1. DEFINITION OF TERM/S
Persons with Disabilities
• Disabled Persons are those suffering from
restriction of different abilities, as a result of
a mental, physical or sensory impairment,
to perform an activity in the manner or
within the range considered normal for a
human being.
• Those who have long-term physical,
mental, intellectual or sensory impairments
which in interaction with various barriers
may hinder their full and effective
participation in society on an equal basis
with others. For purposes of these Rules
and Regulations, persons with disability
shall be classified by the Department of
Health (DOH) through an issuance.

PERSONS
First Violation
a fine of not less than Fifty thousand pesos (P 50,000.00) but not exceeding
One hundred thousand pesos(P 100,000.00) or imprisonment of not less
than six (6) months but not more than two (2) years, or both at the discretion
of the court

Subsequent Violation
a fine of not less than One hundred thousand pesos (P 100,000.00) but not
exceeding Two hundred thousand pesos (P 200,000.00) or imprisonment for
less than two (2) years but not more than six (6) years, or both at the
Penal discretion of the court
Any person who abuses the privileges granted
Clause herein shall be punished with imprisonment of not less than six (6) months or
a fine of not less than Five thousand pesos (P 5,000.00) but not more than
Fifty thousand pesos (P 50,000.00), or both, at the discretion of the court.

If the violator is a corporation


organization or any similar entity, the officials thereof directly involved shall
be liable therefor.

If the violator is an alien or a foreigner


he shall be deported immediately after service of sentence without further
deportation proceedings.

(b) Educational assistance to PWD, for them to pursue primary,
secondary, tertiary, post tertiary, as well as vocational or technical

qualified PWD, including support for books, learning materials, and
uniform allowance to the extent feasible: Provided, That PWD shall
meet the minimum admission requirements;

(c) To the extent practicable and feasible, the continuance of the same
benefits and privileges given by the Government Service Insurance
System (GSIS), Social Security System (SSS), and Pag-IBIG, as the
case may be, as are enjoyed by those in actual service;

(d) To the extent possible, the government may grant special


discounts in special programs for PWD on purchase of basic
commodities, subject to the guidelines to be issued for the purpose by
the Department of Trade and Industry (DTD and the Department of
Agriculture (DA); and

"(e) Provision of express lanes for PWD in all commercial and


government establishments; in the absence thereof, priority shall be
given to them.
Who qualifies for the PWD ID?
Who qualifies for the PWD ID?
Visual impairment – DOH specialists in the PDAO (persons with disabilities affairs office) in your town or city hall have a set
protocol for determining who is visually impaired and who can qualify for a PWD ID based on visual acuity, or the lack of it.

Hearing loss – anyone who cannot hear is considered to be disabled. However, there are various degrees of hearing impairment
depending on the cause of the hearing loss. If the applicant’s inability to hear is apparent, then there is no need to bring a clinical
abstract to the PDAO when applying for the PWD ID.

Orthopedic disability – this category includes all those who have had amputations done to any of the extremities. This also
includes those who have stunted growth because of dwarfism, a medical condition where the patient’s height and extremities did
not grow to full mature size.
Learning disability –
Psychosocial disability – this is a category that includes those who have psychological and social problems that can leave them
the sufferer unable to do what he/she normally does.

Chronic illness – There are illnesses that may not inherently lead to a disability but have been known to cause disability when a
complication sets in.

Mental disability – Sufferers of mental illness are automatically considered to be disabled and are sometimes automatically
granted a PWD ID, as some mental illnesses can be apparent. Included in this category are children with Down syndrome, bi-polar
disorder, post traumatic stress disorder and schizophrenia. Sufferers of this category will need a medical/clinical abstract prior to
the issuance of a PWD ID

Of the 92.1 million household

disability, based on the 2010 Census
of Population and Housing (2010 CPH).
The recorded figure of persons with
disability (PWD) in the 2000 CPH was
935,551 persons, which was 1.23
percent of the household population
