Aplicarea abord rii globale privind migra ia pentru regiunile care se nvecineaz cu
Uniunea European la est i sud-est

INTRODUCERE
n decembrie 2005, Consiliul European a adoptat Abordarea global a migra iei care
s-a concentrat ini ial asupra Africii i regiunii mediteraneene. n concluziile sale din
decembrie 20061, Consiliul European a solicitat Comisiei s fac propuneri privind
un dialog intensificat i m suri concrete cu privire la aplicarea abord rii globale n
cazul regiunilor care se nvecineaz cu Uniunea European la est i sud-est. Prezenta
comunicare vine n ntmpinarea acestei solicit ri i propune o abordare bazat pe
conceptul de rut a migra iei (a se vedea anexa I care include un glosar al tuturor
termenilor folosi i n acest text i o explicare a acronimelor).
Prezenta comunicare se concentreaz n principal asupra regiunilor care se
nvecineaz cu UE la est i sud-est care, n perspectiva Comisiei, includ urm toarele:
Turcia, Balcanii Occidentali (Albania, Bosnia i Her egovina, Croa ia, Fosta
Republic Iugoslav a Macedoniei, Muntenegru i Serbia, inclusiv Kosovo2); rile
partenere din cadrul politicii europene de vecin tate (PEV) din Europa de Est
(Ucraina, Moldova i Belarus3), precum i din Caucazul de Sud (Armenia,
Arzeibaidjan i Georgia); i Federa ia Rus .
n punerea n aplicare a prezentei comunic ri, ar trebui s fie n primul rnd luate n
considerare recomand rile legate direct de aceste ri. Cu toate acestea, aplicarea
abord rii globale regiunilor care se nvecineaz cu UE la est i la sud-est, n
conformitate cu conceptul de rut de migra ie presupune, de asemenea, luarea n
considerare a rilor de origine i de tranzit situate mai departe de acestea.
Deopotriv , trebuie s se acorde aten ie urm toarelor:
rilor partenere PEV din Orientul Mijlociu (Siria, Iordania i Liban), Iranului,
Irakului; Asiei Centrale (Kazahstan, Krgzstan, Tadjikistan, Turkmenistan i
Uzbekistan); i rilor din Asia, precum China, India, Pakistan, Afghanistan,
Bangladesh, Sri Lanka, Vietnam, Filipine i Indonezia.
Prezenta comunicare face recomand ri pe termen mediu i lung pentru aceste
regiuni.

Cu toate rile men ionate anterior, Comunitatea a instituit un cadru institu ional n
care s-au stabilit un dialog politic i economic i rela ii de cooperare, incluznd n
general domeniul migra iei. Prezenta comunicare cuprinde o prezentare a acestor
cadre corespunz toare fiec rui grup de ri. n unele cazuri, dialogul i cooperarea n
domeniul migra iei i al subiectelor conexe (precum ocuparea for ei de munc i
educa ia) sunt deja foarte dezvoltate. Orice posibilitate de intensificare a dialogului i

n cazul Belarusului, dialogul ar trebui s se desf oare n conformitate cu restric iile care se aplic
rela iilor UE-Belarus n ceea ce prive te contactele cu autorit ile i ntr-un cadru regional.

Turcia a fost oficial recunoscut drept ar candidat n decembrie 1999. Negocierile de aderare au fost
lansate la 3 octombrie 2005. Croa ia este, de asemenea, o ar candidat n curs de negocieri n vederea
ader rii la UE. Fostei Republici Iugoslave a Macedoniei i-a fost conferit statutul de ar candidat n
decembrie 2005, dar nu a lansat nc negocierile de aderare.
ASA cu Croa ia i cu Fosta Republic a Macedoniei sunt n vigoare, ASA cu Albania a fost semnat dar
nu a fost nc ratificat, ASA cu Muntenegru a fosta parafat, negocierile privind un ASA cu Bosnia i
Her egovina au fost ncheiate, n timp ce negocierile n vederea unui ASA cu Serbia sunt n prezent
suspendate.

