National Road Right-of-Way (under the supervision of the
DPWH)

Reference: Executive Order No. 621 of 1980

National roads shall have a right of way of not less than twenty
(20) meters, provided, that such minimum width may be
reduced at the discretion of the Minister of Public Highways to
fifteen (15) meters in highly urbanized areas and that a right of
way of at least sixty (60) meters shall be reserved for roads
constructed through unpatented public land and at least one
hundred twenty (120) meters reserved through naturally
forested areas of aesthetic or scientific value.

The ROW shall include the travelway, curb and gutter,
sidewalks, shoulders, canals and other portions of the
defined road ROW.

b. Obstructions and Prohibited uses within ROW



1. All kinds of private temporary and permanent structures, such as
buildings, houses, shanties, stores, shops, stalls, sheds, posts,
canopies, billboards, signages, advertisements, fences, walls, railings,
basketball courts, garbage receptacles, and the like.
2. Plants and plant boxes
3. Driveways and ramps occupying or protruding to the sidewalk
4. Humps, whether permanent or temporary.
5. Construction materials, such as sand, gravel, cement, lumber and
steel bars, earth spoils, waste materials, debris, embankment, heaps,
and the like.
6. Vehicles and equipment, including junked items, that are parked,
occupying or protruding to the sidewalk or shoulder.
7. Vending, repair of vehicles, and other businesses within the sidewalk
and other parts of the ROW.
8. Disposal of household/commercial/industrial wastewater and sewage
into the sidewalk, curve and gutter, and travelway.
9. Raising of animals or allowing them to roam within the ROW.
10. Washing and drying of clothes, crops and similar items.
11. Sports and other related activities.

II. RIVERS & CREEKS
Easement - Development Setbacks Requirement (under
the supervision of the Local Building Officials)

Chapter IV- Utilization of Waters
Article 51. The banks of rivers and streams and the shores of the seas
and lakes throughout their entire length and within a zone of
three (3) meters in urban areas, twenty (20) meters in
agricultural areas and forty (40) meters in forest areas, along
their margins are subject to the easement of public use in the
interest of recreation, navigation, floatage, fishing and
salvage. No person shall be allowed to stay in this zone longer
than what is necessary for recreation, navigation, floatage,
fishing or salvage or to build structures of any kind.

III. ISSUANCE OF BUILDING PERMITS
(For Structures along National Roads)
- Shall be in coordination with the DPWH

CHAPTER X
BUILDING PROJECTION OVER PUBLIC STREETS
Section 1001. General Requirements.
(a) No part of any building or structure or any of its appendages shall project
beyond the property line of the building site, except as provided in this
Code.
Section 1002. Projection into Alleys or Streets.
(a) No part of any structure or its appendage shall project into any alley or
street, national road or public highway except as provided in this Code.

* Requirements for Securing Building/Fencing Permit Clearance
1. Indorsement Letter from Building Official.
2. TCT Minimum of three (3) copies.
3. Tax Declaration- minimum of three (3) copies.
4. Tax Receipt minimum of three (3) copies.
5. Lot Survey Plan duly signed and sealed by Geodetic
Engineer minimum of three (3) copies
6. Plan (Site Development Plan/Perspective) duly signed
and sealed by Civil Engineer/Architect and owner.

Optional:
1. For two (2) Storey and above- structural design and analysis
computation duly signed and sealed by Civil Engineer.
2. Leased of contract (if not owned by the applicant.
