So long as the pupil or student remain in the teachers custody, the teacher stand, to a certain extent, as to their pupils and students, in loco parentis and are called upon to "exercise reasonable supervision over the conduct of the child."
(Palisoc vs. Brillantes G.R. No. L-29025 October 4, 1971)

Custody
WHETHER THE SEMESTER HAS NOT YET BEGUN OR ALREADY ENDED
As long as the student is in the school premises in pursuance of a legitimate student objective, in the exercise of a legitimate student right, and even in the enjoyment of a legitimate student privilege, the responsibility of the school authorities over the student continues.

Custody
the protective and supervisory custody that the school and its heads and teachers exercise over the pupils and students for as long as they are at attendance in the school, including recess time

Custody
- Does not connote immediate and actual physical control but refers more to the influence exerted on the child and the discipline instilled in him as the result of such influence

RECESS TIME

RECESS TIME
a situation of temporary adjournment of school activities where the student still remains within call of his mentor and is not permitted to leave the school premises, or the area within which the school activity is conducted

embraced in the phrase "at attendance in the school does not include dismissal

At Attendance in School
the mere fact of being enrolled or being in the premises of a school without more does not constitute "attending school" or being in the "protective and supervisory custody' of the school, as contemplated in the law a student is not "at attendance in the school" cannot be in "recess" thereat
