 ABSTRACT

Technological innovation is one of the essential factors to

increase the productivity that is needed, in an irrevocable
way, to achieve sustained economic growth. The legal
protection of the results of innovation through the various
titles of Intellectual Property, in a broad sense, is a widely
recognized instrument, and every day with greater intensity,
to promote and encourage innovative activities both in
companies and in the knowledge creation centers.

What is a patent?
The Patent is a privilege granted by the State to the inventor as
recognition of the investment and efforts made by it to achieve a
technical solution that brings benefits to humanity. This privilege consists
of the right to exploit the invention exclusively for a specific time

of Colombia in charge of acting as the Colombian patent and

What is a utility model patent?
The utility model patent is a privilege granted by the State to the inventor
as recognition of the investment and efforts made, to those inventions
that consist of a new form, configuration or arrangement of elements of
an artifact, tool, instrument, mechanism or another object or part
thereof, that allows a better or different operation, use or manufacture
of the object that incorporates it or that provides it with some utility,
advantage or technical effect that it did not previously have.

Is a patent valid in every country?

No, the protection is territorial, that is, it is valid only in the national
territory.
How long does an innovation patent last?
They are 20 years from the presentation and filed

How long does a utility patent last?

Being the only one who for 10 years can exploit the invention. The
exploitation may consist of exclusively and directly marketing the
patented product, or through third parties granting licenses, transferring
the rights obtained through its sale for a third party to exploit the
invention. In conclusion, the benefit is economic for the inventor or
owner of the patent.
 b. Copyrights
• What is copyright?
Copyright is a form of intellectual property protection. Copyright
protection is available for original works of authorship that are fixed in a
tangible form, whether published or unpublished. The categories of
works that can be protected by copyright laws include paintings, literary
works, live performances, photographs, movies, and software.

•What is the difference between moral and property rights?

Copyright is designed to protect the ‘economic rights’ of copyright
holders. In comparison, moral rights protect the reputation and integrity
of creators.
So while the Copyright Agency manages copyright, and monitors the
reproduction and communication of works, it does not monitor the moral
rights of its members.
•What is the competitiveness regulatory agency of the Government of
Colombia in charge of copyrights registration?
The physical record is the one that is made in person at the headquarters of
the National Directorate of Copyright -DNDA-, located in the city of Bogotá.

•What can be protected in Colombia, using copyrights?

Copyright protects literary, scientific and artistic works, without entering into
the quality, theme or destination of it. Ideas, methods or procedures are not
protected, but their concrete form embodied in languages, annotations,
recordings or materials that allow their reproduction.
Artistic: Are those that impact the aesthetic sense of the person who
contemplates them (LIPSZYC, Delia page 77 of their Copyright Manual,
CERLALC / UNESCO / ZAVALÍA, 1993) example: photographs, sculptures,
paintings, among others.
Literary: Are those that are expressed by any form of language such as
novels, stories, didactic and scientific texts, computer programs (software),
poems, among others.
•Are software and videogames protected by copyrights or patents in
Colombia?
The software can eventually be protected by patent when its nature is
inseparable with another invention, but if this is not the case, but it is
software or software separate or in themselves ("as such"), are not
considered inventions and will not be protected by patents.
Colombian legislation does not have a category of protection of
intellectual property determined as "video game", however if these are
broken down into simpler parts it will have to be made up of
characters, music, a story, the name of the game and the code
source with which it has been designed.
Each of these can be protected independently, giving the author of
the game the right to pursue those who infringe one or more of the
rights that fall on it.

A license agreement is an association between an owner of

intellectual property rights (licensor) and another person who is
authorized to use those rights (licensee) in exchange for an
agreed payment (fee or royalty)

How can be protected and negotiated technology innovations in

Colombia?

Through the Superintendence of Industry and Commerce, allows the

accompaniment and advice to all subjects in reference to patents, the
current legislation contained in decision 486 of 2000 by the Commission of
the Andean Community, as the same name indicates applies to all the
member countries of the Andean Community, it presents regulatory
decrees and the Superintendence of Industry and Commerce issues a
single circular containing guidelines that guide future patents to carry out
their respective industrial property and other procedures.
• Is technology innovation an opportunity to eradicate poverty in
undeveloped countries?

If, because technology today gives us a quality of life and facilitates us to
the easiest activity, then why not use that technology to help people who
really need it, for example with the creation of prosthetics for people of low
resources, water treatment plants for places where there is almost no
water, thermal light for places with little access to paid electricity, etc, so I
think that the creators of technology should not only think about making a
profit, but also improving the quality of life of the people who really need a
helping hand, that is why you should think first as a human, love your
neighbor so that each new technology always thinks about the benefit not
only of those who have economic access, but also of those who would like
to have a better quality of life, this also helps to improve the poverty
indexes of a country, and that little by little poverty is eradicated or
diminished.
