Informaţii de bază referitoare la protecţia depozitului

Depozitele constituite la GARANTI Fondul de Garantare a Depozitelor Bancare (FGDB)1
BANK SA sunt protejate de către:
Plafon de acoperire: Echivalentul în lei al sumei de 100.000 EUR per deponent per
instituţie de credit2. Valoarea minimă de la care se plătesc
compensaţii pentru depozitele aferent cărora nu a avut loc nicio
tranzacţie în ultimele 24 de luni este stabilita de către Fondul de
Garantare a Depozitelor Bancare.
Dacă aveţi mai multe depozite Toate depozitele plasate la aceeaşi instituţie de credit sunt
plasate la aceeaşi instituţie de credit: "agregate" şi cuantumul total este supus plafonului de acoperire
stabilit la echivalentul în lei al sumei de 100.000 EUR2.
Dacă aveţi un cont comun cu altă Se aplică plafonul de acoperire stabilit la echivalentul în lei al sumei

INFORMAȚII SUPLIMENTARE
1Schema responsabilă de protecţia depozitului dumneavoastră
Depozitul dumneavoastră este acoperit de o schemă contractuală recunoscută în mod oficial ca schemă de
garantare a depozitelor. În caz de indisponibilizare a depozitelor plasate la instituţia dumneavoastră de
credit, depozitele sunt acoperite în limita plafonului de acoperire stabilit la echivalentul în lei al sumei de
100.000 EUR.
2Plafonul general de acoperire

În cazul în care un depozit este indisponibil deoarece o instituţie de credit nu este în măsură să îşi
îndeplinească obligaţiile de plată conform condiţiilor contractuale şi legale aplicabile, plata compensaţiilor
către deponenţi se face de către schema de garantare a depozitelor. Fiecare compensaţie are un plafon
maxim stabilit la echivalentul în lei al sumei de 100.000 EUR per instituţie de credit. Acest lucru înseamnă
că toate depozitele de la aceeaşi instituţie de credit sunt agregate pentru determinarea încadrării în plafonul
de acoperire. De exemplu, dacă un deponent deţine un cont de economii în valoare de 90.000 EUR şi un
cont curent în care are 20.000 EUR, acesta va primi doar echivalentul în lei al sumei de 100.000 EUR.
In anumite cazuri, depozitele sunt acoperite peste echivalentul in lei al sumei de 100.000 EUR, pentru o
perioadă de 12 luni de la data la care suma a fost creditată în cont la instituţia de credit în cauză sau de la
data la care depozitele pot fi transferate legal la o altă instituţie de credit, dupa cum urmeaza: i) depozitele
care rezultă din tranzacţii imobiliare referitoare la bunuri imobile cu destinaţie locative; ii) depozitele
rezultate din evenimentul pensionării, disponibilizării, din situaţia de invaliditate sau deces al deponentului;
iii) depozitele rezultate din încasarea unor indemnizaţii de asigurare sau a unor compensaţii pentru daune
rezultate din infracţiuni sau pentru condamnări pe nedrept. Informatii suplimentare sunt disponibile la www.

3Plafonul de acoperire aplicabil conturilor comune

În cazul conturilor comune, plafonul de acoperire stabilit la echivalentul în lei al sumei de 100.000 EUR se
aplică fiecărui deponent. Depozitele într-un cont ai cărui beneficiari sunt două sau mai multe persoane în
calitatea lor de membri ai unei asociaţii lucrative, asocieri sau grupări de aceeaşi natură, fără personalitate
juridică, sunt agregate şi tratate ca şi când ar fi fost plasate de un singur deponent, pentru calculul limitei de
100.000 EUR.
4Plata compensaţiilor

Schema de garantare a depozitelor responsabilă este Fondul de Garantare a Depozitelor Bancare, Str.
Negru Voda nr 3, corp A3, et. 2, București, Cod 030774, Telefon 0314 232 882; 031 326 6020, E-mail:
office@fgdb.ro / comunicare@fgdb.ro. Aceasta vă va pune la dispoziţie compensaţiile cuvenite (până la
echivalentul în lei al sumei de 100.000 EUR) în termen de 7 zile lucrătoare de la data la care depozitele au
devenit indisponibile.
Dacă nu v-a fost pusă la dispoziţie compensaţia în acest termen, vă recomandăm să contactaţi schema de

garantare a depozitelor, întrucât termenul în care puteţi pretinde plata compensaţiei poate fi limitat.

ALTE INFORMAȚII SUPLIMENTARE

Nivelul compensației se determină prin deducerea din suma tuturor depozitelor eligibile deţinute de
deponentul garantat la respectiva instituţie de credit la data la care depozitele au devenit indisponibile a
valorii totale a creanţelor exigibile la aceeaşi dată ale instituţiei de credit asupra respectivului deponent.

