ROLUL ŞI LOCUL EXECUTIVULUI ÎN SISTEMUL AUTORITĂŢILOR PUBLICE Constituţia Republicii Moldova (art. 96), Legea cu privire la Guvern (art. 1) determină rolul Guvernului în sistemu l autorităţilor publice, care constă în: asigurarea realizarea politicii interne şi externe a statului şi exercitarea conducerii generale a administraţiei publice. Rolul guvernului este semnificativ nu numai prin activitatea sa executivă internă şi ext ernă, dar şi prin cea normativă, apărută în baza delegării legislative acordate de Parlament în temeiul art. 106/2, sau prin exercitarea dreptului de iniţiativă legislativă prevăzut de articolul 73 din Constituţie. În consecinţă, rolul Guvernului în ca drul statului şi al societăţii se exprimă nu numai în sfera exclusiv executivă, ci şi prin colaborarea cu celelalte autorităţi pu blice, inclusiv cu puterea legislativă. În strânsă legătură cu rolul politic din conţinutul articolului 1 din Legea cu privire la Guvern, se conturează şi poziţia acestui organ ca autoritate publică centrală cu competenţă material generală în domen iul administraţiei publice. Din acest punct de vedere, guvernul are misiunea de a asigura conducerea generală a ultimei. În virtutea acestui rol, guvernul desfăşoară o activitate exclusiv executivă, principalul său atribut fiind organizarea şi asigurar ea executării legilor de către autorităţile administraţiei publice centrale de specialitate. Rolul deosebit atribuit Guvernului de Constituţia Republicii Moldova impune ca acesta să-şi desfăşoare activitatea în conformitate cu principiile: - legalităţii care cere respectarea Constituţiei, celorlalte legi ale republicii, decretelor preşedintelui şi propriilor hotărâri, or donanţe şi dispoziţii; - echităţii sociale; - colegialităţii şi răspunderii personale a membrilor Guvernului în procesul elaborării, adoptării şi realizării hotărârilor sal e; - fundamentării ştiinţifice a procesului de administrare, ţinând seama şi aplicând experienţa mondială în sfera construcţiei de stat. Rolul şi locul Guvernului în sistemul autorităţilor publice este determinat într-o mare măsură şi de direcţiile princi pale ale activităţii sale fixate în Legea cu privire la Guvern, care în conformitate cu împuternicirile sale: - creează condiţii pentru stabilirea şi asigurarea suveranităţii economice şi politice a Moldovei; - elaborează concepţia dezvoltării social-economice a republicii, programul şi mecanismul trecerii la economia de piaţă; - asigură libera iniţiativă, privatizarea, demonopolizarea economiei şi dezvoltarea relaţiilor de piaţă; - elaborează strategia dezvoltării tehnico-ştiinţifice, promovează o politică naţională în domeniul culturii, ştiinţei, tehnicii, tehnologiei; rezolvă problemele reglementării de stat a progresului tehnico - ştiinţific; - garantează tuturor subiecţilor proprietăţii libertatea activităţii economice, diversitatea formelor de proprietate şi egalitate a lor în drepturi, are grijă de păstrarea proprietăţii; - protejează interesele naţionale în activitatea economică, financiară şi valutară; - realizează colaborarea economică cu ţările lumii în condiţiile dezvoltării relaţiilor contractuale, formării infrastructurii de piaţă, integrării general-europene şi mondiale; - asigură protejarea intereselor naţionale în activitatea economică externă, promovează politica liberului schimb, pornind d e la interesele naţionale; - formează un sistem eficient de ocrotire socială a populaţiei, creează condiţii pentru creşterea nivelului de trai, pentru sati sfacerea necesităţilor culturale şi spirituale ale cetăţenilor republicii; - promovează politica de stat în domeniul ocrotirii sănătăţii populaţiei; - asigură apărarea drepturilor consumatorilor prin organizarea şi coordonarea controlului şi supravegherii de stat a calităţii produselor (lucrărilor, serviciilor); - asigură utilizarea raţională a resurselor naturale şi integritatea lor, protecţia ecologică a populaţiei şi a mediului ambiant; - favorizează dezvoltarea autonomiei organelor administraţiei publice de toate nivelurile; - asigură legalitatea, ordinea publică, drepturile şi libertăţile cetăţenilor; - promovează politica securităţii naţionale, dirijează activitatea de apărare a Republicii Moldova; - asigură respectarea şi executarea legilor, hotărârilor Parlamentului, decretelor Preşedintelui Republicii Moldova, tratatel or internaţionale la care Republica Moldova este parte; - promovează o politică externă în conformitate cu competenţa sa 2. MODUL DE ÎNVESTIRE ŞI STRUCTURA GUVERNULUI În funcţie de anumite împrejurări şi norme de instituire, sunt cunoscute mai multe tipuri de guverne: de coaliţie, mi noritare, provizorii, insurecţionale, militare, de drept, de fapt, legitime. Guvernul de coaliţie include în componenţa sa reprezentanţi ai diferitelor partide politice cu scopul obţinerii unei majorită ţi şi sprijin favorabil în parlament. În practica constituţională sunt cunoscute mai multe varietăţi de asemenea coaliţii: 1. Coaliţia câştigătoare minimă (principiul mărimii) propusă de William H. Riker, admite formarea de coaliţii câştigătoare minime din două sau mai multe partide care sunt câştigătoare în sensul că ele controlează împreună majoritatea locurilor d in parlament, dar care sunt minime în sensul că nu vor include nici un alt partid care nu este necesar pentru ca respectiva c oaliţie să devină majoritară. Unul din punctele vulnerabile ale teoriei coaliţiei câştigătoare minime este că ea nu prezice, d e obicei, formarea unei coaliţii particulare, ci a unei game de coaliţii destul de diferite. Doar în cazul când în parlament exi stă un partid majoritar, această teorie face o singură previziune specifică: în situaţia dată cabinetul câştigător minim prezis este un cabinet unipartit, format de partidul majoritar. Când nu există un partid majoritar, teoria coaliţiei câştigătoare mini me prevede întotdeauna mai multe posibilităţi. 2. Coaliţia de mărime minimă se bazează pe aceleaşi supoziţii de maximalizare a puterii ca şi coaliţia câştigătoare minimă, dar urmează acest raţionament până la concluzia sa logică. Dacă partidele politice doresc să excludă din coaliţie partenerii care nu sunt necesari pentru a-şi maximaliza cota lor de putere în guvern, este de aşteptat ca ele să prefere asemenea organ e bazate pe o majoritate parlamentară cât mai îngustă. 3. Coaliţia alcătuită dintr-un număr minim de partide (prezumţia negocierilor) este atribuită lui Michael Leiserson, care ar gumentează că va prevala tendinţa de formare a acelor coaliţii câştigătoare minime care implică un număr minim de partid e, deoarece „alte condiţii fiind aceleaşi, tratativele şi negocierile privind formarea coaliţiilor pot fi duse mai uşor la capăt, i ar o coaliţie este mai uşor de menţinut cu partide mai puţine”. 