3. Noţiuni generale
Sistemul de Control al Importului (ICS) Faza 1 este o componenta a Sistemului Automat al
Importului (AIS) utilizat in cadrul birourilor vamale pentru controlul marfurilor destinate
importului.
Sistemul de Control al Importului (ICS) urmează a fi implementat in Romania începând cu
data de 01.10.2009 şi se aplică în două situaţii:
 la intrarea pentru prima dată a mărfurilor în Uniunea Europeană(UE) prin Primul Birou
de Intrare şi
 la intrarea mărfurilor printr-un birou vamal al următorului Stat Membru – referit ca
Următorul Birou de Intrare.
Implementarea ICS permite schimbul de date între Primul Birou de Intrare în UE şi
următoarele birouri de intrare în alte State Membre UE anterior intrării mărfurilor pe cale maritimă
sau aeriană.
ICS gestionează Declaraţiile Sumare de Intrare (ENS), care depuse electronic la Primul Birou
de Intrare, sau după caz la Biroul de Depunere, înainte de plecarea mărfurilor spre destinaţia finală
(destinaţiile finale). Sistemul tratează de asemenea cererile de devieri care apar atunci când Primul
Birou de Intrare declarat în ENS este incapabil sau nu poate primi mărfurile în tranzit.
ICS-RO va interacţiona cu aplicaţiile informatice ale operatorilor economici prin mesaje
standard de tip XML specifice acestui sistem.

1. Introducere
1.1. Cadru general
Aderarea României la Uniunea Europeană a presupus, printre altele, şi pregătirea sistemelor

ITC vamale în vederea asigurării inter-operabilităţii acestora atât cu sistemele corespunzătoare ale
DG TAXUD din cadrul Comisiei Europene, cât şi cu cele ale administraţiilor vamale din Statele
Membre.
Implementarea Sistemului de Control al Importului – ICS-RO Faza 1 reprezintă unul dintre

obiectivele Autorităţii Naţionale a Vămilor privind implementarea programului ”Vama Electronică”
al Comisiei Europene în vederea simplificării procedurilor vamale, înlocuirii documentelor pe
suport hârtie cu documente electronice, controlul fluxului de mărfuri pe baza informaţiilor de risc ce
trebuie schimbate electronic între administraţiile vamale ale Statelor Membre.
1.2. Scop
Scopul documentului este acela de a defini specificatiile tehnice şi mesajele de tip XML ce
se vor schimba intre aplicatiile operatorilor economici şi ICS–RO.
Mesajele XML ce se vor schimba intre Domeniul National al Autoritatii Nationale a

Vamilor si Domeniul Extern al operatorilor economici, respectiv intre ICS-RO si aplicatiile proprii
operatorilor economici sunt cele prevazute in documentul DG TAXUD ‘CUD-SC01-
DDNIA_ICS_P1_APP_A2_310’, mesaje obligatorii (Mandatory - M) sau puternic recomandate
(Strongly Recommended - SR). Mesajele XML ce fac obiectul schimbului precum si modul de
folosire a acestora sunt definite in urmatoarele subcapitole.

2. Sistemul actual
2.1. Prezentarea sistemului actual
În prezent, Autoritatea Naţională a Vămilor din România dispune de un sistem operaţional

pentru procesarea declaraţilor vamale de import, denumit CDPS/Asycuda++, care include si un
modul de analiză de risc bazată pe liste şi criterii de selectivitate definite la nivel naţional.
Sistemul ICS este un sistem Trans-european care se bazează pe conceptul “e-Customs”,
urmăreşte creşterea sigurantei si securitatii la intrarea mărfurilor pe teritoriul Comunităţii, precum
şi facilitarea comerţului. Pentru aceasta, în cadrul Autorităţii Naţionale a Vămilor se află în curs de
dezvoltare o aplicaţie naţională de control al importurilor, denumită ICS-RO, care va fi lansată în
operare începând cu data de 1 octombrie 2009.
2.2. Interacţiunea ICS-RO cu aplicaţiile informatice ale operatorilor

