Proceduri legislative

Tipuri de legi comunitare:

(1) Legislatie primara: a) Tratatele prin care
s-au infiintat comunitatile; b) Principiile
generale ale legii.
(2) Legislatie secundara: a)Regulamentele;
b) Directivele c) recomandarile si opiniile;
(3) Jurisprudenta (ECJ, ECFI, EC)
(4) Acordurile internationale ale
comunitatii europene
Trei tipuri de obligativitate in
legislatia comunitara:
(1) Regulamente: sunt impuse direct si automat, si
se aplica pe teritoriul tuturor statelor membre.
(2) Directive: impun ajungerea la acelasi rezultat
in toate tarile membre, dar fiecare stat isi alege
maniera de implementare a lor.
(3) Decizii: emise de Consiliul European sau de
Comisia Europeana; sunt obligatorii doar pentru
statele membre sau persoanele fizice/ juridice
carora le sunt adresate .
(4) Recommendari si opinii (nu au efect
obligatoriu) facute de Consiliu sau de Comisie
Legislatia in pregatire :
 Cartea Verde sau Cartea Alba (Green
Paper sau White Paper) pentru a stimula
dezbaterea publica si care detaliaza aspecte
propuse de Comisie
 Inainte ca o propunere sa devina oficial,
Comisia initiaza o Carte Verde sau Alba
 Propunerea Comisiei numita si Commission
Proposal, sau “preparatory act”, poate fi
amendata de mai multe ori.
Procesul legislativ in UE:
 Consultare
 Cooperare
 Co-Decizie
 Incepand cu Tratatul de la Maastricht,
acccentul in legislatie s-a pus pe procedura
co-deciziei, Parlamentul si Consiliul
exercitand impreuna functia legislativa, in
legatura cu propunerile venite, in mare
parte, de la Comisie.
Proceduri legislative
 Consultatarea (ToR 1957): Propunerile Comisiei devin legi daca sunt
sustinute de o majoritate de voturi in Consiliu

 Co-operare (SEA 1987):

– Initial s-a aplicat in mod extins se mai aplica politicilor sociale, R&D
– Parlamentul poate amenda, cu consimtamantul Comisiei si cu votul
Parlamentului
– Parlamentul poate respinge o propunere

 Co-decizia (Maastricht 1992)

– Toate aspectele privind pietele interne, sanatatea publica, educatia,
protectia consumatorilor
– Ii permite Parlamentului European sa aiba drept de veto asupra
legislatiei europene
– Consiliul nu poate respinge un amendament al Parlamentului, daca
Comisia il sustine – procedura de reconciliere
