CONTRACT OF TEMPORARY EMPLOYMENT


BETWEEN:

PREMIER ATTRACTION 29 CC t/a ICON CIVIL & BUILDING


OF

(Here after referred to as "THE EMPLOYER")

(Here after referred to as "THE EMPLOYEE")

The parties hereby agree that the Employer will employ the Employee subject to the following conditions:

1) COMMENCEMENT DATE
2) Contract

(a) This contract will commence on_______________ and will be looked at after the 3
months probation period is over on the 15th December 2011. (b) The termination of this agreement will not give rise to any expectation of permanent appointment or of a temporary renewal of the contract. (c) The employer reserves the right to prematurely terminate this contract in accordance with the notice periods set out in clause 15 and the statutory procedures in the case of conduct, incapacity, or the employers operational requirements. (d) The employer shall pay an hourly rate of R ..as stipulated by the Department of Labour.

3) HOURS OF WORK, OVERTIME AND SHORTTIME a) The employee shall work 45 (fourty-five) hours per week, according to the work schedule determined by the employer from time to time. The employee can be expected to work on Saturdays in case of emergency and when requested by the employer with the provision that reasonable notice must be given in advance.

b) The employee shall be entitled to a meal interval of 30 (thirty) minutes after 5 (five) hours of work, unless the employee works for fewer than 6 (six) hours on a day. The employee will not be remunerated during the meal interval, unless the employee is required to work during the meal interval to perform duties that cannot be left unattended and cannot be performed by another employee c) The employee agrees to work such overtime if the nature of the business requires such overtime work and if so as may be required by the employer on reasonable notice. Time worked in excess of normal working hours and exceeding 45 (fourty five) hours shall be deemed to be overtime only if the employee were required by the employer to work such overtime.

4) PUBLIC HOLIDAYS a) The employee shall be entitled to the following paid public holidays: (a) New Years Day, Human Rights Day, Good Friday, Family Day, Freedom Day, Worker's Day, Youth Day, National Women's Day, Heritage Day, Day of Reconciliation, Christmas Day, Day of Goodwill or any other day so declared in terms of the Public Holidays Act. 5) TERMINATION OF CONTRACT

a) If the employer, intends to terminate this contract, the relevant party shall give the other party notice in
writing. Workers and the CLO will not be permitted to work under conditions and will immediately be dismissed : Undisciplined or unruly behaviour; Insubordination to Team Leader, Supervisors of Management; Abuse of intoxicating substances; Criminal actions by the employee Strike action of political stay ways; Willful or negligent damage to or loss of machines or equipment The Contractor shall ensure that he has statements from at least two witnesses concerning any of the above situations. The Contractor shall inform the Forum within 24hours of any warning issued. The

Forum has undertaken to review such issues within 5 days. i) One week, if the employee has been employed for four weeks or less,

DESERTION i) An employee shall be regarded as having deserted from his/her employers service after a continuous absence of five working days without notification to his/her employer of his/her whereabouts, provided that:

b) The employer attempts to contact the employee in writing at the last-known address supplied by the employee, informing the employee of his/her absence c) The employer has the right to withhold any monies due to the employee, should the employee not adhere to the terminations clause 5

7) CLOTHING, EQUIPMENT AND TOOLS a) Should the employer issue the employee with any clothing, equipment or tools for the purpose of the employee's work, such items shall at all time remain the property of the employer.

8) GENERAL All rules and policies announced from time to time by the employer will form an integral part of this agreement.