economici
Asa cum s-a menţionat, scopul acestui document este de a evidentia interactiunile dintre
ICS-RO şi aplicaţiile operatorilor economici ce se bazează pe schimbul de mesaje de tip XML
definite in acest document.
Pentru aceasta sunt propuse urmatoarele modalităţi de interactiune:
 sistem - sistem: Acesta presupune schimbul securizat de mesaje electronice intre
sistemul ICS-RO si aplicatiile operatorilor economici. Sistemul ICS-RO va primi si
procesa mesajele de la aplicatiile operatorilor economici, va genera si va transmite
raspunsuri la mesajele primite. Mesajele schimbate vor fi conforme cu specificatiile
ICS-RO Faza 1.
 aplicatie WEB: Autoritatea Naţională a Vămilor va pune la dispozitia operatorilor
economici (ce opteaza pentru aceasta solutie de conectare la ICS-RO) o aplicatie WEB
ce va permite inregistrarea si trimiterea declaratiei sumare catre birourile vamale si
receptionarea mesajelor pentru fiecare declaratie sumara in parte. Astfel, se vor putea
inregistra cereri de modificare si rerutare si va putea verifica starea fiecarei declaratii
sumare in parte.
 Serviciu WEB: Acest serviciu va permite conectarea securizata a operatorilor
economici la o interfata WEB a ICS-RO si incarcarea datelor dintr-un fisier XML
obtinut din propriile aplicatii.

3. Prezentarea sistemului propus
3.1 Obiective ICS-RO
Obiectivele sistemului ICS-RO Faza 1 sunt:

 Depunerea electronica a declaraţiei sumare de intrare (ENS) întocmită pentru importurile în
Uniunea Europeană şi comunicarea cu operatorii economici.
 Schimbul de informatii cu privire la declaraţia sumară de intrare (ENS) între birourile vamale
din cadrul Comunităţii
 Aplicarea analizei de risc
 Realizarea de interfeţe între ICS-RO şi sistemele EORI şi AEO.
3.2 Baza legală
Baza legală a Sistemului de Control al Importurilor ICS Faza 1 o reprezintă prevederile

Regulamentului (CE) nr. 648/2005 al Parlamentului European şi al Consiliului din 13 aprilie 2005
de modificare a Regulamentului (CEE) nr. 2913/92 al Consiliului de instituire a Codului vamal
Comunitar şi ale Regulamentului (CE) nr. 1875/2006 al Comisiei din 18 decembrie 2006 de
modificare a Regulamentului (CEE) nr. 2454/93 de stabilire a unor dispoziții de aplicare a
Regulamentului (CEE) nr. 2913/92 al Consiliului de instituire a Codului Vamal Comunitar, cu
privire la siguranţă şi securitate.
3.3 Procese tratate de sistemul ICS-RO

Procesele tratate de aplicatia ICS-RO sunt in numar de şapte, asa cum sunt definite in
documentul DG TAXUD “Doc1043-FSS_AIS Addendum 1-2006-rev6.2-final_main”. Aceste
procese vor fi partial sau in totalitate automatizate:

Astfel, automatizările vor include:
Primirea si transmiterea datelor de la şi către operatorii economici;

Primirea si transmiterea datelor de la şi către diverse birouri vamale aflate pe teritoriul altor State
Membre;
Vizualizarea datelor de către lucratorii vamali din cadrul ANV;
Comunicaţia cu operatorii economici va fi prin Internet şi se va realiza pe baza mesajelor de

tip XML, aşa cum este prevăzut în documentaţia DG TAXUD.

Procesele de Business utilizate în ICS-RO Faza 1 sunt:
 Procesul CO1 (CO1A, CO1B ) – tratează declaraţia sumară de intrare transmisă electronic la
Biroul de Depunere sau la Primul Birou de Intrare pentru mărfurile care urmează să intre pe
teritoriul vamal al Comunităţii.
 Procesul CO1D - tratează rerutarea mijlocului de transport activ
 Procesul CO3A – tratează prezentarea mărfurilor ce urmează a fi decărcate la un Birou care
acţionează ca primul birou actual de intrare
 Procesul CO3B – tratează prezentarea mărfurilor ce urmează a fi decărcate la următorul(ele)

4.2. CO1 – Procesul privind declaraţia sumară de intrare (ENS)
4.2.1. CO1A (SUM) – Procesul privind declaraţia sumară de intrare la Biroul

de Depunere
Acest proces este executat numai dacă declaraţia sumară de intrare (ENS) este depusă la alt
birou decât Primul Birou de Intrare. Dacă ENS este transmisă direct la Primul Birou de Intrare
atunci acest proces nu este utilizat şi se va executa procesul CO1B.

