Whereby the Technical Regulation applicable to braking systems or her components for vehicular or trailer use, that are imported or nationally made for their use or marketing in Colombia, is issued.
ARTICLE TITLE Scope ITEM COMMENTS

This technical regulation is applicable to brake systems and the following components of brake systems for use in motor vehicles or their public service as an individual both trailers, they circulate on roads public or private national territory: Brake fluid used in hydraulic braking systems. Hoses set up for the hydraulic brake system that use brake fluid that is not derived from petroleum Cylinder cups for hydraulic functioning Rubber seals for the cylinders of the hydraulic disc brake system Friction material for brake system (bands, blocks, and brake pads) Cast iron brake drums Master Cylinders for hydraulic brake systems Wheel cylinders for hydraulic brake systems of Drum brakes Cast iron brake discs

Application field

Conformity evaluation procedure

a) That the certificate is issued by a certification body accredited by the accreditation entity, for the purposes of certification here considered. Accredited certification body will issue the certificate of conformity with the regulation technical, supported on results of tests carried out in accredited to the accreditation body, or laboratory designated by the regulator to the tests defined in this regulation. For the purposes of conformity assessment, accredited certification body may rely on any inspection agency accredited by the accreditation body. Supplementary Provisions

In case that in Colombia there is not at least one (1) accredited lab, or appointed by the proper authority, to perform the required tests for the fulfillment of this Technical Regulation, said tests may be performed at labs evaluated under Standard NTC-ISO 17025 or laboratories belonging to the ILAC, subject to approval by the certification body accredited by the accreditation body for the purposes of certification here considered. If in Colombia there is not at least one (1) certification organism accredited by the Accreditation Entity to evaluate the conformity and certify the components object of this Technical Regulation, the Suppliers Declaration of Conformity SDC, undersigned according to the provision of this Technical Regulation, will be valid

The lab accredited by the Accreditation Entity must inform, by written form, within five (5) business days after the request to the accredited certification organism presented to the solicitor, be it because it cannot meet the demand or that due to any reason it is not possible to attend certain request to perform the requested tests for the fulfillment of this Technical Regulation. Said lab must include in the written communication issued, the date of technical availability to perform said tests, being responsible to the solicitors of the test service and to the State for the technical execution and opportunities.

In case that other labs accredited to comply with the request, the accredited certification organism or the solicitor must rely on said accredited labs if these cannot respond to the request in a prompt manner in relation to the communication of the first lab. 19 Technical Impossibility to perform tests In case that no other labs exist and proven the technical impossibility for any accredited lab in Colombia to perform the technical test contemplated in this Regulation in a prompt manner, the certification organism or accredited lab must issue a written proof to the solicitor, explaining the cause of said impossibility. The solicitor, manufacturer or importer may then prove the conformity with this Technical Regulation using the Suppliers Declaration of Conformity, undersigned pursuant to the provisions of this Technical Regulation, for which it must annex to said declaration a certificate issued by the accredited certification organism or lab certificate or certificates if several labs were contacted. The Suppliers Declaration of Conformity issued under conditions of technical impossibility for performance of the test required by the accredited lab or labs in Colombia will be valid only until the date in which, according to the information delivered by the lab(s) to the accredited certification organism or solicitor, it is possible to attend said request of the tests For the certificate referred to in literals a) and (b)) of article 17 of this resolution, the certification bodies accredited by the accreditation body shall use the elements and types of product certification systems referred to in the Guide technique Colombian GTC-ISO-IEC 67 or that in this field modifies, add or replace. Valid documents in accordance to the fulfillment of the technical regulation shall be as follows: 1 Certificate per lot. 2 Mark or seal of conformity for products covered by this technical regulation, while such seal or mark is in force under the terms of his expedition, regardless their quantity and frequency. 3 Type certificate, while maintaining the conditions and specifications of manufacturing. 4. Declaration of conformity of the supplier, for special cases as stipulated in the technical regulation. If trials are required for the purposes of compliance with this technical regulation, inspections or is required to perform sampling of braking systems or their components, these shall be made in accordance with the procedures established by the certification body accredited by the accreditation body for the purposes of certification here considered.

In the cases that a Suppliers Declaration of Conformity is presented, it will be the manufacturers in Colombia or the importers of the components subject to this Technical Regulation, who undersign it according to the requirements and formats established in Colombian Technical Regulation NTC/ISO/IEC 17050 (Parts 1 and 2). Transitional Arrangements

Those braking systems or their components that are nationalized in Colombian territory prior to the date of entry into force of this resolution, which have not been commercialized and are regarded as inventories, will have a period of three (3) years for marketing unless require it compliance with this technical regulation. The manufacturer in Colombia or importer must retain and submit to the competent supervisory authority of the documentary evidence required to show which is described in one of these schemes of transition.

Notification

Once this Resolution is issued and executed, it must be notified through the Contact Point to the countries member of the Andean Community, the World Trade Organization, the G3 and other countries with which Colombia has existing free trade with Colombia treaties in which this obligation has been included. Pursuant to what is established in Numeral 2.12 of the Agreement on Technical Barriers to Trade of the WTO and with Numeral 5 of Article 9 of Ruling 562 of the Commission of the Andean Community, this Resolution will be valid six (6) months after the date of its publication Starting from the publishing date of this Resolution, any contrary provisions are herby annulled, specially Resolution 1001 of April 23, 2010 and resolution 2872 of September 29, 2010
