That I am a deputy prosecuting attorney for Pierce County and I am familiar with the police report and/or investigation conducted by the TACOMA POLICE DEPARTMENT, incident number 121081330; That the police report and/or investigation provided me the following information; That in Pierce County, Washington, on or about the 17th day of April, 2012, the defendants, BOBBY RAY MCKINNEY and MONAROES SAR, did commit the crimes of robbery in the first degree, burglary in the first degree and unlawful imprisonment. On the above date at about 2300 hours, TPD officers responded to 3629 S. Gunnison St., in Tacoma, regarding a 911 hang-up call. Officers had been to this same residence about two hours earlier regarding a welfare check. Upon arrival, two officers approached the residence on foot and as they were opening the gate to the residence, which is encircled by a large wooden fence about 8 feet tall, the officers saw a white male wearing a dark-colored hoodie and mask place a large flat-screen television on the ground and run back through the residence. The officers called out a burglary in progress and took chase of the suspect (later identified as the Grimes). One of the officers chased Grimes over a fence while the other officer got back in his vehicle and planned to cut him off. The officer on foot saw Grimes run north down an alley and called for K-9 assistance, which quickly arrived. The officer lost sight of Grimes temporarily but could hear the defendant jumping chain link fences. Eventually, the K-9 captured the Grimes between a fence on the south side of 3637 S. Gunnison and a detached garage. Grimes was taken into custody and was still wearing the hoodie the officer had originally identified him as wearing. Grimes then admitted he was the one running from the scene. Along the route the defendant ran, officers located a black backpack which Grimes admitted belonged to him. Officers also located a white surgical mask near where Grimes had been hiding. When officers returned to the residence they spoke with the victim, 69 year old, G.S., who was found to be shaking and stuttering and very upset about the incident. The victim was described as wearing a white nightgown and shaking violently. G.S. repeatedly told the officers she had been robbed and the robbers had just left. G.S. stated there were two intruders and told the officers the suspects stated they had been in her home for quite some time before being noticed by the victim. As stated, officers and fire department personnel had responded about two hours before the officers responded to the robbery call and the first officers and fire department personnel had left before the robbery attempt. The suspects told the victim they had been in her home hiding the entire time the previous officers and fire personnel were there. G.S. stated after the officers left the first time, she had gone to bed. She stated as she was lying in bed, two suspects walked into her bedroom. She described one of the suspects as an Asian male, approximately 25 DECLARATION FOR DETERMINATION OF PROBABLE CAUSE -1

years old, wearing a red or orange bandanna, a surgical mask, a black hooded sweatshirt, black pants, black gloves with the tips cut off, and carrying a red backpack. G.S. stated this suspect had a gun. G.S. described the second suspect (later positively identified as Grimes), as a white male, wearing a dark hooded sweatshirt, jeans, and a surgical mask., and carrying a black back pack. G.S. stated the Asian male pointed the gun at her and told her bitch, Im gonna kill you, you better be quiet. She stated they then went through all her belongings. G.S. stated the assailants took 3 necklaces, 8 rings, 10 bracelets, a white coat, and an ATM card. She also stated they were trying to take her television. She stated the jewelry was worth close to $60,000. G.S. stated the assailants took her ATM card and tried to get a PIN number from her. The Asian male told her he would hurt her if she didnt give them the PIN number. She gave them a fake number and also told her they couldnt get money because a camera had to verify it was her face before money would be released. G.S. said when the Asian male was looking for her ATM card, she tried to call 911 but the same male grabbed the phone, pulled out the batteries and tossed it away. When officers searched Grimes at the area of his arrest, they located a pair of black gloves in the large pocket of his hoodie. Inside the gloves officers located a quantity of jewelry, which Grimes admitted he had stolen and placed in there. Grimes gave officers permission to search his backpack and officers located a green shoe back filled with the victims coins, a silver colored crow bar and small black flash light. Grimes chose to speak with officers about the robbery. He told them he received a call earlier from his co-assailant, Nutty, who told him of an easy lick (robbery/burglary), they could do. Grimes stated Nutty told him of the house and the fact that an older lady live there, alone. He said Nutty told him the lady had a safe full of cash and they could easily take it without getting caught. He stated he and Nutty met up down the street just before going to do the robbery. Although Grimes claimed to not know Nuttys true name, he did say that he and Nutty were longtime members of the Juggallo street gang. Grimes stated his own street name is Grimey and has tattoos including symbols of the Juggallos (a hatchet man and joker image, and the letters JG on his forearms. Grimes described Nutty as an Asian male, about 56 with a medium build. Grimes told officers he and Nutty had gone into the house through and unlocked front door. He stated they had been in the residence for about 45 minutes to an hour and that Nutty left at one point to go to a store and try the victims credit cards while he stayed with the victim to comfort her. Grimes is a convicted felon with two prior convictions for residential burglary and one for theft in the first degree. Law enforcement is continuing to investigate and it is believed that one of the victims friends son was involved in setting up the robbery and as many as 5 individuals may have been involved (one setting up the crimes, two in a waiting car, and the two assailants who went inside the residence to commit the crimes.) Detectives received information that Bobby McKinney knew the victim and had set up the robbery. A detective contacted the victim and she reported that McKinney was the son of one of her good friends and that he had been at the house on several occasions. Detectives contacted representatives of the BECU, and they reported that someone had attempted to use the victims ATM card at a Shell station on Center Street. The detectives then contacted the station owner and were provided video surveillance. The video showed an individual matching the description of the Asian male involved. He was wearing a dark baseball hat with the numbers 253 on it, dark clothing, and white athletic shoes. Grimes was interviewed again. Grimes was shown a photo of McKinney and asked if he know McKinney. Grimes stated that he knew McKinney as Bobby and the he is also a Juggalo that goes by the street name of Bob-dog. Grimes then admitted that McKinney planned the robbery. Grimes reported that McKinney had contacted him and asked to meet. Grimes said the he and Nutty met with McKinney. Grimes later identified Nutty as Monaroes Sar. McKinney said he knew a woman who lived alone and had a lot of valuable property. Grimes, Sar, and McKinney went to the victims home and McKinney showed them where they could access the house through the victims window. McKinney told them that she had a safe, valuable jewelry, and two TVs. Their plan was for Grimes and Sar to enter the house to take the property and split the proceeds between the three of them.