 LISTA DEPOZITELOR EXCLUSE DE LA GARANTARE
1. Depozite ale unei instituţii de credit făcute în nume şi cont propriu, cu respectarea prevederilor
art. 64 alin. (2)
2. Instrumente care se încadrează în definiţia fondurilor proprii, astfel cum acestea sunt definite la art. 4
alin. (1) pct. 118 din Regulamentul (UE) nr. 575/2013
3. Depozitele rezultate din tranzacţii în legătură cu care au fost pronunţate hotărâri judecătoreşti definitive
de condamnare pentru infracţiunea de spălare a banilor, potrivit legislaţiei în domeniul prevenirii şi
combaterii spălării banilor. Încadrarea depozitelor în această categorie se realizează de schema de
garantare a depozitelor, pe baza informaţiilor primite de la autorităţile competente, de la instituţia de
credit ale cărei depozite au devenit indisponibile ori de la lichidatorul desemnat de instanţă, după caz.
4. Depozite ale instituţiilor financiare, astfel cum sunt acestea definite la art. 4 alin. (1) pct. 26 din
Regulamentul (UE) nr. 575/2013
5. Depozite ale firmelor de investiţii, astfel cum acestea sunt definite la art. 4 alin. (1) pct. 2 din
Regulamentul (UE) nr. 575/2013
6. Depozitele pentru care identitatea titularului nu a fost verificată până la momentul când acestea devin
indisponibile, potrivit legislaţiei în domeniul prevenirii şi combaterii spălării banilor
7. Depozite ale asigurătorilor şi reasigurătorilor, astfel cum sunt aceştia definiţi la art. 2 lit. A pct. 5 şi 39

Basic information about the protection of the deposit

All deposits made at GARANTI The Bank Deposit Guarantee Fund (FGDB)1
BANK S.A. are protected by:
Coverage limit: The equivalent in RON of 100.000 EUR per depositor per credit
institution2. The minimum value from which compensation may be
paid for the deposits that have not been used in any transaction over
the past 24 months is established by the Guarantee Fund for Bank
Deposits.
If you have several deposits opened All deposits opened at the same credit institution are „aggregated”
at the same credit institution and their total value is submitted to the coverage limit established at
the equivalent in RON of 100.000 EUR2.
If you have a shared bank account The coverage limit established at the equivalent in RON of 100.000
with another person (other persons): EUR shall apply separately, for every depositor3.

ADDITIONAL INFORMATION
1Responsible scheme with the protection of your deposit
Your deposit is covered by a statutory scheme known officially as the deposit guarantee scheme. In case
the deposits opened at the credit institution become unavailable, the deposits are covered within the
coverage limit established at the equivalent in RON of 100.000 EUR.
2The general coverage limit

In the event that a deposit is unavailable because a credit institution is unable to comply with its payment
obligations according to the applicable contractual and legal conditions, the compensations shall be paid to
the depositors according to the deposit guarantee scheme. Every compensation has a maximum coverage
limit established at the equivalent in RON of 100.000 EUR per credit institution. This means that all deposits
opened at the same credit institution are aggregated in order to establish whether and how they match the
coverage limit. For example, if a depositor has a saving account of 90.000 EUR and a current account of
20.000 EUR, such depositor will only receive the equivalent in RON of 100.000 EUR.
In certain cases, the deposits are covered even beyond the equivalent in RON of 100.000 EUR for a period
of 12 months from the date when the amount was received into the account of the respective credit
institution or from the date when the deposits may be legally transferred to another credit institution, as
follows: i) deposits resulting from real estate transactions involving immovable assets. with housing
destination; ii) deposits resulting from the event of retirement, dismissal, invalidity or death situation of the
depositor; iii) deposits resulting from the collection of insurance claims or compensation for damages
generated by criminal activities or unfair convictions.

3Coverage limit applicable to shared accounts

In case of shared accounts, the coverage limit established at the equivalent in RON of 100.000 EUR shall
apply separately, for every depositor. The deposits existing in an account whose beneficiaries are two or
more persons who are members of a profit-generating association, partnership or group of the same sort,
without a legal personality, are aggregated and treated as if they were placed by one single depositor, for
the calculation of the limit of 100.000 EUR.
4The payment of compensations

Based on this scheme, you will have access to the deserved compensations (up to the equivalent in RON of
100.000 EUR) within 7 business days from the date when the deposits became unavailable.
If the compensation is not at your disposal within this time frame, then we recommend that you contact the
deposit guarantee scheme, because the period in which you can claim the compensation payment may be

OTHER ADDITIONAL INFORMATION

The level of the compensation shall be calculated by deducting from the total eligible deposits held by the
guaranteed depositor with the respective credit institution on the date when the deposits became
unavailable the total value of the debts held by the guaranteed depositor with the respective credit institution
on the same day.

 LIST OF DEPOSITS EXEMPTED FROM COMPENSATION
1. Deposits of a credit institution opened on their own behalf and in their own names, in compliance with
the provisions of article 64, paragraph 2.
2. Instruments which fall under the scope of the definition related to own funds, as defined by the article 4
paragraph 1 point 118 from the (UE) Regulation no. 575/2013.
3. The deposits resulting from transactions for which final court decisions have been pronounced whereby
sentences are given for money laundering crimes, as per the anti-money laundering legislation. These
deposits are categorized as per the deposit guarantee scheme, based on the information received from
the competent authorities, from the credit institution whose deposits have become unavailable or from
the liquidator appointed by the court, if the case.
4. Deposits of the financial institutions, as they are defined under article 4, paragraph 1, point 26,
Regulation (EU) No 575/2013.
5. Deposits of investment companies, as they are defined in article. 4, paragraph 1, point 2, Regulation
(EU) No. 575/2013.
6. The deposits for which the identity of the holder has not been verified by the time when they become
unavailable, in accordance with the legislation in preventing and combating money laundering.
7. Deposits of insurers and reinsurers, as they are defined under article 2, letter A, points 5 and 39 from
the Law No. 32/2000 on insurance activity and insurance supervision, as amended and in accordance
with further additions.
8. Deposits of collective investment bodies, as defined by the legislation regarding the capital market.
9. Deposits of pensions funds.
10. Deposits of the central, regional and local public authorities.
11. Debt-like securities issued by the credit institution, as well as other obligations derived from own
acceptance and promissory notes.
