Regulations of hazardous substances

• full compliance with the labeling


Seizure And Condemnation Of
Misbranded Hazardous Substances
• NOT apply to a hazardous substance intended
for export to any foreign country if it

• (1) specifications of the foreign purchaser,


(2) labeled in accordance with the laws of the
foreign country,
(3) is labeled that it is intended for export, and
(4) is so exported.
• Entry of the hazardous substance - disposed
by destruction or sale
• if sold - less the legal costs (Treasury of the
Philippines)
• Can be delivered to the owner for destruction
or for alteration, supervised by an officer or
employee assigned by the Administrator
• all expenses with the storage and labor of th
hazardous substance shall be paid by the
owner or consignee
Regulations On Imported Hazardous
Substances
• Commissioner of Customs
– destruction of hazardous substance refused
admission
– Pending decision on the admissibility of a
hazardous substance - delivered to the owner or
consignee providing payment to the damages in
the event of default.
– relabeling or other action as to the admission of
hazardous substance may be deferred.

Examination and Investigation for
Purposes of Enforcement
• Entering at reasonable hours in domestic
commerce
• Inspection
• Obtaining of samples (labels, receipts)
Prohibited Acts
• (1) introduction to commerce
• (2) non-compliance with label
• (3) The receipt in commerce
• (4) False guarantee or undertaking of the regulation
of the hazardous substances (import/export) .
• (5) hazardous substances in a container or
reused container for food, drug, or cosmetics.
Penalties

EXCEPTIONS
• NOT SUBJECTED TO PENALTIES

- not a misbranded hazardous substance or
banned hazardous substance .