4. Coaliţia de anvergură minimă. Teoriile precedente îşi bazează previziunile pe mărimea şi numărul de partide politice, d ar ignoră programele şi preferinţele lor politice. Teoria coaliţiei de anvergură minimă face presupunerea plauzibilă că este mai uşor să formezi şi să păstrezi o coaliţie între partidele cu preferinţe politice similare, decât între partidele care, sub ace st aspect, se află la o distanţă mare. 5. Coaliţia câştigătoare contiguă minimă, propusă de Robert Axelrod, prognozează formarea coaliţiilor „contigue” (compu se din partide adiacente) şi lipsite de parteneri care nu sunt necesari. La baza acestei teorii stă supoziţia că partidele vor în cerca să coalizeze cu vecinii lor imediaţi, apoi vor ralia alte partide adiacente, până se va forma o majoritate câştigătoare. Guvern minoritar. Această modalitate de guvern nu dispune de o majoritate în parlament. Guvern provizoriu. Este un guvern, ori chiar o formaţiune guvernamentală, destinat să exercite un rol tranzitoriu în proces ul trecerii de la un regim politic la altul. Guvern insurecţional. Se instituie în urma unei insurecţii orientată împotriva guvernului existent şi care nu întotdeauna ex ercită controlul asupra întregului teritoriu aparţinând statului respectiv. Guvern militar. Este format din cadre militare, de regulă superioare, instaurarea sa fiind rezultatul unei lovituri de stat sau într-un teritoriu străin ocupat. În istoria statului nostru avem un exemplu de instituire a unui asemenea guvern. Este vorba de evenimentele legate de cel de-al doilea război mondial când Transnistria prin decretul mareşalului Antonescu, şeful stat ului român, din 29 ianuarie 1944 se instituie administraţia militară în locul administraţiei civile. Guvernul de fapt spre deosebire de guvernul de drept, exercită guvernarea în urma unei lovituri de stat sau a unei ocupaţii militare înlocuind guvernul existent fără acordul poporului obţinut prin proceduri legale. Guvernul de drept (legitim) este format în urma consultării voinţei poporului în calitate de deţinător al suveranităţii naţion ale în conformitate cu dispoziţiile constituţionale în vigoare. Guvernele de drept (legitime) se formează prin învestitură: o „procedură aplicată în urma unor alegeri generale pentru ca executivul să obţină un vot pozitiv din partea parlamentului, c ondiţie necesară exercitării responsabilităţilor guvernamentale”. Din punct de vedere tehnic, procedura de învestitură a Guvernului cuprinde patru etape: - desemnarea candidatului pentru funcţia de prim-ministru; - solicitarea de către candidatul la funcţia de prim ministru a votului de încredere al Parlamentului; - acordarea votului de încredere; - numirea Guvernului. Desemnarea candidatului la funcţia de prim-ministru. La această etapă de o importanţă politică Preşedintele Republicii Moldova, ca mediator între legislativ şi executiv, după consultarea fracţiunilor parlamentare, desemnează un candidat pent ru funcţia de prim-ministru (art. 98 din Constituţie, art. 4 din Legea cu privire la Guvern). Constatăm că, spre deosebire de alte constituţii, Constituţia Republicii Moldova nu include în atribuţiile Preşedintelui numirea directă a primului-ministru. El desemnează doar candidatul la această funcţie, urmând mai apoi ca acesta să obţină votul de încredere al Parlamentului. Constituţia Republicii Moldova nu prevede anumite condiţii pe care trebuie să le întrunească candidatul la funcţia de prim- ministru. Numai Legea cu privire la Guvern (art. 4) stabileşte că membri ai Guvernului pot f i numai cetăţeni ai Republicii Moldova. Drept rezultat, Preşedintele este liber în alegerea candidatului, bazându-se pe calit ăţi considerate de el ca fiind mai importante (apartenenţa la un partid politic ori altul, experienţa de lucru, profesionalismu l, raitingul social etc.). Solicitarea de către candidatul la funcţia de prim-ministru a votului de încredere al Parlamentului . Candidatul pentru f uncţia de prim-ministru, în termen de 15 zile de la desemnare, cere votul de încredere al Parlamentului asupra programulu i de activitate şi a întregii liste a Guvernului. Din dispoziţiile cuprinse în art. 98 din Constituţia Republicii Moldova rezult ă că votul de încredere al Parlamentului trebuie dat asupra programului de activitate şi a întregii liste a Guvernului. Deci P arlamentul nu va da votul de încredere pentru fiecare candidat în parte la funcţia de ministru. Acordarea votului de încredere. Programul de activitate şi lista Guvernului se dezbat în şedinţa Parlamentului în condiţiil e prevăzute de Regulamentul Parlamentului, care dispune următoarele: - Programul de activitate al Guvernului se dezbate în şedinţa Parlamentului, la fel ca şi proiectele de legi şi propunerile leg islative (art.128); - Lista Guvernului propusă de candidatul la funcţia de prim-ministru se supune dezbaterii Parlamentului după prezentarea raportului Comisiei juridice pentru numiri şi imunităţi. În procesul întocmirii raportului, comisia va examina candidaturile pentru alegere, numire sau propunerile pentru numirea în funcţie a membrilor Guvernului, având dreptul de a chema spre audiere persoanele în cauză (art.80 alin. 2 şi 3). Chestiunea cu privire la alegere, numire sau propunerile pentru numirea în funcţie a persoanelor oficiale de stat se supun dezbaterii Parlamentului după prezentarea raportului Comisiei juridice, pent ru numiri şi imunităţi. În procesul întocmirii raportului comisia va examina candidaturile, având dreptul să cheme spre aud iere persoanele în cauză. În urma acestor dezbateri, Parlamentul acordă încredere Guvernului cu votul majorităţii deputaţil or aleşi. Numirea Guvernului. În baza votului de încredere acordat de Parlament, Preşedintele Republicii Moldova numeşte Guver nul. De regulă, guvernele se constituie din două componente: şeful guvernului şi membrii guvernului (miniştri, secretari d e stat, şefi de departamente etc.). Conform Constituţiei Republicii Moldova (art. 97), Guvernul este alcătuit din Prim-mini stru, primviceprim-ministru, viceprim-miniştri, miniştri şi alţi membri stabiliţi prin lege organică. De obicei, numărul de membri ai echipei guvernului, condusă de prim- ministru, variază în funcţie de anumite împrejurări de ordin tehnic şi polit ic. Una din condiţiile de bază care justifică apariţia unor structuri guvernamentale noi este apariţia unor sarcini noi în faţa statului, cum ar fi: mediul, prevenirea unor cataclisme naturale, reformele administrative, drepturile omului, integrarea int erstatală. Un exemplu elocvent serveşte şi formarea în anul 2002 a Ministerului reintegrării al Republicii Moldova. În ter men de trei zile de la data numirii Guvernului Republicii Moldova, Prim-ministrul, viceprimminiştrii, miniştrii şi ceilalţi membri ai Guvernului depun individual, în faţa Preşedintelui Republicii Moldova, jurământul al cărui text este prevăzut în Constituţie (art.79 alin.2). El îşi exercită mandatul din ziua depunerii jurământului până la validarea alegerilor pentru un n ou Parlament. Constituţia Republicii Moldova (art. 100) dispune că funcţia de membru al Guvernului încetează în caz de d emisie, de revocare, de incompatibilitate sau de deces. Dacă ulterior numirii Guvernului apare necesitatea unor schimbări î n componenţa acestuia, nu este necesar votul Parlamentului, Preşedintele republicii, la propunerea Prim-ministrului având dreptul să numească ori să revoce pe unii membri ai Guvernului. Calitatea de membru al guvernului este un act politic deo sebit, care necesită concentrarea sporită a eforturilor, fapt ce face ca această funcţie să fie incompatibilă cu toate celelalte f uncţii de stat sau private, inclusiv cu mandatul parlamentar. Din aceste considerente Constituţia (art. 99) stabileşte că func ţia de membru al Guvernului este incompatibilă cu exercitarea oricărei alte funcţii retribuite. 3. ATRIBUŢIILE GUVERNULUI REPUBLICII MOLDOVA În realizarea funcțiilor sale, Guvernul are următoarele atribuții: a) exercită conducerea generală a administrației publice; b) asigură realizarea politicii interne și externe a statului; c) asigură executarea actelor normative ale Parlamentului și decretelor Președintelui Republicii Moldova, adoptate în conformitate cu normele constituționale, și a prevederilor tratatelor internaționale la care Republica Moldova este parte; d) realizează programul său de activitate; e) înaintează Parlamentului inițiative legislative; f) aprobă, prin hotărîre, și înaintează Președintelui Republicii Moldova proiecte de decrete în condițiile legii; g) avizează inițiative legislative, inclusiv proiecte de legi, și examinează propuneri legislative; h) aprobă documente de politici și acte normative; i) elaborează, prezintă Parlamentului spre adoptare și asigură executarea bugetului de stat, bugetului asigurărilor sociale de stat și fondurilor de asigurare obligatorie de asistență medicală; j) asigură accesul, prestarea, verificarea, evaluarea calității și modernizarea serviciilor publice; k) asigură administrarea eficientă și transparentă a proprietății publice; l) monitorizează și analizează eficiența implementării actelor normative; m) asigură realizarea controlului administrativ al activității autorităților administrației publice locale;
