Narrative
On 01/28/2012 at approximately 0319 hours I, Officer DeBough, responded to 1651 Broadway (Alfalfa's Market Grocery), in reference to a motion alarm originating from the west entry door of the business. Upon arrival, I checked several perimeter doors and discovered an unsecured door on the southwest corner of the building. I could hear an audible alarm emanating from inside the business. I requested that additional units respond to my location. Officers Benjamin Graff and Brent Curnow responded as cover units. Officer Graff, Curnow and I, announced ourselves as Boulder Police Officers and made entry into the building. I observed that all the lights were off inside the building and an audible alarm was sounding as we initiated our search of the store. We made our way into the Deli area of the store (located at the north east corner of the building). I searched behind the Deli counter as Officer Graff and Curnow held the main grocery area. As I rounded the corner, behind the Deli counter (approximately 3 feet in height), I observed a male (later identified as Anthony Nathaniel Tornowski) dressed in a dark blue jacket and dark jeans, attempted to hide behind a steel storage container. responded by lifting both hands into the air and lying down on his back. Officer Curnow and Graff secured Tornowski's arms while I placed him into handcuffs. Officer Curnow asked Tornowski if he was alone; Tornowski stated that his friend "Jeff" was inside the store. Officer Graff requested that additional units respond and immediately set a perimeter around the building. Officer Graff requested that a Boulder County K-9 Unit respond to the scene to assist with searching the remainder of the store. The Boulder County K-9 Unit responded and conducted a search of the store; No other suspects were located. All other doors to the business were found locked and secured and appeared undamaged. Upon inspection, the southwest door (point of entry) appeared undamaged and functional. It appeared that the door was unsecured when entry was made as one of the locking mechanisms was disengaged. I escorted Tornowski to Officer Melanie Patterson's patrol vehicle. Officer Patterson transported Tornowski to the Boulder County Jail; He was cooperative during transport. Officer Graff requested that a reporting party responsible for the store respond to the scene. The store Manager (identified as Michael Dallas Pederson) responded to the scene and spoke with Officer Graff and Curnow. I responded to the jail to speak with Tornowski. At approximately 0458 hours, I read Tornowski his Miranda Advisement from a printed copy I carry with me. Tornowski stated that he understood his rights and refused to speak with me and stated, "This isn't good. I think I should call my lawyer." Note: I observed that Tornowski's eyes were red watery and glassy. I detected the distinct odor of an alcoholic beverage emanating from his breath as he spoke. I spoke with Officer Graff via telephone after he completed a walk through of the store with Pederson. Officer Graff told me the following: During the walk through, the manager (Pederson) observed several food items scattered about the store, specifically in the Deli area where Tornowski was located. It appeared that someone had eaten several food items from the deli display including approximately eight tubs of freshly prepared consumable goods. The consumable items included sushi, muffins, potato salad, roasted chicken, etc. Pederson told Officer Graff that all eight tubs would have to be destroyed as they were not suitable to serve and were subsequently destroyed by the suspect(s). Pederson estimated that approximately $1000.00 in consumable items had been destroyed and/or eaten. Pederson told Officer Graff that video footage may exist but that the footage was not accessible until a technician could access the security system. Officer Graff provided Pederson with a written voluntary statement which will be completed today and picked up later once a complete and accurate list of eaten and destroyed items can be documented. Pederson stated that he wanted to pursue charges. Officer Graff gave Pederson my business card with a case number. Status: Cleared, with an adult arrest Note: Tornowski has a shoplifting and larceny conviction (07/10/2004) out of Aurora, Colorado.

On 01/28/2012 at approximately 2100 hours Officer Benjamin Graff, responded to 1651 Broadway (Alfalfa's Market) to collect a CD-RW containing video evidence and a voluntary written statement. At approximately 2115 hours, Officer Graff returned to the Boulder Police Department (1805 33rd Street) and transferred custody of the CD-RW containing video evidence to me. I reviewed the CD-RW video footage and observed the following. The CD contains approximately 14 still photographs taken from various security cameras inside Alafalfa's Market. The photographs document the suspect (Tornowski) inside the building in various rooms and hallways. The first photograph is dated 01/28/2012 at 0315 hours and the last photograph is dated 01/28/2012 at 0333 hours. At approximately 2215 hours, I placed the CD-RW containing the video evidence into property and evidence at the Boulder Police Department. Status: Unchanged, property report only.
