Revised MARPOL Annex II

Convention : MARPOL Annex II NLS Flag :ALL FLAGS Ship type :Chemical Tankers Up dating 15/06/06 - Change in Tb. 1: new NLS certificate requested for Oil tankers certified to carry NSL I- FOREWORDS The revised MARPOL Annex II will enter into force on 1 January 2007. Chemicals have been reassessed and new four pollution category system developed to X, Y, Z and a category for Other Substances (OS). Most of those of the Annex II products, which so far have been carried by oil product tankers with NLS Certificates, will now need to be carried by Chemical Tankers holding a Certificate of Fitness issued under the revised requirements. Only the few products categorised as Other Substances (OS) may be carried without certificate. Revised MARPOL Annex II applies to all vessels irrespective of date of build or size carrying NLS cargoes as listed in IBC Code. II- NEW CERTIFICATION From 1 January 2007, new certificates should be issued as follow: Products category Chemicals IBC Ch. 17 Cat X, Y, Z Vegetable Oils IBC Ch. 17 Cat. Y Chemicals IBC Chapter 18 cat Z Chemicals IBC Ch. 18 Cat (OS) Liquefied Gases IGC Code MARPOL Annex II* *only if products under Marpol Annex II are carried Following vessels will also need a new certification: - Offshore support vessels certified in accordance with IMO Res. A 673(16) - Dry Cargo ships with deep tanks for vegetable oils certified in accordance with MEPC 148(54) Nb1. The revised requirements may not be used before 1 January 2007. Nb2. No certificate can be issued before the P&A Manual has been approved. Transitional arrangements On 1 January 2007, the chemical lists in force prior this date will cease to exist and certificates attached to their carriage requirements will be no longer valid. To ensure that vessels requiring certification under the revised MARPOL Annex II can continue to trade after 01/01/2007, the following transitional arrangements are to be followed, allowing for new certificates conforming to the revised MARPOL Annex II and the revised Chapters 17 & 18 of the IBC Code to be issued. Note that cargoes legally loaded before 1 January 2007 will be allowed to be carried to the unloading port with subsequent discharge of cargo residues under the old requirements.

III- P & A MANUAL From 1 January 2007, every ship certified to carry substances of Category X, Y or Z shall have on board an approved updated P&A Manual. The Manual shall have a standard format in compliance with appendix 4 of revised MARPOL Annex II. This format is attached here after for easy reference. If the language used is not English, French or Spanish, the text shall include a translation into one of these languages. Manuals are approved on a ship by ship basis. Special consideration could be given for sister ships provided the ships are strictly identical in all matters related to MARPOL Annex II and IBC Code. Previously used Table 1 with pollution related information is no longer to be included in the P&A Manual. Hard copies of the new P&A Manual with all mentioned drawings included should be submitted to Bureau Veritas for formal approval and stamping. Ensure that relevant number of copies is submitted, taking into account that 1 copy will be kept for BV Files and one originally stamped copy is required to be kept on board. IV- CARRIAGE OF VEGETABLE OILS (Reg. 4.1.3) Vegetable oils are, under the revised Annex II and IBC Code, required to be carried by chemical tankers in cargo tanks meeting Ship Type 2 requirements as Pollution Category Y substances. However, regulation 4.1.3 of MARPOL 73/78, Annex II (revised) provides some relaxation for individually identified vegetable oils from the carriage requirements under MARPOL 73/78, Annex II, Regulation 11 (revised). This would be contingent on the subject vessel being a Type 3 Chemical Tanker, and in full compliance with the provisions of Regulation 4.1.3 of MARPOL 73/78, Annex II (revised) and all other applicable Chemical Code and MARPOL Annex II (revised) requirements. V- TRANSPORT OF VEGETABLE OIL IN DEEP TANKS The MEPC also adopted a resolution MEPC 148(54) on Guidelines for the transport of vegetable oils in deep tanks or in independent tanks specially designed for the carriage of such vegetable oils on board dry cargo ships. The guidelines have been developed to allow general dry cargo ships that are currently certified to carry vegetable oil in bulk to continue to carry these vegetable oils on specific trades. The guidelines will take effect on 1 January 2007.
