1. ASPECTE GENERALE

structur: Tema abordat, Activiti desfurate, Surse bibliografice, Dificulti ntmpinate,
Observaii (referitoare la modul de lucru i la rezultatul obinut).
Fiele de activitate reflect activitatea desfurat de studentul practicant i stau la baza
monitorizrii eficiente a activitii derulate de cursant. Totodat, pe baza acestora, se va face i
evaluarea efectiv a studentului.
La baza evalurii stau Fiele de activitate din Caietul de Practic, care reflecta activitatea
desfurata de studentul practicant pe durata perioadei de stagiu, precum i calificativul acordat de
tutorele de practic.
Studentul practicant va prezenta, n vederea evalurii, Caietul de practic i calificativul
acordat de tutore, respectiv Admis/Respins.
Evaluarea stagiului de practic va urmri:
gradul de ndeplinire a sarcinilor i de implicare n activitile de pe parcursul
stagiului de practic;
volumul i relevanta activitilor desfurate;
evaluarea deprinderilor i a cunotinelor dobndite;
modul de elaborare a caietului de practic.
Studentul nu poate fi evaluat i, prin urmare, nu poate fi declarat promovat daca Tutorele
acorda calificativul Respins.
Modalitatea de evaluare a practicii de profil este cea de Colocviu.

Competene generale
- nelegerea specificului activitii juridice practice.
- Formarea unui mod de gndire logico-juridic coerent.
- Dobndirea capacitaii de a susine public un discurs coerent i argumentat.
- Abilitatea de a asigura promovarea i respectarea legalitii.
Competene specifice
- Dobndirea abilitii de recunoatere i evaluare a problemelor de drept in practic instanelor,
parchetelor, cabinetelor de avocatura etc.
- Contientizarea principalelor competene specifice ale fiecrui domeniu din activitatea juridica
(instane, parchete, cabinete de avocatura, notariate, executor judectoresc etc.).
- nelegerea corelaiilor dintre normele procesuale i normele de drept substaniale, dintre teorie i
practic. - Formarea aptitudinii de a corela permanent legislaia i jurisprudena intern cu legislaia
i jurispruden din alte tari, precum i cu tratatele i Conveniile internaionale.
- nsuirea deontologiei profesionale a juristului.
- Formarea atitudinii responsabile pentru pregtirea teoretic i a obinuinei de a verifica In
practic cunotinele nsuite.
- nsuirea procedurilor i tehnicilor de lucru ale autoritilor judiciare.
- Formarea deprinderilor de lucru cu persoane care se adreseaz sau care fac obiectul activitii
autoritilor juridice.
- Dobndirea modalitilor de organizare i conducere a activitilor de soluionare practic a
dosarelor in lucru, a cercetrii penale etc.
- Asimilarea formarea deprinderii i obinuinei de a folosi in practic termenii, procedurile i
tehnicile nsuite in pregtirea teoretic universitara.
- Manifestarea unei atitudini responsabile fa de pregtirea continua, dar i fa de aplicarea corecta
a legilor att in litera ct i in spiritul lor.
- Dobndirea abilitailor pentru redactarea: cererii de chemare in judecat, a rechizitoriului, a
plngerii prealabile, a denunului, a hotrrilor judectoreti etc.
Activiti specifice Practicii de profil
- Studierea unor hotrri judectoreti/alte documente cu caracter juridic coninut, modalitate de
redactare, specific n funcie de emitent.
- Studierea in arhivele instanelor a unor dosare deja finalizate pentru a contientiza piesele necesare
care se ntocmesc pn la soluionarea unor cauze civile i penale;
- Studierea din arhiva parchetului a unor cauze soluionate, la care pot avea acces conform regulilor
instituiei.
- Dobndirea de informaii concrete asupra modului in care se pregtete o edin de judecat;
- Participarea la audierile prilor, martorilor sau a altor persoane ntr-o cauza civila sau penal.
Participarea la edinele de judecat pentru a observa rolul i atribuiunile unui procuror in
prezentarea i susinerea cauzelor prezentate in instan.
- nsuirea modului in care un procuror solicita o cale de atac mpotriva unei hotrri pronunate de
instan
- Implicarea concret cu aprobarea conductorului instituiei n care se efectueaz practic, in
sprijinirea soluionrii problematicii curente a compartimentului instituiei;
- Stabilirea contactului cu publicul i soluionarea concreta a cererilor, plngerilor, petiiilor de
specialitate pe o tem actual din domeniul dreptului;
- nsuirea metodologiei de redactare corect a unor lucrri de cercetare/referate/cereri, cu aplicaie
pe domeniul concret de desfurare a practicii.

b) s nominalizeze specialiti (tutori de practic) care s coordoneze i s participe la
instruirea i evaluarea desfurrii practicii;
c) s pun la dispoziia practicanilor caietul de practic i/sau orice alte materiale suport.
4. Att pe durata, ct i dup denunarea sau ncetarea n orice mod a prezentului Acord-
cadru pentru practica studenilor, organizatorul de practic se oblig s nu dezvluie
terilor, respectiv s nu foloseasc n interes propriu informaiile confideniale despre care
a luat cunotin n orice fel ca urmare a colaborrii cu partenerul de practic. Prin
expresia "informaii confideniale" se nelege orice informaii, fapte date (indiferent de
suportul de stocare/redare) referitoare la activitatea desfurat la partenerul de practic,
precum i cele referitoare la datele/relaiile personale ale beneficiarilor serviciilor asigurate
de partenerul de practic.