ENS este transmisă electronică (IE315) la BD. Numărul local de referinţă (LRN) trebuie
completat obligatoriu de operatorul economic pentru a identifica unic ENS-ul în sistemul ICS-RO şi
pentru a putea fi regăsit de către lucrătorul vamal din cadrul BD. Validarea ENS este un proces
complet automatizat.
Dacă ENS nu este valid, sistemul ICS-RO respinge ENS şi notifică (IE316) persoana care
l-a depus că acesta este invalid comunicând în acelaşi timp şi motivul respingerii acesteia.
Dacă ENS este valid, sistemul ICS-RO generează automat numărul de referinţă al mişcării
(MRN) şi-l comunică (IE328) persoanei care a depus ENS.
MRN-ul este comunicat (IE328) şi operatorului economic ( transportatorului) la intrarea în
Comunitate de către BD dacă sunt îndeplinite toate condiţiile:
 operatorul economic ( transportatorul) este declarat în ENS şi are un numar EORI
valid
 operatorul economic ( transportatorul) este diferit de persoana care depune ENS-ul
 operatorul economic ( transportatorul) este conectat la sistemul ICS-RO unde se află
localizat BD.
În concluzie:
 dacă ENS nu este valid acesta va fi respins şi persoana care a depus documentul este
notificată de respingere (IE316).
 dacă ENS este valid acesta este înregistrat la BD, sistemul ICS-RO îi alocă automat MRN, şi
notifică (IE328) persoana care a depus ENS precum şi operatorul economic( transportatorul)
la intrarea în Comunitat despre înregistrare. BD transmite ENS (IE30) la Primul Birou de
Intrare în Comunitate.

4.2.2. CO1B (SUM) – Procesul privind declaraţia sumară de intrare (ENS) la
Primul Birou de Intrare în Comunitate
Pentru Primul Birou de Intrare există următoarele două situaţii:

 ENS a fost depus la alt birou (Biroul de Depunere)
 ENS este transmis de persoana care depune ENS direct la Primul Birou de Intrare
Informarea persoanei care depune ENS şi a operatorului economic (transportator) în cazul în
care mărfurile nu trebuie încărcate (IE351) se face de către Primul Birou de Intrare. În cazul în
care un Reprezentant acţioneză în numele şi pentru persoana care depune ENS, atunci acesta va
fi informat că mărfurile nu trebuie încărcate (IE351).
Dacă următorul (următoarele) birou(uri) de intrare este(sunt) declarat(e) atunci ENS va fi
transmis la următorul(următoarele) birou(uri) de intrare declarate(IE319) conţinând informaţii cu
privire la marfa ce urmează a se descărca.

4.2.3. CO1D (SUM) – Procesul privind rerutarea internaţională la Primul Birou
de Intrare în Comunitate
Acest proces este executat în situaţia în care mijlocul de transport activ este rerutat în alt Stat
Membru decât:
o Statul Membru unde este localizat primul birou de intrare (declarat în declaraţia
sumară) şi
o Statul(ele) Membru(e) unde este (sunt) localizat(e) următorul (următoarele)
birou(uri) de intrare (declarat(e) în declaraţia sumară).
Dacă aceste condiţii sunt îndeplinite transportatorul notifică Primul Birou de Intrare prin
transmiterea solicitării de rerutare (IE323) şi aşteaptă decizia de confirmare a acestei solicitări.
Procesul nu va fi executat dacă persoana care a transmis ENS mai transmite un nou ENS la
primul birou actual de intrare.
Solicitarea rerutării (IE323) este transmisă la Primul Birou de Intrare declarat în ENS de
către operatorul economic responsabil cu informarea vămii sau de reprezentantul acestuia.
Solicitarea rerutării trebuie să acopere toate mărfurile încărcate pe mijlocul de transport
activ rerutat şi să conţină fie referinţele care să permită lucrătorului vamal să identifice mijlocul de
transport rerutat , fie MRN-ul (urile) declaraţiei sumare de intrare încărcată pe mijlocul de transport.

