Article 25
Private Employment Sector shall participate in recruitment and
placement of workers, locally and overseas under the guidelines,
rules and regulations as may be issued by the Secretary of
Labor.
Article 26
Prohibition of Travel Agencies and Sales Agencies of Airlines
Companies whether for profit or not.
Article 27
Permission to participate of 75% authorized and voting capital
stock owned and controlled by Filipino citizens, corporations,
partnerships and entities.

(A.) Hours of Work
Article 83 -- Normal hours shall not exceed eight (8) hours a day.
Article 84 -- Hours worked includes:
a) When employee is on duty or at prescribed work place.
b) When employee suffered or permitted to work.
c) Rest period of short duration.
) Applies to all establishments and undertaking whether for profit or not.
) Exceptions:
a) Government Employees
b) Managerial Employees
c) Field Personnel
d) Domestic Helpers
e) Family Member of Employer
f) Personnel Service of another
g) Paid workers determined by Secretary of Labor and Employment

(B.) Weekly Rest Period
Article 91 -- Rest period of not less than 24 consecutive hours after
every 6 consecutive normal work days.
-- Why there is NO definite Rest day?
Article 92 Following cases requires work on rest days:
a) During impending emergencies, other disasters, calamities
or imminent danger;
b) Urgent work to be performed on machinery, equipment or
installation;
c) Abnormal work pressure due to special circumstances;
d) Prevention of loss or damage to perishable goods;
e) Required continuous operations in which a stoppage of
work may cause injury or loss and;
f) Other analogous or similar to the foregoing determined by
Secretary of Labor and Employment.
Conditions of Employment
(C.) Holidays, Service Incentive Leaves and Service Charge
Article 95 -- Right to Holiday Pay
a) Paid with a regular and daily wage except retails and service
establishments employing less than 10 workers.
b) Paid with a compensation equal to twice of regular rate.
c) Holidays includes:
i. Regular Holidays
ii. Nationwide Special Days
) Article 96 -- Right to Service Incentive Leaves
a) 1 year of service = yearly service incentive leave of 5 days with pay.
b) Not applicable to:
i. Those enjoying vacations leave for atleast 5 days with pay.
ii. Those employed in establishments with less than 10 employees.
iii. Those exempted establishment by Secretary of Labor.
c) Grant of benefit in excess shall not be a subject or arbitration or any
court or administrative actions.

Article 95 -- Right to Service Charges
Service charges is distributed to all covered employees at 85% and the
management at 15%. (Hotel, Restaurants)
