How does a person with HIV looks like?

One cannot determine a person’s HIV


status just by looking at him/her.
A person’s HIV status can only be determined
through HIV Antibody Testing

How can I protect myself from HIV?
BSTINENCE: Do not have sex. In the case of adolescents,
delaying sexual debut (age of first sexual encounter) will help.

IMPRISONMENT of 1 yr but not more than 10
yrs. FINE of not <Php 50K and not >Php
500K or BOTH.

Manufacturer, Importer, Distributor: At least 5


yrs IMPRISONMENT but not >10 years; FINE of
not <Php 500K and not >Php 5M.
Imprisonment for 6 to 12 years w/o prejudice
to the imposition of administrative sanctions
such as FINES & SUSPENSION or REVOCATION
of professional license.

CANCELLATION or WITHDRAWAL of permit to


operate business entity or accreditation of
hospital, laboratory or clinic.
Any HCW in a DOH-designated Treatment
Facility for HIV/AIDS who fails to provide the
necessary health services for PLHIVs.

coverage of any PLHIV is in violation of
discrimination.

IMPRISONMENT for 6 mos to 5 yrs and/or a FINE of not

(1)IMPRISONMENT for 6 mos to 2 yrs for
any person who breaches
confidentiality and/or a FINE of not
less than Php 50K but not more than
Php 150K, at the discretion of the
court.
(2) IMPRISONMENT for 2 yrs and 1 day to 5 yrs
for any person who causes the mass
dissemination of the HIV status of a person,
including spreading information online or
making statements to the media
and/or a FINE of not less than Php 150K but not
more than Php 350K, at the discretion of the
court.
(3) IMPRISONMENT for 5 yrs and 1 day to 7 yrs for any
health professional, medical instructor, worker,
employer, recruitment agency, insurance company,
data encoder, and other custodian of any medical
record, file, data, or test result who breaches
confidentiality
and/or a FINE of not <Php 350K but not >Php 500K, at
the discretion of the court.
IMPRISONMENT for 6 mos to 5 yrs and/or a
FINE of not <Php 50K but not >Php 500K,
at the discretion of the court with prejudice
to revocation/cancellation of licenses and
permits.
Use of obtained confidential information on HIV/AIDS to
malign or cause damage, injury, or loss to another person
- face liability under the articles of the new Civil Code of
the Philippines & relevant provisions of RA 10174 (The
Data Privacy Act).

Corresponding imprisonment, fines, revocation or


cancellation of permits & licenses apply, including
deportation for aliens & disqualification from office for
public officials.
