possess and carry the necessary firearm within his
territorial jurisdiction, subject to appropriate rules

MC No. 2002-150, the role of the sangguniang


barangay in concurring the appointment issued by the
Punong Barangay is to ascertain whether the appointee
has the qualifications and none of the disqualifications
provided by law, particularly the positions of the barangay
secretary and barangay treasurer (Section 394 & 395 of RA
7160).

SEC. 394. Barangay Secretary: Appointment, Qualifications,

Powers and Duties.


(a) The barangay secretary shall be appointed by the punong
barangay with the concurrence of the majority of all the
sangguniang barangay members. The appointment of the
barangay secretary shall not be subject to attestation by the
Civil Service Commission.
(b) The barangay secretary shall be of legal age, a qualified
voter and an actual resident of the barangay concerned.
(c) No person shall be appointed barangay secretary if he is a
sangguniang barangay member, a government
employee, or a relative of the punong barangay within
the fourth civil degree of consanguinity or affinity.

SEC. 395. Barangay Treasurer: Appointment, Qualifications,
Powers and Duties.
(a) The barangay treasurer shall be appointed by the punong
barangay with the concurrence of the majority of all the
sangguniang barangay members. The appointment of the
barangay treasurer shall not be subject to attestation by the
Civil Service Commission.
(b) The barangay treasurer shall be of legal age, a qualified
voter, and an actual resident of the barangay concerned.
(c) No person shall be appointed barangay treasurer if he is a
sangguniang barangay member, a government
employee, or a relative of the punong barangay within
the fourth civil degree of consanguinity or affinity.

Article 220 of the Revised Penal Code
states:
Art. 220. Illegal use of public funds or property. Any
public officer who shall apply any public fund or property
under his administration to any public use other than for
which such fund or property were appropriated by law or
ordinance.
Note: Illegal use of public funds or property is also known as
technical malversation.
Public fund or property is diverted to another
public use other than that provided for in the law.

Punong Barangay

Organize and lead an emergency group for maintenance of peace


and order, or during emergency and calamity;

Enforce laws and regulations relating to pollution control and


protection of the environment;

Administer the operation of the Katarungang Pambarangay;

Exercise general supervision over the activities of the SK;

Ensure the delivery of basic services;

Conduct an annual Palarong Barangay;

Promote general welfare of the barangay;

Exercise other duties and functions as may be prescribed by law or


ordinance.