4.3. CO3 – PROCESUL DE PREZENTARE
4.3.1. CO3A – Procesul de prezentare la primul birou actual de intrare
Acest proces este executat în situaţia în care mărfurile ce urmează a fi decărcate la un Birou care
acţionează ca primul birou actual de intrare
Operatorul economic la intrarea în Comunitate va furniza o notificare de sosire pentru toate
mărfurile ce trebuie descărcate la acest birou. Notificarea de sosire va conţine referinţe (identificator
unic al mijlocului de transport sau MRN-ul/numărul articolului din MRN) ale ENS.

4.3.2. CO3B – Procesul de prezentare la următorul birou actual de intrare
Acest proces este executat numai dacă cel puţin unul sau mai multe articole de marfă
declarate în ENS urmează a fi decărcate la următorul(următoarele) birou(uri) actual(e) de intrare.
Operatorul economic la intrarea în Comunitate va furniza o notificare de sosire pentru toate
mărfurile ce urmează a fi decărcate la următorul(următoarele) birou(uri) actual(e) de intrare.
Notificarea de sosire va conţine:
o referinţe (identificator unic al mijlocului de transport sau MRN-ul/numărul
articolului din MRN) ale ENS ori de câte ori un ENS a trebuit să fie furnizat
în prealabil, sau
o toate datele complete din declaraţia sumară pentru toate mărfurile care nu au
solicitat un ENS (ex. Pentru mărfurile încărcate în porturile UE în
conformitate cu Art. 184f din Regulamentul de aplicare al Codului Vamal).

4.3.3. CO3C – Procesul de eliberare pentru intrarea la biroul actual de intrare
Biroul vamal de intrare poate decide sa efectueze controlul (ex. controlul fizic al mărfurilor,
controlul documentar sau al sigiliilor).
Mărfurile pot fi sau nu eliberate pentru intrare.

5. Arhitectura sistemului
5.1. Arhitectura sistemului
Soluţiile ce se vor implementa în sistemul ICS-RO sunt următoarele:

 sistem - sistem: Acesta presupune schimbul securizat de mesaje electronice intre
sistemul ICS-RO si aplicatiile operatorilor economici. Sistemul ICS-RO va primi si
procesa mesajele de la aplicatiile operatorilor economici, va genera si va transmite
raspunsuri la mesajele primite. Mesajele schimbate vor fi conforme cu specificatiile
ICS-RO Faza 1.
 aplicatie WEB: Autoritatea Naţională a Vămilor va pune la dispozitia operatorilor
economici (ce opteaza pentru aceasta solutie de conectare la ICS-RO) o aplicatie WEB
ce va permite inregistrarea si trimiterea declaratiei sumare catre birourile vamale si
receptionarea mesajelor pentru fiecare declaratie sumara in parte. Astfel, se vor putea
inregistra cereri de modificare si rerutare si va putea verifica starea fiecarei declaratii
sumare in parte.
 Serviciu WEB: Acest serviciu va permite conectarea securizata a operatorilor
economici la o interfata WEB a ICS-RO si incarcarea datelor dintr-un fisier XML
obtinut din propriile aplicatii.

 Completarea şi transmiterea cererii de rerutare
 Completarea şi transmiterea notificării de sosire
 Căutarea declaraţiei sumare de intrare.
 Vizualizarea declaraţiei sumare de intrare
5.2.3. Serviciul WEB
Serviciul WEB permite:

 Autentificarea in sistem.
 Încărcarea declaratiei sumare de intrare în ICS-RO : Utilizatorul autentificat are posibilitatea
să încarce datele unei noi ENS dintr-un fisier XML obţinut din propria aplicaţie.

6. Considerente de proiectare
6.1. Considerente initiale

Operatorul economic poate opta fie pentru schimbul de mesaje (sistem –sistem) fie pentru
aplicaţia sau serviciul WEB.
Autoritatea Naţională a Vămilor va accepta ca ENS să se depună si la un birou, altul decât
Primul Birou de Intrare în Comunitate aflat pe teritoriul României si va accepta recepţia ENS
depusă într-un alt Stat Membru pentru situaţia în care Primul Birou de Intrare se află pe teritoriul
Romaniei.
6.2. Mediul de dezvoltare
Soluţia “ Sistem – sistem” va fi dezvoltată conform Simple Object Access Protocol

(SOAP) v1.1 si standardelor XML.
[Descrierea si configurarea serviciilor pentru schimbul securizat de mesaje ce vor fi puse la
dispozitie pentru operatorii economici vor fi prezentate intr-o versiune viitoare a acestui document.]
Aplicatia şi Serviciul WEB vor fi puse la dispoziţia operatorilor economici prin Internet şi
vor fi accesibile din orice browser WEB.