n vederea complet rii dialogului privind migra ia din cadrul forurilor bilaterale i
regionale, platforme de cooperare la nivel na ional i subregional privind migra ia ar
putea facilita n continuare dialogul ntre to i protagoni tii implica i, valorificndu-se
experien a acumulat n urma ini iativei MARRI.
Dialogul cu autorit ile din rile candidate i partenere ar trebui s includ discu ii cu
privire la modul n care impactul migra iei asupra dezvolt rii poate contribui la
nt rirea stabilit ii i stimularea cre terii n regiune. Ar trebui dezvoltate politici care
s previn atragerea de inteligen , precum investi ia n formare i n consolidarea
capacit ii n vederea mbun t irii condi iilor de munc i sporirii oportunit ilor de
ncadrare n munc , contribuind astfel la prevenirea exodului lucr torilor califica i. Ar
trebui analizate n continuare modalit ile de reducere a costurilor legate de transferul
fondurilor i sporirea impactului acestora asupra dezvolt rii rilor din aceast regiune. Ar
trebui aranjate vizite de studiu ale exper ilor n scopul ncuraj rii contactelor i stimul rii
cooper rii directe ntre administra ii, precum i examin rii capacit ii institu ionale. De
asemenea, ar putea fi organizate ateliere referitoare la diverse aspecte ale agendei privind
migra ia i dezvoltarea. n final, ar trebui ncurajate ini iative destinate s dezvolte leg turi
ntre migran ii cu nalte calific ri, precum cercet torii tiin ifici, i rile acestora de
origine.
Ar trebui sporite oportunit ile privind migra ia circulatorie, n acela i timp lundu-se n
considerare deplas rile transfrontaliere existente, pe termen scurt i cu caracter sezonier
din regiune. Cu excep ia Croa iei care beneficiaz deja de un regim de liberalizare a vizelor
pentru UE, regimul vizelor n regiune trebuie mbun t it i armonizat n continuare n
vederea permiterii circula iei for ei de munc . Ar trebui analizat posibilitatea oferirii unei
game mai variate de programe de schimb pentru cercet tori i studen i. De asemenea, ar
trebui acordat o aten ie cuvenit asigur rii preg tirii corespunz toare a migran ilor, n
sensul unei idei realiste despre via i oportunit ile de ocupare a for ei de munc n UE.
Cursuri de formare sau programe speciale i o corelare a cererii i a ofertei n ceea ce
prive te for a de munc ar contribui la acest proces. Portalurile privind migra ia vor de ine
un rol esen ial n acest sens i vor fi func ionale pn la sfr itul lui 2007. Ca urmare a
evalu rii experien ei acumulate n cadrul centrelor actuale pentru servicii n domeniul
migra iei, alte centre de acest tip ar putea fi create. nfiin area unor puncte focale n fiecare
minister al muncii sau al internelor ar contribui la definirea unor politici adecvate care s
asigure un echilibru ntre nevoile for ei de munc i securitatea aspectelor privind migra ia.
n ceea ce prive te vizele pentru o perioad scurt , punerea n aplicare a acordurilor
comunitare de facilitare a regimului vizelor, parafate pn n prezent cu unele ri din
Balcanii Occidentali, va contribui la mbun t irea i simplificarea procedurilor de
acordare a vizelor pentru anumite categorii de cet eni ai acestor ri.
Legisla ia n domeniul azilului i protec iei refugia ilor ar trebui consolidat sau
completat n vederea oferirii de garan ii juridice complete n ceea ce prive te drepturile
persoanelor care pot avea nevoie de protec ie interna ional . Muntenegru i Serbia trebuie
nc s adopte legi fundamentale n domeniul azilului i ar trebui ncurajate n acest sens.
Turcia trebuie n continuare s - i modifice legisla ia primar n domeniul azilului n
conformitate cu acquis-ul aferent, s asigure punerea n aplicare eficient a acesteia,
precum i s stabileasc o capacitate administrativ corespunz toare celor mai bune
practici la nivelul UE. n toate statele, este necesar s se depun eforturi sporite pentru a

asigura punerea n practic adecvat a dispozi iilor juridice. Este nevoie s se consolideze
lupta mpotriva imigra iei ilegale i traficului de persoane. n acest sens, FRONTEX ar
trebui s dezvolte n continuare rela iile existente cu rile din aceast regiune. Asisten a
tehnic pentru rile partenere care ar include formarea suplimentar a poli iei de frontier
i a func ionarilor din domeniul migra iei, ct i dezvoltarea de statistici fiabile pentru
cazuri semnalate, ar trebui asigurat prin folosirea unor instrumente precum IAP sau
programele de nfr ire i TAIEX. Unele ac iuni privind controlul frontierelor i
gestionarea migra iei n rile candidate la UE i n eventualele ri candidate pot, de
asemenea, beneficia de asisten prin IAP. Acordurile de readmisie CE cu rile din
Balcanii Occidentali trebuie puse n aplicare, iar acordul de readmisie CE cu Turcia trebuie
ncheiat n cel mai scurt timp6.
Promovarea unei cooper ri mai strnse pentru punerea n aplicare a legisla iei
pluridisciplinare regionale n scopul combaterii crimei organizate este necesar la nivelul
UE, n special prin consolidarea cooper rii ntre Europol i Centrul SECI din Bucure ti. n
acest sens, se va ncheia un memorandum de n elegere ntre Europol i SECI, care s
abordeze ndeosebi subiectul traficului de persoane, n timp ce obiectivul pe termen lung l
reprezint ncheierea unui acord de cooperare opera ional .

