 The State shall protect the right of
children to assistance, including
proper care and nutrition, and special
protection from all forms of neglect,
abuse, cruelty, exploitation and other
conditions prejudicial to their
development (Art. XV. Sec. 3(b))

The person exercising substitute parental authority
shall have the same authority over the person of the
child as the parents.
In no case shall the school administrator, teacher or
individual engaged in child care exercising special
parental authority inflict corporal punishment upon
the child. (n)
Code of Ethics for Professional Teachers
Art. VIII
Sec. 2 A teacher shall recognize that the interest and
welfare of learners are of first and foremost concern,
and shall deal justifiably and impartially with each of
them.
Sec. 8 A teacher shall not inflict corporal punishment
on offending learners nor make deductions from their
scholastic ratings as a punishment for acts which are
clearly not manifestation of poor scholarship
WHY ARE THERE VARIOUS LAWS
TO PROTECT SCHOOL CHILDREN

• VULNERABILITY OF CHILDREN:
– Children are incapable to fully protect
themselves.
– It is the obligation of the State to protect its
children.
• ADDRESS A WRONG PRACTICE:
– Most children grow up doing the same thing their
parent were doing.
– Most teacher teach the way their teachers taught
and treated them.

SALIENT FEATURES OF THE DEPED
CHILD PROTECTION POLICY
FORMS OF CHILD ABUSE:
1. PHYSICAL ABUSE: Any act that inflict bodily
or Physical Harm.

- Most common form of Child Abuse


-Often viewed as child discipline in schools
-Boxing, Kicking, Slapping, Spanking etc…
2. SEXUAL ABUSE
• Includes:
a. Rape, Sexual Harassment,
Acts of Lasciviousness,
Making demeaning and
sexually suggestive remarks,
Physically attacking sexual
parts

b. Forcing a child to watch


obscene publication and
shows
3. PSYCHOLOGICAL ABUSE:
Causing mental and emotional
suffering.
Includes: Intimidation,
Harassment, Stalking,
Damage to property, Public
Ridicule, Threat of Deduction
of grade as a form of
punishment and Repeated
verbal abuse.
-Any kind of punishment or penalty
-carried out or inflicted
-for the purpose of discipline, training
or control
-by a teacher, school administrator, an
adult, or any other child who has been
given or has assumed authority or
responsibility for punishment or discipline.
CORPORAL PUNISHMENT
Punishment or Penalty Includes
Any of the Following:
1. Infliction of Bodily Harm
eg: beating, slapping, kicking, whipping
2. Forcing a child to perform painful or
damaging acts
eg: Holding weights, kneeling on stones
3. Deprivation of a child’s physical need/s
4. Tying up a child
5. Deliberate exposure of a child to fire, ice,
water, smoke, pepper, rain, sunlight.
6. Forcing a child to swallow any substance that
causes discomfort or poses danger to a child’s
health
7. Confinement of a child/ Deprivation of liberty
8. Verbal abuse and assaults
9. Forcing a child to wear a sign, undress of to
put a child in a in situations that make them
feel foolish or embarrassed in front of others
10. Permanent confiscation of a child’s personal
property, EXCEPT if such property poses
danger to the child or to others.

11. Other analogous cases.


In case of Child Abuse, Exploitation and Discrimination
Committed by Public School Personnel:

1. File complaint with School Head/D.O./R.O.

2. School Head shall immediately Report the same to


the Division Office.

MAY report to the Local Social Welfare and


Development Office (LSWDO) or Children and
Women’s Desk
PUBLIC SCHOOL’S CHECKLIST
(Child Abuse Cases)
1. It should INFORM the Parents of the incident
and the action taken in Writing;

2. It should REFER the victim-student to the CPC;

3. Intervention Programs are being made;

4. It should REPORT the matter to the Division


Office immediately through a letter;
4. Other Actions:

or Division Office may direct.

5. Make SURE that the Child overcomes the

classmates.
Fred Aston Mendoza, a Grade 4 student, is
currently confined in the Philippine
Children's Medical Center after undergoing
surgery.

The victim's mother, Vilma Santos Mendoza,


said her son had bruises when he went home
last Friday.

"Hinabol daw siya, tapos hinubaran, yun


yung pagkakwento po niya. Tapos
pinagsusuntok na siya sa tiyan, sinipa," she
added.-ABS-CBN
PROCEDURES IN HANDLING BULLYING CASES:
A. BULLYING:
1. Report to School Head;

-Anonymous complaints should


be entertained.
-Public schools are not allowed to
refer the issue to the Barangay Officials
for settlement.

2. Any school personnel should:


Stop the Bullying Immediately.
-Separate/Remove the victim/bully in the site
-Attend to the medical needs
-Bring Bully to Guidance Office or point
person
3. School Head INFORMS THE PARENTS OF THE
INCIDENT and the steps to be done in the
investigation and actions to avoid further
bullying

4. SET MEETING WITH PARENTS


FOR THE INVESTIGATION;

5. REFERRAL OF VICTIM OR OFFENDER TO CPC-ABC


for intervention
-Determine interventions to be done.
6. FACT FINDING AND DOCUMENTATION
-Separate interview with parties;
-should be with the Parents
-Students/Parents should be given
opportunity to give written comments

with the Division Office after its investigation;
5. IMPOSE THE APPROPRIATE SANCTION against the
erring STUDENT, as the case maybe.
6. Make SURE that the Child overcomes the
Trauma. Include a report regarding this to the
R.O./D.O

Bullying-IRR

1. Draft School Child Protection Policy and Anti-Bullying
Policy with Code of Conduct.

2. Identify, Refer and Report to Appropriate Offices cases


involving child abuse and Bullying.

3. Giving Assistance to Parents/Guardians when


appropriate.

4. Initiate information dissemination programs and


organize activities for the protection of children;
5. Ensure that the children’s right to be heard
are respected and upheld in all matters and
procedures affecting their welfare.