4. ORGANIZAREA ACTIVITĂŢII ŞI ACTELE GUVERNULUI
Conducerea operativă a Guvernului este realizată de Prim-ministru care în acelaşi timp coordonează activitatea mem brilor acestuia. În acest scop Prim-ministrul Republicii Moldova este înzestrat cu următoarele împuterniciri: - prezidează şedinţele Guvernului şi ale Prezidiului lui; - în cazuri excepţionale ia decizii în problemele conducerii Republicii Moldova în limitele competenţei Guvernului şi info rmează despre aceasta Guvernul la şedinţa lui ordinară; - asigură colegialitatea în activitatea Guvernului; - formează Guvernul şi propune componenţa lui în modul stabilit; - acordă împuterniciri pentru negocierea şi semnarea tratatelor internaţionale ale Republicii Moldova; - prezintă spre examinare Prezidiului Guvernului sau pune în faţa Preşedintelui Republicii Moldova chestiunea cu privire l a stimularea sau aplicarea unor sancţiuni disciplinare faţă de membrul Guvernului; - în cazul în care unul din miniştri nu îşi exercită atribuţiile conform legislaţiei, este în drept să înainteze Preşedintelui Rep ublicii Moldova propunere privitor la revocarea acestui ministru; - informează Preşedintele Republicii Moldova în problemele deosebit de importante pentru ţară. În conformitate cu Constituţia (Legea Fundamentală a Republicii Moldova), Prim-ministrul este învestit şi cu alte împuter niciri prevăzute de legislaţia Republicii Moldova. În cazul în care Prim-ministrul este în imposibilitatea de a-şi exercita atr ibuţiile, Preşedintele Republicii Moldova va desemna un alt membru al Guvernului ca Prim-ministru interimar. Ministrul care îndeplineşte temporar obligaţiile Prim-ministrului are aceleaşi atribuţii ca şi Prim-ministrul, cu exc epţia: - adoptării hotărârii privind demisia Guvernului sau Prim-ministrului; - formării şi propunerii componenţei Guvernului; - înaintării propunerilor privind numirea în funcţie şi eliberarea din funcţie a miniştrilor; - numirii în funcţie şi eliberării din funcţie a Directorului Cancelariei de Stat; - numirii în funcţie şi eliberării din funcţie a conducătorilor organelor şi instituţiilor din subordinea Guvernului. Ministrul nu este în drept: să deţină o oricare altă funcţie în organele autorităţilor publice centrale şi locale; să se încadreze în organele de conducere a unităţilor comerciale; să practice activitate de întreprinzător personal sau prin terţe persoane; s ă deţină o altă funcţie retribuită, cu excepţia activităţii ştiinţifico-pedagogice. Funcţia de membru al Guvernului şi împuter nicirile membrului Guvernului încetează în cazul demisiei, revocării, incompatibilităţii funcţiei sau decesului. Principala formă de lucru a Guvernului ca organ colegial este şedinţa. Şedinţele Guvernului Republicii Moldova se desfăşoară după caz, dar nu mai rar decât o dată pe trimestru. La şedinţele Guvernului se supun examinării: - programul său de activitate şi declaraţia de politică generală; - proiectele concepţiilor, prognozelor şi strategiilor dezvoltării social-economice a ţării; - proiectele programelor de importanţă statală; - proiectul bugetului de stat şi bugetului asigurărilor sociale de stat, iniţiativele legislative şi amendamentele ce ţin de maj orarea sau reducerea veniturilor bugetare sau împrumuturilor, precum şi de majorarea sau reducerea cheltuielilor bugetare; - darea de seamă asupra executării bugetului consolidat; - darea de seamă a Guvernului asupra activităţii sale, care va fi prezentată spre examinare Parlamentului; - proiectele de legi şi avizele asupra iniţiativelor legislative; - adoptarea hotărârilor şi ordonanţelor; - aprobarea structurii şi regulamentelor ministerelor, departamentelor de pe lîngă Guvern şi altor organe şi instituţii din su bordine; - aprobarea Regulamentului Guvernului; - numirea judecătorilor la Curtea Constituţională; - numirea în funcţii publice, conform competenţei; - chestiunile privind demisia Guvernului; - alte chestiuni majore de politică internă şi externă. Hotărârile se adoptă cu votul majorităţii membrilor Guvernului prezenţi la şedinţă, iar ordonanţele - cu votul majorităţii m embrilor Guvernului. Şedinţele Guvernului sunt publice însă la decizia Prim-ministrului, şedinţele pot fi închise. Guvernul asigură transparenţa activităţii sale. În acest scop, Guvernul din oficiu sau la solicitare, hotărăşte publicarea în mijloacele de informare în masă (inclusiv electronice) a anumitor proiecte de acte legislative şi proiecte de acte ale Guvernului, stenograme ale şedinţelor s ale publice şi a altor acte vizând activitatea executivului, în funcţie de importanţa lor pentru societate. După caz, prin acee aşi hotărâre, Guvernul stabileşte modul de dezbatere publică a proiectelor de acte legislative şi a proiectelor de acte ale Gu vernului, de acumulare, examinare şi discutare a propunerilor prezentate în legătură cu acestea. Actele Guvernului. Pentru exercitarea atribuţiilor constituţionale şi ale celor ce decurg din Legea Guvernului, precum şi p entru organizarea executării legilor, Guvernul adoptă hotărâri. Dispoziţiile se emit de către Prim-ministru pentru organizar ea activităţii interne a Guvernului. Atât hotărârile cât şi dispoziţiile Guvernului se semnează de Prim-ministru. Unele hotăr âri se contrasemnează de miniştrii care au obligaţia punerii lor în aplicare în următoarea ordine: - hotărârile privind executarea bugetului, utilizarea împrumuturilor şi creditelor interne şi externe, desfăşurarea reformelor financiar-economice şi sociale, administrarea proprietăţii publice - respectiv, de ministrul finanţelor, ministrul economiei; - hotărârile cu privire la asigurarea securităţii statului, ordinii publice, capacităţii de apărare, activitatea Forţelor Armate – respectiv, de ministrul afacerilor interne şi de ministrul apărării; - hotărârile privind politica externă - de ministrul afacerilor externe; - hotărârile privind exercitarea de către Guvern a dreptului de iniţiativă legislativă, elaborarea programelor de activitate le gislativă, aprobarea proiectelor de legi şi prezentarea lor Parlamentului spre examinare - respectiv, de ministrul justiţiei; - hotărârile cu caracter complex, care reglementează funcţionarea diferitelor ramuri ale economiei naţionale - se contrase mnează, la decizia Prim-ministrului, de către un ministru responsabil pentru punerea acestora în aplicare. Hotărârile şi dispoziţiile Guvernului, cu excepţia celor care conţin secret de stat, se publică în Monitorul Oficial al Republ icii Moldova în termen de 10 zile de la data adoptării sau emiterii. Hotărârile şi dispoziţiile Guvernului intră în vigoare la data publicării în Monitorul Oficial al Republicii Moldova sau la data indicată în textul acestora, dar care nu poate precede data publicării lor. În cazul în care prin legea de abilitare se cere aprobarea ordonanţelor de către Parlament, Guvernul, concomitent cu proiectul ordonanţei, examinează şi proiectul legii privind aprobarea ordonanţei şi îl prezintă Pa rlamentului spre adoptare în termenul stabilit de legea de abilitare. În cazul în care Parlamentul respinge proiectul legii pri vind aprobarea ordonanţei, aceasta îşi pierde efectele juridice de la data intrării în vigoare a legii de respingere. Ordonanţe le sunt acte normative cu putere de lege ordinară, adoptate într-o anumită perioadă de timp şi în domeniile care nu fac obie ctul legilor organice. Ordonanţele se semnează de Prim-ministru şi se contrasemnează de miniştrii care au obligaţia puneri i lor în aplicare. Ordonanţele se publică în Monitorul Oficial al Republicii Moldova şi intră în vigoare în modul stabilit pe ntru actele oficiale. Ordonanţele se abrogă, se suspendă sau se modifică de Guvern prin adoptarea de ordonanţe în limitele termenului de abilitare. După expirarea termenului de abilitare ordonanţele pot fi abrogate, suspendate sau modificate num ai prin lege. Verificării sistematice a executării lor pe lângă Guvern îşi desfăşoară activitatea un aparat unic - Cancelaria d e stat a Republicii Moldova. 