COMMON LAW
(ANGLO-AMERICAN LAW)
• the body of customary law, based upon judicial
decisions and embodied in reports of decided cases,
which has been administered by the common-law
courts of England since the Middle Ages.
• From this has evolved the type of legal system now
found also in the United States and in most of the
member states of the Commonwealth of Nations.
• Common law stands in contrast to the rules developed
by the separate courts of equity, to statute law (i.e., the
acts of legislative bodies), and to the legal system
derived from civil law now widespread in continental
Europe and elsewhere.

• din acesta a evoluat tipul cadrului legal încă în vigoare
atât în Statele Unite, cât şi în cea mai mare parte a
statelor membre ale Commonwealth of Nations.
• Common law contrastează cu regulile dezvoltate de
diferitele curţi de equity, cu dreptul statutar (respectiv,
legile elaborate de corpurile legislative) şi cu sistemul
legislativ provenit din dreptul civil răspândit în prezent
în Europa continentală şi în restul lumii.

COMMON LAW
• Common law is the law that was developed in
England after the Norman Conquest (1066), by
judges who ruled in individual cases in the light
of precedent or custom, with minimal recourse
to statutes or enactments.
• This body of customary law continued to evolve
through the end of the 18th century in England
and its overseas colonies. Common law
continues to undergo considerable
modernization.

• Common law este sistemul de drept dezvoltat în
Anglia după cucerirea normandă (1066), de
către judecătorii care decideau în diferite
cazuri în lumina precedentului sau cutumei,
făcând apel minimal la statutes or enactments.
• Acest corp de drept cutumiar a continuat să
evolueze spre sfârşitul secolului 18 in Anglia şi
în coloniile sale de peste mări. Common law
este într-un proces permanent de modernizare.

• The main difference between the systems
consists of the ways in which the norms of the
law are articulated and in which new rules are
derived from older ones in novel cases.
• Though law cannot remain static, adaptation to
new circumstances should be orderly and
gradual so as not to unduly undermine
predictability and stability in human affairs.

• In the common law, the role of adapting the law
to changing conditions has traditionally
belonged to judges. Because the administration
of justice has been centralized, English judges
have been well situated to assume this
responsibility.
• In civil-law countries, where the multiplicity of
courts has prevented this task from being
performed by the judges, it has been professors
who have taken the leading role.

• În sistemul de drept comun rolul de adaptare a
legii la modificarea circumstanţelor a aparţinut
în mod tradiţional judecătorilor. Întrucât în
Anglia administrarea justiţiei a fost
centralizată, judecătorii au deţinut o poziţie
corespunzătoare pentru a-şi asuma această
poziţie.
• În ţările cu sisteme de drept civil, în care
numărul mare al tribunalelor a constituit o
piedică pentru ca această sarcină să fie
îndeplinită de judecători, rolul de lideri a fost
preluat de profesori.