Acordul de readmisie CE cu Albania este n vigoare din mai 2006; Acordurile de readmisie cu Bosnia i
Her egovina, Serbia, Fosta Republic Iugoslav a Macedoniei i Muntenegru au fost parafate i
urmeaz s intre n vigoare pn la sfr itul lui 2007.

n mod cert, rela iile cu fiecare ar n parte difer , dar priorit ile pe termen scurt ar
trebui s includ urm toarele:
n pofida faptului c exist deja cadrul necesar pentru dialogul la nivel bilateral cu toate
aceste ri (cu excep ia Belarusului), este necesar ini ierea n prezent a dialogului privind
aceste aspecte cu Armenia, Azerbaidjan i Georgia n contextul planurilor acestora de
ac iune PEV, iar pentru Moldova i Ucraina dialogul existent este n curs de a fi
aprofundat. Cu toate c rela iile cu Belarusul sunt limitate, ar trebui ini iate contacte la
nivel de exper i privind aspecte legate de migra ie. Un astfel de dialog este n egal m sur
important pentru abordarea problemei referitoare la xenofobie i impactului acesteia asupra
migra iei i integr rii.
La nivelul regional la care migra ia i aspectele aferente acesteia sunt abordate, s-ar putea
beneficia de experien a acumulat n urma proceselor de la Sderkping i Budapesta. De
asemenea, ar trebui nt rit sprijinul pentru mbun t irea capacit ii rilor partenere de a
trata migran ii ilegali n conformitate cu standardele interna ionale. Acest lucru ar putea fi
legat att de deten ia migran ilor ilegali, de nevoile victimelor traficului de persoane,
precum i ale altor persoane vulnerabile, ct i de standardele privind protec ia
interna ional a refugia ilor pe care aceste ri sunt obligate s le respecte ( i anume n
calitatea lor de membrii ai Consiliului Europei). Totu i, se observ nc lipsa unei
legisla ii, a unor proceduri i practici eficiente n domeniul azilului i protec iei
refugia ilor. Eforturile ar trebui continuate al turi de organiza iile interesate, inclusiv n
ceea ce prive te reintegrarea persoanelor repatriate.
Prin promovarea unei abord ri globale a migra iei, regiunea M rii Negre prezint o
importan deosebit n ceea ce prive te migra ia i traficul de tranzit. Plecnd de la
structurile de cooperare existente n regiunea M rii Baltice, ar trebui analizat viabilitatea
stabilirii unei platforme de cooperare regional care ar reuni state membre ale UE
interesate, agen ii ale UE, alte ri care au ca frontier Marea Neagr , organiza ii regionale
precum SECI, Organiza ia Cooper rii Economice a M rii Negre (OCEMN), Task Force
pentru crima organizat din regiunea M rii Baltice (Baltic Sea Task Force on Organised
Crime, TF-OC), ct i Forumul M rii Negre, n efortul de a mbun t i gestionarea
migra iei. n acest context, s-ar putea promova folosirea n comun a informa iilor i s-ar
putea coordona activit ile de patrulare i de supraveghere. Contribu ia UE poate s varieze
de la activit i de formare (nfr ire) a personalului responsabil cu aplicarea legii, la
cooperarea cu FRONTEX i Europol, precum i de la aspecte ca de exemplu protec ia
social i formarea func ionarilor pe teme legate de for a de munc , la reabilitarea
victimelor traficului de persoane.

Nu exist nici un APC n vigoare cu Belarusul i, n conformitate cu concluziile Consiliului, rela iile
UE cu Belarusul sunt reglementate printr-o politic cu dubl orientare, i anume politica contactelor
restrnse la nivel ministerial n paralel cu asisten a CE pentru procesul de democratizare i sprijinul
pentru nevoile popula iei.