5. RESPONSABILITATEA GUVERNULUI ŞI A MEMBRILOR LUI Actualul Guvern al Republicii Moldova rămâne responsabil în faţa Parlamentului pentru activitatea sa, aceasta constituind fundamentul regimului parlamentar. În ce priveşte Guvernul Republicii Moldova, acesta, în baza unei hotărâri a Parla mentului, prezintă în faţa lui dări de seamă asupra activităţii lor. Miniştrii şi conducătorii departamentelor sunt obligaţi să răspundă, în modul stabilit, la întrebările şi interpelările formulate de deputaţi referitor la activitatea Guvernulu i şi a organelor din subordinea lui. Guvernul examinează deciziile comisiilor Parlamentului vizând activitatea Guvernului şi a organelor din subordinea lui, comunică comisiilor rezultatele examinării deciziilor sau măsurile luate pe marginea lor. Guvernul şi fiecare membru al Guvernului are dreptul să demisioneze din propria iniţiativă. Solidaritatea membrilor Guve rnului se exprimă nu numai în procesul de formare şi de activitate a acestui organ, dar şi la dizolvarea acestuia. Din acest punct de vedere Constituţia (art. 101) a dispus că demisionarea Prim-ministrului conduce la demisionarea Guvernului în c omponenţă deplină. În acest caz, cererea de demisie a Prim-ministrului şi a întregii componenţe a Guvernului se prezintă Parlamentului, care se pronunţă asupra ei. Cererile de demisie ale unor membri ai Guvernului se prezintă Prim-ministrului şi se aduc la cunoştinţa Preşedintelui Republicii Moldova. Guvernul îşi dă demisia în cazul în care: - Parlamentul şi-a exprimat neîncrederea în Guvern, la propunerea a cel puţin o pătrime din deputaţi, cu votul majorităţii d eputaţilor (art. 106 din Constituţie). La fel, Guvernul îşi poate angaja răspunderea în faţa Parlamentului asupra unui progra m, unei declaraţii de politică generală sau unui proiect de lege. Guvernul este demis dacă moţiunea de cenzură, depusă în t ermen de 3 zile de la prezentarea programului, declarației de politică generală sau proiectului de lege, a fost votată de maj oritatea deputaţilor. Dacă Guvernul nu a fost demis, proiectul de lege prezentat se consideră adoptat, iar programul sau de claraţia de politică generală devine obligatorie pentru Guvern (art. 1061 din Constituţie). - Prim-ministrul a demisionat sau a decedat; - a fost ales un nou Parlament. După cum am văzut, responsabilitatea Guvernului şi a miniştrilor poate să fie politică, care se exercită sub formă de interp elări, ultimele pot provoca chiar şi schimbări de guvern. În sistemele constituţionale contemporane, responsabilitatea mini ştrilor poate să fie judiciară şi chiar civilă. Însă din cele mai vechi timpuri miniştrii au luat un exemplu urât de a se sustrag e făţiş de la responsabilitate. 6. RELATII DINTRE EXECUTIV ŞI LEGISLATIV Într-un sistem parlamentar, şeful executivului, pe care îl numim în general primministru, şi cabinetul său sunt responsabili faţă de legislativ în sensul că ei depind de votul de încredere al acestuia şi pot fi demişi printr-un vot de cenzură ori de neî ncredere. Într-o republică prezidenţială, şeful executivului - preşedintele - este ales pentru o perioadă prescrisă de constituţ ie şi în circumstanţe normale nu poate fi silit să demisioneze la un vot de neîncredere al legislativului (deşi este posibil ca preşedintele să fie înlăturat prin procedura impeachmentului). Forma de guvernământ parlamentară se mai deosebeşte de c ea prezidenţială prin modul de alegere: preşedinţii sunt aleşi de popor direct sau prin intermediul unui colegiu electoral, ia r prim-miniştrii sunt selectaţi de către legislative. Deoarece guvernările parlamentare şi prezidenţiale se definesc în termen ii celor două caracteristici distincte, din combinarea acestor trăsături rezultă trei forme de guvernare: a) guvernare parlamentară (şeful executivului este ales de Legislativ: Australia, Austria, Belgia, Canada, Danemarca, Ge rmania, Islanda, Irlanda, Israel, Italia, Japonia, Luxemburg, Olanda, Noua Zeelandă, Norvegia, Suedia, Marea Britanie); b) guvernare de forma hibridă ( şeful executivului nu depinde de încrederea legislativului: Elveţia. Guvernul elveţian - C onsiliul Federal- este ales de parlament, dar cei şapte consilieri se află în oficiu pentru o perioadă fixă de patru ani şi nu po t fi destituiţi printr-un vot de neîncredere al legislativului); În sistemul parlamentar, dreptul prim-ministrului de a dizolva parlamentul şi a anunţa alegeri anticipate este un corolar logic al dreptului legislativului de a destitui cabinetul. În mod si milar, în sistemul prezidenţial, incapacitatea parlamentului de a destitui preşedintele are un corespondent în incapacitatea preşedintelui de a dizolva parlamentul. Autoritatea executivă este evident afectată de faptul dacă are sau nu această putere asupra legislativului, dar, sub acest aspect, nu apare o deosebire esenţială dintre parlamentarism şi prezidenţialism. Există şi alte două deosebiri, ale diferitelor forme de guvernare. De regulă, formele de guvernământ parlamentare au executive bi cefale: un şef al statului mai mult simbolic şi ceremonial (monarh sau preşedinte), care deţine puteri neînsemnate, şi un şef al guvernului (prim-ministru), care, împreună cu guvernul, exercită cea mai mare parte din atribuţiile aparţinând puterii ex ecutive. În sistemele prezidenţiale, preşedintele este concomitent şef al statului şi al guvernului. O altă deosebire dintre sis temul parlamentar şi cel prezidenţial, menţionată în literatura de specialitate, este că preşedintele reprezintă un executiv si ngular, pe când prim-ministrul şi cabinetul său formează un organ executiv colectiv. 7. ACTELE ADOPTATE DE GUVERN Guvernul adoptă hotărîri, ordonanțe și dispoziții. Hotărîrile, ordonanțele și dispozițiile se semnează de către Prim-ministru.Hotărîrile și ordonanțele se contrasemnează de miniștrii care au obligația punerii în aplicare a acestora și/sau care sînt responsabili de domeniile de activitate care intră parțial sau integral în obiectul de reglementare al actului contrasemnat. Hotărîrile, ordonanțele și dispozițiile se publică și intră în vigoare în conformitate cu legislația privind modul de publicare și intrare în vigoare a actelor oficiale. 8. RĂSPUNDEREA GUVERNULUI Articolul 43. Angajarea răspunderii Guvernului Guvernul își poate angaja răspunderea în fața Parlamentului asupra unui program, a unei declarații de politică generală sau a unui proiect de lege, adoptînd în acestsens o hotărîre. În cazul în care este necesară întreprinderea unor măsuri urgente, Guvernul își poate angaja răspunderea în fața Parlamentului asupra unui proiect de lege sau, concomitent, asupra mai multor proiecte de lege, dacă acestea reglementează relații din același domeniu de activitate și stabilesc norme juridice de aplicare imediată, pentru a asigura protejarea sau realizarea interesului public, care ar putea fi afectat prin neadoptarea proiectului sau proiectelor respective de lege. THE ROLE AND PLACE OF THE EXECUTIVE IN THE SYSTEM OF PUBLIC AUTHORITIES The Constitution of the Republic of Moldova (art. 96), the Law on the Government (art. 1) determines the role of the Gov ernment in the system of public authorities, which consists in: ensuring the realization of the internal and external policy o f the state and the exercise of general management of the public administration. The role of the government is significant not only through its internal and external executive activity, but also through the normative one, arising on the basis of the legislative delegation granted by the Parliament pursuant to art. 106/2, or by exercising the right of legislative initiative