuseMaps owns the copyright to the images offered on its internet site. The data on which the maps are created are subject to terms of use as specified by NASA and British Oceanographic Data Centre. (2) The products sold may thus as such be used by the customer for private purposes only without time restriction and worldwide. Commercial re-selling in particular, but also any kind of reproduction, dissemination, publication, modification and processing of the product is forbidden. 4 Delivery, delivery period (1) Delivery will be handled by MuseMaps' partner company, except where a written agreement to the contrary exists. (2) Partial deliveries are permitted and shall be deemed independent deliveries, except in cases where customer cannot be reasonably expected to accept partial delivery. Customer will not be invoiced for the additional cost of partial delivery. (3) MuseMaps always strives to keep deadlines it quotes. Should MuseMaps be in default, customer can withdraw from the contract based on the following provisions. (4) The duration of the period of grace to be granted to MuseMaps is hereby defined as two weeks. The period shall commence upon receipt of customers notice of default by MuseMaps. The above shall not apply, in cases where customer cannot reasonably be expected to accept a delay in delivery, in cases of transactions with fixed deadlines, or the customers interest on granting a period of grace is abrogated by compelling, legally permissible reasons. (5) In case of impairments in delivery beyond the control of MuseMaps (in particular due to force majeure) and which were not negligently caused by MuseMaps, MuseMaps is entitled to withdraw from the contract, providing that the impairment to performance is not of a temporary nature, without being liable to provide compensation. During the period of impairment, MuseMaps shall not be deemed in default. The purchase price paid will be refunded should MuseMaps withdraw from the contract. (6) Orders and services will only be processed and rendered by MuseMaps if the customer is not

arrears from other contracts. Payments will be credited against outstanding accounts, interest and costs first, in the temporal order of their due dates. (7) If upon delivery the product is not in accordance with the specifications (e.g. size, material, selected map) of the order as placed by the customer and received by MuseMaps, MuseMaps has the right and obligation to provide the customer with the correct product. The customer should notify MuseMaps within one week after receiving the product about the inconsistencies including a photograph of the received product. This also applies to defects to the product noticeable at the time of delivery. 5 Terms of payment (1) The purchasing price is due immediately on conclusion of contract and will be debited from customer's account in advance. Direct debit transactions or debit entries against credit cards will be effected on completion of the order. (2) Prices are quoted including Dutch VAT (BTW) at current rates, and apply to orders from Austria, France, Germany, Italy, The Netherlands, The United Kingdom. MuseMaps charges the VAT based on Dutch taxes (19% BTW). This is applicable to virtually all clients in the EU. If the customer buys the product for its company and the customer is based inside the EU but outside The Netherlands and has a company VAT number, 0% VAT is applicable. Only if this is the case, please contact us with the VAT number and product list. (3) Customer is entitled to pay by credit card or direct debit. (4) Should customer fail to settle, and in particular reverse an effected payment, or should circumstances come to the attention of MuseMaps that question customer's creditworthiness, MuseMaps is entitled to demand immediate payment of all outstanding amounts. (5) In case of returned debit notes in direct debit transactions, or reversed credit card transactions, MuseMaps reserves the right to charge a reasonable handling fee in each case, except in cases where the customer is not responsible for the returned debit note or reversed credit card transaction. (6) All shipping costs shall be borne by customer. All prices and surcharges are billed by MuseMaps in line with the price lists valid at point in time of provision and handover to shipment. (7) Should MuseMaps be billed for additional shipping costs due to customer quoting an incorrect delivery address, or an incorrect addressee, said costs are to be borne by customer, except where customer is not liable for the incorrect statements. 6 Retention of ownership (1) Until all accounts have been settled, MuseMaps reserves right of ownership on any goods delivered. (2) Should the customer be in default of payment of the purchasing price, MuseMaps reserves the right to repossess the items subject to retention of ownership after issuing a reminder and after the period of grace stated in the reminder has elapsed. This assertion of retention of ownership and the repossession or distraint of the goods by MuseMaps shall not be deemed as a withdrawal from the contract, except in cases where compelling legal reasons, in particular the provisions governing consumer credit mandate the contrary. 7 Warranty / Passing of risk (1) Information, drawings, figures, technical data, weights, measures and descriptions of features published in brochures, catalogues, circular letters, advertisements or price lists are for information purposes only. MuseMaps accepts no liability for the accuracy of these details. The type and scope of delivery are subject only to the details specified in the order and confirmation of order. (2) No guarantee is given against fading or for the waterproofing capability of printed products, except in cases where a written guarantee to the contrary is issued (e.g. UV coated printing process or lamination). MuseMaps points out that printed products are designed for use in closed rooms. Any use outdoors is at the customer's own risk. (3) The designations and specifications laid down on conclusion of the contract represent the state

