1. COGNIZABLE /NON-COGNIZABLE
OBJECTIVE- For the purpose of investigation.
 COGNIZABLE OFFENCE [Sect. 2(c)]

 Police officer is entitle to arrest without warrant.

 Sect.154 (First Information Report)

 NON-COGNIZABLE OFFENCE [Sect. 2(l)]

 Police officer is not empowered to arrest without


warrant or without the permission of magistrate.
 Sect. 155(Non- Cognizable Report)
2. BAILABLE/ NON-BAILABLE
OFFENCE
OBJECTIVE- To set a person at liberty
 BAILABLE OFFENCE [Sect. 2(a)]

 Arrested person is entitle to claim for the bail as a


matter of right.
 NON-BAILABLE OFFENCE

 Court has the discretion to grant bail after seeing


the facts and circumstances.

general rule and a custody or jail as an exception.”
3. SUMMON CASE AND WARRANT
CASE
OBJECTIVE- Process to compel appearance and
for the purpose of trial.
 SUMMON CASE[Sect. 2(w)]

 Punishment or imprisonment not exceeding 2yrs


or with fine
 WARRANT CASE [ Sect. 2(x)]

 Other than summon case i.e., offences punishable


with death sentence or life imprisonment or
imprisonment for the period more than 2 years.
4. COMPOUNDABLE AND NON-
COMPOUNDABLE OFFENCE
 COMPOUNDABLE OFFENCE
 To end the criminal proceeding through
compromise.
 Victim of the offence is allowed by law to
withdraw his case without the permission of the
court or with the permission of court (Sect .320)
 NON-COMPOUNDABLE OFFENCE

 Victim is not entitle to make conciliation outside


the court
 The non-compoundable offence is the name of the
vehicle of which the ignition is made on that can
never be stopped outside the court.