pr ovided for by Article 73 of the Constitution. Consequently, the Government's role within the state and society is expressed not only in the exclusively executive sphere, but also through collaboration with other public authorities, including the leg islative power. In close connection with the political role in the content of Article 1 of the Law on Government, the positio n of this body as a central public authority with general material competence in the field of public administration is taking shape. From this point of view, the government has the mission of ensuring the general leadership of the latter. By virtue o f this role, the government carries out an exclusively executive activity, its main attribute being the organization and ensur ing the execution of laws by the specialized central public administration authorities. The special role assigned to the Government by the Constitution of the Republic of Moldova requires that it carry out its a ctivity in accordance with the principles: - the legality that requires compliance with the Constitution, the other laws of the republic, the president's decrees and his own decisions, ordinances and provisions; - social equity; - the collegiality and personal responsibility of the members of the Government in the process of elaborating, adopting an d implementing its decisions; - the scientific foundation of the administration process, taking into account and applying world experience in the sphere o f state building. The role and place of the Government in the system of public authorities is largely determined by the main directions of it s activity fixed in the Law on the Government, which in accordance with its powers: - creates conditions for establishing and ensuring the economic and political sovereignty of Moldova; - elaborates the concept of the social-economic development of the republic, the program and the mechanism of the transit ion to the market economy; - ensures free initiative, privatization, demonopolization of the economy and the development of market relations; - elaborates the strategy of technical-scientific development, promotes a national policy in the field of culture, science, tec hnique, technology; solves the problems of state regulation of technical-scientific progress; - guarantees all subjects of property the freedom of economic activity, the diversity of forms of property and their equality of rights, takes care of the preservation of property; - protects national interests in economic, financial and currency activity; - realizes the economic collaboration with the countries of the world under the conditions of the development of contractu al relations, the formation of the market infrastructure, the general European and world integration; - ensures the protection of national interests in external economic activity, promotes the policy of free trade, starting from national interests; - forms an efficient system of social protection of the population, creates conditions for increasing the standard of living, f or satisfying the cultural and spiritual needs of the citizens of the republic; - promotes state policy in the field of population health protection; - ensures the protection of consumer rights by organizing and coordinating state control and supervision of the quality of p roducts (works, services); - ensures the rational use of natural resources and their integrity, the ecological protection of the population and the enviro nment; - favors the development of the autonomy of public administration bodies at all levels; - ensures legality, public order, rights and freedoms of citizens; - promotes the national security policy, directs the defense activity of the Republic of Moldova; - ensures compliance and execution of laws, Parliament decisions, decrees of the President of the Republic of Moldova, in ternational treaties to which the Republic of Moldova is a party; - promotes a foreign policy in accordance with its competence 2. INVESTMENT METHOD AND GOVERNMENT STRUCTURE Depending on certain circumstances and rules of establishment, several types of governments are known: coalition, minori ty, provisional, insurrectionary, military, de jure, de facto, legitimate. The coalition government includes in its composition representatives of the various political parties with the aim of obtain ing a majority and favorable support in the parliament. In constitutional practice, several varieties of such coalitions are kn own: 1. The minimal winning coalition (principle of size) proposed by William H. Riker, admits the formation of minimal winn ing coalitions of two or more parties which are winning in the sense that they jointly control the majority of seats in the pa rliament, but which are minimal in the sense that they do not they will not include any other party that is not necessary for that coalition to become a majority. One of the weak points of minimal winning coalition theory is that it usually does not predict the formation of a particular coalition, but rather a range of quite different coalitions. Only in the case when there i s a majority party in the parliament, this theory makes only one specific prediction: in the given situation the minimum pre dicted winning cabinet is a single-party cabinet, formed by the majority party. When there is no majority party, the minim um winning coalition theory always predicts several possibilities. 2. The minimum size coalition is based on the same power-maximizing assumptions as the minimum winning coalition, b ut follows this reasoning to its logical conclusion. If the political parties want to exclude from the coalition partners who a re not necessary to maximize their share of power in the government, it is expected that they would prefer such bodies bas ed on the narrowest possible parliamentary majority. 3. The coalition made up of a minimum number of parties (the presumption of negotiations) is attributed to Michael Leise rson, who argues that the tendency to form those minimal winning coalitions involving a minimum number of parties will prevail, because "other conditions being the same, negotiations and coalition negotiations can be carried out more easily, a nd a coalition is easier to maintain with fewer parties." 4. The minimal scope coalition. Previous theories base their predictions on the size and number of political parties, but ign ore their political programs and preferences. The theory of the minimal scope coalition makes the plausible assumption th at it is easier to form and maintain a coalition between parties with similar policy preferences than between parties that are in this respect, at a great distance. 5. The minimum contiguous winning coalition, proposed by Robert Axelrod, predicts the formation of "contiguous" coalit ions (composed of adjacent parties) and devoid of unnecessary partners. The basis of this theory is the assumption that the parties will try to form a coalition with their immediate neighbors, then they will rally other adjacent parties, until a winni ng majority is formed. Minority government. This form of government does not have a majority in parliament. Provisional government. It is a government, or even a government formation, destined to exercise a transitional role in the process of transition from one political regime to another. Insurrectionary government. It is instituted following an insurrection directed against the existing government and which does not always exercise control over the entire territory belonging to the respective state. Military government. It is made up of military cadres, usually superior, its establishment being the result of a coup d'état o r in an occupied foreign territory. In the history of our state we have an example of the establishment of such a governmen t. It is about the events related to the Second World War, when