of the image at that time. Minor technical deviations (especially with respect to cropping and colour of the print) of the goods delivered compared to the goods advertised are permissible and do not represent a defect as long as they are typical for the industry and do not impede the contractually agreed purpose. Cropped images may differ slightly, but not significantly, from the specified size as is typical for images in stock frames. Minor differences in printed colors that are typical for the industry may occur if the customers display is not calibrated to represent true colors. Black / white prints contain a minor color tint that is typical for the industry due to color printing processes. Complaints, credit notes and replacement prints based on these claims are excluded, except where deviations are above and beyond the norm for the industry. (4) The limitation period for claims against warranty for defects is 24 months. If the customer is a business owner, the period is 12 months. (5) For business owners, the legal provisions, duty to inspect and duty to claim apply in line with Dutch Commercial Code (Wetboek van Koophandel). 8 Limited warranty (1) MuseMaps shall be liable only for damage caused by deliberate act or gross negligence. MuseMaps is not responsible for any damage caused directly or indirectly by the use, movement or placement of the product, including but not limited to use of materials and hanging. All waivers of liability apply also to immediate consequential damage such as lost profits. (2) MuseMaps is not liable towards consumers for any damage or injury caused directly or indirectly by the use, movement or placement of the product, including but not limited to use of materials and hanging. (4) The liability limitations in paragraphs 1 to 3 applies in kind in favor of the staff and agents of MuseMaps. 9 Right of revocation and instructions 9.1. Right of revocation Any customer has the right to revoke his / her contractual statement within 2 weeks of receiving the product in writing (e.g. letter, e-mail) including a photograph of the product to MuseMaps followed by returning the goods. The product is to be sent to MuseMaps (or other locations as instructed by MuseMaps) within two weeks. The respective revocation period commences at the moment the customer receives the respective product. In order to observe the revocation period, you must give notice of revocation within the two week revocation period. Please address notice of revocation to MuseMaps via the contact form. You are not entitled the right of revocation in case of deliveries manufactured to your specifications, or obviously customized to meet your personal requirements, or whose characteristics make them unsuitable for returning. The right of revocation is not applicable if the product is damaged by the customer. 9.2. Consequences of revocation In case of valid revocation, all payments received by MuseMaps shall be redeemed to the customer, except for shipping costs. Obligations to refund payments must be fulfilled within 30 days. This period commences on the date of receipt of the return product by MuseMaps. It the responsibility of the customer to ensure proper return of the product, including but not limited to packaging and shipping, in case of revocation. All direct associated costs of returning the product are paid by the customer, if the product provided was as ordered. If you are unable to return the product provided in full or in part, or only in impaired state, you may be obliged to provide compensation for lost value. You can avoid being held liable to provide compensation for lost value in case of orderly use of an

item, by not using the item as if it were your own property and avoiding any actions that could impair the item's value. 10 Privacy Statement (1) MuseMaps uses the data supplied by the user (e.g. salutation, name, address, email address, telephone number, fax number, bank account, credit card data) with extreme care. (2) Customer's personal data are used exclusively for processing contracts concluded between the two parties, such as for billing purposes. If the customer has subscribed to the newsletter, the customer gives MuseMaps the permission to contact the customer with advertisements regarding MuseMaps' products. (3) No personal data supplied by the customer to MuseMaps will be disclosed to third parties, except in cases where this is inevitable due to legal order, or order from authorities. (4) This website uses various web analysis services like Google Analytics by Google Inc. ("Google"). Google Analytics uses "Cookies", text files that are stored on your computer and to support analysis of your use of this website. The information generated by your use of this website (including your IP address) is sent to a Google server in the USA and stored there. Google will section this information to evaluate your use of this website, to generate reports on website activities for the website operators, and to provide further services related to the use of the website and the internet. Google may pass on this information to third parties, if required to do so by law, or if these third parties process data as Google's agents. You can prevent cookies being installed by configuring your browser software to refuse them; in this case, please note that some features offered by this website may not be fully usable. In using this website you express your agreement with Google processing the acquired data in the manner and for the purpose described above. (5) In case of advance performance, we may check your credit rating with official creditworthiness registration companies like the Dutch company Bureau Krediet Registratie.Your privacy will be respected in line with legal requirements.
