BY OPENING THIS PACKAGE OR BY AUTHORIZING THE INSTALLATION OF THIS SOFTWARE, YOU AGREE TO BE BOUND BY THE TERMS OF THE FOLLOWING AGREEMENT. THIS AGREEMENT INCLU DES THE SOFTWARE LICENSE AND DISCLAIMER OF WARRANTY. PLEASE READ THIS DOCUMENT CAREFULLY. IF YOU DO NOT AGREE TO THESE TERMS, PROMPTLY RETURN THE COMPLETE SOFT WARE PACKAGE ALONG WITH THE INVOICE AND A FULL CREDIT WILL BE ISSUED. License This license allows you to use Harcourt Achieve software on a single computer, o n multiple computers, in a network environment, or through the Internet, dependi ng upon the terms of your purchase. If you purchased the network version, you ar e permitted to use this software in the environment for which it was purchased, including but not limited to, multiple central processing units, local and widearea computer networks (see restrictions below), or emulations on a mainframe or microcomputer. You are prohibited from using any version of the software in an y other way.

Restrictions If you purchased a standalone version, such as a CD-ROM, you may not reproduce o r distribute copies of the software to others, use the software on multiple work stations, or electronically transfer the software to another medium. If you pur chased a site-license version, you may install the product on as many stand-alon e computer systems as you have within the pre-defined limitations of the site un less the number of installations is limited by your purchase agreement. If your purchase agreement specified a maximum number of installations or simultaneous n etwork users, your usage may not exceed that maximum. If you purchased a network version, you may install the product on a single Local Area Network (LAN) opera ted by you solely for use by authorized users of that network. If prior permissi on was obtained from Harcourt Achieve, and you purchased a network version, you may install the product on a Wide Area network (WAN). Transmittal of all or part of the product to other LANs, WANs, sites, or over the Internet or other public networks is expressly prohibited. No other copying of the product is permitted.

Termination This license is effective until terminated. This license will terminate automat ically without notice from Harcourt Achieve if you fail to comply with any provi sion of this license. Upon termination you must destroy the Harcourt Achieve so ftware and all copies thereof and/or remove any copies that have been installed to hard-drives or network servers. You may terminate this license at any time b y destroying the Harcourt Achieve software and all copies thereof.

Export Law Assurances You agree and certify that neither the Harcourt Achieve software nor any direct product thereof is being or will be shipped, transferred or re-exported, directl y or indirectly into any country prohibited by the United States Export Administ ration Act and the regulations thereunder, or will be used for any purpose prohi bited by the same.

Government End Users. If you are acquiring the software on behalf of any unit or agency of the United States Government, the following provisions apply. The Government agrees that: (i) if the software is supplied to the Department of Defense (DoD), the software is classified as "Commercial Computer Software," and the Government is acquirin g only "restricted rights" in the software and its documentation as that term is defined in Clause 252.227-7013 (c)(1) of the DFARS; and (ii) if the software is supplied to any unit or agency of the United States Gove rnment other than DoD, the Governments rights in the software and its documentati on will be defined as in Clause 52.227-19(c)(2) of the FAR or, in the case of NA SA, in Clause 18-52.227-86(d) of the NASA Supplement to the FAR.

Limited Warranty Harcourt Achieve warrants the discs on which the software is recorded to be free from defects in materials and faulty workmanship under normal use for a period of 60 days from the date of delivery or installation. Harcourt Achieve will rep lace the product or refund the purchase price of the disc, provided you return t he faulty disc with proof of purchase to Harcourt Achieve. Harcourt Achieve sha ll have no responsibility to replace or refund the purchase price of a disc dama ged by accident, abuse, or misapplication.

Limitations of Warranty and Liability HARCOURT ACHIEVE DOES NOT WARRANT THAT THE SOFTWARE WILL MEET YOUR REQUIREMENTS

OR THAT ITS OPERATION WILL BE UNINTERRUPTED OR ERROR-FREE. WE EXCLUDE AND EXPRE SSLY DISCLAIM ALL EXPRESSED AND IMPLIED WARRANTIES NOT STATED HEREIN, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE SHALL NOT BE LIABLE FOR ANY DAMAGE OR LOSS OF ANY KIND ARISING OUT OF THE US E OF THE SOFTWARE REGARDLESS OF WHETHER SUCH LIABILITY IS BASED IN TORT, CONTRAC T, OR OTHERWISE AND INCLUDING BUT NOT LIMITED TO ACTUAL, SPECIAL, INDIRECT, INCI DENTAL, OR CONSEQUENTIAL DAMAGES. IF THE FOREGOING IS HELD TO BE UNENFORCEABLE, OUR MAXIMUM LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT OF THE LICENSE FEE PAI D BY YOU FOR THE SOFTWARE. THESE REMEDIES ARE EXCLUSIVE. SOME STATES DO NOT ALL OW LIMITATION OR EXCLUSION OF IMPLIED WARRANTIES OR LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO Y OU.