Transnistria, by the decree of Marshal Antonescu, the head of the Romanian state, from January 29, 1944, the military administration was established instead of the civil administrati on. The de facto government, as opposed to the de jure government, exercises government following a coup d'état or military occupation by replacing the existing government without the consent of the people obtained through legal procedures. The rightful (legitimate) government is formed after consulting the will of the people as the holder of national sovereignty in accordance with the constitutional provisions in force. De jure (legitimate) governments are formed by investiture: a "pr ocedure applied after general elections for the executive to obtain a positive vote from the parliament, a necessary conditio n for the exercise of governmental responsibilities". From a technical point of view, the investiture procedure of the Government includes four stages: - nomination of the candidate for the position of prime minister; - the request by the candidate for the position of prime minister for the vote of confidence of the Parliament; - granting the vote of confidence; - appointment of the Government. Designation of the candidate for the position of prime minister. At this stage of political importance, the President of the R epublic of Moldova, as a mediator between the legislature and the executive, after consulting the parliamentary factions, a ppoints a candidate for the position of prime minister (art. 98 of the Constitution, art. 4 of the Law on Government). We fi nd that, unlike other constitutions, the Constitution of the Republic of Moldova does not include the direct appointment of the prime minister in the President's powers. He only appoints the candidate for this position, after which he must obtain t he Parliament's vote of confidence. The Constitution of the Republic of Moldova does not provide certain conditions that must be met the candidate for the position of prime minister. Only the Law on the Government (art. 4) establishes that me mbers of the Government can only be citizens of the Republic of Moldova. As a result, the President is free to choose the candidate, based on qualities considered by him to be more important (belonging to one political party or another, work ex perience, professionalism, social rating, etc.). The request by the candidate for the position of prime minister for the vote o f confidence of the Parliament. The candidate for the position of prime minister, within 15 days from the appointment, req uests the Parliament's vote of confidence on the activity program and the entire list of the Government. From the provision s contained in art. 98 of the Constitution of the Republic of Moldova results that the vote of confidence of the Parliament must be given on the activity program and the entire list of the Government. So the Parliament will not give the vote of co nfidence for each individual candidate for the position of minister. Giving the vote of confidence. The activity program and the Government's list are debated in the Parliament session under the conditions provided by the Parliament Regulation, which provides the following: - The Government's activity program is debated in the Parliament session, as well as draft laws and legislative proposals (art. 128); - The Government's list proposed by the candidate for the position of prime minister is submitted to Parliament's debate af ter the presentation of the report of the Legal Commission for Appointments and Immunities. In the process of drawing up the report, the commission will examine the candidacies for election, appointment or the proposals for the appointment of the members of the Government, having the right to summon the persons concerned for a hearing (art. 80 par. 2 and 3). Th e matter regarding the election, appointment or the proposals for the appointment of state officials are submitted to the deb ate of the Parliament after the presentation of the report of the Legal Commission, for appointments and immunities. In th e process of drawing up the report, the commission will examine the candidacies, having the right to call the persons conc erned for a hearing. Following these debates, the Parliament gives confidence to the Government with the vote of the majo rity of the elected deputies.Appointment of the Government. Based on the vote of confidence granted by the Parliament, t he President of the Republic of Moldova appoints the Government. As a rule, governments are made up of two component s: the head of the government and the members of the government (ministers, secretaries of state, heads of departments, et c.). According to the Constitution of the Republic of Moldova (art. 97), the Government consists of the Prime Minister, Fi rst Deputy Prime Minister, Deputy Prime Ministers, Ministers and other members established by organic law. Usually, the number of members of the government team, led by the prime minister, varies depending on certain technical and political circumstances. One of the basic conditions that justify the emergence of new governmental structures is the emergence of new tasks before the state, such as: the environment, the prevention of natural disasters, administrative reforms, human rig hts, interstate integration. An eloquent example is the formation in 2002 of the Ministry of Reintegration of the Republic o f Moldova. Within three days from the date of appointment of the Government of the Republic of Moldova, the Prime Mi nister, the Deputy Prime Ministers, the Ministers and the other members of the Government shall individually take the oat h before the President of the Republic of Moldova, the text of which is provided for in the Constitution (art. 79 paragraph 2) . He exercises his mandate from the day of taking the oath until the validation of the elections for a new Parliament. Th e Constitution of the Republic of Moldova (art. 100) stipulates that the position of a member of the Government ceases in case of resignation, revocation, incompatibility or death. If, after the appointment of the Government, there is a need for c hanges in its composition, the vote of the Parliament is not necessary, the President of the Republic, upon the proposal of t he Prime Minister, has the right to appoint or dismiss some members of the Government. The quality of being a member o f the government is a special political act, which requires increased concentration of efforts, which makes this position inc ompatible with all other state or private positions, including the parliamentary mandate. For these reasons, the Constitutio n (art. 99) establishes that the position of member of the Government is incompatible with the exercise of any other remun erated position. 