REGULAMENT AL PARLAMENTULUI I CONSILIULUI EUROPEAN
Privind consolidarea supravegherii economice i bugetare a statelor membre care se confrunt
sau sunt ameninate cu dificulti grave n ceea ce privete stabilitatea lor financiar n zona euro.

Avnd n vedere Tratatul privind funcionarea Uniunii Europene, n special articolul 136 in
combinatie cu articolul 121 alineatul (6),
Avnd n vedere propunerea Comisiei Europene,
Avnd n vedere avizul/opinia Bncii Centrale Europene,
Dup transmiterea proiectului de act legislativ ctre Parlamentele naionale,
Hotrnd n conformitate cu procedura legislativ ordinar,
ntruct:
1. Criza mondial fr precedent care a lovit lumea de-a lungul ultimilor trei ani a afectat
grav creterea economic i stabilitatea financiar provocnd o puternic deteriorare a
poziiei deficitului public i datoria public a statelor membre, conducnd un numr

dintre acestea s solicite asisten financiar n afara cadrului Uniunii.


Coerena deplin a cadrului de supraveghere multilateral al Uniunii, instituit prin tratat
i eventualele condiii de politic aferente acestei asistene financiare ar trebui s fie
consacrat n dreptul Uniunii. Integrarea economic i financiar a statelor membre a cror
moned este euro apelurile pentru o supraveghere consolidat pentru a preveni o
contagiune dintr-un stat membru care se confrunt cu dificulti n ceea ce privete

stabilitatea sa financiar pentru restul zonei euro.


3. Intensitatea supravegherii economice i fiscale trebuie s fie proporional cu gravitatea
dificultilor financiare ntmpinate i ar trebui s in seama n mod corespunztor de
natura asistenei financiare primite, care poate varia de la un simplu sprijin preventiv
bazat pe condiiile de eligibilitate pn la un program complet de ajustare
macroeconomic condiionalitate politic strict.

Un stat membru a crui moned este euro ar trebui s fac obiectul unei supravegheri
mai stricte atunci cnd se confrunt - sau risc s se confrunte - cu perturbri financiare
grave, n scopul de a asigura revenirea rapid la o situa ie normal i protec ia celorlalte
euro statele membre din zona mpotriva unor posibile efecte asupra scurgerii negativ. O
supraveghere sporit ar trebui s includ un acces mai larg la informa iile necesare pentru
o monitorizare atent a situaiei economice, fiscale i financiare i o raportare periodic
ctre Comitetul economic i financiar (CEF) sau ctre orice subcomitet acesta din urm
poate desemna n acest scop . Aceleai modaliti de supraveghere ar trebui s se aplice
statelor membre care solicit asisten preventiv de la Fondul european de stabilitate
financiar (FESF), Mecanismul european de stabilitate (MES), Fondul Monetar
Internaional (FMI) sau de o alt instituie financiar internaional.

PROPUNERE DE REZOLUIE A PARLAMENTULUI EUROPEAN


coninnd recomandri ctre Comisie privind aplicarea principiului egalitii de renumerare
ntre lucrtorii de sex masculin i feminin, pentru aceeai munc sau pentru o munc de
valoare egal(2011/2285 (INI))
PARLAMENTUL EUROPEAN
1. Solicit Comisiei s revizuiasc Directiva 2006/54 / CE, pn la 15 februarie 2013 cel
trziu, n conformitate cu articolul 32, precum i de a propune modificarea acestuia n
temeiul articolului 157 din TFUE, n conformitate cu recomandrile detaliate expuse n anexa
la prezenta rezoluie, cel puin n legtur cu urmtoarele aspecte ale problemei diferenei de
remunerare ntre femei i brbai:
- definiii,
- Analiza situaiei i transparena rezultatelor,
- Evaluarea muncii i clasificarea locurilor de munc,
- Organismele de promovare a egalitii i ci legale,
- Dialogul social,
- Prevenirea discriminrii,
- Integrarea dimensiunii de gen,
- sanciuni,
- Raionalizarea reglementrilor UE i a politicii UE

2. Recunoate c mai multe niveluri, abordare multilateral necesit o conducere puternic


din partea Uniunii Europene n coordonarea politicilor, promovarea bunelor practici i
implicarea diferiilor actori ca parteneri sociali europeni, cu scopul de a crea o strategie la
nivel european pentru a aborda diferena de remunerare ntre femei i brbai ;
3. Confirm faptul c recomandrile respect drepturile fundamentale i principiul
subsidiaritii;
4. Consider c propunerea solicitat nu va avea implicaii financiare;

