1.0 CONTRACTING STRATEGY 1.

1 LIST OF BIDDERS Since the nature of works involved is mostly builders work related, it is recommended that bidders who are to be invited for the tender are Builders Work contractors. The list of bidders proposed is derived from the following sources: 1. DRH1 2. Consultants Please refer to attachment 3 for the full list of id contractors. Based on the estimated value of works, it is proposed that the selected bidders shall have CIDB registration certificate with minimum grade of g4, category b (in building construction) with accreditation for the relevant headings and subheads. Out of xx from the list of contractors above, only xx contractors meet the above initial criteria. The following are the short listed bidders proposed to be invited for the tender.

1.2 TYPE OF TENDER It is proposed that a single contract package be adopted based on xxxx standard conditions of contract with a firm price lump sum where bills of quantities form part of the contract. No fluctuation in price/rates for labour, materials and equipment shall be allowed

DESIGN & DOCUMMENTATION STAGE

DESIGN OF BUILDINGS, SYSTEMS, ETC. FROM CONCEPT TO PRELIMINARY DESIGN UP TO TENDER STAGE INCLUDING CO-ORDINATION BETWEEN CONSULTANTS PREPARE SPECIFICATIONS ASSIST IN EVALUATION OF SUBMISSION PREPARE CONTRACT DOCUMENTS REVIEW, AUDIT AND ENSURE COMPLIANCE OF ALL DRAWINGS, SUBMITTALS, PROPOSALS AND ASBUILT DRAWINGS SUBMITTED BY CONTRACTOR IN ACCORDANCE TO THE CONTRACT DOCUMENTS COST AND CONTRACT MANAGEMENT WITNESS AND VERIFY ALL TESTING AND COMMISSIONING AND RECOMMEND FOR ACCEPTANCE SUPERVISION OF WORK ON SITE

PROVIDE PERFORMANCE GUARANTEES AND WARRANTIES ASSIST IN OBTAINING THE CERTIFICATE OF FITNESS FOR OCCUPATION

2.2

The following are the salient points of the ITB

2.2.1 Instruction to Tenderers (volume 1) y y Bidder shall mean an individual Malaysian company. Confidential information Bidder shall not disclose any information without prior written consent from the employer at any time. Documentation fees RM X00.00 per set payable to XXXXXXXXXXX sdn bhd (not refundable). Type of tender selective tendering based on XXXXXXX conditions of contract. Bid price currency Ringgit Malaysia (RM). Validity of tender 90 days from the tender closing date. Addenda Addenda shall be issued (if necessary) to clarify or modify the ITB documents prior to closing to tender. The last date of issuance of addenda (if any) will be seven (7) calendar days prior to closing of tender. Submission of tender Bidder shall submit in separate envelopes for: i) part 1 mandatory requirements; ii) part 2 technical proposals; and iii) part 3 commercial proposal Award of contract The Client reserves the right not to award to the lowest priced technically qualified tender or to any tender.

2.2.2 Requirement for mandatory criteria (Volume 4 / Part 1) y Tender bond (section a) Bidder shall provide a bank guarantee or bank draft (as per the format and wording contained in the ITB) issued by a bank licensed to operate in Malaysia (excluding off-shore Labuan banks) in the amount of ringgit Malaysia XXX thousand only. Statement of Compliance of Base Bender (Section B) Bidder shall submit signed statement of compliance of base tender in stipulated format. CIDB Registration (Section C) Bidder shall submit details and evidence of registration with the CIDB for minimum Grade 4 Building Works.

2.2.3 Detail Technical Information (Volume 4 / Part 2) y Evidence of sufficient funding for the project (Section D) The bidder shall submit evidence of sufficient funding that would be made available for the project of minimum RM XXX,000.00. List of similar project completed by bidder only (Section E.1) Bidder shall submit a list of projects of similar nature and complexity completed within the last 5 years. Financial Information (Section F.2) Bidder shall provide audited accounts for the last three (3) financial years. Letter of undertaking to provide bank guarantee for performance bond (section F.3) Bidder shall submit an undertaking letter to provide bank guarantee issued by a bank operating in Malaysia (excluding off-shore Labuan banks). Base Outline Tender Programme (Section G.1) Bidder is to base its conforming bid on a construction period of XX weeks. Outline Work Method Statement (Section G.2) Bidder shall submit the work method statement describing their plan of work i.e. coordination, supply and delivery constraints, logistics provision, construction phasing and workflow.

2.2.4 Requirements for Commercial Proposal (Volume 5) y Form of Tender Bidder shall submit a duly completed form of tender bearing bidders full legal name and registration address. Summary of Tender Sum Bidder shall submit a summary of tender sum which is a collection of total amount from the breakdown of tender sum. Schedule of Unit Rates Bidder shall submit a priced schedule of rates which comprises of the following: A. Labour Day work rates B. Plant/Machineries day work rates C. basic material rates D. unit rates These rates shall form the basis of payment for day works and variation of work in accordance with the condition of contract.

2.2.5 Conditions of Contract (Volume 1)  Form of Conditions of Contract Based on XXXXXXXXXXXX standard form of conditions of contract where bills of quantities form part of the contract. Performance Bond For 5% of the contract sum, to be unconditional and on demand and valid until the issuance of final certificate, in the form of bank guarantee. Payment to Contractor and Interim Certificates The Client will make payment within 30 days upon issuance of the interim certificate. Retention Sum Shall be 10% of the total work done and limit up to 5%. Half moiety of 2% shall be released upon issuance of Certificate of Practical completion and another 2% to be released upon final certificate. Defects After Completion The defects liability period is 12 months from the date of issuance of certificate of practical completion for the whole works. Completion of the works XX weeks from site possession.

Damages for Non-Completion Liquidated and Ascertained (LAD) for the non-completion shall be RMX,X00.00 per calendar day. There will be no capping of the amount of lad to be imposed.

Insurances The contractor shall procure or extend and maintain during the duration of the contract, the following insurance applicable to their operation:-

FOR FULL REPLACEMENT VALUE OF CONTRACTORS PLANTS / EQUIPMENT / ASSETS. NOT FORMING PERMANENT PART OF THE WORKS.

COMPREHENSIVE GENERAL LIABILITY AUTOMOTIVE LIABILITY

LIMIT OF RM x,000,000.00 FOR ANY ONE LOSS STATUTORY LIMIT IN ACCORDANCE WITH THE ROAD TRAFFIC ORDINANCE AS PER WORKMENS COMPENSATION ORDINANCE 1952 AND AMENDMENTS THERETO TO COVER ALL MATERIALS FROM THE RESPECTIVE WAREHOUSE AND/OR POINT OF SUPPLY/ MANUFACTURE UNTIL ARRIVAL AT SITE.
