 LEGISLATIVE AUTHORITY
UNDER SECTION 31 (1) OF THE AJ&K INTERIM CONSTITUTION ACT, 1974
BOTH THE COUNCIL AND ASSEMBLY SHALL HAVE THE POWERS TO MAKE
LAWS:-

1.For the territories of the Azad Jammu and Kashmir.

2.Under section 31(2) (a) the Council has exclusive powers to make laws on
52 subjects mentioned in Council Legislative List (Third Schedule)
3.Under section 31(2) (b) the Assembly shall, and the Council shall not, have
power to make laws with respect to any matter not enumerated in the Council
Legislative List.
4.Under Section 31(3) neither the Council nor the Assembly has powers to
make laws on :
§ Matters relating to UNCIP resolutions
§ Defense and Security.
§ Currency; and
§ External affairs including foreign trade and foreign
aid.
 EXECUTIVE AUTHORITY OF THE
COUNCIL.
[Section 21(7)]

 The Council has the Executive Authority in all matters

in which it can make Laws .
 The Executive Authority is exercised by the Chairman
( Prime Minister of Pakistan ) who may act either
directly or through the Council Secretariat headed by a
Federal Minister nominated by the Chairman as Incharge
of the Council .