5. Invit statele membre s pun n aplicare i de a pune n aplicare directiva reformat


2006/54 / CE, n mod consecvent i pentru a ncuraja sectorul privat s joace un rol mai activ
n eliminarea diferenei ntre femei i brbai;
6. Subliniaz faptul c negocierea colectiv i de afacere au un rol important n combaterea
discriminrii mpotriva femeilor, nu n ultimul rnd n ceea ce privete accesul la locuri de
munc, s plteasc, condiiile de munc, avansarea n carier i formarea profesional;
7. ntmpin iniiativa Ziua Egalitii Salariale a Comisiei care a fost prima dat stabilit la 5
martie 2011;
8. . ntmpin iniiativa Consiliului, sub preedinia belgian, n 2010, privind evaluarea i
actualizarea setului de indicatori cantitativi i calitativi;
9. ncurajeaz Comisia s promoveze o coordonare mai strns ntre statele membre n ceea
ce privete cercetarea, analiza i profitnd pe deplin de partajare a celor mai bune practici;
10. Solicit Comisiei s revizuiasc Directiva Consiliului privind acordul-cadru cu privire la
munca pe fraciune de norm, n scopul eliminrii decalajului de remunerare ntre femei i
brbai;
11. ncurajeaz partenerii sociali s-i asume responsabilitatea pentru crearea unei structuri
mai salariale egale ntre femei i brbai;
12. Solicit lucrtorilor i angajatorilor organizaiilor s dezvolte mpreun instrumente de
evaluare a muncii obiective, pentru a reduce diferena de remunerare ntre brbai i femei;
13. ncredineaz Preedintelui sarcina de a transmite prezenta rezoluie, precum i
recomandrile detaliate Comisiei, Consiliului i guvernelor i parlamentelor statelor membre.

Articolul 1
Obiect i domeniu de aplicare
1. Prezentul regulament stabilete dispoziii pentru consolidarea supravegherii economice i
bugetare a statelor membre care se confrunt sau sunt ameninate cu dificult i grave n ceea ce
privete stabilitatea lor financiar i / sau care primesc sau pot primi asisten financiar din
partea unuia sau mai multor alte state, de stabilitate financiar european facilitate (FESF),
Mecanismul european de stabilitate financiar (MESF), Mecanismul european de stabilitate
(MES) sau a altor instituii financiare internaionale (IFI), cum ar fi Fondul Monetar Internaional
(FMI).

2. Prezentul regulament se aplic statelor membre a cror moned este euro.


Articolul
Statele membre n cadrul unei supravegheri mai stricte
1. Comisia poate decide ca un stat membru care se confrunt cu dificult i grave n ceea ce
privete stabilitatea sa financiar s fie supus unei supravegheri mai stricte. Statul membru n
cauz i se ofer posibilitatea de a-i exprima punctul de vedere n prealabil. Comisia decide o
dat la ase luni dac prelungete supravegherea consolidat.
2. Comisia va decide dac un stat membru care beneficiaz de asisten financiar preventiv din
partea unuia sau mai multor alte state, a FESF, MES sau a oricrei alte institu ii financiare
internaionale, precum FMI, sub rezerva unei supravegheri mai stricte. Comisia stabilete o list
a instrumentelor de asisten financiar preventiv n cauz i l actualizeaz n funcie de
eventualele schimbri intervenite n politica de susinere financiar a FESF, MES sau oricare alt
instituie financiar internaional relevant.

3. Paragraful 2 nu se aplic n cazul unui stat membru care beneficiaz de asisten financiar
preventiv sub forma unei linii de credit care nu este condiionat de adoptarea unor noi msuri
de politic de ctre statul membru n cauz, atta timp ct linia de credit este nu tras.

Articolul 3
Supravegherea consolidat

1. Un stat membru care face obiectul unei supravegheri mai stricte trebuie, n consultare i
cooperare cu Comisia, acionnd n colaborare cu Banca Central European (BCE), s adopte
msuri care vizeaz abordarea surselor reale sau poteniale de dificulti.

2. Monitorizarea mai atent a situaiei fiscale, prevzut la articolul 7, alineatele 2, 3 i 6, din


Regulamentul (UE) nr XXX al Parlamentului European i al Consiliului se aplic unui stat
membru care face obiectul unei supravegheri mai stricte, indiferent de existena unui deficit
excesiv. Raportul n conformitate cu alineatul 3 din prezentul articol se depun trimestrial.