Federa ia Rus

Recomand ri
Din momentul dezmembr rii URSS, Rusia a reprezentat o destina ie principal
pentru refugia i i migran i economici din rile nvecinate, precum i o ar cu un
num r mare de persoane dislocate n interiorul teritoriului. Recent, Rusia a devenit,
de asemenea, o ar de tranzit major pentru fluxurile de migran i, n principal, din
Asia de Sud-Est, China i Afganistan, nspre Europa Occidental . Astfel, cooperarea
cu Rusia privind politicile n domeniul migra iei, ct i circula ia persoanelor
reprezint un aspect de o importan crescnd .
Este necesar s se aprofundeze dialogul global cu Rusia privind aspecte legate de migra ie
inclusiv azilul, lupta mpotriva migra iei ilegale i traficului de persoane, migra ia for ei de
munc , ct i privind toate aspectele sociale aferente ale migra iei. Sporirea schimburilor
de experien ntre statele membre ale UE i Rusia cu privire la gestionarea migra iei for ei
de munc ar fi deosebit de folositoare.
Ar trebui s se intensifice punerea n aplicare a priorit ilor stabilite prin foaia de parcurs
a spa iului comun, i anume obiectivele referitoare la schimbul de informa ii privind

politicile de gestionare a migra iei i de cele mai bune practici, inclusiv evaluarea
statisticilor i, dac este cazul, cooperarea cu rile ter e. n acest context, ar trebui
ncurajat cooperarea ntre autorit ile competente responsabile de punerea n aplicare a
acordurilor privind facilitarea readmisiei i regimul vizelor, printr-o monitorizare atent a
procesului de punere n aplicare a acestora, contribuind astfel la o combatere mai eficient
a migra iei ilegale i favoriznd n acela i timp contactele interumane. n plus, dup cum sa stabilit n spa iul comun, a fost ini iat n calitate de obiectiv pe termen lung, dialogul
pentru analizarea condi iilor privind c l toriile care nu presupun obligativitatea de inerii
unei vize. Cadrul recent stabilit ar putea fi folosit n vederea examin rii de modalit i de
amplificare a rela iilor n alte domenii legate de migra ie.
Este necesar solu ionarea preocup rilor referitoare la punerea n aplicare de c tre
legisla ia rus a Conven iei privind statutul refugia iilor din 1951, printr-o consolidare a
cooper rii cu Federa ia Rus n ceea ce prive te azilul. De asemenea, este necesar s se
mbun t easc protec ia persoanelor dislocate n interiorul teritoriului n conformitate cu
standardele interna ionale, n special pentru a evita exercitarea de presiuni asupra
sistemelor de azil ale rilor nvecinate.
Schimburile de informa ii privind cadrul legislativ n leg tur cu toate formele de trafic de
persoane ar trebui ncurajate, inclusiv n contextul task force pentru crima organizat (TFOC). Ar trebui ndeosebi sporit punerea n aplicare a Acordului de cooperare EuropolRusia din 2003 privind lupta mpotriva diverselor forme de activit i ilegale
transna ionale. De asemenea, ar trebui sporit sprijinul pentru activitatea TF-OC n lupta
mpotriva traficului de persoane, n calitate de instrument destinat mbun t irii cooper rii
regionale pluridisciplinare privind aplicarea legii n regiunea M rii Baltice i, n special, n
Federa ia Rus . Ar trebui analizate modalit i de consolidare a rolurilor Europol i
FRONTEX n regiunea M rii Baltice.
Existen a unei cooper ri opera ionale eficiente ntre FRONTEX i serviciul de paz a
frontierelor ruse, dup cum se prevede n mandat, este important , n special, pentru
promovarea celor mai bune practici n ceea ce prive te gestionarea frontierelor.
3.
ALTE REGIUNI
3.1.

3.1.1.

