CITIZEN

Is a person with certain rights and duties under a government.


We each have certain rights and duties.
 Have right to express an opinion
 Right to protection under the law
 Duty to obey the law
 Duty to pay taxes
CITIZENSHIP

It is defined as the condition or status and a


citizen, with its rights and duties. It is a term
denoting membership of a citizen in a political
society, which membership implies, reciprocally, a
duty of allegiance on the part of the member and
duty of protection on the part of the State.
CITIZENSHIP AND CITIZEN

The following are citizens of the Philippines :


1. those who are citizens of the Philippines at the time of the
adoption of this Constitution;
2. Those whose fathers and mothers are Filipino citizens;
3. Those born before Jan. 17,1973, of Filipino mothers, who elect
Philippine Citizenship upon reaching the age of majority ; and
4. Those who are naturalized in accordance with law.
GENERAL WAYS OF ACQUIRING CITIZENSHIP
Generally there are two ways of acquiring citizenship ( by birth and by naturalization)
1. Jus soli or loci – Place of birth serves as the basis for acquiring citizenship. This is
accepted in the United States, to people born in their territories.
2. Jus Sanguinis – if any one of a person’s parents is a citizen of a particular
country, then that person will get the parent’s citizenship. This is true for the
Philippines,where one Filipino parent (mother or father) is enough to make
anyone a Filipino.
3. Naturalization – if a person wants to be as citizen of a particular country, maybe
due to the person’s liking the tradition, culture, and lifestyle in that country, then
the person can apply for naturalization of citizenship, subject to applicable laws in
that particular territory.
MEANING OF SUBJECT AND ALIEN

1. A citizen is a member of a democratic community who enjoys


full civil and political rights. In a monarchial state, he is often
called the subject.
2. An alien is citizen of a country who is residing in or through
another country. He is populary called “foreigner”.
LOSS OF CITIZENSHIP
One’s citizenship is not permanent, indelible mark. It may be lost due to
certain acts. Among are the ff :
1. By renunciation of one’s citizenship and embracing the citizenship of another
country.
2. By taking oath of allegiance to another country upon attaining the age of
majority.
3. By joining the military service of another country.
One’s citizenship may also be lost due to the following reasons :
1. By the court’s cancellation of one’s naturalization; or
2. By being convicted of desertion in the Philippines Armed Forces in times of
war.
NATURALIZATION
Is the act of granting an alien the rights and privileges of
citizenship.There are two ways to be naturalized :
a. By applying to a court and b. through a law passed by Congress
The act of naturalization has several qualifications.They are as
follows :
1. The person must be at least 21 years of age.
2. The person must have resided continuously in the Philippines for at least
10 years.
3. The person must own real estate property in the Philippines or must
have a profitable trade or lawful occupation.
NATURALIZATION

4. The person must have behaved well during his stay in the
Philippines.
5. The person must be able to speak and write in English or
Spanish and any Filipino dialect.
6. He must have enrolled the children if he is married, in any
public or private school.
REASONS FOR DISQUALIFICATION FROM
NATURALIZATION
Not all foreigners can have the chance of apply for naturalization.There are
various reasons for disqualification.These are as follows :
a. If the person does not believe in organized government;
b. If the person’s ideas advocate violence;
c. If the person is a polygamist, or one who believes in having more than one spouse;
d. If person is convicted of a crimes involving immorality; or
e. If the person is suffering from insanity or from an incurable or contagious disease.
One on the other hand, aliens can be deported. Naturalization aliens can travel
and reside in countries. However, if they become undesirable, they can be
deported and ordered to return back to their country of origin.
DUAL CITIZENSHIP
A person may have dual citizenship under any of the following conditions, although
does not necessarily mean dual allegiance:
1. Those born of Filipino father and/or mothers in foreign countries which follow
the principle of Jus soli
2. Those born in the Philippines of Filipino mothers and alien fathers if by the
laws of their fathers’ country such children are citizens of that country
3. Those who marry aliens if by the laws of the latter’s country the former are
considered citizens, unless by their act or omission they are deemed to have
renounced their Philippine citizenship.
The Philippines government has the power to deport
aliens doing the following :
1. Supporting anarchism, violence and other subversive ideologies
2. Smuggling prohibited drugs, cigarettes, liquor, and arms or weapons,
3. Forging and counterfeiting money,
4. Car napping and hijacking
5. Doing immoral acts;
6. Participating in illegal gambling:
7. Disrespecting the Philippines flag
8. Spying:
9. Engaging in child prostitution;
10.Refusing to socially associated with Filipinos or adopt Filipinos
customs, Traditions, and ideals;
11.Refusing to embrace the act of naturalization.
DUTIES AND OBLIGATIONS OF CITIZENS

a. To be loyal the Republic


b. To defend the State
c. To contribute to the development and welfare of the State
d. To uphold the constitution and obey the laws
e. To cooperate with duly-constituted authorities;
f. To exercise responsibly and with due regard for the rights of others
g. To engaged in gainful work
h. To register and vote.
CITIZENSHIP
ARTICLE IV
REMEMBER :

A good citizen is helpful, willing to put others first,


respect them; is a good listener, one that think about
what is important to others; loves knowledge as a way of
a better understand of the world and is a loving person,
who does not like to harm anyone. Good Citizen is also
a GOOD HUMAN BEING.
