Attempts to Amend or Change

the 1987 Constitution

Three methods to change the constitution:

•Constituent Assembly

•Constitutional Convention

•People’s Initiative
Constituent Assembly

• A constituent assembly or constitutional assembly is a


body or assembly of popularly elected representatives
which is assembled for the purpose of drafting or adopting
a constitution or similar document.
Constitutional Convention
• A constitutional convention is a gathering for the
purpose of writing a new constitution or revising an
existing constitution.
People’s Initiative
• People's Initiative (or "PI") is a common appellative in the
Philippines that refers to either a mode for constitutional
amendment provided by the 1987 Philippine Constitution
or to the act of pushing an initiative (national or local)
allowed by the Philippine Initiative and Referendum Act of
1987.
1995 First attempt to amend the constitution

• The Secretary of National Security Council Jose Almonte


drafted a constitution but it was exposed to the media and
it never prospered

1997 Second attempt


• When a group called PIRMA hoped to gather signatures from
voters to change the constitution
• Many were against this including the late Senator Mirriam
Defensor-Santiago, who brought this to the Supreme Court and
won saying that the people’s initiative cannot push through
without an enabling law
1998
• Joseph Ejercito Estrada, formed a study commission to
investigate the issues surrounding charter change focusing
on the economic and judiciary provisions of the
constitution.

2001
• House Speaker Jose de Venecia endorsed constitutional
change through a constituent assembly.
2010
• 15th President Benigno Aquino III had no marked interest
in charter change but under his term Speaker of the House
Feliciano Belmonte Jr. attempted to introduce an
amendment but it also did not succeed.

December 7, 2016
• President Duterte signed an executive order creating a
consultative committee to review the 1987 Constitution.
FEDERALISM
It is a form of government where sovereignty is
constitutionally shared between a central governing
authority and constituent political units called states or
regions.