Dialogul cu Libanul i Iordania n domeniul migra iei, vizelor, azilului i gestion rii
frontierelor va fi continuat n mod activ n cadrul reuniunilor subcomitetului aferent i n
conformitate cu priorit ile stabilite n planurile de ac iune PEV. n ceea ce prive te Siria,
un dialog bilateral privind migra ia va fi lansat dup semnarea acordului de asociere.
Avnd n vedere importan a crescnd a aspectelor legate de refugia ii din aceste ri, n
special n ceea ce prive te conflictul din Irak i impactul acestuia asupra rilor nvecinate
i lund n considerare faptul c pn n prezent majoritatea refugia ilor se afl n rile
gazd (Iordania i Siria fiind rile gazd cele mai importante cu 750 000 i respectiv 1
milion de refugia i), UE trebuie s fie preg tit s sprijine i s participe n continuare la
ini iativele adecvate privind dialogul regional sau cooperarea. n rela iile lor cu Iordania i
Siria, UE i statele membre ar trebui s promoveze n continuare condi ii care s permit
comunit ii interna ionale s asigure asisten umanitar i protec ie interna ional , inclusiv
sprijin prin proiecte de reabilitare i alte programe.
Iranul ar trebui ncurajat s de in un rol mai activ n cooperarea cu rile nvecinate (n
special Turcia i Caucazul de Sud, dar i Pakistan i Afganistan) pentru prevenirea i
urm rirea penal a migra iei clandestine i a traficului de persoane. S-ar putea analiza
forme pilot concrete de cooperare la nivel tehnic.
Toate aceste ri ar trebui deopotriv ncurajate s ratifice, dac este cazul, i s pun n
aplicare Conven ia de la Geneva, precum i Conven ia ONU mpotriva criminalit ii
transna ionale organizate (UNTOC) i protocoalele adi ionale.
3.2.
Asia Central
3.2.1.

Negocierile cu Iranul pentru ncheierea unui acord comercial i de cooperare (ACC) au fost lansate n
2002. Din cauza crizei nucleare iraniene, nicio rund de negocieri nu a putut avea loc dup iulie 2005.
n momentul n care este posibil s se reia negocierile pentru ncheierea unui ACC, UE i Republica
Islamic Iran pot considera c este n interesul lor comun s includ unele dispozi ii specifice pentru
dialog i cooperare n domeniul migra iei.
n noiembrie 2006, Comisia a deschis negocierile pentru ncheierea unui ACC cu Irakul. Dialogul cu
Irakul n domeniul migra iei, vizelor i azilului va depinde semnificativ de situa ia privind securitatea n
Irak, ct i de m sura n care administra ia irakian i consolideaz capacit ile proprii.

n ceea ce prive te gestionarea frontierelor s-ar putea analiza posibilitatea stabilirii unei
cooper ri sporite, n conformitate cu orientarea proiectului BOMCA (Border Management
Programme for Central Asia Programul de gestionare a frontierelor din Asia Central ),
sau prin intermediul altor proiecte n desf urare din domeniul gestion rii migra iei for ei
de munc .
Pentru rile din regiune s-ar putea lua n considerare acordarea de asisten tehnic n
vederea sporirii cooper rii acestora cu UE, Turcia i rile estice partenere din PEV pentru
prevenirea migra iei ilegale i pentru lupta mpotriva migra iei clandestine i traficului de
persoane.

Pe lng aspectele legate de migra ie i de dezvoltare, domenii precum regimul
vizelor, azilul, migra ia i alte politici din domeniul liberei circula ii a persoanelor
dobndesc o importan crescnd n rela iile noastre cu Asia, n special n contextul
dezvolt rii rela iilor comerciale, inclusiv a comer ului cu servicii; al schimb rilor
demografice care nregistreaz o cre tere semnificativ a popula iei n cea mai mare
parte a Asiei, n contrast cu declinul popula iei n Europa; precum i al importan ei

Numeroase ini iative diverse sunt deja luate n vederea promov rii gestion rii
migra iei n rile i regiunile nvecinate, ct i n cele mai dep rtate. Lund n
considerare faptul c valoarea Abord rii globale ar cre te dac s-ar asigura o coeren
i o complementaritate sporite ntre aceste ini iative, Comisia propune ca statele
membre s contribuie ini ial la completarea listei tuturor ini iativelor comunitare din
rile i regiunile care fac obiectul prezentei comunic ri (a se vedea anexa I) cu lista
propriilor ini iative na ionale. Astfel, se poate stabili o imagine complet a situa iei
actuale.
Pe lng aceasta, se pot ntreprinde mai multe ac iuni pentru a n elege amploarea i
caracteristicile fluxurilor de migra ie care provin din est i sud-est. Informa iile
disponibile nu sunt reunite sau folosite n mod sistematic. Anumite organiza ii dispun