ANEXA A. Formatul mesajelor folosite in sistemul ICS-RO Faza 1
Introducere
Anexa conţine descrierea detaliată a Structurii Mesajului Functional (Functional Message Structure
(FMS)) pentru fiecare mesaj ce face obiectul schimbului între ICS-RO şi aplicaţiile operatorilor
economici, conform documentaţiei DG TAXUD DDNIA v4.0 şi Listei de Erori Cunoscute (Known
Error List (KEL)) Vers. 0.20 pentru DDNIA
FMS – urile sunt organizate în grupuri de date ce conţin elemente de date. Un grup de date nu
trebuie sa fie neaparăt echivalentul unei entitati în baza de date. Elementele de date sunt grupate
împreuna de aşa manieră încât să construiască blocuri logice coerente in cadrul FMS.
Structurile detaliate cuprind :
- Caracteristicile grupurilor de date ce aparţin FMS: secvenţa, număr de repetări, o
valoare de stare ce indică dacă grupul de date este obligatoriu (R: Required), optional
(O: Optional) sau conditional (D:Dependent);
- Identarea grupului de date care indică faptul că grupul de date poate să conţină nu
numai elemente de date ci şi alte grupuri de date;
- Regulile şi condiţiile aplicabile
- Listele de coduri aplicabile

IMPORT OPERATION.MRN poate fi inlocuit cu urmatoarele
alte elemente de date care identifica mijloacele de transport
rerutate/care sosesc.
- 'Identificarea mijloacelor de transport ' si
- ‘Modul de transport la frontiera (rub 25)' si
- ‘ Data de sosire asteptata’
'Identificarea mijloacelor de transport ' va depinde de ‘Modul de

transport la frontiera (rub 25)' declarat – caruia ii corespund
valorile urmatoare:
 1 si 8 (maritim si transport pe apele interioare):
o numarul de identificare al navei (vasului) (IMO) sau
o Numarul de Identificare European al Navei (EIN)
(ambele corespunzand la IE315.IMPORT
OPERATION.Identitatea la trecerea frontierei (rub 21)
 4 (transport aerian):
o Numar de zbor (IATA). In situatii de ‘code-share”
numarul zborului al partenerilor ‘code-share’ trebuie
folosit.
o (corespunzator la IE315.IMPORT OPERATION.
Conveyance reference number ) – "IE315.IMPORT
OPERATION.numar de referinta al Transportului)
Acest atribut va fi utilizat conform conditiei 520.
Aceasta data trebuie sa fie in urmatorul format YYYYMMDD

unde:

Codul Tarii Biroului primei Intrari Codul tarii este cerut pentru a permite ICS sa ceara datele ENS
declarat si rezultatele analizei de risc privind siguranta si securitatea la
Biroul primei Intrari declarat (ex. In cazul unei rerutari
internationale sau unde trimiterea a esuat din diverse motive).
Codul tarii trebuie declarat daca este diferit de primele 2
caractere din MRN.
El trebuie sa corespunda la primul si la al doilea digit din
numarul de referinta (codul) ptr. 'Biroul Vamal al primei Intrari’

declarat in ENS. Este cerut numai daca PAN/Notificare de
Sosire este transmisa la Statul Membru care este diferit de acea
tara.
Acesta este codul ISO al tarii.