3. DUTIES OF THE GOVERNMENT OF THE REPUBLIC OF MOLDOVA In carrying out its functions, the Government has the following attributions: a) exercise the general management of the public administration; b) ensures the implementation of the state's internal and external policy; c) ensures the execution of the normative acts of the Parliament and the decrees of the President of the Republic of Moldo va, adopted in accordance with the constitutional norms, and the provisions of the international treaties to which the Repu blic of Moldova is a party; d) carries out its activity program; e) submits legislative initiatives to the Parliament; f) approve, by decision, and submit draft decrees to the President of the Republic of Moldova in accordance with the law; g) endorses legislative initiatives, including draft laws, and examines legislative proposals; h) approve policy documents and normative acts; i) elaborates, submits to the Parliament for adoption and ensures the execution of the state budget, the state social insuranc e budget and the mandatory medical assistance insurance funds; j) ensures access, provision, verification, quality assessment and modernization of public services; k) ensures efficient and transparent administration of public property; l) monitor and analyze the effectiveness of the implementation of normative acts; m) ensures the realization of the administrative control of the activity of the local public administration authorities; 4. ORGANIZATION OF THE ACTIVITY AND GOVERNMENT ACTS The operative leadership of the Government is carried out by the Prime Minister who at the same time coordinates the acti vity of its members. For this purpose, the Prime Minister of the Republic of Moldova is endowed with the following powe rs: - presides over the meetings of the Government and its Presidium; - in exceptional cases, takes decisions on the management of the Republic of Moldova within the limits of the Governmen t's competence and informs the Government about this at its ordinary meeting; - ensures collegiality in the Government's activity; - forms the Government and proposes its composition in the established manner; - grants powers for the negotiation and signing of international treaties of the Republic of Moldova; - submits for examination to the Presidium of the Government or puts before the President of the Republic of Moldova the question regarding the stimulation or application of disciplinary sanctions against the member of the Government; - in the event that one of the ministers does not exercise his duties according to the legislation, he is entitled to submit to t he President of the Republic of Moldova a proposal regarding the revocation of this minister; - informs the President of the Republic of Moldova on issues particularly important for the country.In accordance with the Constitution (Fundamental Law of the Republic of Moldova), the Prime Minister is also vested with other powers provide d by the legislation of the Republic of Moldova. If the Prime Minister is unable to exercise his duties, the President of the Republic of Moldova will appoint another member of the Government as interim Prime Minister. The minister who temporarily fulfills the duties of the Prime Minister has the same powers as the Prime Minister, except: - the adoption of the decision regarding the resignation of the Government or the Prime Minister; - forming and proposing the composition of the Government; - submission of proposals regarding the appointment and dismissal of ministers; - appointment and dismissal of the Director of the State Chancellery; - appointing and dismissing the heads of bodies and institutions subordinate to the Government. The Minister is not entitled: to hold any other position in the bodies of the central and local public authorities; to be part of the governing bodies of commercial units; to practice activity as a personal entrepreneur or through third parties; to hold a nother remunerated position, with the exception of scientific-pedagogical activity. The position of member of the Govern ment and the powers of the member of the Government cease in case of resignation, revocation, incompatibility of the pos ition or death. The main form of work of the Government as a collegial body is the meeting. The meetings of the Govern ment of the Republic of Moldova are held as the case may be, but not less often than once a quarter. At the Government m eetings, the following are subject to examination: - its activity program and general policy statement; - drafts of conceptions, forecasts and strategies for the socio-economic development of the country; - projects of programs of state importance; - the draft of the state budget and the state social insurance budget, legislative initiatives and amendments related to the in crease or decrease of budget revenues or loans, as well as the increase or decrease of budget expenses; - reporting on the execution of the consolidated budget; - the Government's report on its activity, which will be presented to the Parliament for examination; - draft laws and opinions on legislative initiatives; - adoption of decisions and ordinances; - approving the structure and regulations of ministries, departments outside the Government and other subordinate bodies and institutions; - approval of the Government Regulation; - appointing judges to the Constitutional Court; - appointment to public positions, according to competence; - issues regarding the resignation of the Government; - other major domestic and foreign policy matters. Decisions are adopted with the vote of the majority of the members of the Government present at the meeting, and ordinan ces - with the vote of the majority of the members of the Government. The meetings of the Government are public, but at t he decision of the Prime Minister, the meetings can be closed. The government ensures the transparency of its activity. Fo r this purpose, the Government ex officio or upon request, decides to publish in the mass media (including electronic) cert ain draft legislative acts and draft acts of the Government, transcripts of its public meetings and other acts concerning the activity of the executive, in depending on their importance for society. As the case may be, by the same decision, the Gov ernment establishes the manner of public debate of the draft legislative acts and the draft acts of the Government, of the ac cumulation, examination and discussion of the proposals presented in relation to them. Government Acts. In order to exercise the constitutional powers and those arising from the Government Law, as well as to organize the execution of the laws, the Government adopts decisions. The provisions are issued by the Prime Minister for the organization of the internal activity of the Government. Both the decisions and the provisions of the Government are si gned by the Prime Minister. Some decisions are countersigned by the ministers who have the obligation to implement the m in the following order: - the decisions regarding the execution of the budget, the use of internal and external loans and credits, the implementation of financial-economic and social reforms, the administration of public property - respectively, by the Minister of Finance, the Minister of Economy; - decisions regarding ensuring state security, public order, defense capacity, the activity of the Armed Forces - respectivel y, by the Minister of Internal Affairs and the Minister of Defense; - decisions regarding foreign policy - by the minister of foreign affairs; - the decisions regarding the Government's exercise of the right of legislative initiative, the elaboration of legislative activi ty programs, the approval of draft laws and their presentation to the Parliament for examination - respectively, by the Mini ster of Justice; - decisions of a complex nature, which regulate the operation of various branches of the national economy - are countersig ned, at the decision of the Prime Minister, by a minister responsible for their implementation. Government decisions and provisions, except for those containing state secrets, are published in the Official Gazette of the Republic of Moldova within 10 days from the date of adoption or issuance. The decisions and provisions of the Governme nt enter into force on the date of publication in the Official Gazette of the Republic of Moldova or on the date indicated in their text, but which cannot precede the date of their publication. If the enabling law requires the approval of ordinances b y the Parliament, The Government, simultaneously with the draft ordinance, also examines the draft law on the approval of the ordinance an d presents it to the Parliament for adoption within the term established by the enabling law. If the Parliament rejects the dr aft law on the approval of the ordinance, it loses its legal effects from the date of entry into force of the rejection law. Ordi nances are normative acts with the force of ordinary law, adopted in a certain period of time and in the fields that are not t he subject of organic laws. The ordinances are signed by the Prime Minister and countersigned by the ministers who have the obligation to implement them. The ordinances are published in the Official Monitor of the Republic of Moldova and e nter into force in the manner established for official documents. Ordinances are repealed, suspended or modified by the G overnment by adopting ordinances within the limits of the authorization term. After the expiration of the authorization ter m, ordinances can be repealed, suspended or modified only by law. The systematic verification of their execution is carrie d out by a unique apparatus under the Government - the State Chancellery of the Republic of Moldova. 