de informa ii valoroase referitoare la diverse regiuni care fac parte din abordarea
global a migra iei. Ar putea fi luat n considerare o ini iativ de instituire a unei
re ele de schimb de informa ii ntre FRONTEX, Europol, OIM (Organiza ia
Interna ional pentru Migra ie), ICMPD (Centrul Interna ional pentru Dezvoltarea
Politicilor n domeniul Migra iei), OIM (Organiza ia Interna ional a Muncii),
diverse agen ii ale ONU Programul Na iunilor Unite pentru Dezvoltare (UNDP),
naltul Comisariat ONU pentru Refugia i (UNHCR) i Oficiul Na iunilor Unite
privind Drogurile i Crima (UNODC) n special i alte organiza ii interna ionale i
regionale, precum Ini iativa de cooperare n Europa de Sud-Est (SECI).
Avnd n vedere importan a migra iei clandestine i a traficului de persoane, este
necesar o abordare mai coordonat pentru a duce mai departe ini iativele politice
destinate s lupte mpotriva acestui fenomen. Ini iativele concrete ar putea include
dezvoltarea mai ampl a listelor de ini iative existente (a a cum au fost deja
ntocmite de Alian a mpotriva Traficului de Persoane), extinderea dialogului cu
rile ter e privind promovarea politicilor eficiente de combatere a traficului de
persoane, precum i abordarea unor domenii specifice de interes, precum protec ia
victimelor acestui trafic, n special femeile i copii. n plus, UE ar trebui s ia n
considerare o participare activ n cadrul unor ini iative globale n desf urare,
precum Grupul ONU de cooperare interinstitu ional privind traficul de persoane

n scopul combaterii fluxurilor ilegale de migra ie, ar trebui s se acorde o mai mare
importan rolului de inut de FRONTEX i, n acela i timp, s se asigure o coeren
i o coordonare ntre activit ile acesteia i politica global a UE n domeniul
rela iilor externe. Printre priorit ile geografice ale Agen iei FRONTEX n 2007 se
num r dezvoltarea cooper rii cu Rusia, Ucraina, Moldova, Georgia, Balcanii
Occidentali i rile din Asia, n special China, Pakistan i India. Avnd n vedere c
n prezent strategia i programul de lucru sunt stabilite, este necesar s se garanteze
Agen iei FRONTEX resursele de care are nevoie pentru ndeplinirea eficient a
mandatului s u, iar statele membre trebuie s se asigure c dispun de resurse
disponibile adecvate pentru participarea la opera iunile comune ale FRONTEX i la
analizele de risc, dac este cazul. De asemenea, se recomand posibilitatea folosirii
RABIT (echipe de interven ie rapid la frontiere) la frontierele din est i sud-est.
FRONTEX ar trebui s dezvolte n continuare metodologii adecvate de informare
pentru a oferi analize de risc fiabile i ar trebui, n egal m sur , ncurajat s
participe la proiecte, reuniuni, conferin e i programe de formare cu rile ter e.
De asemenea, este necesar o abordare mai coordonat pentru a asigura

Statele membre ale UE ar putea spori n regiune num rul ofi erilor de leg tur n
domeniul imigra iei (ILO) i dezvolta re elele de ILO pe rutele principale de
migra ie. Comunitatea poate contribui la aceste eforturi prin Fondul European pentru
Frontierele Externe.
Instituirea unor centre comune pentru solicitarea de vize precum cel deschis n
Moldova care beneficiaz de cooperarea cu Austria, Ungaria, Letonia i Slovenia i,
n curnd, cu Estonia i Danemarca ar putea, de asemenea, s contribuie la
furnizarea comun de servicii ntre statele membre. n plus, lansarea la nivel regional
a Sistemului de informa ii privind vizele ar putea stimula intensificarea reprezent rii
statelor membre, precum i nfiin area unor centre comune pentru solicitarea de vize
n aceast regiune.

biroului este totu i limitat la rile candidate i la rile care fac obiectul PEV. n
viitor s-ar putea analiza noi forme de cooperare.

