In a Chinese shop, a man named D. B. Jeffrey appeared therein, and, without any
apparent reason whatever, struck the woman three times on the hip with a bottle
that he was carrying, in consequence of which the woman fell to the ground with
an abundant hemorrhage from the womb; she was immediately taken to her home
in a carretela, and being three months pregnant she had a miscarriage on the
following day, according to the examination made by the president of the
municipal board of health. The woman was ill and unable to attempt to her usual
duties for forty-five days.
The testimony of the military surgeon, Raymond F. Metcalf, who,
seven days thereafter, examined the injured woman and stated
that he did not discover upon her body any signs of abortion, has
not affected the preponderance of the evidence offered by the
prosecution.
After the lapse of seven days, the miscarriage having occurred
the day following the night when the woman was brutally struck
upon the hips with a bottle, it is not strange that he did not find
any traces of the hemorrhage or of the miscarriage, as seen by
the physician who examined and attended the maltreated woman
and certified to the act of the abortion.
The abortion was caused by the same violence that caused
the death of the victim. It is unintentional because accused-
appellant must have merely intended to kill the victim but
not necessarily to cause an abortion.

Medical Findings:
xxx1. Rope embedded around the neck with knot directing to the right lateral
of the neck;

xxx 5. Abdomen enlarged, at about 5 months size with fetal parts on
abdominal palpation.

CAUSE OF DEATH: Asphyxation secondary to hanging.


Accused-appellant lived with his eighteen year old legal wife, Norma Desalisa,
and two year old daughter in a small nipa house. Norma complained to her
mother that she was manhandled by the accused by slapping and boxing her on
the stomach. They had an altercation because of his drinking. Norma was found
dead, hanging from a tree, the day after the accused left their child to his
parents-in-laws house which is nearby.

Librada, mother of the victim heard a commotion and saw that the
accused was attacking his son, John Frank, brother of the victim, who
was already bleeding then. When she tried to help, she was grabbed by
the hair and pushed aside. Her son came to her rescue. Librada got
away. The accused wrestled with John Frank and was able to get away.
He then entered the bathroom where the victim was in. John Frank
peeped from the top of their sink and saw the accused violently stabbing
Gina who fell on her back to the ground. Gina somehow managed to get
up, forcing her way out by tearing down a GI sheet which served as part
of the enclosure of the bathroom. She was lifted to a parked jeep but the
accused followed and dragged her out and continued to box and stab her
mercilessly, and then he fled.

Hypovolemic shock, Hermorrhage massive. Secondary to
multiple stab wound, penetrating, multiple organ perforation
(Lung, Liver, Small Intestine, Pregnant Uterus, Fetal death, full
term, female, secondary to stab wound right parietal area with
brain tissue, damage, thus resulting also to the death of the
fetus, as per Autopsy Report issued by Dr. Benjamin Marcial
Bautista, Rural Health Physician.
On 26 November 2002, at around 6:30 in the morning, appellant, who
worked as a butcher, came home from the slaughter house carrying his tools of
trade, a knife, a bolo, and a sharpener.

His wife was preparing their children
for school and was waiting for him to come home from his work. For reasons
known to him alone, appellant stabbed his wife 14 times. Tito, whose house is at
back of appellants house, heard his daughter shouting for help. When he arrived,
he saw his daughter lying prostrate near the door and her feet were trembling. But
seeing appellant, who was armed, he stepped back. Angelina told Tito by the
window that appellant had held her mothers neck and stabbed her. Paycana
claimed that it was his wife who attacked him first and he acted on self-defense.

Dr. Rey Tanchuling, a defense witness who attended to
appellants wound, testified on cross-examination that the
injuries suffered by appellant were possibly self-inflicted
considering that they were mere superficial wounds.
In any event, self-defense on the part of appellant is
further negated by the physical evidence in the case.
Specifically, the number of wounds, fourteen (14) in all, indicates
that appellant's act was no longer an act of self-defense but a
determined effort to kill his victim. The victim died of multiple
organ failure secondary to multiple stab wounds.
Dr Ajit Grover, owner of Lovely Nursing Home in Burail, and his wife
Kamlesh Kaur have been convicted by additional district and
sessions judge, Raj Shekhar Attri for allegedly carrying out abortion
without the consent of the patient.

Dr Ajit Singh Grover and his wife, trained midwife Kamlesh Kaur,
were booked in April 2006, on the complaint of one Surinder Singh.
The complainant alleged the two carried out abortion on his
pregnant wife, Bimlesh, without consent.

Surinders wife complained of pain in the stomach and was taken to
Lovely Nursing Home. The doctor told her she was pregnant and
advised her a few tests. Surinder was asked to wait outside while
his wife was taken in for treatment, but was operated upon.

Dr Grover and Kamlesh are facing trial in a case registered in March
2003 after the death of a woman allegedly due to negligence by
them.

New York doctor guilty of murder in abortion death
(convicted on August 8, 1995)

A jury of five women and seven men took only two hours to convict Dr. David Benjamin of
murdering Guadalupe Negron on 9 July 1993. Mrs. Negron, a 33 year old Honduran immigrant to the
US and a mother of four, was about 20 weeks pregnant and allegedly paid $800 (530) for a late-term
abortion. Dr. Benjamin, whose license had been revoked in 1993 because of charges of gross
incompetence and negligence in abortions performed on five women in 1990, was continuing to
practise pending the outcome of his appeal.

Dr. Benjamin lacerated Mrs. Negron's cervix and perforated her uterus while removing
the fetus. About two hours after the procedure Mrs. Negron was wheeled out of the examination room
on a stretcher, bleeding profusely and complaining of pain. Dr. Benjamin gave instructions that she
should be cleaned up and then began another abortion.

Mrs. Negron was placed in a recovery area, where she continued to bleed. No trained
staff were available to observe her condition, and no equipment was provided to monitor her vital signs.
She was noticed to be unwell and an ambulance was called.

She was pronounced dead on arrival at the hospital.