5. RESPONSIBILITY OF THE GOVERNMENT AND ITS MEMBERS The current Government of the Republic of Moldova remains responsible to the Parliament for its activity, which constitut es the foundation of the parliamentary regime. As for the Government of the Republic of Moldova, it, based on a decision of the Parliament, presents before it reports on their activity. The ministers and heads of departments are obliged to answe r, in the established manner, the questions and interpellations formulated by deputies regarding the activity of the Govern ment and its subordinate bodies. The Government examines the decisions of the Parliament's committees regarding the act ivity of the Government and its subordinate bodies, communicates to the committees the results of the examination of the decisions or the measures taken on their side. The Government and each member of the Government has the right to resig n on their own initiative. The solidarity of the members of the Government is expressed not only in the process of formati on and activity of this body, but also in its dissolution. From this point of view, the Constitution (art. 101) ordered that the resignation of the Prime Minister leads to the resignation of the Government in full composition. In this case, the resignati on request of the Prime Minister and the entire composition of the Government is submitted to the Parliament, which deci des on it. The resignation requests of some members of the Government are presented to the Prime Minister and brought t o the attention of the President of the Republic of Moldova. The government resigns if: - The Parliament expressed its lack of confidence in the Government, at the proposal of at least one fourth of the deputies, with the vote of the majority of the deputies (art. 106 of the Constitution). In the same way, the Government can undertak e its responsibility before the Parliament on a program, a general policy statement or a draft law. The government is dismi ssed if the censure motion, submitted within 3 days of the presentation of the program, the general policy statement or the draft law, was voted by the majority of deputies. If the Government has not been dismissed, the presented bill is considere d adopted, and the program or general policy statement becomes binding for the Government (art. 1061 of the Constitutio n). - The Prime Minister resigned or died; - a new Parliament was elected. As we have seen, the responsibility of the Government and the ministers can be political, which is exercised in the form of interpellations, the latter can even cause changes of government. In contemporary constitutional systems, the responsibilit y of ministers can be judicial and even civil. But since ancient times, ministers have taken a bad example of openly evadin g responsibility. 6. RELATIONS BETWEEN EXECUTIVE AND LEGISLATIVE In a parliamentary system, the head of the executive, whom we generally call the prime minister, and his cabinet are respo nsible to the legislature in the sense that they depend on its vote of confidence and can be dismissed by a vote of censure o r no confidence. In a presidential republic, the head of the executive - the president - is elected for a period prescribed by t he constitution and under normal circumstances cannot be forced to resign on a vote of no confidence in the legislature (al though it is possible for the president to be removed by impeachment). The parliamentary form of government also differs from the presidential one by the method of election: the presidents are elected by the people directly or through an elector al college, and the prime ministers are selected by the legislatures. Since parliamentary and presidential governments are d efined in terms of these two distinct characteristics, the combination of these features results in three forms of government: a) parliamentary government (the head of the executive is elected by the Legislature: Australia, Austria, Belgium, Canada, Denmark, Germany, Iceland, Ireland, Israel, Italy, Japan, Luxembourg, Netherlands, New Zealand, Norway, Sweden, Gre at Britain); b) hybrid form of government (the head of the executive does not depend on the confidence of the legislature: Switzerland. The Swiss government - the Federal Council - is elected by the parliament, but the seven councilors are in office for a fix ed period of four years and cannot be dismissed by a vote of no confidence in the legislature); In the parliamentary system , the prime minister's right to dissolve parliament and announce early elections is a logical corollary of the legislature's righ t to dismiss the cabinet. Similarly, in the presidential system, the parliament's inability to impeach the president has a coun terpart in the president's inability to dissolve the parliament. The executive authority is obviously affected by whether or n ot it has this power over the legislature, but, under this aspect, there is no essential difference between parliamentarism an d presidentialism. There are two other differences, of the different forms of government. As a rule, parliamentary forms of government have bicephalic executives: a more symbolic and ceremonial head of state (monarch or president), who holds insignificant powers, and a head of government (prime minister), who, together with the government, exercises the most o f the attributions belonging to the executive power. In presidential systems, the president is simultaneously the head of the state and the government. Another difference between the parliamentary and presidential system, mentioned in the special ized literature, is that the president represents a singular executive, while the prime minister and his cabinet form a collecti ve executive body. 7. ACTS ADOPTED BY THE GOVERNMENT The government adopts decisions, ordinances and provisions. Decisions, ordinances and provisions are signed by the Prim e Minister. Decisions and ordinances are countersigned by the ministers who have the obligation to implement them and/o r who are responsible for the fields of activity that fall partially or fully into the regulatory object of the countersigned act . Decisions, ordinances and provisions are published and enter into force in accordance with the legislation on the manner o f publication and entry into force of official acts. 8. RESPONSIBILITY OF THE GOVERNMENT Article 43. Engagement of the Government's liability. The Government can undertake its responsibility before the Parliam ent on a program, a general policy statement or a draft law, by adopting a decision in this sense. In case it is necessary to u ndertake urgent measures, the Government can engage its responsibility before the Parliament on a draft law or, simultane ously, on several draft laws, if they regulate relations in the same field of activity and establish legal rules of application i mmediate, to ensure the protection or achievement of the public interest, which could be affected by not adopting the resp ective draft or drafts of the law.