CONCLUZII
Regiunile care se nvecineaz cu UE la est i sud-est sunt importante n ceea ce
prive te migra ia legal i ilegal , att n rndul rilor din regiunea respectiv , ct i
pentru UE. Dialogul i cooperarea n domeniul migra iei se afl deja ntr-o etap
foarte avansat cu numeroase ri din aceste regiuni, n special cu privire la lupta
mpotriva migra iei ilegale. Aplicarea Abord rii globale n cazul acestor regiuni
presupune c , n m sura mijloacelor disponibile, au loc n continuare dezvoltarea,
echilibrarea i extinderea cooper rii i anume printr-o abordare mbun t it a
aspectelor legate de mobilitate i de dezvoltarea dimensiunii migra iei n scopul de
a permite UE s c tige mai mult credibilitate n fa a partenerilor s i i s accead la
etapa urm toare n procesul de cooperare cu ace tia.
ntr-o prim faz , Comisia consider esen ial ca, folosindu-se cadrul existent pentru
discutarea migra iei, s fie intensificat dialogul i consolidate acordurile privind
mobilitatea n rela iile UE cu rile partenere PEV. Pentru ndeplinirea acestei
priorit i politice, pn la sfr itul lui 2007, ar trebui realizat o evaluare a
procedurilor actuale de acordare a vizelor i ar trebui analizate m surile practice
pentru facilitarea mobilit ii categoriilor principale de c l tori prev zute de
regimurile actuale de vize. Dat fiind modificarea frontierelor UE dup extindere, n
prezent, promovarea cooper rii regionale cu regiunea M rii Negre i n interiorul
acestei regiuni, n special n domeniile referitoare la controlul frontierelor i la
combaterea migra iei ilegale solicit o aten ie special . De asemenea, cooperarea cu
Federa ia Rus ar trebui continuat i intensificat . n plus, se vor extinde n

Migration portals: web portals with information about legal migration opportunities and
various other aspects of migration. The establishment of these web portals will be financially
supported by the new budget line, 'Preparatory Action: Migration management Solidarity in
action'.
Migration profiles: a tool to bring together and analyse all the relevant information needed to
develop policy in the field of migration and development and to monitor the impact of
policies implemented.
Migration routes initiative: work along the main migratory routes through a particular
region and towards the EU is identified and takes into account the need to work in close
collaboration with the third countries along these routes.
Mobility partnerships: would provide the overall framework for managing various forms of
legal movement between the EU and third countries. Such partnerships would be agreed with
those third countries committed to fighting illegal immigration and that have effective

This annex aims to provide an overview of the cooperation which has been established until
now in the field of migration and asylum by the EU and the European and Asiatic countries
which are located along the migratory routes on the Eastern and South-Eastern flanks of the
EU. The list is indicative and by no means exhaustive.
The annex presents the projects which have been funded by the European Commission in
these countries in the field of asylum, migration, border management and visa policy.
As regards the information included, it should be underlined that:
a) only those projects that were committed through programmes of the previous EU financial
framework (2000-2006) are included in the list;
b) projects related to development of border infrastructures or addressing customs services or
the police forces generically (not specifically the border police) are not included in the list;
and

Several projects were funded by TACIS (from RAP 2000 until NAP 2005) in view of providing
the border guards of Ukraine with better equipment to control the green border and the land border
crossing points (walky-talkies, radios for long distance communication including data transmission, 4
wheels cars, night-visors, metal detectors, passport readers, computers, software for data registration
etc.) along the entire Northern and Eastern border with Belarus and Russia, and the South-West
border with Moldova for an overall amount of approximately 20 million.
Under the TACIS NAP 2006, an allocation of 5 million (within a larger project addressing also
Customs Service) is available to promote further improvement of the quality of Border Guards
capacity of surveillance and alignment to the EU/Schengen standards. Both through this allocation and
an additional 4 million which is available under the CBC programme (2006 budget) it will be
possible to procure additional border equipment.

The overall objective of this project is the protection of the human and
legal rights of migrant workers and asylum-seekers in Lebanon.
By the end of its implementation period:
1. The existing legal protections for migrants rights will be enforced in
the courts of Lebanon and migrants will have access to the legal and
social counselling necessary to take advantage of these protections;
2. Migrants and asylum-seekers will be more capable of protecting
themselves from abuse, exploitation and detention by understanding
and using the legal process and their social networks;
3. The Lebanese public will be informed of the legal and human rights
of the migrants working and living among them and of the nature and
extent of the abuse and exploitation they experience;
4. The official administrative instructions and general practices
regulating the status and treatment of migrant workers, especially
female household workers, will provide greater protection for their
human and legal rights.