3. La solicitarea Comisiei, statul membru care face obiectul unei supravegheri mai stricte trebuie:

(a) s comunice Comisiei, BCE i Autoritatea Bancar European (ABE), la intervalele solicitate
informaii detaliate privind situaia financiar a instituiilor financiare, care se afl sub
supravegherea autoritilor de supraveghere naionale;

(b) s efectueze, sub supravegherea Autoritii Bancare Europene, exerciii de stress test sau
analize ale sensibilitii dup cum este necesar pentru a evalua rezilien a sectorului bancar la
diverse ocuri macroeconomice i financiare, astfel cum sunt specificate de ctre Comisie i
BCE, i a cotei de rezultatele detaliate cu acestea;

(c) s fac obiectul unor evaluri periodice ale capacitilor sale de supraveghere a sectorului
bancar n cadrul evalurii inter pares efectuate de ABE;

(d) s comunice orice informaii necesare pentru monitorizarea dezechilibrelor macroeconomice


stabilite prin Regulamentul nr XXX al Parlamentului European i al Consiliului privind
prevenirea i corectarea dezechilibrelor macroeconomice.

MEMORANDUM EXPLICATIV
1. CONTEXTUL PROPUNERII
Acest memorandum explic un cadru legal propus, creat pentru a ntrii ncrederea n tranzac iile
electronice pe piaa intern.
Creterea ncrederii n mediul online este esenial pentru dezvoltarea economic. Lipsa
ncrederii face consumatorii, afacerile i administraia s ezite s desfoare tranzacii electronice
i s adopte noi servicii.
Agenda Digital pentru Europa identific bariere existente pentru dezvoltarea digital a Europei
i propune legislaia pe e-semnturi ( Cheia de Aciune 3) i recunosterea mutual a eidentificrii i autentificrii ( Cheia de Aciune 16 ), stabilind un cadru legal clar cu scopul de a
elimina dizolvarea i lipsa operabilitii ntre pri, ntrirea ceteniei digitale i prevenirea
infraciunilor cibernetice.
Legislaia care ntrete recunoaterea mutual a identificrii electronice n spaiul UE i
reevaluarea Directivei Semnturii Electronice este de asemenea o cheie de ac iune n Actul Pie ei
Unice, pentru realizarea pieei digitale unice.
Harta pentru Stabilitate i Cretere subliniaz rolul cheie pentru dezvoltarea economiei digitale a
viitorului cadru legal comun pentru recunoatere mutual i acceptare a identificrii economice i
autentificrii de-a lungul granielor.
Cadrul legal propus, care const n Reglementarea Parlamentului i Consiliului European pe
tema identificrii electronice i a serviciilor de ncredere pentru tranzacii electronice pe piaa
intern, urmrete s permit interaciuni electronice sigure i unitare ntre afaceri, cet eni i
autoritile publice, dezvoltnd astfel eficacitatea serviciilor online publice i private, a eafacerilor i comerului electronic n UE.
Legislaia existent a UE, i anume Directiva 1999/93/CE pe Cadrul comunitar
pentru semnturi electronice acoper n mod esenial doar semntura electronic.
Nu exist niciun cadru UE transfrontalier i intersectorial cuprinztor pentru
tranzacii electronice sigure, demne de ncredere i uor de folosit, care s includ
identificarea, autentificarea i semnturile electronice.

Scopul este de a consolida legislaia existent i de a o extinde pentru a reglementa recunoaterea


i acceptarea reciproc, la nivelul UE, a sistemelor notificate de identificare electronic i a altor
servicii de asigurare a ncrederii electronice conexe eseniale.

2. REZULTATELE CONSULTRILOR CU PRILE INTERESATE


I EVALURILE DE IMPACT

Aceast iniiativ este rezultatul consultrilor extinse asupra unei revizuiri a cadrului juridic
actual privind semnturile electronice n cursul crora Comisia a colectat reacii din partea
statelor membre, a Parlamentului European i a altor pri interesate. A fost organizat o
consultare public online completat de o analiz de impact SME pentru a colecta opiniile i
nevoile specifice ale SME i alte consultri vizate cu prile interesate. De asemenea, comisia a
lansat un numr de studii n relaie cu identificarea electronic, autentificarea i serviciile de
ncredere (eIAS).