"C" (create) :
The create operation is used to create a new occurrence of an entity;
"U" (update):
The update operation is used to change an existing occurrence. It can render an existing occurrence
invalid or it can modify existing values of attribute(s) of an occurrence;
"D" (delete):
The delete operation is used to physically delete an occurrence. This operation must only be used when
data has been created erroneously.
R411 The ‘Operation’ attribute is used to indicate what action is applied:
‘C’ (create), ‘D’ (delete).
In case of “updates”, the data group ‘SYSTEM UNAVAILABILITY’ to be updated will be first deleted and
then (re)-created.
R422 This attribute refers to the content of Column 2 in the UN/LOCODE. Column 2 shows the names of the
locations (city names) which have been accepted for inclusion in UN/LOCODE, in accordance with the
provisions of Recommendation n° 16 (see Rule 460).
R425 The attribute "Season Code" is NOT used as a flag. It is possible to have up to 9 different "seasons" in a
year, depending on a defined time period, which is completely covering the year-period.
R430 The "Day in the week (end)" must be equal or greater then the "Day in the week (begin)".
R445 The SENSITIVE GOODS CODE consists of two parts: the first part represents the HS6 six digit

These codes are used in the ""List of Goods which when transported give rise to an increase in the
Flat-rate Guarantee" (see proper domain).
R456 For "Package Code" use the alphabetic two-digit UN-code going from "AE"= "aerosol" to "WB" =
"Wickerbottle".
R460 This UN/LOCODE refers to the 3 digit alphabetical code of the second part of Column 1 in the
UN/LOCODE - Code for Ports and other Locations . Column 1 shows in a first part the ISO 3166
alpha-2 Country Code, which is followed by a space and a 3-alpha code for the city (location) name: XX
XXX. This combination is invariably identifying the "City Name". This UN/LOCODE city name is used as

R486 This attribute can be used to indicate potential specific characteristics of the Customs Office, namely
regarding variation of opening hours (e.g. during public holidays, etc.), operational and/or procedural
restrictions (e.g. competent only for simplified procedures, competent only for certain goods, the only
office authorised to accept flat-rate guarantees, etc.). This attribute will be coded by DG TAXUD after
clear definition of the need of the NAs.

TR9001 The content and the format of the ACTION.Action identification attribute is free to be chosen by the
producer of the message. The content must be unique in the context of the enclosing Original message
TR9006 The UPL RESPONSE.Original message identification is equal to the Interchange control reference of the
corresponding IE30 transmitted.
TR9007 The value of this attribute can be: "OK", "REJECTED", "ERRORS" or "NOAUTH".
TR9009 The value of the UPL ERROR.Action identification is equal to the Action identification of the
corresponding transmission.
TR9010 The attribute path is a hierarchical path from the root of the modifying occurrence down to the attribute in
the message using indexed data group names and attribute names.
TR9020 The values of a date and time attribute must be specified by NAs using GMT time reference.
TR9025 Only System Unavailability Type "S" is acceptable for this field in the IE912 message.
TR9080 Within the "HEADER" data-group, the "Period from date" must be prior or equal to the "Period to date".

TR9160 Reference Number Competent Authority for Enquiry is used to indicate that the Customs Office in
question has a Competent Authority of Enquiry for the NCTS P4. As a consequence this attribute
becomes required when the Office in question has a Competent Authority of Enquiry.
TR9170 Reference Number Competent Authority for Recovery is used to indicate that the Customs Office in
question has a Competent Authority of Recovery for the NCTS P4. As a consequence this attribute
becomes required when the Office in question has a Competent Authority of Recovery.
TR9175 The last digit, which is used to identify the type of risk, shall be validated against codelist “Risk analysis
result code”.
TR9181 The field is Required for response and rejection messages. It does not apply for requests and one way
messages.

Anexa D: Liste de coduri
In aceasta anexa sunt prezentate Listele de coduri in ordinea numarului listei de coduri:
- Codurile tehnice pentru care valorile date in DDNIA pentru ICS sunt definitive;
- Codurile de business ( identificate in “FTSS Addendum 1/2007” si in “C2007 WORKING ENQUIRY
GROUP” ) pentru care valorile definitive sunt cele incarcate in Baza de Date de Referinta (RD) de catre
Serviciul Central (Central Service -CS) al DG TAXUD si disponibile Autoritatilor Vamale pentru descarcare.
De aceea, acele valori incarcate in CS/RD nu sunt prezentate sau sunt prezentate doar informativ.
Fiecare lista de coduri este structurata dupa cum urmeaza:

Numar Numar utilizat pentru acea lista in DDNIA Appendix J tabele de corelatii
Nume Nume, in cele mai multe cazuri asemantor cu numele atributelor relevante.
Format Tipul de cod si, prin urmare, de atribute la care se aplica codul de lista