massively fled in a neighbouring country, which were carried out mainly through the "Aid to Uprooted
People" budget line, and 2) actions more specifically addressing other aspects of migrations and in
particular migrations towards the EU.
As concerns the "Aid to Uprooted People" budget line, there have been several large scale
interventions concentrated in a few countries. Among them Afghanistan was a priority. 145.4 million
was allocated between 2001 and 2006. Interventions aimed at facilitating return and reintegration of
internally displaced Afghans or Afghans willing to repatriate in particular from Iran and Pakistan by
facilitating land and houses recovery, access to information and employment, removal of various legal
and material obstacles. The programme also supported the functioning of the Afghanistan
Comprehensive Solutions Unit (ACSU), whose task is to steer the overall collection of information on
Afghans abroad and promotion and coordination of their return and reintegration back home, while
coordinating among all the State agencies and the actors involved into this process.
Furthermore, the "Aid to Uprooted people" budget line mobilised between 2001 and 2004 up to 3.8
million to support Bhutanese refugees in Nepal. In the same period, 26 million were allocated to help
Burmese refugees in Burma, Bangladesh and Thailand. Additional 18 million were allocated under
the budgets 2005 and 2006 of that budget line.
In Indonesia 15.7 million were mobilised by the "Aid to Uprooted people" budget line, with focus on
Sulawesi and Timor populations.
The "Aid to Uprooted people" budget line mobilised 8.5 million between 2001 and 2004 for projects
implemented by UNHCR in the Philippines aimed at assisting internally displaced people, with special
focus on Mindanao. At the same time, in Sri Lanka the "Aid to Uprooted people" budget line provided
up to 15.5 million between 2001 and 2004 for projects implemented by UNHCR aimed at assisting
internally displaced people.
Furthermore many more interventions of a purely humanitarian nature were promoted by ECHO.

Overview of the migratory situation and flows from and in the Eastern and South-Eastern
regions neighbouring the EU and statistics
The latest available data indicates that around 5.5 million migrants from countries in the Eastern
and South-Eastern regions are residing legally in the EU, which represents nearly 30% of all
resident third-country nationals. The most important countries of origin are Turkey, Serbia,
Montenegro, Albania and Ukraine.
In terms of illegal immigration, and in comparison to migration from Africa, migration from the
Eastern and South-Eastern regions is different in nature: the flows are more constant (there is no
specific seasonal cycle), more diffuse (given the multiplicity of possible entry points and the fact
that an important share of illegal immigration is due to persons who enter the EU legally but
overstay their visa) and more under the control of networks connected with organised crime and
involved in multiform criminal businesses.
As regards numbers, a rough analysis suggests that migration flows to the EU originating in
neighbouring countries reached its peak at the end of the 1990s and that this is now stabilising if not
slightly declining; this is a trend that is likely to continue due to economic growth and increased
political stability. At the same time there is evidence that migrants from Asia are seeking new
routes into the EU via Africa, the Mediterranean and the Atlantic. It is predicted that flows from
Asia will increase.
While illegal immigration negatively impacts on the EU, countries of origin are also significantly
affected by migration. Whilst in some cases, attracting migrant labour is an important concern for
the EU given the sharp decline in population, for countries of origin difficult economic situations
can generate high levels of emigration among people of working age, people who may then
however remit important earnings to their country of origin.
Assessing the scale and nature of migratory flows from, through or to the countries in the Eastern
and South-Eastern regions neighbouring the EU is a difficult task which must take into account the
changes in the EU's external borders: following enlargement of the Union to include Bulgaria and
Romania, the EU now has more extended external borders with Serbia, the former Yugoslav
Republic of Macedonia, Ukraine and Turkey; a new external border with Moldova; and an
additional external sea border at the Black Sea which brings the countries of the Southern Caucasus
closer. Land borders are also due to change as soon as the newer Member States join the Schengen
area. As the borders of the EU shift, migratory routes also shift, displacing existing routes or adding
new ones. New routes also appear when certain routes are closed off following increased action by
enforcement agencies charged with tackling illegal immigration and organised crime. In addition, in
recent years migratory flows have increasingly diversified and new migratory flows are emerging
alongside traditional and relatively long-standing ones. In this context, migration is more difficult to
manage and Member States increasingly turn to the EU to seek solutions via cross-border dialogue
and cooperation with and within the partner regions.
Regarding asylum, according to UNHCR, seven of the ten main countries of origin of asylumseekers in the EU in 2004 were countries in the Eastern and South-Eastern regions neighbouring the
EU, namely in the Western Balkans, the Middle East and Asia. This is compared to three countries
in sub-Saharan Africa. Capacity to ensure proper asylum processing in many countries of these
regions is weak. Even when refugees staying in the region enjoy legal security, the poor social and
economic climate is a barrier to integration.
