STATISTICS &
APPLICABILITY
• Enacted in the year 1961
• The act came into force on 1st march
1962
• The act extends and is applicable to the
whole of India.
• It applies to any industry.
OBJECT OF THE ACT
The object of the act
is to impose
statutory obligation
of all employers in
the notified
industries to engage
apprentices in the
ratio prescribed for
• To provide for the regulation and control of
training of apprentices and for matters connected
therewith.
• To promote a conductive climate for training and
imparting skills to youth
• To prepare the youth to meet the growing needs
of fast expanding industries, trade and commerce
to be gainfully employed therein.
• To create such healthy conditions with the
employers wherein apprentice labour may not be
exploited and victimised.
DEFINATIONS

Apprentice – sec(2(aa)) – ‘Apprentice’


means a person who is undergoing
apprenticeship training in pursuance of a
contract of apprenticeship.

• Apprenticeship training:
"Apprenticeship training" means a course of
training in any industry or establishment
undergone in pursuance of a contract of
apprenticeship & under prescribed terms &
conditions which may be different for different
categories of apprentices.
ELIGIBILITY
• Above 14 years
• Satisfies standard of education &
Physical fitness as may be prescribed.
• Act also provides reservations of
training vacancies for candidates
belonging to SC, ST keeping in view
their population in state..
OBLIGATIONS OF
EMPLOYER
• To provide the apprentice with
the training in his trade in
accordance with the provisions
of the act.
• Must appoint the right person
to supervise the apprentice if
the employer himself is not
qualified in the trade
• And to carry out his
obligations under the contract
OBLIGATIONS OF
APPRENTICE
• To attend classes regularly.
• To carry out lawful orders
of his employer &
superiors.
• To carry out his obligations
under the contract of
apprenticeship & to learn
his trade conscientiously &
RIGHTS OF APPRENTICE
• As per Section 13 The employer is required to
pay a stipend to every apperentice during the
period of apprenticeship training.
• If apperentice is undergoing training in factory,
provisions of chapters of factory act 1948 shall be
applicable so far as their health, safty and welfare
is concerned.
• Entitled to casual leave, medical leave, &
extraordinary leave in accordance with the rules
• 90 days maternity leave without stipend has been
